This is one of the best letters that Heather Cox Richardson has written since I started reading her posts. It puts the current Supreme Court’s radical decisions into historical perspective. This Court, hand-picked by Leonard Leo and the Federalist Society, is engaged in a shameless effort to move the clock back to the world as it existed before the New Deal. This Court threatens our democracy and our rights.

She writes:

Today the Supreme Court followed up on yesterday’s decision gutting affirmative action with three decisions that will continue to push the United States back to the era before the New Deal.

In 303 Creative LLC v. Elenis the court said that the First Amendment protects website designer Lorie Smith from having to use words she doesn’t believe in support of gay marriage. To get there, the court focused on the marriage website designer’s contention that while she is willing to work with LGBTQ customers, she doesn’t want to use her own words on a personalized website to celebrate gay marriages. Because of that unwillingness, she said, she wants to post on her website that she will not make websites for same-sex weddings. She says she is afraid that in doing so, she will run afoul of Colorado’s anti-discrimination laws, which prevent public businesses from discriminating against certain groups of people.

This whole scenario of being is prospective, by the way: her online business did not exist and no one had complained about it. Smith claims she wants to start the business because “God is calling her ‘to explain His true story about marriage.’” She alleges that in 2016, a gay man approached her to make a website for his upcoming wedding, but yesterday, Melissa Gira Grant of The New Republic reported that, while the man allegedly behind the email does exist, he is an established designer himself (so why would he hire someone who was not?), is not gay, and married his wife 15 years ago. He says he never wrote to Smith, and the stamp on court filings shows she received it the day after she filed the suit.

Despite this history, by a 6–3 vote, the court said that Smith was being hurt by the state law and thus had standing to sue. It decided that requiring the designer to use her own words to support gay marriage violated the First Amendment’s guarantee of free speech.

Taken together with yesterday’s decision ruling that universities cannot consider race as a category in student admissions, the Supreme Court has highlighted a central contradiction in its interpretation of government power: if the Fourteenth Amendment limits the federal government to making sure that there is no discrimination in the United States on the basis of race—the so-called “colorblind” Constitution—as the right-wing justices argued yesterday, it is up to the states to make sure that state laws don’t discriminate against minorities. But that requires either protecting voting rights or accepting minority rule.

This problem has been with us since before the Civil War, when lawmakers in the southern states defended their enslavement of their Black (and Indigenous) neighbors by arguing that true democracy was up to the voters and that those voters had chosen to support enslavement. After the Civil War, most lawmakers didn’t worry too much about states reimposing discriminatory laws because they included Black men as voters first in 1867 with the Military Reconstruction Act and then in 1870 with the Fifteenth Amendment to the Constitution, and they believed such political power would enable Black men to shape the laws under which they lived.

But in 1875 the Supreme Court ruled in Minor v. Happersett that it was legal to cut citizens out of the vote so long as the criteria were not about race. States excluded women, who brought the case, and southern states promptly excluded Black men through literacy clauses, poll taxes, and so on. Northern states mirrored southern laws with their own, designed to keep immigrants from exercising a voice in state governments. At the same time, southern states protected white men from the effects of these exclusionary laws with so-called grandfather clauses, which said a man could vote so long as his grandfather had been eligible.

It turned out that limiting the Fourteenth Amendment to questions of race and letting states choose their voters cemented the power of a minority. The abandonment of federal protection for voting enabled white southerners to abandon democracy and set up a one-party state that kept Black and Brown Americans as well as white women subservient to white men. As in all one-party states, there was little oversight of corruption and no guarantee that laws would be enforced, leaving minorities and women at the mercy of a legal system that often looked the other way when white criminals committed rape and murder.

Many Americans tut-tutted about lynching and the cordons around Black life, but industrialists insisted on keeping the federal government small because they wanted to make sure it could not regulate their businesses or tax them. They liked keeping power at the state level; state governments were far easier to dominate. Southerners understood that overlap: when a group of southern lawmakers in 1890 wrote a defense of the South’s refusal to let Black men vote, they “respectfully dedicated” the book to “the business men of the North.”

In the 1930s the Democrats under President Franklin Delano Roosevelt undermined this coalition by using the federal government to regulate business and provide a social safety net. In the 1940s and 1950s, as racial and gender atrocities began to highlight in popular media just how discriminatory state laws really were, the Supreme Court went further, recognizing that the Fourteenth Amendment’s declaration that states could not deprive any person of the equal protection of the laws meant that the federal government must protect the rights of minorities when states would not. Those rules created modern America.

This is what the radical right seeks to overturn. Yesterday the Supreme Court said that the Fourteenth Amendment could not address racial disparities, but today, like lawmakers in the 1870s, it signaled that it would not protect voting in the states either. It rejected a petition for a review of Mississippi’s strict provision for taking the vote away from felons. That law illustrates just how fully we’re reliving our history: it dates from the 1890 Mississippi constitution that cemented power in white hands. Black Mississippians are currently 2.7 times more likely than white Mississippians to lose the right to vote under the law.

The court went even further today than allowing states to choose their voters. It said that even if state voters do call for minority protections, as Colorado’s anti-discrimination laws do, states cannot protect minorities in the face of someone’s religious beliefs. In her dissent, Justice Sonia Sotomayor wrote that for “the first time in its history,” the court has granted “a business open to the public a constitutional right to refuse to serve members of a protected class.”

It is worth noting that segregation was defended as a deeply held religious belief.

Today, using a case concerning school loans, the Supreme Court also took aim at the power of the federal government to regulate business. In Biden v. Nebraska the court declared by a vote of 6 to 3 that President Biden’s loan forgiveness program, which offered to forgive up to $20,000 of federally held student debt, was unconstitutional. The right-wing majority of the court argued that Congress had not intended to give that much power to the executive branch, although the forgiveness plan was based on law that gave the secretary of education the power to “waive or modify any statutory or regulatory provision applicable to the student financial assistance programs…as the Secretary deems necessary in connection with a…national emergency…to ensure” that “recipients of student financial assistance…are not placed in a worse position financially in relation to that financial assistance because of [the national emergency]”.

The right-wing majority based its decision on the so-called major questions doctrine, invented to claw back regulatory power from the federal government. By saying that Congress cannot delegate significant decisions to federal agencies, which are in the executive branch, the court takes on itself the power to decide what a “significant” decision is. The court established this new doctrine in the West Virginia v. Environmental Protection Agencycase, stripping the EPA of its ability to regulate certain kinds of air pollution.

