Peter Greene takes a hard look at the real goals of the voucher crowd: to kill public education. Not by offering better choices but by defunding it, step by step.

Doug Mastriano was not out of step with the movement; he was just a bit early.

Mastriano ran for governor of Pennsylvania with the idea that he could end real estate taxes entirely and cut state funding for public schools to $0.00. Just give everyone a tiny voucher and send them on their way. The idea was far enough out there that the campaigntried to back away from it (without entirely disowning it) and even other GOP politicians raised eyebrows and said, “No, not that.”You slice them off at the knees, right here–

The thing is, this is not a new idea. It has been the fondest dream of some choicers all along. Nancy MacLean, professor of history and public policy at Duke University, offered a succinct digest in the Washington Post of what Milton Friedman, granddaddy of the not-overtly-racist wing of the school choice movement, thought about the movement and its ultimate goals.Friedman, too, was interested in far more than school choice. He and his libertarian allies saw vouchers as a temporary first step on the path to school privatization. He didn’t intend for governments to subsidize private education forever. Rather, once the public schools were gone, Friedman envisioned parents eventually shouldering the full cost of private schooling without support from taxpayers. Only in some “charity” cases might governments still provide funding for tuition.

Friedman first articulated this outlook in his 1955 manifesto, but he clung to it for half a century, explaining in 2004, “In my ideal world, government would not be responsible for providing education any more than it is for providing food and clothing.” Four months before his death in 2006, when he spoke to a meeting of the conservative American Legislative Exchange Council (ALEC), he was especially frank. Addressing how to give parents control of their children’s education, Friedman said, “The ideal way would be to abolish the public school system and eliminate all the taxes that pay for it.

You don’t have to set the wayback machine to find folks saying this quiet part out loud. Utah is one of several red states racing to ram through a voucher bill. Here’s Allison Sorenson, executive director of Utah Fits For All, an outfit marketing the voucher plan like crazy; in this clip, she’s explaining that the folks who back Utah’s plan can’t come right out and say they’re going to defund public education entirely, that admitting the goal is to destroy public education would be too politically touchy.

Vouchers are not about choice. Just look at Florida, which has worked to disrupt, defund and dismantle public schools for years, while simultaneously shutting down and limiting what choices schools are allowed to offer. Look at every state’s voucher law; they all enshrine a private “education provider’s” right to deny and discriminate as they wish, thereby denying choice to any students they wish to deny choice to. One of the biggest limiters of school choice is not the public system, but the private system’s unwillingness to open their doors to all these students who, we hear, are just thirsting for choices.

We know what a free market education system looks like–it looks like the US post-secondary education system. Occasional attempts at free-to-all schools are beaten down by racist and classist arguments, along with charges of socialist indoctrination. You get as much choice as you can afford, the private schools only accept (and keep) the students they want, and those who aspire to certain levels of schooling have to sink themselves in debt to get it. Meanwhile, state’s slowly but surely withdraw financial support from the few “public” universities left.

Ohio has poured taxpayer dollars into charter schools, even though public schools consistently outperform charter schools. Ohio has poured more than $1 billion into virtual charters, even though the biggest of them (ECOT, or The Electronic Classroom of Tomorrow) had the lowest graduation rate in the nation and declared bankruptcy rather than pay back $67 million to the state for large numbers of phantom students. But despite its dismal statistics, it collected $1 billion over its 20 years in business. Vouchers were evaluated by a researcher chosen by a pro-choice think tank, and the report said that voucher students were falling behind.

Given this long history of school choice failure, wouldn’t you think the state would step back and evaluate its commitment to failure?

Of course not. The GOP dominated Legislature wants to expand vouchers.

COLUMBUS, Ohio — A bill to expand the school voucher system and provide more money to home-schoolers has been proposed in Ohio as the Department of Education is investigating a Nazi home-schooling scandal. This is not the first Holocaust education issue the state has had in one year.

Ohio’s public schools have been pushing for consistent funding for decades.

William Philis, executive director of the Ohio Coalition for Equity & Adequacy of School Funding, has spent his career fighting against the voucher system.

“We don’t have a constitutional system and they’re exacerbating the unconstitutionality of the system by draining money out of the public school system,” Philis said.

A new bill introduced to the state Senate will continue to leave public schools behind in favor of supporting private schools, he added.

Senate Bill 11 is expected to use taxpayer money to give $5,500 to elementary and middle school students and $7,500 to high schoolers so they can attend any public, community or charted nonpublic school. Ashtabula Republican Sen. Sandra O’Brien introduced the bill because, “Ohio should act now to put parents, not government, in control of their children’s education,” she said in sponsor testimony Tuesday.

Eric Frank, president of School Choice Ohio, believes the legislation allows children to get the best education possible.

“Primarily, what those do is they target scholarships to families that either live in what we typically refer to as under-performing public school areas, not necessarily districts, but buildings within districts and also low-income families,” Frank said.

The bill would expand the current EdChoice Scholarship to give universal eligibility to all students in the state of Ohio.

There are two sections of the current program:

  • EdChoice Expansion, which the state reported had 17,152 students participating in fiscal year 2021, requires income verification. Eighty-five percent of these students were below the 200% poverty rate.
  • Standard EdChoice, which the state reported has 33,129 student in FY 2021, does not require income verification. More than 75% of the students utilizing this program were not low-income qualified.

Of the total 50,281 students, 25,180 are low-income qualified, with 25,101 that are not. This means that half of the students utilizing taxpayer money to go to a private or charter school are not designated as “needing government assistance.”

This is not to say that people who aren’t in that designation don’t struggle to have to pay the full price of the tuition — but it just means it is unknown if they do struggle to pay or not.

“Most people are really happy with their public schools,” Frank added. “But families that aren’t, they should have another option.”

Philis strongly disagreed.

“I’d say that’s pure poppycock,” Philis said. “I don’t get a voucher for a backyard swimming pool because I don’t want to go to the public pool.”

Even if a student takes a voucher, private schools choose who will be admitted, the advocate said.

“What we’re doing in Ohio right now is that we’re funding segregation,” he stated. “We are funding, with taxpayer money, White Flight.”

The Fair School Funding Plan (FSFP), was somewhat attempted to be put into place for fiscal year 2021-22. It was supposed to change how the state delegates funding for school districts.

Starting in the 2021 FY, lawmakers added hundreds of millions of state dollars in both direct funding and tax credits to subsidize families sending their children to private and charter schools. Critics, like Ohio Education Association, said this makes taxpayers pay for these for-profit schools and diverts money away from public education, which desperately needs it.

The bill would also expand the home-school tax credit from $250 to $2,000, which raises concerns.

