John Thompson, historian and retired teacher, believes that Ryan Walters, the state superintendent, may take control of Tulsa Public Schools, despite the fact that he has no idea how to improve them and that state takeovers have seldom (if ever) improved any schools. It’s ironic that Walters is eager to fire Tulsa superintendent Deborah Gist, since Gist received national plaudits for threatening to seize control of the impoverished Central Falls school district in 2010 when she was state superintendent in Rhode Island.

Thompson writes:

We’ve known that State Superintendent Ryan Walters was rapidly ramping up his attacks on public education, especially the Tulsa Public Schools (TPS), but the intensity of his assaults keeps growing at a frightening rate. Even though I’ve been worrying that Walters would combine the destructive rightwing extremists’ venom with the worst of the discredited neo-liberal corporate privatization reforms, it sounds like on August 24, he may do it in the worse possible way. Rather than remove the TPS’s accreditation and/or its superintendent, Walters may order a rushed takeover of the district patterned after the recent takeover of Houston’s schools.

As Nondoc reported on Tuesday, on Saturday Walters said at a Moms for Liberty event, “Tulsa Public Schools is getting money from the Chinese communist government,” He said, “They funneled it through a nonprofit — I mean, money-laundered it through a nonprofit in Texas.” On Monday, “Walters appeared at the Tulsa County Republican Party headquarters to discuss the district,” saying that it must “Reorient finances to serve students, increase reading proficiency scores to the state average, and lift its schools off of the state F-list.” “Now,” Nondoc reports, “state board members could choose to place TPS on full probation.” Moreover, Walters has “also declined to rule out a non-accreditation vote on TPS, though it is unclear how that action would play out for a district of 33,000 students after the school year has already started.”

Clearly, the removal of Superintendent Deborah Gist is a major priority. Ironically, Walters is challenging the honesty of TPS administrators as his “administration of federal GEER funds is being investigated by FBI agents and the Oklahoma Attorney General’s Office, according to people with direct knowledge of the inquiry.”

Even worse, Walters says he is regularly consulting with the Texas education commissioner, Mike Morath, about “strategies Texas used in its takeover of HISD.” The new Houston superintendent, Mike Miles, has long relied on mass exiting of teachers, and he’s already ordered educators at 28 schools to reapply for their jobs, and ordered the closures of many  “reformed” schools’ libraries. So, it is no surprise that the President of the Tulsa Classroom Teachers Association, Shawna Mott-Wright, says that “the uncertainty over the district’s future already has some teachers stepping away from their jobs.”

In response, TPS board member, Jennettie Marshall, “said during the board’s 90-minute discussion of the district’s accreditation status. ‘We are under attack. If you’re not keeping up with Houston, … if we continue the course we’re on, that’s where we’re headed. That shouldn’t be.’” She warned, “We can’t afford to lose our educators, support groups and people who provide wraparound services. We can’t afford for this district to lose its accreditation.”

To understand why Walters’ new attack could be an existential threat to public education in Tulsa, one should listen to Nancy Bailey’s analysis of such takeovers:

State takeovers aren’t new. Nor are they known for innovation, but for creating school voids, cutting services, and firing key staff, promising to close learning gaps. Takeovers usually only weaken schools, breaking them up and leaving communities with fewer and poorer schools.

Moreover, the Hechinger Report cited a study by Brown University and the University of Virginia which “looked at all 35 state takeovers between 2011 and 2016. ‘On average, we find no evidence that takeover generates academic benefits.’” But the Hechinger Report added, “Race, meanwhile, plays a role in the likelihood of a district being taken over.”

The HIDC takeover campaign sped up in 2018 when “four of Houston’s 274 schools, all of them in the city’s economically distressed north and east sides, hadn’t met the standards for four years running.” By the time the takeover was ordered, “all but one of the district’s four failing schools was meeting state standards” but a rule change caused Phillis Wheatley High School to “narrowly” miss the mark. By 2021-22, Phyllis Wheatley had already improved from an F to a high C grade. Persisting in the takeover thus added support to researchers who concluded, “Now red-state governors increasingly use the takeovers to undermine the political power of cities, particularly those governed by Black and Hispanic leaders.”