“Let’s not beat around the bush,” constitutional analyst Ian Millhiser wrote today in Vox, today’s decision in Biden v. Nebraska “is complete and utter nonsense. It rewrites a federal law which explicitly authorizes the loan forgiveness program, and it relies on a fake legal doctrine known as ‘major questions’ which has no basis in any law or any provision of the Constitution.”

Today’s Supreme Court, packed as it has been by right-wing money behind the Federalist Society and that society’s leader, Leonard Leo, is taking upon itself power over the federal government and the state governments to recreate the world that existed before the New Deal.

Education Secretary Miguel Cardona called out the lurch toward turning the government over to the wealthy, supported as it is by religious footsoldiers like Lorie Smith: “Today, the court substituted itself for Congress,” Cardona told reporters. “It’s outrageous to me that Republicans in Congress and state offices fought so hard against a program that would have helped millions of their own constituents. They had no problem handing trillion-dollar tax cuts to big corporations and the super wealthy.”

Cardona made his point personal: “And many had no problems accepting millions of dollars in forgiven pandemic loans, like Senator Markwayne Mullin from Oklahoma had more than $1.4 million in pandemic loans forgiven. He represents 489,000 eligible borrowers that were turned down today. Representative Brett Guthrie from Kentucky had more than $4.4 million forgiven. He represents more than 90,000 eligible borrowers who were turned down today. Representative Marjorie Taylor Greene from Georgia had more than $180,000 forgiven. She represents more than 91,800 eligible borrowers who were turned down today.”

In the majority opinion of Biden v. Nebraska, Chief Justice John Roberts lamented that those who dislike the court’s decisions have accused the court of “going beyond the proper role of the judiciary.” He defended the court’s decision and urged those who disagreed with it not to disparage the court because “such misperception would be harmful to this institution and our country.” But what is at stake is not simply these individual decisions, whether or not you agree with them; at stake is the way our democracy operates.

Norman Ornstein of the American Enterprise Institute didn’t offer much hope for Roberts’s plea. “It is not just the rulings the Roberts Court is making,” he tweeted. “They created out of [w]hole cloth a bogus, major questions doctrine. They made a mockery of standing. They rewrite laws to fit their radical ideological preferences. They have unilaterally blown up the legitimacy of the Court.”

In a shot across the bow of this radical court, in her dissent to Biden v. Nebraska, Justice Elena Kagan wrote that “the Court, by deciding this case, exercises authority it does not have. It violates the Constitution.”

Dana Milbank, a regular columnist for the Washington Post, writes here about the bizarre behavior of House Republicans, who have no agenda other than impeaching Biden, censuring Adam Schiff, and punishing anyone else who doesn’t share their Trump-worship. Marjorie Taylor Greene and Lauren Boebert got into a tiff on the House floor about whose impeachment resolution would be introduced first. Greene reportedly called Boebert a “little bitch,” for being first to offer a Biden impeachment resolution.These petty, vindictive people are our nation’s “leaders.”

Milbank wrote:

A couple of weeks before the midterm elections, Kevin McCarthy assured voters that House Republicans, if given the majority, wouldn’t be so rash as to go on an impeachment binge.

“I think the country doesn’t like impeachment used for political purposes at all,” he told Punchbowl News at the time. “I think the country wants to heal,” he added, and avowed that he didn’t think anybody in the Biden administration merited impeachment proceedings.

The voters gave Republicans a chance, awarded them narrow control of the House.
And now Republicans are starting their impeachment binge.

Rep. Lauren Boebert (R-Colo.) rose in the House Tuesday evening after the last vote. “For what purpose does the gentlewoman from Colorado seek recognition?” asked the presiding officer, Rep. Russell Fry (R-S.C.).

The gentlewoman sought recognition to unveil a parliamentary maneuver that would force a vote within 48 hours on H. Res. 503, “Impeaching Joseph R. Biden Jr., president of the United States, for high crimes and misdemeanors.”

No impeachment proceedings. No investigation. No evidence. No crimes. Not so much as parking ticket. Just a willy-nilly, snap vote to impeach the president, because Boebert dislikes Biden’s immigration policies. In her mind, “President Biden has intentionally facilitated a complete and total invasion at the southern border,” she charged on the House floor.

At this, Rep. Marjorie Taylor Greene (R-Ga.) flew into a fit of jealousy because Boebert had thought to use the maneuver (called a “privileged resolution”) to force an impeachment vote before Greene got a vote on her articles of impeachment against Biden. Boebert stole her impeachment articles, Greene whined to reporters, calling Boebert that name that every kindergartner fears: “Copycat.”

Congresswoman Jewish Space Lasers then confronted Boebert on the House floor and called her a “little b—-” who “copied my articles of impeachment,” according to a Daily Beast account that Greene confirmed.

But Boebert was unmoved — because she’s on a mission from God. She filed her impeachment resolution because “I am directed and led by Him … by the spirit of God,” she told the evangelical Victory Channel.

God could not be reached for comment…

McCarthy had tried to stall his caucus’s drive for impeachment by setting House committee chairmen loose to launch a series of overlapping probes into whatever catches their fancy. At least three committees are investigating Hunter Biden. At least three committees are auditioning impeachment articles against Homeland Security Secretary Alejandro Mayorkas. At least three committees are probing imagined “censorship” of social media by the administration. Multiple committees are pursuing fanciful conspiracy theories involving public health officials and the supposed “weaponization” of the FBI, the Justice Department and the rest of the government by the “deep state.” And, of course, the committees investigate anybody — Jack Smith, Alvin Bragg — who investigates Trump.

Exit polls in the midterms showed voters cared most about inflation and abortion, followed by guns, crime and immigration. Yet the House majority just passed a bill to expand access to a common mass-shooting weapon and is now moving tax cuts that would aggravate inflation.
There’s talk that House Republicans next month will take up bills further restricting abortion access — that is, if they can find time between impeachment votes.

Since any legislation to impeach the President requires a 2/3 majority in the Senate, this bill is obviously cheap grandstanding. But House Republicans choose to devote their time and energy to such displays of petty vengeance. Pathetic.