Ohio’s Nazi Education Problem

The Ohio Dept. of Education is investigating a family in Upper Sandusky after it was revealed that their home-school program was allegedly a Nazi propaganda school, where children were taught how to love Hitler and become a “wonderful Nazi.”

Logan and Katja Lawrence were the alleged creators of the “Dissident Homeschool” group which had 2,500 members on its Telegram channel when they were exposed in a late January article from VICE News.

“We need to ensure that home-schooling is not an opportunity for parents to systemically teach their children hatred,” state Sen. Catherine D. Ingram (D-Cincinnati) said. “Senate Bill 1, which is pending in Education Committee, weakens home-schooling requirements. The legislature must protect our children from instruction fueled by racism and intolerance.”

News 5 asked Sen. President Matt Huffman (R-Lima) if there should be oversight over the home-school program, which he said “absolutely,” but there are specific rules and regulations.

“I hope we’re long past the point in our society where we take the actions of one person or a small group of people and paint the entire group as though somehow they’re participating in that,” Huffman responded.

The Department of Education should be figuring out what is going on, he added.

“I hope, frankly, that people will not try to take some political advantage or policy advantage… basically trying to decide that a couple of sociopaths somewhere in Ohio who are doing strange things that… somehow should affect the policy of the rest of the state is anathema to me,” the GOP leader said (anathema means something that a person hates).

Democrats have already been jumping at making sure a situation like this does not happen again.

There are only two Jewish members in the Ohio House — Democratic Reps. Casey Weinstein of Hudson and Dani Isaacsohn of Cincinnati.

Weinstein consistently tweets about antisemitism, including a recent post advocating for more home-schooling regulations. Republican state Rep. Riordan McClain, who represents the area in which the alleged Nazi-group resides, responded to him.

“Let’s not take freedom away from all for the terrible ideas of a few,” McClain said. “I can tell you as a home-educating parent from Upper, I’ve never heard of these people.”

In a statement to the press, McClain condemned the Nazi-based teachings and “racial hatred.” He, however, acknowledged that “differing opinions exist in a free society and our job as community members is to have robust ongoing debates.”

“Get the public system out of the way, give the parents the money — we’re going to have a school that involves the Ku Klux Klan mentality,” Philis said.

Frank argued back.

“There are 50,000 families in Ohio that are home-schooling their kids,” Frank said. “And my guess is 99.9% of them probably do a good job and they are their kids, and so it’s their right.”

News 5 continues to search to find out if the Lawrence family has received any funding from the state.

This is not the first time Ohio has dealt with a Holocaust-related scandal in the past year.

Back in March of 2022, News 5 aired an exclusive report about comments made by one of the primary sponsors of a bill to ban schools from teaching “divisive topics” — H.B. 327. The report stemmed from an interview exchange between state Rep. Sarah Fowler Arthur (R-Ashtabula) and News 5 Statehouse reporter Morgan Trau.

During the interview, Fowler Arthur was asked about the financial aspect of the bill. While attempting to talk about funding, she brought up the Holocaust, saying that students needed to hear the massacre from the perspective of the “German soldiers.”

After the exclusive story went international, the original divisive concepts bill had been renamed the “both sides bill” or the “both sides of the Holocaust bill.”

Former Speaker of the Ohio House Bob Cupp (R-Lima) responded to a question about the lawmaker’s comments on the Holocaust, saying they were “inappropriate remarks, they were uninformed remarks.”

The bill swiftly died, despite Fowler Arthur’s repeated efforts to bring it back to life, a records request by News 5 showed. Also in the records were dozens of angry emails to the lawmaker.

She was previously on the state Board of Education but has never participated in the public education system as a student or a parent. She was home-schooled and did not attend college.

In the new General Assembly, the lawmaker will have more power than she has ever had. News 5 shared in January that Fowler Arthur will be the primary and secondary Education Committee’s vice chair.

“I think that in terms of the committee makeup, is it concerning to me that that individual has been given a leadership position on an education committee? Absolutely,” Minority House Leader Allison Russo (D-Upper Arlington) told News 5 in a one-on-one interview.

Luckily, Russo said, the vice chair shouldn’t have a huge role in leading the direction of a committee.

The harrowing story of a Maine family shows the potential perils families face when they transfer to privately run schools that are less subject to government oversight.

“I am the type of parent who always made sure my kids had the good teachers and always took the right classes,” said Esther Kempthorne in an interview with Our Schools. So, in 2014, when she moved with her husband and two daughters to their new home in Washington County, Maine, in a bucolic corner of the state, near the Canadian border, she made it a top priority to find a school that would be the right educational fit for their children.

“We settled in Washington County hoping to give our children the experience of attending one high school, making lasting friendships, and finally putting down some roots,” said Esther’s husband, Nathan, whose career in the military had sent the Kempthorne family traveling the world, changing schools more than 20 times in 17 years. “Both of our children were born on military bases while I was on active duty with the U.S. Navy and the U.S. Air Force,” said Nathan, whose role in military intelligence often meant that he was deployed to high-risk assignments in war zones.

“We said that when we got to Maine, we weren’t going to keep bouncing from school to school,” said Esther.

But after some firsthand experience with the education programs provided by the local public schools, the Kempthornes decided to investigate other options the state offers. One of those options was the state’s provision that allows parents who live in a district that doesn’t have a school matching their child’s grade level the choice to leave the public system and transfer their children to private schools, with the “home” public school district picking up the cost of tuition and transportation, subject to state allowance.

Because the rural district the Kempthornes lived in did not have a high school, they took advantage of that option to enroll their daughters—at taxpayer expense—in Washington Academy, an elite private school founded in 1792 that offersa college track curriculum and access to classes taught by faculty members from a nearby university.

Their decision to leave the public school system for Washington Academy seemed all the better when Esther, a naturalized U.S. citizen born in Mexico, got a full-time job teaching Spanish at the school.

Thinking back on how the Kempthorne family negotiated the school choice landscape in Maine, Nathan recalled, “I thought we were finally going to be okay.”

But the Kempthornes weren’t okay. Far from it, in 2021, the Kempthornes found themselves in the front seat of their car while they were traveling in another state, using Nathan’s iPhone to call in via Zoom and provide testimony to a Maine legislative committee on why Washington Academy, and other schools like it, pose significant threats to families like theirs and how the state needs to more heavily regulate privately operated schools that get taxpayer funding.

Fighting through tears, they spoke of “racism” and “bullying” at Washington Academy and the school administration’s unwillingness to acknowledge and address the school’s culture.

In his written testimony, Nathan wrote of “a disturbing pattern of systemic racism and institutionalized oppression, harassment, and bullying behavior based on race, ethnicity, country of origin, gender, and sexual orientation that has occurred for years at [Washington Academy].”