We must also remember the history of the disastrous reigns of non-educator Mike Miles, a Broad Foundation corporate reform trainee, who Texas commissioner Morath placed in charge of Houston. When Miles was selected, apparently nobody asked about “the 26% drop in high school enrollment during the 6 years he was superintendent over Harrison School District Two in Colorado.” In Dallas, Miles set a target of “at least 75 percent of the schools are ‘partially proficient’ in four areas that focus on classroom instruction.” One of many reasons why that goal was impossible was “the loss of 6000 teachers in just three years.” His dictatorial mindset was illustrated by Miles ordering the removal by the police of a board member visiting a middle school where he had “replaced the principal, two assistant principals and 10 teachers.”

Dallas student outcomes had been increasing before Miles took over but student performance largely stagnated during his administration. As the Dallas Morning News reported, his tenure was marked by “disruptions, scandals, clashes.”

Now, Houston is facing the same situation where “sweeping changes include longer instructional days, lessons scripted by planners, not teachers, and new evaluations for educators that tie pay to academic performance.” The focus will be on math and reading. Cameras will be placed in each classroom to monitor behavior. Not surprisingly, Nancy Bailey notes that as the “HISD is losing qualified teachers, school libraries, and librarians,” it is “advertising for 350 long-term substitutes who don’t require a college degree.” She presciently concludes, “Watch as these kinds of reforms become prevalent in other school districts if they haven’t already.”

I have long had serious problems with Superintendent Gist, but I would have never called her “Woke Barbie” as her opponents have. To me, this is similar to the situation when Democrats joined with former Rep. Liz Cheney in defending our democracy. And, if we unite, the damage that Walters is promising to inflict on the TPS, and the Tulsa metropolitan area as a whole, could undermine his extremist campaigns. On the other hand, if we don’t recognize the extent of the threats of a HISD-style takeover, he might unite the worst of the corporate reform privatizers, with his Moms for Liberty extremism, and impose irreparable damage on the TPS and other school systems.

Mike Miles is asking the Texas Education Agency to allow him to recruit uncertified teachers, principals, and deans. This move follows the Broadie playbook that education experience doesn’t matter. Broadies are known for their love of TFA. Miles may be reaching even lower since uncertified teachers do not require a college degree.

Houston ISD is seeking board approval this month for a waiver from the Texas Education Agency to hire uncertified deans and assistant principals for the next three years.

This follows the district asking for state approval to have an uncertified superintendent and uncertified teachers.

HIRING HUNDREDS HISD to seek TEA approval to hire uncertified teachers to fill classroom vacancies

The HISD Board of Managers is set to meet Thursday evening for a work session, where they’ll discuss the agenda for the board’s regular Aug. 10 meeting. Next week, the board is expected to vote on whether to approve an application for a certification waiver to employ assistant principals and deans without a certification through the 2025-2026 school year.

To be an assistant principal in Texas, an educator must have a certificate as an administrator, assistant principal, mid-management administrator, principal or superintendent.

Texas no longer issues an assistant principal certification, but the requirements for a principal certification in Texas include a master’s degree, a valid classroom teaching certificate, two years of teaching experience, and completion of a principal educator preparation program and two principal certification exams.

According to the TEA, districts can request a teacher certification waiver for someone to serve as a principal or assistant principal if an education does not currently hold a state certification. The request needs board approval before it is submitted to TEA for review and approval.

The board’s Thursday agenda also includes the topics of teacher vacancies and teacher certification waivers. In addition to a waiver for principals and deans, the district is seeking to waive Texas certification requirements for teachers to reduce vacancies on campuses before the school year begins.

Military man Mike Miles has launched his overhaul of Houston’s public schools, and parents and teachers are alarmed. Miles previously failed in Dallas, but that has not dimmed his authoritarian style. Trained for school leadership by the Broad Academy, which admires authoritarian style, Miles was imposed on Houston as part of a state takeover.

The state education department is led by non-educator Mike Morath but controlled by Governor Greg Abbott. Abbott hates Houston, because its a Democratic city. The takeover was triggered by the “failure” of one high school, Wheatley, which enrolls higher proportions of students with disabilities than other high schools. Miles, however, has far exceeded his mandate by firing the staff at 29 schools—not just Wheatley—and telling staff to re-apply for their jobs. Miles now sees himself as an education expert and has declared his grandiose ambition to create a “New Education System” (NES), to show the nation how it’s done.

Parents, teachers, and students at the schools that Miles is disrupting are outraged.

