Both Neil Gorsuch and Brett Kavanaugh testified at their Senate hearings that they considered Roe v. Wade to be an established precedent.

Now, it appears that they will join with three other extremist justices to overturn Roe v. Wade, which has been in effect for half a century.

They both lied.

Is that perjury?

Ever since Governor Ron DeSantis punished the Disney Corporation for opposing his “Don’t Say Gay” law, I’ve been wishing that the Magic Kingdom would pull up stakes and move to another state. It’s one of Florida’s biggest employers and attracts millions of tourists every year. Surely it would be welcome in any other state, especially one that does not insult and humiliate any of its employees.

Turns out that Washington Post columnist Dana Milbank had the same idea.

He wrote:

Mickey Mouse needs a sanctuary city.

Gov. Ron DeSantis (R-Hades) got his state legislature this week to abolish the favorable tax arrangement that brought Disney World to Orlando and kept it there for 55 years. It’s the latest salvo against corporate America from the Trump right, which has already threatened Twitter, Facebook, Citigroup and Delta Air Lines. But now they’re canceling Mickey and Minnie? That’s just Goofy…

Suddenly, sad times are upon the Happiest Place on Earth. Jared Polis, the Democratic governor of Colorado, has promised to “grant Mickey and Minnie full asylum in Colorado” and offered Disney a “Mountain Disneyland” retreat from “Florida’s authoritarian socialist attacks on the private sector.” Many Disney fans online are urging Disney World to leave Florida.

Of course, you can’t just put a resort with six theme parks and two dozen or so hotels on a magic carpet ride to, say, New Jersey. (As it is, central Floridians could be stuck with more than $1 billion in debt and a massive property-tax increase because of DeSantis’s anti-Disney vendetta.) But Disney is the place where dreams come true, and mine is that the whole of Disney World, which employs roughly 80,000 Floridians and attracts tens of millions of tourists every year, will take the second star to the right and straight on till morning — and abandon Florida entirely.
DeSantis would be left with a 25,000-acre house of horrors in Orlando: an abandoned resort in a state nobody wants to visit, thanks to Ron’s Runaway Railway.

His “don’t say gay” legislation makes Florida unwelcoming to LGBTQ people. His voter-suppression laws and race-baiting attacks on teaching history and race make Florida hostile to Black, Latino and Asian Americans. Rising antisemitism (Florida’s most famous resident just had a film screening at Mar-a-Lago characterized by antisemitic swipes at Mark Zuckerberg) gives Jews pause about the state. DeSantis’s MAGA-signaling anti-immigrant and antiabortion laws repel more large swaths of the population. His banning of math textbooks should send educated Floridians packing. His opposition to Medicaid expansion and Florida’s excessive covid-19 death rate over the past year have sent many Floridians to the morgue.


Soon, there won’t be much of a constituency left. As J.D. Vance, a Republican Senate candidate from Ohio, put it in a just-released private message from 2016, “We are, whether we like it or not, the party of lower-income, lower-education white people, and I have been saying for a long time that we need to offer those people SOMETHING.” So offer them a theme park! Rename Disney World’s ruins DeSanty World.

DeSanty World would make the Carousel of Progress turn in reverse, reimagining the Disney classics to suit its growing audience of Snow White nationalists. Pinocchio would dream of becoming not a “real boy” but a Proud Boy. Lady Tremaine, the wicked stepmother, would become the heroine of Cinderella, championing parental rights. Bambi would be seen from the hunters’ point of view. Aladdin’s new soundtrack would warn of “A Whole New World Order,” and Mulan would be reviled for spreading the coronavirus. Brave Frollo would fight valiantly to free France of minority groups and the disabled. And all would cheer for QAnon’s own Captain Hook as he battles to prevent villainous Peter Pan from grooming the Lost Boys.

Some attractions would require only minor changes. The Barnstormer roller coaster (“a staggering series of stupendous stunts”) would be dedicated to DeSantis instead of Goofy. The Mad Tea Party and Festival of Fantasy Parade could pretty much stay as they are, and the Hall of Presidents would just be dispossessed of its 46th inductee. DeSanty World would build a wall around the Alien Swirling Saucers. And, because of the park’s new open-carry gun policy, the whole thing would become a Frontierland Shootin’ Arcade.