In her letter of resignation from the school, presented to the committee, Esther wrote of a school environment where she and her daughters, who identify as Hispanic, experienced “racist, anti-immigrant sentiments.” She wrote, “As the racist anti-immigrant rhetoric became more mainstream, we had to teach our daughters how to defend themselves without our intervention, and they did. However, such self-defense has been exhausting and stressful for my children, and it should not be their responsibility to constantly deflect harassment; rather they should be guaranteed a safe educational environment by school leaders.”

Although their daughters eventually graduated from Washington Academy and went on to college, the family became totally uprooted because of their experience at the school. Nine years after building their dream home in rural Maine, they now find themselves living in an apartment in New York City, embroiled in a years-long battle with Washington Academy and Maine officials, which has absorbed countless hours of their time and thousands of dollars of their life savings.

Esther has been unable to reenter the classroom as a full-time teacher due to the lingering effects of the traumatic experiences she had from teaching at Washington Academy, and both parents and daughters speak of long-term adverse mental health effects stemming from the years they spent at the school.

“We sold everything,” Nathan said in his spoken testimony to the committee. “We lost everything in your state and we left for our safety. Our children are completely traumatized. They lost all their friends.”

The Kempthornes’ story about the consequences of leaving the public education system for a private school is a cautionary tale about what can happen when a system designed to provide parents with taxpayer-supported private school options fails to consider the potential risks when students and parents transfer to these schools that are less subject to government oversight.

Their story is even more significant given the current trend across the country where states have increasingly been adopting charter schools, voucher programs, education savings accounts, “backpack funding,” and other so-called school choice options that use taxpayer money to fund alternatives to the public system.

These options are favored by politicians on the right and left, and, at least one state, Arizona, has a voucher program called the Empowerment Scholarship Account Program, which every student in the state is eligible to tap.

This rapid expansion of school choice options is taking place even though there is ample anecdotal evidence and a growing body of research showing that parents in a school choice marketplace often make questionable choices they sometimes come to regret.

As the Kempthornes came to learn, private education providers that are not governed within the public domain pose legal problems that parents often either don’t know about or don’t understand, and local and state government officials often either have no authority to intercede on parents’ behalf or are reluctant to assert what little authority they do have.

The Kempthorne family’s saga, which is still enduring, is a sharp counterpoint to advocates who promote school choice as a simplistic solution for families without acknowledging that transferring taxpayer-funded education services from the public to the private realm will actually complicate parents’ and students’ lives.

Bryant goes in to describe a school culture that was implicitly racist and unwilling to act in complaints of racism.

Washington Academy is one of several Maine “town academies” that benefit from what’s known as “town tuitioning,” in which private schools receive public funding from districts that “tuition out” students to the schools rather than paying to educate them in their “home” district. These Maine academies had from 80.4 to 99.3 percent of their student enrollments funded with public dollars in the fiscal year 2020-2021. Most of them also obtain additional income by operating expensive residential programs that enroll students, often from countries outside the U.S.

The practice of using town tuitioning programs as alternatives to providing public schools started in Vermont, according to Education Week, but has since spread to New Hampshire, Massachusetts, and Connecticut, as well as Maine.

Supporters of these programs call them a “model of educational choice,” according to Education Week, and although supporters of vouchers haven’t always held up town academies as their ideal, they’ve more recently been describing them as the “oldest school choice program in the nation” and calling for expanding them so that all students are eligible to attend the town academies.

But the rationale for having town academies and funding them with public money seems to no longer hold, if it ever did.

‘A Common Myth’

“A common myth is that town academies in New England exist in rural areas which have a scarcity of public schools due to the relatively low population density of families with school-aged children and a lack of funding to support district schools,” according to Bruce Baker, an education professor at the University of Miami in Florida. “But that’s not the reality.”

According to Baker, many of these schools started in the early 1800s, or earlier, as private secondary schools for their communities prior to the existence of public high schools “and in many cases,” prior to the creation of the nation’s system of public common schools. “Some, like Burr and Burton Academy in Manchester, Vermont, were originally funded by local businessmen,” he noted.

Given that origin, town academies that are in operation today are “holdovers,” according to Baker, “of what were once proxy public schools that never converted to district public schools,” although a few have, such as Bellows Free Academy in St. Albans, Vermont, which converted from private to public in 2008.

Contrary to the town academy narrative, some of the schools are in communities that have sufficient populations to educate school-aged children. For instance, New Bedford Academy in New Bedford, Massachusetts, is located in a city with a population exceeding 100,000, according to the 2021 U.S. census. Norwich Free Academy is located in Norwich, Connecticut, a community with a population of more than 40,000.

Also, the notion that town academies are needed in Maine because public schools are few and far between seems hardly the case. “The distances between publicly funded town academies and competing public high schools in Maine is often negligible,” Nathan Kempthorne wrote in an email, pointing out that the distance between Washington Academy and Machias Memorial High School in Machias is only 4.2 miles, and John Bapst Memorial High School, a town academy in Bangor, is only 2.5 miles from Bangor High School and 2.1 miles from Brewer High School.

Public schools in rural communities are quite commonplace. “More than 9.3 million—or nearly one in five students in the U.S.—attend a rural school,” according to a 2019 reportby the Rural School and Community Trust. “This means that more students in the U.S. attend rural schools than in the nation’s 85 largest school districts combined.”

Whereas rural public schools are subject to the same government oversight that all public schools are subject to, that oversight does not extend to private schools, even when they get a substantial portion of their funding from the public.

“In private schools, students end up losing basic constitutional rights and essentially don’t have due process rights,” Todd DeMitchell told Our Schools. DeMitchell is a professor emeritus at the University of New Hampshire at Manchester who studies laws governing school policies and the impact of court cases on these policies.

According to him, if the Kempthornes had their children enrolled in public schools they would have had access to certain rights protected by the U.S. Constitution, including Title 6, which addresses race, and Title 9, which addresses discrimination on the basis of sex. Washington Academy, being a private school, is exempt from these protections.

DeMitchell pointed to a 1987 decision by a federal courtthat ruled a private academy in New Hampshire had the right to fire a teacher who, contrary to school policy, grew a beard, because the school argued successfully that it was “not a state actor,” according to DeMitchell. That ruling’s logic has been extended to a potential 2023 U.S. Supreme Court case in which a North Carolina charter school is arguing that it has the right to require girl students to wear skirts at school because it also is not a state actor. (Charter schools are also privately operated schools that are funded almost exclusively with public money.)