The Houston Chronicle reports:

Elmore Elementary School was never perfect, but Kourtney Revels felt prospects were improving for the northeast Houston campus. A new principal, Tanya Webb, had taken the helm in December, and while Revels didn’t approve of every move she made, she admired the newcomer’s initiative.

Revels and other parents had long been frustrated, for example, that the school bus would often arrive late in the afternoon because kids would act up on board. So the principal took matters into her own hands — she, or another staff member, began riding the bus home with students, to make sure their behavior stayed in line. Now, Revels’ third grader, Judith, arrives home faster from school.

“Going that one extra mile took a burden off of parents who were waiting an hour, two hours, three hours for their kid to come from down the street,” Revels said.

It remains to be seen if Elmore parents can count on the practice to continue. Webb, along with the majority of staff members at 28 other schools in northeast Houston, has to reapply for her job as part of a major shakeupannounced by new Superintendent Mike Miles on his first day in office. 

“I do see a little bit of turnaround since she came in this year but she’s only been here since December,” Revels said. “And now she has to reapply for her job.”

Radical changes

The 29 schools in the New Education System program that Miles announced on June 1 will likely look radically different when doors open to students on Aug. 28. For starters, kids might be greeted by an entirely new roster of teachers, administrators and support staff; all employees besides custodians, cafeteria workers, bus drivers and nurses have to reapply for their jobs.

Miles has already said that librarians will likely be removed from NES schools, though he promised that they, along with all other teachers, principals, assistant principals and counselors who are already under contract, will be guaranteed similar jobs with the same salary at other schools if they are not brought back. Other staff members have received no such guarantees.

Teachers who do return will make over $90,000 after factoring in various stipends offered for teaching at high-need schools, and be supported by teaching apprentices and learning coaches who will handle much of the supplementary work such as grading and classroom preparation.

The application process is already underway for principals and teachers. NES principals will be selected by June 23, and teachers by July 3.

But staffing changes are just part of the transformation coming to NES schools. Curriculum will be standardized across campuses and lesson plans prepared for teachers in advance. Classes will be recorded via webcam, and students who are pulled from class for disruptive behavior will be sent to another room to watch the streamed class. Magnet offerings such as STEM and dual language programs “will be evaluated on a case-by-case basis” and may be cut.

Emails shared with the Houston Chronicle from principals to their staff suggest school leaders will be observing teachers every day, and that schools will be open from 6:30 a.m. to 5 p.m. each day for free childcare before and after school, with teachers serving four supervisory shifts per month. Miles is also bringing the Dyad program that he had introduced at his charter school network, Third Future Schools, to the NES schools, in which community members will teach students in extra-curriculars, such as sports or arts twice a week, according to emails shared with the Chronicle.

Miles says the changes put students’ most fundamental needs at the forefront by allowing teachers to focus purely on instruction.

“We will be aligning our resources—especially our most effective teachers and principals—to better serve students in underserved communities,” Miles said. “For students who need to catch up and in schools that have failed for years, we will be offering more instructional time.”

Miles has repeatedly stated that he understands the concerns emanating from many in the HISD community, but that he hopes improvements at the schools will eventually win their trust.

“Change brings some anxiety, and there will be some anxiety most of the summer, probably, but we will keep putting information out there so that we can turn that anxiety into hope,” Miles said during his first week in office.

‘Pugh es nuestra familia’

Several parents at Pugh, Martinez and other northeast Houston elementary schools gathered Thursday morning with their children at the Denver Harbor Multi-Service Center to protest the potential removal of teachers from their A-rated schools, before traveling to HISD headquarters to bring their complaints to the district. Children held signs with their teachers’ names — Ms. Rodriguez, Ms. Arguelles, Mr. Infante — and pleas to keep them in place. “Pugh es nuestra familia,” one sign read.

“Every morning, everyone from the principal to the office staff, custodians and cafeteria workers, they greet our children with a smile. I think the kids forget the problems they have at home when they go to school. We don’t want new teachers, we want the same teachers because they’ve been our second family at Pugh,” said Nancy Coronado, a parent volunteer at Pugh for 13 years, in Spanish.

Her son, Ricardo Delgado, graduated from fifth grade at Pugh this year. He discussed his favorite teacher, Ms. Lopez, and how she was a warm, familiar presence to him even before he’d ever taken her class. Now set to start at the Baylor College of Medicine Academy at Ryan Middle School in the fall, Delgado credits Ms. Lopez with teaching him the reading skills he’ll need in middle school.