Heather Cox Richardson hits it out of the park with this column. Republicans are screaming that Hunter Biden got a slap on the wrist for his crimes, and that the Justice Department went easy on him. But Richardson points out that President Biden left the Trump-appointed U.S. Attorney for Delaware in place, and he prosecuted the case. For those upset about Hunter Biden, when will they demand to know why the Saudis gave Jared Kushner $2 billion six months after he left office?

She writes:

After years of accusations and rumors swirling around Hunter Biden, the 53-year-old son of President Joe Biden, the Department of Justice has reached a tentative deal with the younger Biden: He will plead guilty to two misdemeanor charges of failing to file income tax returns for 2017 and 2018 by the filing date, for which he owed more than $100,000 each year. Biden’s representatives say he has since paid the Internal Revenue Service what he owed. Prosecutors will ask for two years’ probation.

Biden will also admit to the fact that he possessed a firearm as an addict, for which he and prosecutors have agreed he will enter a pretrial diversion agreement that will require that he stay clean for two more years, after which the charge will be removed from his record.

Representative James Comer (R-KY), chair of the House Oversight Committee, promptly accused “the Bidens” of “corruption, influence peddling, and possibly bribery” and called the deal “a slap on the wrist.” Throughout the day, right-wing figures have insisted that the deal is proof that President Biden is using the Justice Department to shield his family and to persecute his enemies.

In fact, Biden worked hard to reestablish the independence of the Justice Department after Trump had used it for personal ends. Trump broke the tradition that FBI directors should serve out their ten-year term—a term chosen to emphasize that the position should not be political—by firing FBI director James Comey when Comey refused to stop the bureau’s investigation of the 2016 Trump campaign’s ties to Russian operatives; Biden tried to reestablish the guardrails around the position when he declined to replace FBI director Christopher Wray, appointed by Trump.

Biden also left in place the U.S. attorney for the District of Delaware—the person overseeing the investigation into Hunter Biden that began in 2018—to make the independence of the investigation clear. That Trump appointee, U.S. Attorney David C. Weiss, is responsible for the deal. Georgetown University policy professor Don Moynihan pointed out that Weiss has been investigating Hunter Biden for five years and “[b]est they could do is tax charges which rarely get this level of attention. If Comer has anything real, the prosecutor would have used it.”

Indeed, rather than going easy on Hunter Biden, there are signs that prosecutors treated him more harshly than is typical for similar crimes. Roger Sollenberger, a senior political writer for the Daily Beast, explained that “Roger Stone and his wife settled a $2 million unpaid taxes civil case with DOJ last year—they weren’t charged criminally, unlike Hunter Biden, so they didn’t even get probation.” Justice reporter for NBC News Ryan Reilly noted that it is very rare for prosecutors to bring the addict in possession of a weapon charge they used against Biden. In the past it has been used to find a charge that will stick or alongside charges concerning violent crime.

As right-wing leaders, including House speaker Kevin McCarthy (R-CA), nonetheless attacked the Justice Department for what they claimed was a “two-tiered justice system” that went easy on Biden, Greg Sargent of the Washington Post noted, “The right doesn’t seem to care about the legal process—they care about the results. Their aim is the destruction of the independence of federal law enforcement in favor of a weaponized justice system, and they will keep creating new pretexts until they get it.”

Trump had his own reaction to the Biden charges, calling them “a massive INTERFERENCE COVERUP & FULL SCALE ELECTION ‘SCAM’ THE LIKES OF WHICH HAS NEVER BEEN SEEN IN OUR COUNTRY BEFORE. A ‘TRAFFIC TICKET,’ & JOE IS ALL CLEANED UP & READY TO GO INTO THE 2024 PRESIDENTIAL ELECTION – AND THIS AS CROOKED DOJ, STATE, & CITY PROSECUTORS, MARXISTS & COMMUNISTS ALL, HIT ME FROM ALL SIDES & ANGELS WITH BULL….! MAKE AMERICA GREAT AGAIN!!!” [sic]

Eric Lipton of the New York Times reported today on the Trump family’s ties to a multibillion-dollar project in Oman. The resort project is backed by the Omani government, which has put up the land for the project and is investing up to a billion dollars to upgrade the infrastructure near the project and to fund the project’s initial phase. It will also take a cut of the profits. A Saudi real estate firm closely allied with the Saudi government brought Trump into the deal. The Trump family will not put any money into the project, but the Omani government has paid the Trump Organization at least $5 million for the use of his name and will pay the Trump Organization to manage a hotel, golf course, and golf club for the next 30 years.

“There is a big wealth concentration in the world, which means that those people will more and more demand more exclusive products and more exclusive projects,” the chief executive of the London-based DarGlobal subsidiary of the Saudi real estate firm said earlier this year. The project is being constructed by migrants paid as little as $340 a month for ten hours a day of grueling work in heat above 100°F, or 38°C.

Tonight news broke that on Friday, Owen Shroyer, who worked alongside Alex Jones at the right-wing conspiracy media site InfoWars, will change his plea for charges associated with the January 6, 2021, attack on the U.S. Capitol to “guilty,” which might signal that he has flipped.

Shroyer was at the so-called “War Room” on January 5 with Trump lawyer Rudy Giuliani, advisors Steve Bannon and Roger Stone, General Michael Flynn, and Christina Bobb, the lawyer who later signed off on Trump’s statement that he had returned all the classified documents in his possession (he had not). Trump’s chief of staff, Mark Meadows, repeatedly expressed interest to his aide Cassidy Hutchinson in joining the people in that command center, but in the end was talked into calling the group rather than going over.

Shroyer was also part of the 47-member “Friends of Stone” encrypted chat group that organized in 2019 to support Trump in the upcoming election and then to keep him in office after he lost in 2020. If Shroyer has, indeed, flipped, he could provide an important window into the upper levels of the attempt to overturn the results of the 2020 presidential election.

Both the New York Times and the Washington Posthave recently reported that several months ago, officials in the Biden administration began indirect talks with Iran in hopes of stopping Iran’s proxy attacks on U.S. forces in Syria, bringing home three Iranian American business executives being held on charges the U.S. considers false—Emad Shargi (detained 2018), Morad Tahbaz (detained 2018), and Siamak Namazi (detained 2015)—and reining in that country’s nuclear weapons development program. In 2018, Trump pulled the U.S. out of the Joint Comprehensive Plan of Action (JCPOA) with Iran that limited Iran’s nuclear research and development. Tehran quickly restarted its uranium enrichment, research and development of advanced centrifuges, and expansion of its stockpile of nuclear fuel. According to Colum Lynch of Foreign Policy, this cut in half the time Iran would need to produce enough weapons-grade fuel to build a nuclear weapon.