Along with their problematic funding rationale, town academies also have issues with being truly diverse and inclusive schools. For instance, they’ve “long struggled” to serve students with disabilities, according to Baker. And the student populations of these town academies tend to be more white and affluent than their surrounding communities, with any purported claims of student diversity being largely due to their enrollments of international students in residential programs.

Governor Ron DeSantis and his Education Commissioner Manny Diaz Jr. denounced the new AP African American Studies course in January. They listed specific objections to the syllabus. When the College Board released its final draft on February 1, everything that Florida opposed had been deleted.

The College Board insisted that it did not bow to political pressure because the revisions were made before Florida officials denounced the original.

The New York Times reported that the College Board and Florida officials were in frequent contact between September and February 1. The first attack on the AP course was written by Stanley Kurtz and published in the National Review on September 12. Kurtz warned that the AP course was “NeoMarxist” and takes “leftist indoctrination to a whole new level.”

About the same time, the College Board and Florida officials began negotiations.

The Times said today:

While the College Board was developing its first Advanced Placement course in African American studies, the group was in repeated contact with the administration of Gov. Ron DeSantis of Florida, often discussing course concepts that the state said it found objectionable, a newly released letter shows.

When the final course guidelines were released last week, the College Board had removed or significantly reduced the presence of many of those concepts — like intersectionality, mass incarceration, reparations and the Black Lives Matter movement — though it said that political pressure played no role in the changes.

The specifics about the discussions, over the course of a year, were outlined in a Feb. 7 letter from the Florida Department of Education to the College Board.

The existence of the letter was first reported by The Daily Caller, aconservative news site. A copy of the letter was posted on Scribd. Its authenticity was verified by a spokeswoman for the Florida Department of Education, which released a copy early Thursday.

The College Board responded to the letter with one of its own, released on Thursday, saying that Florida’s concerns had not influenced any revisions to the course, which had been shaped instead by feedback from educators.

“We provide states and departments of Education across the country with the information they request for inclusion of courses within their systems,” the letter said, adding, “We need to clarify that no topics were removed because they lacked educational value. We believe all the topics listed in your letter have substantial educational value.”

The discussions between the College Board and the state took place as right-wing activists across the country were increasingly taking aim at school lessons that emphasize race and racism in America. Governor DeSantis, who has presidential ambitions, has cast himself as the voice of parents who are fed up with what he has called “woke indoctrination” from progressive educators.

The back and forth between Florida and the College Board is sure to add to the controversy over the Advanced Placement curriculum, which has prompted a debate among academics in the fields of Black studies, U.S. history and beyond. It has also cast suspicion on the College Board, long criticized for producing exams that seemed to favor white and affluent students.

Supporters of the new A.P. course — which can yield college credit for high school students who do well in it — say it encourages the study of Black history and culture, which have often had only a limited place in high schools. They see another advantage as well, saying that the class will attract Black and Hispanic students, who have not enrolled in A.P. classes as frequently as white students, enriching their study skills and potentially enabling them to amass college credit.

The Florida letter suggests discrepancies with the College Board’s account of events. Florida publicly announced that it had rejected the A.P. course in January, a few weeks before the College Board released its final guidelines — too little time, the board said, to make any politically motivated revisions. But according to the letter, the state informed the College Board months before, in September 2022, that it would not add the African American Studies class to the state’s course directory without revisions.

The Florida letter also outlines a key Nov. 16 meeting to air differences between the state and the College Board over the course. In the meeting, the state claimed that the A.P. African American Studies course violated regulations requiring that “instruction on required topics must be factual and objective and may not suppress or distort significant historical events.”

According to the state, the College Board acknowledged that the course would undergo revisions, while pushing back against the state’s request to remove concepts like “systemic marginalization” and “intersectionality,” which the College Board saw as integral to the class.

Nevertheless, by the time the course’s final framework was released on Feb. 1, those terms had largely been removed, except that intersectionality was listed as an optional subject for the course’s required final project, in which students can choose their area of focus.

In its response to the Florida letter, the College Board said, “We are confident in the historical accuracy of every topic included in the pilot framework, as well as those now in the official framework.” The board has also said that students and teachers could still engage with ideas like intersectionality through optional lessons or projects and through A.P. Classroom, a free website that will serve as a repository for important texts for the class.

Even so, many scholars have noted the omission of terms that, according to the College Board’s own research documents, are considered central to African American Studies as it is taught on college campuses.

Intersectionality, for example, is an influential theory first laid out by the legal scholar Kimberlé Crenshaw in 1989. It posits that race, class, gender, sexuality and other forms of identity intersect in ways that shape individuals’ experience of the world.

Professor Crenshaw’s work is important to several disciplines, including African American studies, gender studies and legal studies. She is also closely associated with critical race theory, a concept that has become a lightning rod among conservative curriculum activists, who object to schools emphasizing the concepts of racism or white privilege.

Ron DeSantis threw his weight around, and the College Board capitulated. He is now the official arbiter of what history may be taught to advanced students in American high schools.

Dave Dewitt, editor-in-chief of the Ohio Capital Journal, wrote a blistering critique of the state’s political leadership, who place the interests of the private sector above the common good of the public.

Many Ohioans pay taxes for schools but don’t have school-age children. Their taxes are meant to fund quality public schools because having educated citizens is a public good. Sending their money to unaccountable for-profit, private, and religious schools is a terrible abuse.

Compelling taxpayers to support private interests at the expense of public ones is not only unethical, but unconstitutional when those private interests intertwine with religion. American taxpayers should never be forced to fund the efforts of religious institutions of any kind. Not one red cent.

The very first clause in the First Amendment of our Bill of Rights is couched firmly in that defining principle. The entire basis for making “no law respecting an establishment of religion” the first clause was “Father of the Constitution” James Madison’s takedown of anti-Constitution Patrick Henry’s proposal to send taxpayer money to support religious institutions.

Nevertheless, Ohio Gov. Mike DeWine has put forward a budget proposal to expand school voucher subsidies that would send money to private, for-profit, and religious ventures. Prominent Ohio Republican Statehouse leaders appear to be on board.

“Families are eligible for EdChoice scholarships by either living in the boundaries of a low-performing school or by household income. Currently, a family of four can qualify for state money if the household income is at or below $69,375, or 250% of the Federal Poverty Guidelines. The limit would increase to 400% of the Federal Poverty Guidelines, which would be $111,000 for a family of four, under DeWine’s proposal. …”

EdChoice vouchers are distributed as checks given to private schools to help cover a student’s tuition. The scholarship amount is currently $5,500 for students in grades k-8 and $7,500 for grades 9-12. Republicans who control the legislature expanded vouchers in 2012, 2020, and 2021.