“If other teachers come, it wouldn’t be the same because she’s been there since I was 6 years old,” Delgado said.

The plan to have teachers reapply for their job has left other Houston parents with mixed feelings. Karmell Johnson, a Fifth Ward mother of three students at NES schools, said there are “pros and cons” to the situation. She welcomes the opportunity to remove under-performing teachers, but worries that some effective teachers, who understand the community they’re serving in and may have formed bonds with students, may be caught up in the mix.

“It’s an emotional roller coaster. Once a bond is established and they rip that out, the kids have to get used to their teachers, the teachers have to get used to the schools, and it’s going to take some time. It’s going to be uncomfortable for everybody,” Johnson said.

Uncertain future for teachers, staff

At many NES schools, however, teacher and principal turnover has already become a fact of life. It was only 10 years ago that North Forest High School was completely reconstituted when the Texas Education Agency ordered North Forest ISD to be absorbed into Houston ISD, and after a brief upswing, it has failed 80 percent of its TEA evaluations since (it passed this year with a C). Wheatley High School replaced a significant portion of their teachers just last year.

Ainhoa Donat, a bilingual fourth grade teacher at Paige Elementary, said she worked with a different fourth-grade colleague in each of her six years at the Eastex/Jensen school.

Donat said she was told by her principal that the school would no longer offer a bilingual program, and that she was welcome to apply for a standard teaching position at the school (the district, in a statement, said that NES schools “will now have a dedicated English Language Arts block for English language development,” which “includes bilingual support for emerging English speakers based on their proficiency level”).

With 16 years of experience at HISD under her belt, the extra money being offered wasn’t enough for Donat to overcome the indignity of being blamed for the school’s low performance. She’s currently in the process of applying for a bilingual job at another HISD campus.

“I have a lot of experience and I work super hard, so when I went to that meeting and the superintendent (basically) said ‘you didn’t do your job,’ I felt really humiliated,” Donat said.

One longtime teacher at Martinez Elementary School, who asked to remain anonymous out of fear of retribution, said she worries that the financial incentives may “entice the wrong people.”

“I would give it back to stay at Martinez,” she said. “There are some teachers who are all about the money… but not at our school.”

The fear is even more acute for support staff, who aren’t guaranteed positions.

One administrative assistant, who has worked for over 20 years at an NES elementary school and also asked to remain anonymous, said she may be forced to retire early if she isn’t rehired. The assistant has spent almost her entire career with HISD and doesn’t know what else she could do.

She wonders who will manage the payroll, procure supplies for teachers, plan field trips and do all the other unseen tasks that keep a school running if support staff are eliminated.

“All I’ve ever known is HISD, getting up and going to work at these schools. We’re not here for the money, we’re here for the children,” she said. “You talk about the children but what are you doing for them? John Thompson, historian and retired teacher, brings us up to date on the latest twists in the bizarro world of Oklahoma politics, where the most bizarro of all is the State Superintendent Ryan Walters (I think I could use that headline again and again, just changing the name of the state). John talks to Republicans in the legislature, and he finds that there are moderates who don’t agree with their leadership but keep a low profile and rein them in whenever they get too whacky.

He writes:

The 2023 Oklahoma legislative session, combined with the rightwing extremism of Gov. Kevin Stitt and State Superintendent Ryan Walters, began as possibly the worst threat to public education in our state’s history. Following more than a decade of teach-to-test mandates and increased segregation by choice, the Covid pandemic, and a history of underfunding schools, education faced a combination of existential threats.

But, rightly or wrongly, my history of working Republicans tempered my pessimism; so I’ve been struggling to listen and evaluate whether the victories that came out of the final education bills were mostly band aids or whether the resistance to Gov. Stitt and Superintendent Walters could lead to a turning point.

Yes, the total increase for education came to $785 million, but one can only guess how much of those expenditures will be beneficial to students, and how much damage will be done. Worse, Oklahoma is likely to see an economic downturn, as $2 billion in federal Covid money runs out. Moreover, it seems unlikely that pro-education legislators will gain the power to reverse policies that fail. For instance, what happens (which seems increasingly likely) if $250 million per year in “tax credits” (vouchers) are institutionalized? And worse of all, what will be the longterm costs if the cruelty and lies by extremists are institutionalized?