Biden yesterday announced a $600 million investment in addressing climate change, with that investment focused on coastal areas and communities around the Great Lakes. Funding for projects, including modernizing electrical grids to make them resilient to extreme weather events, national disasters, and wildfires, comes from the Inflation Reduction Act and the Bipartisan Infrastructure Law.

Historian Heather Cox Richardson brilliantly contrasts the views of Republicans and Democrats on the role of government. Republicans want it to be as minimal as possible. Democrats want it to use its powers and resources to improve people’s lives. Understanding this difference helps illuminate why Republicans want to get rid of public schools and why billionaires like Charles Koch and Betsy DeVos support vouchers and libertarianism in a society where everyone is on their own.

Yesterday, the Republican Study Committee, a 175-member group of far-right House members, released their 2024 “Blueprint to Save America” budget plan. It calls for slashing the federal budget by raising the age at which retirees can start claiming Social Security benefits from 67 to 69, privatizing Medicare, and enacting dramatic tax cuts that will starve the federal government.

I’m actually not going to rehash the 122-page plan. Let’s take a look at the larger picture.

This budget dismisses the plans of “President Joe Biden and the left” as a “march toward socialism.” It says that “[t]he left’s calls to increase taxes to close the deficit would be…catastrophic for our nation.” Asserting that “the path to prosperity does not come from the Democrats’ approach of expanding government,” it claims that “[o]ver the past year and a half, the American people have seen that experiment fail firsthand.”

Instead, it says, “the key to growth, innovation, and flourishing communities” is “[i]ndividuals, free from the burdens of a burdensome government.” 

It is?

Our history actually tells us how these two contrasting visions of the government play out.

Grover Norquist, one of the key architects of the Republican argument that the solution to societal ills is tax cuts, in 2010 described to Rebecca Elliott of the Harvard Crimson how he sees the role of government. “Government should enforce [the] rule of law,” he said. “It should enforce contracts, it should protect people bodily from being attacked by criminals. And when the government does those things, it is facilitating liberty. When it goes beyond those things, it becomes destructive to both human happiness and human liberty.”

Norquist vehemently opposed taxation, saying that “it’s not any of the government’s business who earns what, as long as they earn it legitimately,” and proposed cutting government spending down to 8% of gross national product, or GDP, the value of the final goods and services produced in the United States. 

The last time the level of government spending was at that 8% of GDP was 1933, before the New Deal. In that year, after years of extraordinary corporate profits, the banking system had collapsed, the unemployment rate was nearly 25%, prices and productivity were plummeting, wages were cratering, factories had shut down, farmers were losing their land to foreclosure. Children worked in the fields and factories, elderly and disabled people ate from garbage cans, unregulated banks gambled away people’s money, business owners treated their workers as they wished. Within a year the Great Plains would be blowing away as extensive deep plowing had damaged the land, making it vulnerable to drought. Republican leaders insisted the primary solution to the crisis was individual enterprise and private charity. 

When he accepted the Democratic nomination for president in July 1932, New York governor Franklin Delano Roosevelt vowed to steer between the radical extremes of fascism and communism to deliver a “New Deal” to the American people. 

The so-called alphabet soup of the New Deal gave us the regulation of banks and businesses, protections for workers, an end to child labor in factories, repair of the damage to the Great Plains, new municipal buildings and roads and airports, rural electrification, investment in painters and writers, and Social Security for workers who were injured or unemployed. Government outlays as a percentage of GDP began to rise. World War II shot them off the charts, to more than 40% of GDP, as the United States helped the world fight fascism. 

That number dropped again after the war, and in 1975, federal expenditures settled in at about 20% of GDP. Except for short-term spikes after financial crises (spending shot up to 24% after the 2008 crash, for example, and to 31% during the 2020 pandemic, a high from which it is still coming down), the spending-to-GDP ratio has remained at about that set point.

So why is there a growing debt?

Because tax revenues have plummeted. Tax cuts under the George W. Bush and Trump administrations are responsible for 57% of the increase in the ratio of the debt to the economy, 90% if you exclude the emergency expenditures of the pandemic. The United States is nowhere close to the average tax burden of the 38 other nations in the Organization of Economic Cooperation and Development (OECD), all of which are market-oriented democracies. And those cuts have gone primarily to the wealthy and corporations. 

Republicans who backed those tax cuts now insist that the only way to deal with the growing debt is to get rid of the government that regulated business, provided a basic social safety net, promoted infrastructure, and eventually promoted civil rights, all elements that stabilized the nation after the older system gave us the Depression. Indeed, the Republican Study Committee calls for making the Trump tax cuts, scheduled to expire in 2025, permanent. 

“There are two ways of viewing the government’s duty in matters affecting economic and social life,” FDR said in his acceptance speech. “The first sees to it that a favored few are helped and hopes that some of their prosperity will leak through, sift through, to labor, to the farmer, to the small businessman.” The other “is based upon the simple moral principle: the welfare and the soundness of a nation depend first upon what the great mass of the people wish and need; and second, whether or not they are getting it.”

When the Republican Study Committee calls Biden’s policies—which have led to record employment, a booming economy, and a narrowing gap between rich and poor— “leftist,” they have lost the thread of our history. The system that restored the nation after 1933 and held the nation stable until 1981 is not socialism or radicalism; it is one of the strongest parts of our American tradition.

Notes:

Millions of Americans are saddled with debt due to the cost of their college education. I have met adults who were still paying for their college education years after they graduated. As a society, we send mixed messages to young people: we want you to get a college education, but you will have to spend years paying for it.

When I visited Finland a decade ago, I was amazed to learn that all higher education there is tuition-free. My guide explained the Finnish view: education is a human right, and it’s immoral to make people pay for a human right.

We as a nation know that investing in education is good for the nation’s future. We all benefit when more people are better educated and have more skills and knowledge. To the extent that young people are reluctant to assume the high cost of a college education, they will choose not to go to college. This is not good for them or for our society.

President Biden understands the dilemma and developed a plan to help college students pay down their college student loans. “Unveiled in August, Biden’s loan forgiveness plan would eliminate $10,000 of federal student debt for borrowers earning up to $125,000 annually, or $250,000 for married couples. Recipients of Pell Grants, a form of financial aid for low- and middle-income students, are eligible for an additional $10,000 in forgiveness.”