So vouchers are already available to low-income households and in low-performing districts, which means the only reason to increase the voucher threshold to 400% is for a massive sweetheart giveaway to private interests.

DeWine’s budget also would increase per-student building funding for all charter schools from $500 to $1,000 per student — a 100% bump — and provide an extra $3,000 for each economically disadvantaged student, or a student who qualifies for free or reduced lunch — up from $1,750 currently.

DeWine, Hancock notes, did not propose any extra per-student money for traditional public education.

Sadly, American public education was marked as a $500 billion a year opportunity for private profiteering some time ago, and Ohio has been leading the way.

Over the past several decades, Ohio’s seen one boondoggle after another.

Ohio taxpayers were ripped off by hundreds of millions of dollars, and nearly 12,000 Ohio schoolchildren and their families left in the lurch, when the ECOT schemedreamed up on a Waffle House napkincrashed and burned in 2018.

Another for-profit charter school operator called White Hat Management drained $67 million a year away from Ohio public schools before low test scores and soaring high school dropout rates led to a lawsuit from school boards and its eventual demise.

Dayton Daily News’ Josh Sweigart has uncovered a smattering of cases the past decade, including nepotistic hiring, undocumented purchasing, and charter school board members overpaying themselves.

Meanwhile, Ohio Capital Journal’s Zurie Pope revealed in reporting this past summer that the proposed “Backpack Bill” legislation last General Assembly to send public education money to private schools by the head was written with help from religious lobbying group the Center for Christian Virtue (CCV) and a think tank that promotes charter schools.

Promotion for the so-called “Backpack Bill” law featured CCV President Aaron Baer speaking at a press conference for it, and documents obtained by OCJ also revealed behind-the-scenes advice and promotion by outside groups like Heritage Action and the American Legislative Exchange Council (ALEC).

ALEC even held a luncheon for lawmakers at the Statehouse promoted as a “Backpack Bill Briefing.”

All of this has come amid a decades-long right-wing assault on public education itself, only becoming more venomous and destructive in recent years.

But by wide margins, parents express satisfaction with their kids’ schools, and educational outcomes over the past 50 years in America have only steadily improved. From Education Next:

Contrary to what you may have heard, average student achievement has been increasing for half a century. Across 7 million tests taken by U.S. students born between 1954 and 2007, math scores have grown by 95 percent of a standard deviation, or nearly four years’ worth of learning. Reading scores have grown by 20 percent of a standard deviation during that time, nearly one year’s worth of learning.

The narrative of “failing public schools” has been manufactured by corrupt private school bloodsuckers looking to wet their beaks in the public school money pot.

Aside from its false pretenses, it undercuts funding and saps the ability of public schools to address real problems.

The biggest achievement gap in American education is directly tied to poverty. Exacerbating this situation is the fact that Ohio has had unconstitutional property tax-based school funding for 25 years. Wealthy districts do great, while low-income districts suffer mightily.

We have ample empirical evidence to prove that the way to address the poverty achievement gap is by robustly funding public schools to institute best practices: early childhood education; a well-rounded school experience including culture, sports, and the arts; extra-curricular activities that give students a sense of purpose; community-minded and community-building schools; cooperative learning.

But initiatives like these are the very things money-strapped districts are forced to cut first, alongside practical necessities like busing or the teachers themselves.

DeWine’s proposed budget does include money for things such as early childhood education, and he has already awarded significant grants for it, which is commendable.

But he seems to want to balance this politically with a massive giveaway of public dollars to private school interests and the religious zealots aligned with CCV, which is unacceptable.

Many Ohio taxpayers — even those who don’t have children or whose children are no longer school-age — are happy to help fund public schools.

We understand that quality public schools increase property values and make our communities attractive places to live, which helps them thrive.

We want our communities and our public schools to thrive.

What most Ohio taxpayers do not want is our public schools to continue to suffer as money and resources are siphoned away from them to prop up private, for-profit, and religious interests.

But when it comes to funding those interests, or fully and fairly funding Ohio’s public schools, Republican Statehouse leaders have continually legislated for the private interests.

The vultures have poll-tested their messaging, so they love to talk about “school choice,” “parents’ rights,” and “funding the students, not the system.”

This is a smooth evasion that attempts to elide the fact that the question isn’t about whether parents have a choice where to send their kids for schooling; everybody already does.

What these interests are asking for are endless direct state subsidies to their private enterprises and religious institutions.

And that’s what DeWine and these lawmakers stand prepared to keep giving them, on our dime and at the expense of our public schools.

Every Ohio public school faces a yearly audit, but no such requirement exists for private schools receiving public vouchers. Why not? If public money is continually funneled into these schools, why are they not subjected to the same auditing standards as public schools to make sure that money is actually going toward appropriate education of students?In an analysis of one proposed bill, the nonpartisan Legislative Services Commission found that two-thirds of kids getting vouchers in Ohio’s expansion program have never been in public schools.

So that means that these kids aren’t being “rescued” from public schools; they were never going to public schools in the first place. This is pure state subsidy of private school tuition. As the LSC puts it, these are “existing nonpublic school students that represent a new state responsibility.”

Do the private schools lead to greater academic success?

A Cincinnati Enquirer analysis of nearly 2.5 million test scores from schools in more than 150 Ohio cities during the 2017-18 and 2018-19 school years found that in 88% of the cities, the public district achieved better state testing results than the private schools.

Given all this, what assurances are Ohioans being given that our money will not be misused as it has been in the past? If this money is coming out of public school funding, what guarantees do we have that our public schools will be fully funded under the new Fair Funding plan?

Ohio Senate Republicans led by President Matt Huffman have made clear they want the full “Backpack Bill” pushed by the CCV. That would be the biggest win possible for the private interests. As this DeWine proposal is brought and negotiated between the House and Senate, it looks likely to become, essentially, “Backpack Bill Light.”

I’m not holding my breath for full, fair public school funding. Legislators repeatedly steamroll DeWine and there’s no reason to think they won’t on this. There’s only one pot. It’s meant for high-quality public schools. But they always turn their backs on our public schools in favor of the private interests.

I come from a family of educators: My mom, a longtime teacher and junior high school principal; my sister, a primary school special education teacher; my grandmother, a high school teacher; my other grandmother, a school librarian; my grandfather, a school teacher and later the dean of a Kent State University branch.

I grew up surrounded by public educators, both at school and at home. I grew up generally believing that we as a society agreed about the importance and value of public education.

It came as a great shock to me when I entered adulthood that there are incredibly well-funded private interests working every day to undermine and rob our public schools.

Then I started seeing one for-profit school scam after another in Ohio, and realized that our state government was actively stoking the grift.