Only five years ago, the Teacher Walkout led to an important increase in educators’ salaries in 2018 and 2019. And Republican leaders invested $150,000 to purge their party’s craziest haters. (But then, it would have been hard for me to believe that the xenophobic, Muslim-hating Sen. John Bennett would survive and become the Republican Party Chair.) And after listening to thousands of educators, Sen. Adam Pugh (R) started this year with bills proposing $541 million in new spending. They would raise average teacher pay to the middle of the pack of neighboring states, even though starting teacher pay would remain below $40,000. Pugh would fund maternal leave, and his bills didn’t even mention vouchers.

Previously, rural Oklahomans were so firmly opposed to school vouchers that it seemed impossible that local candidates would listen to “astro-turf” think tanks, funded by rightwing Billionaires Boys Clubs which insisted that candidates running for state office would have to support vouchers, marketed as “tax credits.” But, then, Republicans gained an overwhelming super-majority, where individual legislators’ had to obey each and every one of the leaderships’ orders.

The strangest of 2023’s non-negotiable demands were made by House Speaker Charles McCall who, almost certainly, was driven by his desire to be elected governor. He switched from opposing vouchers to demanding complete loyalty to “tax credits” for private schools. Almost certainly, his mandates backfired, unleashing chaos which allowed the more reasonable Senate Republicans to fight back and to win some victories.

Even so, McCall misleadingly claimed, “the Legislature will have invested more funding into public education in the past five years than in the previous 27 years combined.”  Moreover, Shawn Hime, executive director of the Oklahoma State School Boards Association, agreed that the bill is “really game changing for public education.”  He added, “Over the past six years, state leaders have put an additional $1.5 billion into funding public schools, a 59% increase.”

A more accurate evaluation was provided by Rep. John Waldron who twittered, “My initial assessment of the budget process this year: ‘Never has so much money been argued over for so long to benefit so few.’” And Senate Minority Leader Kay Floyd, D-Oklahoma City said, “It is important to remember that we are talking about $600 million over three years that will not serve 95% of Oklahoma students,”

Actually, McCall and Hime inadvertently pointed to an historical fact that is essential to understanding why Oklahoma schools have gone from one crisis to the next. In the early 1990s, a comprehensive increase in school funding, HB 1017, “used a $560 million tax increase over five years to reduce class sizes, boost minimum teacher salaries, and fund statewide curriculum standards, testing, and early childhood programs.”

HB1017 launched a decade of progress, but it also produced a backlash, passing State Question 640, which required a super-majority to raise taxes. So, during the 21at century it’s been virtually impossible to maintain funding for salaries and other needs. Yes, we occasionally found the votes for a pay raise, but then real wages would stagnate. Worse, as a Republican legislator recently explained to me, we had no plan for fixing schools.

I would add that the only comprehensive plan that I recall was the first step towards full implementation of test-driven, choice-driven corporate reforms. They sought to use reward-and-punish mandates, and testing to provide the ammunition for charter-driven competition to undermine neighborhood schools and teachers’ autonomy. They used segregation by choice to supposedly recover from generations of Jim Crow. And during and after the Covid pandemic ordeal, anti-public education leaders like Gov. Stitt and Superintendent Walters’ sowed falsehoods and bitterness, while censoring class discussions regarding LGBTQ and Trans students’ rights; Diversity, Equity, and Inclusion (DEI); and honest History lessons.

Even after increasing average wages to below average in the region, and wages of new teachers to almost $40,000 per year, (as assaults on teaching have spun out of control) we can only guess whether such increases will improve teacher retention and morale. For instance, how much bigger of a paycheck would it take to get educators to forget Walters’ charges that teacher unions are “terrorist organizations;” schools are “a breeding ground for liberal indoctrination,” and spreading pornography; and claiming:

The far left wants to turn kids against their families,  … They want to convince them that America has a racist, socialist history. Instead of allowing your kids to see the fundamental principles that guide this country. … What they want is your kids to hate America.

Similarly, on the financial side, the costs of these policies haven’t been fully estimated. As mentioned earlier, the costs of vouchers start out at $150 million per year, increasing to $250 million. On one hand, some hope that, real world, only the affluent who already send their kids to private schools will widely benefit from “tax credits,” thus keeping the price tag down. But what if we see a surge of lower cost, low- quality private schools that attract families making less than $75,000 per year, undermining the stability of large numbers of public schools?