The GOP is unanimously opposed to helping relieve students of their debt. They reason that others have paid their debt, so no one should get relief. This is penurious and hard-hearted.

Aided by a few Democratic votes (three Senators— Manchin, Sinema, and Tester of Montana—and two members of the House), Republicans passed a bill to kill Biden’s plan for student debt relief. The President vetoed their bill.

The Supreme Court will soon rule on whether it’s constitutional to relieve students of their debt, and that’s another peril for Biden’s plan.

The stubborn opposition of the GOP to any student debt relief is another reason to vote Blue in 2024.

President Biden on Wednesday vetoed a Republican-led resolution that would have struck down his controversial plan to forgive more than $400 billion in student loans.

In a statement on Wednesday, the president said the resolution — which the Senate approved on a 52-46 vote Thursday under the Congressional Review Act, a week after the House passed the measure — would have kept millions of Americans from receiving “the essential relief they need as they recover from the economic strains associated with the COVID-19 pandemic.” The resolution called for a restart of loan payments for millions of borrowers that have been on pause since early in the coronavirus pandemic. It also would have prevented the Education Department from pursuing similar policies in the future.

In his statement, the president said it is “a shame for working families across the country that lawmakers continue to pursue this unprecedented attempt to deny critical relief to millions of their own constituents, even as several of these same lawmakers have had tens of thousands of dollars of their own business loans forgiven by the Federal Government.”

(It wasn’t the first time the White House has highlighted that lawmakers received financial relief from the government during the pandemic through the Payment Protection Program loans.)
The student loan forgiveness program has faced legal challenges, and the Supreme Court is set to issue a ruling on its legality before the end of June.

“I remain committed to continuing to make college affordable and providing this critical relief to borrowers as they work to recover from a once-in-a-century pandemic,” Biden said in his statement Wednesday.

Is it possible for us one day to be a nation that sees the importance of investing in the future and restoring a sense of common purpose? Could we begin to care for everyone’s children as if they were our own?

There is a growing awareness that Biden managed to outsmart Kevin McCarthy in the debt negotiations. Robert Hubbell thinks so. Biden is a lot smarter than he gets credit for. Fifty years in Congress counts for something.

Hubbell writes:

A key part of the Republican mythology heading into 2024 is that Joe Biden is addled to the point of incoherence and incompetence. So, on the eve of the House vote on the debt ceiling legislation, Republicans are struggling with the reality that Biden bested them in a high-stakes negotiation in which they were holding a nuclear bomb they were willing to detonate. 

As Rep. Lauren Boebert admitted on Twitter, “We got absolutely destroyed in this negotiation.” Or, as former-adult-in-the-room GOP Rep. Nancy Mace tweeted, “Republicans got outsmarted by a President who can’t find his pants.” [See my criticism of Rep. Mace in Concluding Thoughts.]

          As Charlie Sykes aptly noted, Republicans are experiencing “cognitive dissonance” as they struggle to digest their defeat. In the Orwellian logic of the GOP, Kevin McCarthy is declaring “total victory” for negotiating a deal that has ignited calls for his removal as Speaker. As Freedom Caucus member GOP Rep. Chip Roy said,

I want to be very clear: Not one Republican should vote for this deal. Not one. It is a bad deal. No one sent us here to borrow an additional $4 trillion to get absolutely nothing in return. . . . [The deal is] a complete and total sellout . . . and a betrayal of the House power-sharing arrangement.

          While McCarthy is attempting to convince his caucus that the sow’s ear compromise bill is a silk purse for Republicans, Biden is being praised in the political press for his Ninja-like negotiating skills.           It may take a few days for Republicans to understand what just happened to them, but here is an example. One of McCarthy’s proudest achievements is that he imposed new work requirements for SNAP food assistance for recipients between 50 and 54 years old. But Biden negotiated “carve-outs” to that expanded work requirement that will actually increase the amount of SNAP funding by expanding the pool of eligible recipients. Per the NYTimes,

[The Congressional Business Office] said a series of changes in work requirements for food stamp eligibility — tightening them for some adults, but loosening them for others including veterans — would actually increase federal spending on the program by $2 billion.

While Republicans demanded stricter work requirements be a part of the compromise, the White House bargained to lessen the impact, and the budget office estimated that overall, the deal would increase the ranks of the program, making an additional 78,000 people eligible for nutrition assistance.

          Got that? The signature achievement of Republicans designed to kick people off SNAP will instead increase funding for the program (by $1.8 billion) and expand the number of eligible recipients. As Josh Marshall said, “How the “F” did Biden to that?” Democrats should help pass the bill through Congress before more such details emerge.

         The “good” news is that a floor vote in the House will likely occur on Wednesday—five days before the US will not have sufficient cash to pay all of its bills.  Late on Tuesday evening, the legislation cleared a key hurdle in the House, passing out of the House Rules Committee.           But . . . many Democrats are unhappy with compromises made by Biden to avoid default. Two of the leading criticisms involve the age-based increased work requirements for SNAP recipients and changes to the permitting process for energy projects.

          As to SNAP, Biden agreed to increase the existing work requirements to include beneficiaries 50 to 54 years old. But as noted above, carve-outs to those increased work requirements have the effect of increasing the total number of Americans eligible for SNAP benefits. Still, the precedent of using a debt-ceiling negotiation to target the poorest and most vulnerable Americans is a bad one.           A corollary to the GOP’s effort to punish the poor is their effort to protect the rich. By reducing funding for the IRS and leaving tax rates untouched, the two groups unaffected by the debt-ceiling compromise are ultra-wealthy Americans and large corporations. A second major point of criticism is the concession to “fast track” future energy projects, thereby limiting environmental review. And the deal expressly grants special consideration for the Mountain Valley Pipeline, a Joe Manchin pet project. Per The Guardian,

Environmental groups, already angered by Biden’s ongoing embrace of large fossil fuel projects, such as the recently approved Willow oil drilling operation in Alaska, said these provisions mean that Democrats should block the debt deal when it is voted upon in Congress this week.

“President Biden made a colossal error in negotiating a deal that sacrifices the climate and working families,” said Jean Su, energy justice program director at the Center for Biological Diversity. “Congress should reject these poison pills and pass a clean debt ceiling bill.”