When I ask the public educators I know for their thoughts, many tell me there’s a definite role for traditional charters and private schools for the maybe 10% of students best off at them, but it’s unconscionable to rob the other 90% of public school students and prioritize the 10%.

That seems reasonable.

Traditional charter and private schools have a place, but they must face just as much scrutiny and accountability and auditing as our public schools if they are to receive our money.

And propping up private schools should never, ever come at the expense of our already woefully unsupported public schools.

We need to dedicate ourselves to a positive vision of the wonderful beacons our public schools can be when we invest in them, when we support them, when we encourage them to be creative, and when we give them the resources and opportunity to thrive.

Public education is not failing. Ohio politicians are failing to prioritize and invest in public education.

Jan Resseger looks behind the daily news and ties together fast-moving events in the red states. The sudden proliferation of voucher programs is no accident, she writes, nor is it a response to public demands. It is a carefully crafted, well-funded strategy to defund public schools, to smash teachers’ unions, and to implement a rightwing ideology that does not benefit students or improve education.

She writes:

This week in Iowa, Governor Kim Reynolds signed an Education Savings Account, universal voucher program into law. And last week in Utah, the same kind of voucher plan took the first step toward adoption when it was passed by Utah’s House of Representatives.

The Des Moines Register reports on Iowa’s new vouchers. The program will “phase in over three years and eventually allow all Iowa families to use up to $7,598 a year in an ‘education savings account’ for private school tuition. If any money is left over after tuition and fees, families could use the funds for specific educational expenses, including textbooks, tutoring, standardized testing fees, online education programs and vocational and life skills training. The $7,598 per private school student is the same amount of funding the state provides to public school students and is expected to rise in future years… The bill allows the Iowa Department of Education to contract with a third party to administer the education savings accounts, but the state has not yet issued a request for proposals from companies seeking to manage the funds.”

It would appear that the Iowa Legislature tried to calm the fears of the public school community by promising that, “Public school districts would also receive an additional $1,205 in funding for students receiving education savings accounts who live within the public school district’s boundaries.” But despite that promise, a drop in overall public school funding is expected: “By the fourth year, the (Legislative Services) agency estimates public school districts will receive $49.8 million in new per-student funds for private school students within the public district’s boundaries. The agency also expects a net decrease of $46 million in public school funding as a result of more students attending private schools.”

It is hard to keep track of all the states that now have school vouchers or are considering voucher programs and to know which states have the latest flavor of vouchers—Education Savings Accounts (ESAs). Most ESA programs, unlike Iowa’s, don’t even require that families use the vouchers at private schools. In most places, ESA’s can be used for educational programs, for educational tools and materials like books and computers, and for homeschooling. In some states families can use the money for so-called micro-schools in which families come together and hire a teacher to work with children in someone’s home.

Why is there so much so much legislative activity about expanding vouchers? Several factors are important to consider, and many of them were the subject of economist Gordon Lafer’s analysis in The One-Percent Solution. Lafer’s book focused on the public policy that flowed from state legislatures after the Tea Party wave election in 2010, but his observations are still on point as we begin 2023. Lafer enumerates all the reasons why far-right ideologues and big corporate moneyed interests seek to undermine and privatize public schools: “At first glance, it may seem odd that corporate lobbies such as the Chamber of Commerce, National Federation for Independent Business, or Americans for Prosperity would care to get involved in an issue as far removed from commercial activity as school reform. In fact, they have each made this a top legislative priority… The campaign to transform public education brings together multiple strands of the agenda… The teachers’ union is the single biggest labor organization in most states—thus for both anti-union ideologues and Republican strategists, undermining teachers’ unions is of central importance. Education is one of the largest components of public budgets, and in many communities the school system is the single largest employer—thus the goals of cutting budgets, enabling new tax cuts for the wealthy, shrinking the government, and lowering wage and benefit standards in the public sector all coalesce around the school system… There are always firms that aim to profit from the privatization of public services, but the sums involved in K-12 education are an order of magnitude larger than any other service, and have generated an intensity of corporate legislative engagement unmatched by any other branch of government. Finally, the notion that one’s kids have a right to a decent education represents the most substantive right to which Americans believe we are entitled, simply by dint of residence… (F)or those interested in lowering citizens’ expectations of what we have a right to demand from government, there is no more central fight than around public education. In all these ways, then, school reform presents something like the perfect crystallization of the corporate legislative agenda.” (The One-Percent Solution, pp 128-129)

It is hard for public school advocates to mobilize nationally against the expansion of vouchers. Voucher battles are fought state by state because public education and the funding of public education is a state-by-state issue. Advocates are likely to focus on public education legislation in their own state and not to pay attention to what’s happening elsewhere. And citizens are not likely to pay much attention to what is happening in the legislature. Once again, Gordon Lafer identifies the problem: “(M)any of the factors that strengthen corporate political influence are magnified in the states. First, far fewer people pay attention to state government, implying wider latitude for well-funded organized interests… Apart from labor unions and a handful of progressive activists, the corporate agenda… encounters little public resistance at the state level because hardly anyone knows about or understands the issues… So, too, corporate lobbies’ financial advantage is magnified in the states. Citizens United marked a sea change in state as well as federal politics.” (The One Percent Solution, pp. 34-36)

Christopher Lubienski, a professor of education policy at Indiana University who has studied the impact of school privatization and the politics around privatizing public schools, recently published a reminder that school privatization is driven by the power of the corporate agenda. Expansion of vouchers has never been an expression of voters’ overall preference: “School choice is continuing to expand across the United states…. But these successes often come in spite of overwhelming voter opposition to school choice programs… According to the pro-voucher organization EdChoice.org, the U.S. has over 75 publicly funded private school choice programs, including vouchers, and education savings accounts, as well as another 45 charter school programs. But all of these programs have been implemented by legislators, not the electorate… In fact, voters have been allowed to weigh in on school choice programs only nine times since 2000, and they almost always reject them, often by overwhelming margins. Only twice did school choice programs pass through the ballot box. In 2012, Georgia voters empowered their legislature with the ability to create charter schools. That same year… Washington voters passed a charter school referendum.”

Who are the far-right advocacy groups and think tanks powerfully promoting Education Savings Account vouchers? They include the usual suspects: the American Legislative Exchange Council and a state- by-state group of think tanks that are ALEC’s partners in the State Policy Network, EdChoice, the Goldwater Institute, the Heritage Foundation, and the Institute for Justice, which provides two model laws—“Education Savings Account Act: Publicly Funded,” and “Education Savings Account Act: Tax-Credit Funded“—so that state legislators can merely adapt a canned statute to their own state’s particular needs. SourceWatch reports corporate funding streams for these and other far-right think tanks that promote vouchers—funding from the Koch Brothers, the Bradley Foundation, and investments from the Donor’s Capital Fund, a powerful investor of corporate dark money since the 2010, U.S. Supreme Court ruling in Citizens United.