Yes, one of the worst parts of the bill, the attempt to undermine the state’s funding formula, was defeated. The House’s bill would have only increased per student funding in urban schools by about $60- $70, when rural per capita spending increased by up to $750 (or more). Now, about $500 million will be distributed by Oklahoma’s much more fair funding formula, meaning that per student funding will be $1000 (which is far short of what our students need.)  Moreover, the demand for merit pay was beaten back. But, will the new $125 million Redbud Fund, combined with the successful voucher campaign, open the door to more survival-of-the-fittest attacks on urban and poor students?

Finally, during this year’s chaos, a “longtime education grant writer,” Terri Grissom, testified that Walters “lies” to legislators. Grissom said:

“He (Walters) said, ‘We have applied for millions and millions of grants since I took office.’ We have not applied for one single grant. That was a blatant lie,” she said. “When legislators said, ‘We want a list of those,’ he gave them a list of everything I did under (former Superintendent Joy Hofmeister’s) leadership. Nothing was new.

“The new leadership team is not moving on anything. They won’t approve anything. They won’t sign contracts. No work is actually happening. When work shuts down, everything is in jeopardy.”

Some legislators are investigating the total costs of competitive grants that Walters hasn’t filed and/or mishandled. For instance the whistle-blower explained that Ryan Walters hasn’t spent “between $35 and $40 million of grant money,” and “the state could be on the hook to repay.”

Also, the legislature is now operating in a “concurrent session,” in order the override Stitt’s 20 vetoes, especially his effort to defund the Oklahoma Educational Television Authority (OETA), in order to punish legislators who didn’t support his education plan. 

Due to the lack of transparency, we can only guestimate the benefits and costs of the education bills. I intentionally avoided reaching conclusions until the end of the process. My best judgement is that I wish the adult Republicans had been more open in expressing concerns about the bills, but I acknowledge that that was probably impossible. We must not underestimate the value of their efforts to strip the most destructive parts from the process. Their wage and other funding increases may not be enough to reduce the damage to public education but, without them, its future would be worse. It’s unlikely that one year’s resistance could provide more than band aids. What matters is whether pro- or anti- public education advocates win the battles of the next few years.  

Since this post was submitted, a bill which gives grounds for optimism was passed. The Tulsa World reports:

“The State Department of Education shall not decline, refuse participation in, or choose not to apply for any federal grant funding that had been received by the Department prior to FY2023 without joint approval from the President Pro Tempore of the Oklahoma State Senate and the Speaker of the Oklahoma House of Representatives,” states Senate Bill 36x, which was approved 20-0 on the Senate side and 34-0 in the House.

School officials in a Mississippi high school told a graduating senior that she must wear boys’ clothing at her high school graduation; if she didn’t, she would not be permitted to participate in the ceremony. The girl is transgender and has worn girls’ clothing for the four years of high school. The mother sued with the legal help of the Mississippi ACLU. The Trump-appointed federal judge ordered the trans girl to wear boys’ clothing.

The Mississippi Free Press reported:

A federal judge ruled late Friday evening that the Harrison County School District can prohibit a 17-year-old transgender girl from attending her graduation Saturday unless she dresses in attire designated for boys, the Sun Herald’s Margaret Baker reported.

U.S. District Court Judge Taylor McNeel issued the ruling after hours of testimony from the Harrison Central High School senior and school district officials. Former President Donald Trump appointed the conservative judge to the U.S. District Court for the Southern District of Mississippi in 2020.

“The court’s decision to uphold the school district’s explicit discrimination of our client is deeply disappointing and concerning,” the ACLU of Mississippi responded in a Twitter thread this morning. “Our client should be focused on celebrating this life milestone alongside her friends and loved ones. Instead, this ruling casts shame and humiliation on a day that should be focused on joy and pride. All Mississippi students should have the right and autonomy to be who they are—not who judges and school officials think they should be…”

“On May 9, 2023—less than two weeks before graduation day, Defendants informed Plaintiff L.B. that she could not attend or participate in her high school graduation ceremony while wearing a dress and heeled shoes,” says a complaint the American Civil Liberties Union of Mississippi filed in the U.S. District Court for the Southern District of Mississippi on Thursday.