          But apart from the permitting concessions, Biden managed to protect the massive investments in climate and clean energy achieved in the infrastructure bill and Inflation Reduction Act passed during the last session of Congress. The Inflation Reduction Act alone invested $369 billion in climate protection and clean energy—the largest investment in protecting the environment by an order of magnitude. That investment will reduce carbon emissions by 40% by 2030. See CNBC, Inflation Reduction Act: Climate change provisions.

          The criticisms over cruelty targeting the poor and special accommodations for a pipeline that will make Joe Manchin richer are well-taken. But as the director of the Office of Management and Budget, Shalanda Young, said in defense of the bill:

We are in divided government. This is what happens in divided government. They get to have an opinion and we get to have an opinion, and all things equal, I think this compromise agreement is reasonable for both sides.

And we must remember that as we evaluate the provisions of the bill, the implied question is always, “Compared to what?” Here, the relevant comparison is to a national default that would have injured hundreds of millions of Americans and millions of American businesses. Retirement savings would have been decimated, and monthly benefit checks would have been diminished or halted. It is legitimate and reasonable to evaluate (and criticize) the proposed bill, but to do so without recognizing the alternative outcome is an incomplete analysis.

Hubbell goes on to chastise former moderate Nancy Mace of South Carolina, who has gone full-MAGA in her cruel taunts aimed at Biden, who apparently negotiated the pants off McCarthy.

Heather Cox Richardson writes about Biden’s deliberately low-key description of the deal he made with Kevin McCarthy. McCarthy is on television, Biden is not. McCarthy claims victory, Biden is quiet. What gives? (Interesting comment at the end of the post: Tara Reade, the woman who accused Joe Biden of sexually assaulting her has moved to Russia “for her safety.”)

She writes:

“[O]ne of the things that I hear some of you guys saying is, ‘Why doesn’t Biden say what a good deal it is?’” President Joe Biden said to reporters yesterday afternoon before leaving the White House on the Marine One helicopter. “Why would Biden say what a good deal it is before the vote? You think that’s going to help me get it passed? No. That’s why you guys don’t bargain very well.”

Biden’s unusually revealing comment about the budget negotiations was actually a statement about his presidency. Unlike his Republican opponents, he has refused to try to win points by playing the media and instead has worked behind the scenes to govern, sometimes staying out of negotiations, sometimes being central to them.

The result has been, as Daily Beast columnist David Rothkopf summarized today, historic. Biden has worked to replace 40 years of supply-side economics with policies to rebuild the nation’s economy and infrastructure by supporting ordinary Americans. The American Rescue Plan gave the United States a faster economic recovery from the COVID pandemic than any other major economy. The Bipartisan Infrastructure Law has already funded more than 32,000 projects in more than 4,500 communities in all 50 states, Washington D.C., and U.S. territories.

The Inflation Reduction Act made the biggest investment in addressing climate change in our history, and according to University of Washington transportation analyst Jack Conness, it and the CHIPS and Science Act have already attracted over $220 billion in private investment, much of it going to Republican-dominated states: Tennessee, Nevada, North Carolina, and Oklahoma have each attracted more than $4 billion; Ohio, more than $6 billion; Arizona, more than $7 billion; South Carolina, more than $9 billion; and Georgia, more than $13 billion.

Victoria Guida in Politico yesterday reported that the reordering of the economy under Biden and the Democrats has reversed the widening income gap between wage workers and upper-income professionals that has been growing for the past 40 years. The pay of those making an average of $12.50 an hour grew by almost 6% from 2020 to 2022, even after inflation.

Those gains are now at risk as pandemic measures end and the Fed raises interest rates to bring down inflation, although the wage increases are only a piece of the inflation puzzle: Talmon Joseph Smith and Joe Rennison of the New York Times today reported that companies raising their prices to “protect…profits” are “adding to inflation.” In other words, companies pushed prices beyond normal profit margins during the pandemic and the economic recovery, then maintained those higher profit margins with the Russian invasion of Ukraine, and continue to maintain them now.

The fight over the debt ceiling is both an example of the different approaches to negotiation on the part of Biden and Republicans like House speaker Kevin McCarthy (R-CA), and part of the larger question about the direction of the country.

On January 13, 2023, Treasury Secretary Janet Yellen warned McCarthy that the Treasury was about to hit the borrowing limit established by Congress and that she would have to resort to extraordinary measures in order to meet obligations until Congress raised the debt ceiling.

On March 9, as part of the usual budget process, Biden produced a detailed budget, which was a wish list of programs that would continue to build the country from the bottom up. He told McCarthy he would meet with the speaker as soon as he produced his own budget, which McCarthy could not do because the far-right House Freedom Caucus (these days being abbreviated as HFC) wanted extreme cuts to which other Republicans would never agree.

On April 26 the House Republicans passed a bill that would require $4.8 trillion in cuts but was quite vague about how it would do so apart from getting rid of much of the legislation the Democrats had just passed. HFC members said they would not raise the debt ceiling until the Senate passed their bill. That is, they would drive the United States into default, crashing the U.S. and the global economy, until the president and the Democrats agreed to their policies. Even then, they would raise it only until next spring, with the expectation that it would then become a key factor in the 2024 election.

Biden insisted all along that he would not negotiate over the debt ceiling, which pays for money already appropriated under the normal process of Congress and which Congress raised three times under former president Trump even as he added $7.8 trillion to the national debt. Biden said he would happily negotiate over the budget. McCarthy, meanwhile, was out in front of the cameras and on social media insulting Biden and insisting that it was Biden’s fault that talks took so long to get started.

Late Saturday, the two sides announced an agreement “in principle” to raise the debt ceiling for two years—clearing the presidential election. As the Washington Post’s Catherine Rampell noted, it protects current spending on Social Security, Medicare, and Medicaid; keeps tax rates as they are; increases spending on defense and veterans’ programs; leaves most other domestic spending the same; cuts a little from the expanded funding of the Internal Revenue Service; and tweaks both the permitting process for energy projects and the existing work requirements in the food assistance program.

As Rampell points out, “this much-ballyhooed ‘deal’ doesn’t seem terribly different from whatever budget agreement would have materialized anyway later this year, during the usual annual appropriations process, under divided government. To President Biden’s credit, the most objectionable ransoms that Republicans had been demanding are all gone.”