In the past two years, the campaign to undermine public schooling and promote the expansion of vouchers has developed a new strategy to convince parents that their children in public schools are being brainwashed by critical race theory and surrounded by discussion of gender and sexual orientation. In a new report published by the Network for Public Education this week, political scientist Maurice Cunningham traces the money behind what may appear to be a spontaneous emergence of parents’ groups—Parents Defending Education, Moms for Liberty, and No Left Turn in Education. Cunningham points to clues that these are not local grassroots groups of parents; their websites, for example, betray a big investment in communications. And while, for example, the founders of Parents Defending Education (PDE) claim to be a bunch of working moms, Cunningham explains: “PDE took in $3,178,272 in contributions and grants in 2021… Donor’s Trust, a dark money donor associated with the Koch network donated $20,250 to PDE in 2021. The Achelis & Bodman Foundation which funds voucher and charter school programs and targets public education, contributed $25,000. Searle Freedom Trust, another right-wing donor with ties to Donors Trust, contributed $250,000 in 2021. We don’t know all the names on the checks, but we do know that those checks had to be pretty large, that the attorneys and consultants sit at the hierarchy of right-wing operatives, and that the board members and staffers are connected to the highest levels of conservative donors including the Koch network.”

The same people who are promoting vouchers are working to scare parents with the huge, culture war campaign driven by identifiable funders and a mass of dark money supporting an education marketplace and undermining parents’ confidence in public schools. But as Christopher Lubienski, the scholar who has studied the effect of the privatization of public education reminds us, expanding vouchers has not improved the outcomes for our children: “(R)ecent research is repeatedly showing that… vouchers are not a good investment. Although publicly funded vouchers may be propping up some private schools that might otherwise go out of business, they are not really helping the people they purport to help. In fact… study after study shows that students using vouchers are falling behind where they would have been if they had remained in public schools. Thus, policymakers might think twice about defying voters on initiatives that actually cause harm to children.”

The political theorist Benjamin Barber warns that school choice does not really provide freedom for families: “We are seduced into thinking that the right to choose from a menu is the essence of liberty, but with respect to relevant outcomes the real power, and hence the real freedom, is in the determination of what is on the menu. The powerful are those who set the agenda, not those who choose from the alternatives it offers. We select menu items privately, but we can assure meaningful menu choices only through public decision-making.” (Consumed, p. 139)

At ex-Governor Cuomo’s urging several years ago, the Legislature passed a law requiring the New York City Department of Education to provide free space to charter schools, and if no space was available, to pay their rent in private space. This requirement gave rise to the dreadful practice of “co-location,” in which a new charter school was crammed into an existing public school. The public school typically lost space for class size reduction, performances, special education services, and everything else that was not designated as a classroom. Meanwhile, the charter school got fresh new furniture and the best of everything. There was no collaboration between the schools under the same roof.

A few days ago, charter advocates were stunned when the Department of Education rejected three requests for co-location by the rich and politically powerful Success Academy charter chain. The Wall Street Journal immediately published an editorial blasting Mayor Eric Adams (whose campaign was bankrolled by charter billionaires) and who put charter advocates on the city’s school board. The decision was made by Chancellor David Banks and never reached the pro-charter city board.

For Eva Moskowitz of Success Academy, this was a surprising rejection. She is accustomed to cowing politicians (she has her own PAC) and getting her way.

Charter fans and the pro-charter media blame “the unions,” their usual enemy, but this isn’t correct. Parents and educators in these communities contacted their legislators and won their support. And the legislators and local officials killed the deal.

Congressman Jamaal Bowman stepped up to oppose the co-location in a school that he knew. He wrote a thread on Twitter (@JamaalBowmanNY) that began:

The @NYCSchools proposal to open and co-locate a new @SuccessCharters school in Building X113 is absolutely outrageous. The Panel for Education Policy has to vote against this plan, and I urge my colleagues and neighbors to get loud in opposition. Here’s why: 🧵

As a former educator & principal of a middle school in the same district as X113, I’ve seen up close how the educators there have done a tremendous job serving their students & families. Our community is incredibly grateful for the love they pour into their work every day.

I’ve also seen how charter schools can harm students, educators, and traditional public schools in our communities. We can’t let that happen at X113.

Big charter networks have a history of draining students & funds from traditional public schools, and violating the rights of their students. Last year, Success Academy had to pay out $2.4 million in a federal court settlement for pushing out students with disabilities.

The plan will decrease available space for the existing schools at Building X113 – both district-run public schools – and prevent them from lowering class sizes adequately. Class size matters. We’ve got to demand schools get the resources & physical space to meet student needs.

As many charter school expansions do, this destructive plan will also disproportionately harm students with disabilities. The plan does not include sufficient analysis of what intervention rooms are necessary to provide students with IEPs with the services they need.

Another surprise: the Rupert Murdoch-owned New York Post got the story right. The story recognized that the pressure to block the co-locations came not from the union but from parents. The Post has been a vocal supporter of charters, and Murdoch himself has contributed to them.

Elected officials helped kill a plan to open three new charter schools in existing public schools or other city-owned buildings — after hearing fierce opposition from local parents.

Bronx Borough President Vanessa Gibson — who last week spoke at the ribbon-cutting ceremony for a new DREAM Charter High School in Mott Haven — suggested Tuesday that her hand was forced against the planned Success Academy in Williamsbridge.

“Parents of School District 11 spoke to us loud & clear. The deep rooted history of disinvestment at the Richard R. Green Campus must be recognized. So much progress has been made,” she tweeted.

A City Hall insider also cited “a lot of pushback” from community members opposed to the new charter schools.

“They vote and they hold folks accountable,” the source said.

Schools Chancellor David Banks’ unexpected withdrawal of the proposal came even though Mayor Eric Adams packed the board in charge of the decision with pro-charter allies.

Writing in Forbes, Peter Greene explains why state takeovers fail. Greene retired as a teacher after 39 years in the classroom. They fail and fail, but state legislatures won’t stop imposing them on struggling school districts that need help. The usual traits of a “failing” school or school district: high poverty, high numbers of limited-English proficient students, high numbers of students with disabilities. Funny, one seldom, if ever, finds a school or district in an affluent white neighborhood that needs to be run by the state.

Greene writes:

Since policy writers and thinky tanks first started pushing the idea of identifying “failing” schools, the search has been on for a way to fix those schools. A popular choice has been the school takeover model, where the state strips the local school district of authority and then waves some sort of magic wand to make things better.