“Defendants based this instruction on the HCHS gender-based dress code policy for graduation, which provides that girls must wear a white dress and dress shoes and that boys must wear a white button-down shirt, black dress pants, black dress shoes, and a tie or bowtie,” the complaint continues.

“Defendants instructed that L.B. must dress in accordance with her sex assigned at birth—in other words, that L.B. must dress in accordance with the stereotypical male standards, even though she entered high school as a girl and has lived every aspect of her high school career as a girl.

L.B. would be humiliated in the company of her classmates if compelled to dress as a boy after living as a girl for four years. Why should it matter to school officials if she chooses to dress as a girl and her parent(s) permits it. Does her mother have no parental rights?

Mercedes Schneider employs her highly honed investigative skills to examine the background of Tennessee State Commissioner of Education Penny Schwinn, who announced her resignation, as well as the “credentials” of her replacement Lizzette Gonzalez Reynolds.

Schwinn started in Teach for America, then worked her way up to become chief deputy commissioner of academics for the Texas Education Agency. Such meteoric advances seem to happen only with TFA experience, especially in red states. Schwinn caused a bit of controversy after she handed out a $4.4 million no-bid contract to a newly-formed vendor who also had a TFA background. Strangely the whistle-blower was fired, while Schwinn rose yet again to be state commissioner of education in Tennessee.

In 2021, a Republican legislator introduced legislation calling for her resignation, due to the astronomical turnover rate in her department. But the proposal was withdrawn.

Then Schwinn audaciously awarded a multimillion dollar contract to TNTP (founded by Michelle Rhee) without disclosing that her husband worked for TNTP.

Schwinn’s successor, Reynolds, has no classroom experience. None. She rose through Ed deform organizations, largely connected to George W. Bush and Jeb Bush.

Schneider concludes:

Ed-reform makes for a tight and influential club.

For now, Schwinn is out, but with Reynolds replacing her, market-based ed reform will almost certainly not be taking a back seat in the Volunteer State.

Scandal might. But not corporate-styled ed reform.

If the people of Tennessee want a different approach to education, they will have to elect a new governor.

Houston Mayor Sylvester Turner told the Houston Chronicle that he has heard from several people that the state will choose former Dallas superintendent Mike Miles as the takeover superintendent to replace the elected local Board of Education.

This would be a punishment for the Houston Independent School District.

Mike Miles is a military man who trained at the Broad Academy. He is known for top-down leadership. He led the Harrison School District in Colorado Springs, Colorado, before coming to Dallas. He lasted three years in Dallas, from 2012 to 2015. During his tenure, he established a teacher evaluation system based on test scores. Teacher dissatisfaction soared during his tenure, and many teachers abandoned the district.

When Miles arrived, he set out numerical goals that the district was expected to reach. He expected everyone to share his vision.

After one year, Miles’ family returned to Colorado because of hostility to him.

Governor Ron DeSantis continues his takeover of higher education in the state of Florida, in this case, by appointing a board of cronies who appoint another crony.

A Republican politician with no higher education experience has emerged as the lone finalist to lead a Central Florida state college after three other candidates abruptly withdrew from a selection process that has raised concerns about political influence.

Republican state Rep. Fred Hawkins, a close ally of Gov. Ron DeSantis, was picked by the South Florida State College District Board of Trustees on Wednesday morning — two days after Hawkins submitted his application and five days after the board voted to lower the education requirements for the position, a move that allows Hawkins to qualify.

Hawkins is still considered a candidate and is scheduled to be interviewed on May 31.

But he is already claiming the job. “Pages turn and new chapters begin. I am looking forward to becoming the next President of South Florida State College,” Hawkins posted on Twitter Wednesday evening.

The seven political appointees on the board of trustees are scheduled to vote for the college’s next president on June 7. Five of the trustees were appointed by DeSantis in 2020.

A side note about Hawkins:

A former rodeo rider, he was arrested in 2020 for impersonating a law enforcement officer. Prosecutors agreed to drop the charges, if he completed a diversion program. DeSantis suspended him from being an Osceola County commissioner due to the charges.

The talent pool for college presidents seems to be shallow. That won’t deter DeSantis from his determination to cleanse higher education of WOKE professors.

Back a few years, the business restructuring company Alvarez & Marsal became deeply involved in reorganizing school districts, despite their lack of any educational experience. As a reflection of the corporate mindset of the early 2000s, A&M’s corporate experience was thought to be a major asset in rearranging school districts.