Now the measure has to get through both parties, with congressmembers back in Washington today after the holiday weekend. Freedom Caucus members are howling at the deal. Representative Chip Roy (R-TX) is threatening to bottle the measure up in the House Rules Committee, which decides what bills make it to the floor. The Freedom Caucus forced McCarthy to stack that committee with far-right extremists as part of his deal for the speakership (it has nine Republicans but only four Democrats on it). But Josh Marshall of Talking Points Memo suggests that McCarthy’s alliance with Representatives Jim Jordan (R-OH) and Marjorie Taylor Greene (R-GA) might pay off here, since the two have thrown their weight behind the measure.

Even if the measure does pass before the June 5 deadline when the Treasury runs out of money, it has had an important effect. As Rampell noted, it has weakened the United States. It has enabled both China and Russia to portray the U.S. as unstable and an unreliable partner. As if to prove that criticism, Biden had to cancel a trip to Australia and Papua New Guinea, where he was strengthening the Indo-Pacific alliances designed to weaken Chinese dominance of the region. (And Russia continues to involve itself in U.S. politics: today Tara Reade, the woman who in 2020 accused Biden of sexually assaulting her, appeared on Russian television next to alleged spy Maria Butina to say she has fled to Russia out of fear for her life in the U.S.)

Writing in Foreign Policy, Howard W. French sees a more sweeping problem with the debt ceiling fight: it “highlights America’s warped priorities.” “[W]hen a rich and powerful country finds it easier to cut back on the way that it invests in its people, in education, in science, and in making sure that the weakest among them are not completely left behind than to curtail useless and profligate weapons spending,” he said, “there are reasons to worry about the foundations of its power.”

As everyone, I hope, remembers, Kevin McCarthy wanted to be Speaker of the House. He wanted it so badly that he had to wheel and deal to get the votes he needed from the Republican Caucus. Even though the Caucus had a slim majority, the most rightwing members withheld their votes, denying him victory. Ultimately, the so-called Freedom Caucus was able to deny him what he wanted until he made multiple concessions, like putting its members on important committees and agreeing that he could be ousted by a simple majority vote. To win the Speakership on the 15th round of balloting, he had to agree to their demands.

Now his hands are tied in the debt negotiations with President Biden because the Freedom Caucus wants deep budget cuts and no compromise. Basically, everything but defense, Social Security and Medicare would be slashed by some 22%, and Biden’s efforts to address climate change would be gutted.

The Freedom Caucus doesn’t care if the federal government defaults on its debts. The public doesn’t follow details closely, and it would likely blame Biden, because he is President.

Kevin McCarthy needs a way to escape the chokehold of the Freedom Caucus so he can negotiate a compromise.

Here’s a plan to free him. The number of Republicans who are aligned with the Freedom Caucus is between 20-50 (they don’t publicize their numbers). That’s how many votes McCarthy needs to hold on to his job.

Why don’t Democrats offer him enough votes so he doesn’t need the Freedom Caucus? Since the Democrats can never win the Speakership in this session, why shouldn’t they all vote for McCarthy in exchange for his agreement to negotiate to raise the debt ceiling? Why shouldn’t he win bipartisan support for doing the right thing?

The Democrats have it within their power to free McCarthy from the extremists in his party who have no qualms about crashing the world economy.

President Biden has said he would not compromise on raising the debt ceiling but lately he has sent mixed signals. If the debt ceiling is not raised, the United States would be forced to default on its bonds for the first time in history. Congress raised the debt ceiling three times during Trump’s term in office. Congressional Republicans passed a budget that allows increases for defense and border security but requires steep cuts in everything else. Trump, the titular leader of the Republican Party, said at his New Hampshire town hall, that the U.S. should default on its debt, even though most economists predict that a default would likely precipitate a deep recession, with global consequences. Trump once called himself “the king of debt,” so he has no fear of the consequences, which would hurt Biden in 2024.

Ryan Cooper of The American Prospect explains why the President should not compromise and what those cuts would mean:

For months, President Biden had a consistent line on the debt ceiling: He would accept only a clean increase, without conditions. This was the lesson from the Obama administration, it was thought, learned at great expense when President Obama tried to negotiate with Tea Party Republicans in 2011 to get a grand bargain to cut the deficit. The result was the budget “sequester,” which badly eroded the federal government and elongated the agonizingly slow economic recovery. That’s why Obama stood his ground in 2013, and Republicans—eventually—backed down, getting essentially nothing out of the eventual debt ceiling increase.

But now all that is out the window. With the June 1 X-date approaching, the Washington media clamoring for Biden to cave, and administration officials working themselves into an anxious fit over potential executive actions to nullify the ceiling, it seems President Dark Brandon is returning to be old Conciliatory Joe. The man himself telegraphed this in a speech in New York last week that was designed to hammer Republicans over the debt ceiling, saying “we should be cutting spending and lowering the deficit without a needless crisis, in a responsible way.”

Reuters and Politico report that the White House is preparing to offer concessions in the form of cutting discretionary spending to the level of fiscal year 2022, and then capping the rate of increase at 1 percent per year for an indeterminate period, maybe two years. There would be other parts to the compromise, including rescinding some COVID aid and some bargain on permitting reform, but as far as spending, the discretionary caps would be the major piece.

This is a disastrous move. Politically, it reinforces the precedent that Republicans can extract concessions through legislative terrorism, and by signaling weakness and timidity in the Democratic leadership, it will further enable GOP extremism. If Republicans control either chamber of Congress next time the ceiling is hit—a high likelihood given how bad the Senate map is in 2024—then they’re virtually certain to take the debt ceiling hostage again.

But the practical consequences will also be terrible. We don’t know the details yet, but returning to fiscal year 2022 budget levels would mean an immediate cut of about 13 percent to every government agency and program (thanks to an unusually large spending increase in 2023 to account for economic growth, high inflation, and a few additional programs). If defense and border cops are exempted, then the cut will be perhaps 22 percent.

Rep. Rosa DeLauro (D-CT), the ranking member on the House Appropriations Committee, solicited estimates from various government departments on what that 22 percent cut would mean. They told her that just for starters, 60,000 people would not be able to attend college; 200,000 children would get kicked off Head Start; 100,000 families would lose child care; and 1.2 million people would be removed from WIC nutrition assistance.

One hundred twenty-five air traffic control towers would be shut down, affecting one-third of airports, and no doubt worsening the chronic snarls in American air travel. Rail safety inspections would be cut back by 11,000 work days, meaning 30,000 miles of track going uninspected. (More dangerous chemical spills, here we come!) Some 640,000 families would lose rental assistance, and 430,000 more would be evicted from Section 8 housing. And even all that isn’t the whole list of carnage.