The Obama administration used School Improvement Grants as a tool, offering federal funds to schools that were “failing,” but those funds came with very strict rules about how they could be used. This is a good example of the Takeover By Puppetry model, in which the local officials are left in place, but they are only allowed to make certain government-approved moves or must only implement consultant-approved steps. The SIG program spent in the neighborhood of $7 billion. USED’s own report found that it “had no significant impacts on math or reading test scores, high school graduation, or college enrollment.”

That report, to which Greene refers, was released in the last day of the Obama administration’s eight-year term. It gave an F to a major part of the failed “Race to the Top.” $7 billion spent, nothing to show for it.

The more direct takeover approach has also been tried. Tennessee formed the Achievement School District; in this model, the state takes control of “failing schools” and lumps them into a state-run district. The initial promise was that schools from the bottom 5% would be catapulted into the top 25%. After a few years, they were not even close to achieving their, so they rewrote the goal. The head of the ASD moved on to another job. Versions of the ASD have been tried in several states and in cities (e.g. Philadelphia) and in almost all cases, they’ve been rolled back or shut down because they cost a lot of money and achieve few worthwhile results.

1) The Wrong Measure of Failure

How are we going to decide which schools are in need of taking over? The most common answer is by standardized test scores–which is a lousy answer. This bad definition is important because it biases the process in favor of bad solutions. A school may have a hundred problems, but if all we’re focused on is the test scores, too may real problems will be unaddressed. Worse, many important elements of children’s education will be swept aside to make room for more test prep–the exact opposite of what students in struggling schools need. This is like calling AAA because you’re stranded beside the road with three flat tires, a busted radiator, an empty gas tank, and failing brakes–and AAA sends someone to wax the car.

2) The Wrong Diagnosis

Takeover programs focus on school governance. The thesis of a takeover is that the school board, the administration, and probably the teachers, are the root of all the problems at the school. If we just take them out of the way and replace them with shinier people, then everything will just fall into place. Somehow, all these people who work in the district either don’t know how to raise test scores, or they just don’t care. Resources for the district, issues in the community, systemic lack of support for the school, poverty–none of that is on the table. The belief is that when the old bureaucracy (including unions) is swept away and replaced, preferably by a visionary CEO type who will whip the troops into shape, then everything will run so much better. Often the unspoken premise is, “If we could just run these schools like charter schools…” Here’s what Chris Barbic, who was supposed to be the visionary CEO of the Tennessee ASD, said as he was leaving the job:

Let’s just be real: achieving results in neighborhood schools is harder than in a choice environment. I have seen this firsthand at YES Prep and now as the superintendent of the ASD. As a charter school founder, I did my fair share of chest pounding over great results. I’ve learned that getting these same results in a zoned neighborhood school environment is much harder.

I have always been partial to Greene’s third reason: the mystical belief that someone who works for the State Departmenf of Education knows how to fix everything. This is absurd. You would think even the Legislature knows that Superman or Woman is not in a desk job at DOE.

Periodically, the Network for Public Education sponsors a conversation with an important voice in education policy. On January 11, I interviewed Josh Cowen, Professor of Education Policy at Michigan State University.

Josh has been an insider in voucher research for almost 20 years. It’s a small club, and he knows the research and the researchers. Josh came to the conclusion that vouchers have been a disaster for the students who leave public schools, supposedly to be “saved” by them.

But he points out that 70-80% of the students who use vouchers were never enrolled in public schools. Many return to the public schools. The political pressure for vouchers comes from politicians and parents seeking a subsidy for students already attending private and religious schools. The claim that they will help “save kids from failing schools” is a hoax to cover up the real purpose of vouchers: to transfer funds to private and religious schools.

The Network for Public Education has released a new report on for-profit charters, which grew during the pandemic years. The report is titled Chartered for Profit II: Pandemic Profiteering. It builds on the findings of a report published by NPE in 2021. For-profit charters not only divert money away from the public schools, which enroll the vast majority of students in every state, but they skim off profits that should have been spent on students and teachers. The report details the nefarious deals that enrich the charter operators. Every citizen who cares about our future should be aware of the facts detailed in this report. We believe readers will be genuinely shocked by the findings in this report, which shows how scammers and grifters have gotten a stronghold in the charter industry, to the detriment of students, teachers, and taxpayers.

In March of 2021, the Network for Public Education published Chartered for Profit: The Hidden World of Charter Schools Operated for Financial Gain. In this follow-up report on the charter for-profit sector, we chronicle its expansion during the years of the Covid-19 pandemic by reporting growth in the number of schools, the number of for-profit corporations that run them, and student enrollment.

Acccording to our research, the for-profit sector dominated the charter school sector during the pandemic years. As the pandemic wore on – the percentage of charter schools run by for-profits jumped from 15 percent to 16.6 percent of the charter sector. This is a far greater percentage than is reported by the National Alliance for Public Charter Schools, which inexplicably does not report schools run by for-profit Education Management Organizations (EMOs) that control only one or two schools. These micro-EMOS comprise nearly half of all for-profit EMOs.

However, the number of schools run for profit underestimates the true growth of for-profit schooling during Covid 19. The percentage of students attending a charter school designed to produce a profit for its management company soared. According to the Common Core of Data of the National Center for Education Statistics, the total student enrollment in charter schools during the second year of the pandemic (the 2021-2022 school year) was 3,676,635. Student enrollment in for-profit-run charter schools jumped to 731,406 that year.

That means that 20 percent of all charter school students, 1 in 5, were enrolled in a charter school managed by a for-profit management corporation by the pandemic’s end.

More disturbing is that 27 percent of the students attending for-profit-run schools were enrolled in low-quality virtual charter schools that teach students either exclusively or primarily online. That was in 2021. During the prior year (2020) the number was even higher.

Those who defend for-profit charter schooling claim it is no different from public schools using vendors for transportation services or to purchase textbooks. However, as this report explains, for-profit chartering is very different from vendors who supply discreet products and services. We detail the various ways in which the owners of EMOs extract profit via a lack of oversight and regulation that fails to protect taxpayers from sweetheart deals, sweeps contracts, and related party transactions designed to enrich EMO owners, their friends and their family members. And we explain how the acquisition of real estate and exploitative lease and purchase agreements drive the expansion of for-profit-run charter schools and, in some cases, put the school at financial risk.

Chartered For-Profit II: Pandemic Profiteering makes a case for substantive state and national reform so that the best interests of students and taxpayers trump financial gain. Like our first report, it provides insight into the most controversial sector of the charter school world—charters operated for financial gain.