The president of A&M, Bill Roberti, who had previously been CEO of the elite menswear company Brooks Brothers was hired to take charge of the St. Louis school district, at $5 million a year.

During his 13 months as superintendent of St. Louis public schools, former Brooks Brothers chief executive William V. Roberti closed 21 schools, lopped $79 million off the school budget, privatized many school services and laid off more than 1,000 employees. He stepped down in June at the end of his contract….

The basic assumption behind the Roberti reforms was that a school district operates in much the same way as a retail business. Both systems rely on “supply chain management,” he said. “Many people talk as if there’s some magic to education. But the job of getting supplies from a warehouse to a building is the same in schools as it is in business as it is in the federal government.”

To slash costs, Roberti outsourced many operations to private contractors. He also cut hundreds of positions, including supervisors, counselors and department coordinators. He is proud of the fact that he did not fire a single teacher — dozens of teachers were permitted to retire without being replaced, which resulted in larger classes in many schools.

He left after 13 months, and the firm was hired in June 2005 (three months before the Hurricane) to take part in the restructuring of New Orleans public schools. Roberti was in charge of finance, purchasing, accounting and human resources for $16.8 million for two years. In light of the added duties after the Hurricane, A&M’s fee for three years was double the original proposal.

Then came a nice gig in New York City, where Joel Klein paid A&M $15.8 million to reorganize the school bus routes and save money. That was a fiasco, launched on the coldest day of the year, many students left stranded.

ProPublica investigated how the super-rich avoid taxes by buying super-yachts and private jets. It’s first example: the very wealthy Alvarez & Marsal.

Over the past two years, ProPublica has documented the many ways that the ultrawealthy avoid taxes. The biggest or most daring maneuvers scale in the billions of dollars, and while the tax deductibility of private jets isn’t the most important feature of U.S. tax law, the fact that billionaires’ luxury rides come with millions in tax savings says a lot about how the system really works.

There are dozens of examples of wealthy Americans taking these sorts of deductions, which are premised on the notion that the planes are used mainly for business, in the massive trove of tax records that have formed the basis for ProPublica’s “Secret IRS Files” series. The ultrawealthy, however, can easily blur business and pleasure. And when they purport to make their planes available for leasing, to fulfill one definition of using the planes for business, they tend to be more adept at generating tax deductions than revenue.

Flying to Ireland to inhale the seaside air as you drive a golf ball into the scenic distance. Crossing the country to reach your enormous yacht, which is ready for your Hudson River pleasure cruise. Hosting a governor’s wife on your very own aircraft. These are only a few of the joys that the richest Americans have experienced in recent years through their private jets. And what made them all the sweeter is that they came with a tax write-off.

Tony Alvarez and Bryan Marsal built a successful consulting firm specializing in restructuring — advising struggling or bankrupt companies on what to sell and whom to lay off. It can be a grim business: Marsal has been known to announce to prone firms that they were now a “community of pain.” But the partners, who are also close friends, own another enterprise, the Hogs Head Golf Club (“Built by Friends, for Friends, for Fun”), on the southwest coast of Ireland. It boasts views of the nearby mountains and bay.

In 2016, before opening their new course, the pair teamed up, via an LLC they named after their golf club, to buy a 2001 Gulfstream IV jet. The next year, President Donald Trump signed his big tax cut into law. It made buying a plane even more attractive: The full price of the plane could be deducted in the first year, a perk called “bonus depreciation.” Before, depreciation was typically only partially front-loaded, with the full balance spread over five years. The law also for the first time made pre-owned planes eligible for this treatment.

As a result, when Alvarez and Marsal sprang for their second plane in 2018, this one a Gulfstream V, the entire cost was deductible. That year, the pair’s two planes netted them a tax deduction of $14 million.

Last August, their Gulfstream V took off from Westchester County Airport in New York state for Ireland. About an hour later, their Gulfstream IV left for the same destination, a small airport in County Kerry near their club. Both planes can comfortably seat over a dozen passengers, but flight records don’t show who was on board. Over the coming month and a half, the two planes crisscrossed the Atlantic several times.

Were these business trips? Possibly, yes. (ProPublica’s records do not indicate whether specific trips were taken as deductions.) If so, operating expenses — including crew, fuel and other costs — from the partners’ trips to oversee the course would be fully deductible. These deductions would come in addition to depreciation.