Now, Republicans have not suggested an across-the-board cut, and it’s certainly possible that some of the above priorities would be spared. But that would only make the cuts to the programs that don’t get such treatment worse, because appropriators would need to hit that overall cap number.

Incidentally, this illustrates well the utter stupidity of Republican budget politics. Instead of drawing up a list of priorities, calculating how to fund them, and then writing a budget plan to fit—they neither know nor care about any of that stuff—they just demand arbitrary and escalating cuts to everything that isn’t the troops or border police, because that’s what right-wing media says is the most conservative thing to do.

Needless to say, there’s no indication of any revenue increases being discussed to offset this pain. Anti-tax Republicans wouldn’t like that, and in this hostage situation, you mustn’t anger the guys (and it’s mostly guys) with the guns.

There may well be macroeconomic effects from this deal as well. These cuts would suck hundreds of billions of dollars out of an economy that is already plainly softening, thanks to high interest rates and instability in the banking system. A ton of austerity might just be the thing that tips America into a recession during an election year, with Biden, a willing negotiator in this process, on the ballot.

Finally, it’s not at all clear that House Republicans will actually accept this partial ransom. Speaker of the House Kevin McCarthy just barely managed to pass his current debt ceiling hostage note by giving the far right everything it asked for (and then only because two Democrats were absent from the chamber). Sure enough, several members told PoliticoFriday that they want the spending cap to last ten years instead of two, at a minimum. As I was writing this, others also told Politico they want harsh border controls as well.

From their perspective, this makes perfect sense. If Biden is too weak-willed to stare down Republicans like Obama did in 2013, and too chicken to mint the coin or invoke the 14th Amendment, why not demand more concessions while he’s on the ropes? Heck, why not demand the entire ransom, including work requirements for Medicaid and gutting the Inflation Reduction Act?

Two years of capped spending is bad enough. But it might end up being even worse.

In this column, he takes issue with media bias against older people. As a woman approaching her 85th birthday, I share his view. Fifty years ago, I was physically vigorous, not so much now. But I know so much more now than I did when I was 35. I dare say I’m less impetuous, less likely to be caught up in fads, less likely to be fooled. I would rather be led by a wise person than a relatively youthful fascist like DeSantis or an old liar like Trump. Age is of far less consequence than character and beliefs. (I was going to say “convictions,” but that word favors Trump, who is probably going to have at least one conviction by November 2024, an unenviable record.)

Hiltzik writes:

The cry is heard that America has become a “gerontocracy.” That’s supposed to be bad, it’s argued, because our superannuated political leadership is out of touch with the electorate and blocking younger and (theoretically) more vigorous and intellectually vibrant leaders from taking their hour upon the stage.

Earlier this year, CNN called President Biden’s age a “hot topic.” Leaving aside that news organizations such as CNN have helped make it a hot topic, the real question is whether it’s anything more than that. The answer is no….

The gerontocracy critique also threatens to deprive us of our most experienced leaders. Rather than remove poor performers from their sinecures, the current fixation on age could remove from our political and economic structures men and women who have spent decades learning about the world and offering the wisdom born of long professional experience.

The U.S. State Department, for example, requires its professional foreign service staff to retire at 65, “when they are at the height of their wisdom and knowledge,” publishing executive and author Michael Clinton observed recently, a rule he attributed to “toxic ageism.” Some corporations require their top officers to retire at 60 or 65, while most are still willing to make a professional contribution….

Claims that a political gerontocracy is somehow undermining American democracy — the theme of so much political navel-gazing— simply don’t hold water. They depend on the notion that as we grow older, our political outlooks coalesce into something at odds with the public interest. Where’s the evidence for that?

It’s widely noted that Biden and his likeliest presidential challenger, Donald Trump, would be the oldest president if either wins election in 2024. Biden would be 82 on inauguration day 2025 and Trump nearly 80. Does that tell us anything about how their administration would unfold? Obviously not.

Biden would almost certainly run on his record of creating remarkably inclusive and progressive White House policies and overseeing an economy of job growth and economic expansion in the wake of the pandemic; Trump, judging from his most recent speeches, would continue to flog personal grievances based on his groundless claims of fraud in his 2020 loss…

Some of our political leaders have notched their most outstanding achievement at an age decades later than when conventional wisdom holds that they should have retired.

The questions raised about the physical and mental capacity of Sen. Dianne Feinstein (D-Calif.), 89, didn’t apply to former House Speaker Nancy Pelosi (D-San Francisco), who compiled what might be the most successful record in House history by shepherding the Affordable Care Act through Congress in 2010 at 70 and Biden’s progressive policies to enactment after the age of 80….

As for whether older politicians are out of step with the younger members of the American electorate, Sen. Bernie Sanders (I-Vt.) didn’t seem to have much trouble connecting with youthful voters when he ran for president in the run-up to the 2016 election, at age 75.

Nor are there signs that the liberal Sen. Elizabeth Warren (D-Mass.) has lost the youth vote because of her age, 73. Senate Minority Leader Mitch McConnell (R-Ky.) and Sen. Charles E. Grassley (R-Iowa) seemed to have little trouble getting reelected in the last election, when they were, respectively, 80 and 89….

Quite plainly, the best guides to politicians’ adequacy are their words and actual performance in office. Few reach the highest echelons of American politics without leaving a record to be examined.

Republican presidential hopeful Nikki Haley, a former South Carolina governor, recently took a swipe at Biden’s age, remarking that he would be unlikely to live to the end of his next term.

Does that tell you anything about what she has to offer as an alternative? No; for that you’d have to delve into her positions on gun control (after a deadly school shooting in Nashville, she called for more metal detectors at schoolhouse doors but not more gun legislation) or abortion rights (she’s against them).

Who shows more mental acuity? Joe Biden, who occasionally stumbles over his words (apparently an artifact of his youthful stuttering)? Or Rep. Marjorie Taylor Greene (R-Ga.), who recently called for a “national divorce,” i.e., secession by red states, at the age of 48?

Does the age of Texas Republican Gov. Greg Abbott explain his boasting about signing a 2021 law allowing almost any Texan to carry a gun in public — “No license or training is needed,” he bragged in a tweet. Abbott was 63 at the time, a relative spring chicken. How has that worked out for his Texas constituents?