DeSanty World would surely sack the China Pavilion at Epcot and its planned film “Wondrous China.” This would be replaced by a Covid Theater (no masks allowed!). A new 101 Dalmatians Dog Whistle attraction would feature DeSantis, who said, when he had a Black opponent in 2018, “The last thing we need to do is to monkey this up.” The existing Under the Sea Journey of the Little Mermaid would be repurposed to promote offshore oil. The Frozen Ever After boat ride would refute the climate change hoax. Splash Mountain, already getting re-themed around “The Princess and the Frog,” would now swap the evil voodoo practitioner Dr. Facilier with the more evil Dr. Fauci.

A thoroughly remodeled Tower of Terror would have the MAGA faithful screaming as Ursula lures them into gender reassignment surgery, Maleficent tries to enchant them with universal health care, and the demons Pain and Panic attempt to vaccinate them.

Then, after all but the QAnon faithful had self-deported from DeSanty World, the few remaining stragglers would sing as one: It’s a small world after all.

Good news from the Brooklyn Public Library for teens whose libraries have been ransacked by censors and other vandals.

The Brooklyn Public Library will give you free access to its collection, which is uncensored.

Like we needed another reason to love libraries: with book bans ramping up in school systems around the country, the Brooklyn Public Library is taking steps to make its massive catalog available to as many young people as possible.

Right now, and for a “limited time,” anyone in the United States between the age of 13 and 21 can apply for a free Brooklyn Public Library eCard, which gives access to 350,000 eBooks, 200,000 audiobooks, and online databases. (Normally, Brooklyn Public Library eCards are only free for people who live and/or work in New York state.)…

High school students in several districts in Iowa have staged walkouts to protest legislation that affects their education. Students want their teachers to have the freedom to teach, and they want the freedom to learn. Iowa legislators don’t want either.

In light of recent education bills at the Iowa Legislature, whether it’s promoting vouchers for private schools or restricting what teachers are allowed to mention in class, many Iowa students are getting fed up. And they’re standing up.

Friday afternoon in Johnston, a group of close to 100 students walked out of class and stood on school grounds to talk about those bills, explain how they’re impacting Iowa students and teachers, and encourage their peers to register to vote and to elect different legislators.

“I think the biggest thing now is putting people in positions of power that actually will do the work and will care and represent the student voices that are speaking out about this,” said Waverly Zhao, a junior at Johnston High School who helped lead the walkout.

The walkout was organized by students and two student organizations, Johnston Community of Racial Equity (CORE) Club and Iowa WTF.

And Johnston was only one of several with recent walkouts. Thursday, students walked out at Ankeny and other events have been planned for public and private high schools in Ames, West Des Moines, Des Moines, and possibly Waukee. All are organized by student groups, and generally around the same issue of not having their voices heard about their educations. Students have also held walkouts in recent months in Iowa City, Cedar Rapids and Waterloo.

Specifically, students are calling out House File 2577, the bill that requires teachers to post every single piece of classroom material online, and Senate File 2369, the bill which allows vouchers for private schools and includes a parents’ bill of rights. Both have only passed in their chambers.

Students are also calling out House File 802, the law that prohibits so-called “divisive concepts” being taught in school, which passed last year…

HF 802 prohibited teachers from teaching “divisive concepts” and targets ideas such as systemic or institutionalized racism and sexism, and how those have shaped the way the country was built and how it functions now. Students say they’ve already seen it cause a chilling effect in their classrooms.

“As a student of color, it’s been hard enough in the district, and with the recent legislation, it’s harder to discuss racism and harder for us to combat that in schools,” said Anita Danakar, a Johnston high schooler.

For example, she said her history teacher made sure to tell students they weren’t trying to make student feel guilty when they talked about redlining in class.

Zhao said in her history and social studies classes teachers are talking less about racism and sexism so they don’t cross any lines. A history lesson she had about the 3/5ths compromise in the Constitution left most of the class confused, Zhao said, because the teacher was never quite able to explain why it existed….

Overall, the students said they want to learn about these topics in school, from a trusted source and in an environment where they can ask questions.

“This entire attitude that [says] these students are not mature enough to learn and have mature conversations in the classroom about race, gender, sexuality, to say we can’t even talk about that in an educational environment is disgusting,” said Nicholas Arick, a 17-year-old student who plans to vote in the next presidential election. “It’s saying these students don’t deserve to learn about these things, and eventually when they get out of high school, they’re be ignorant and they won’t know what they’re voting for.”

Three major religious events converge this weekend: Easter, Passover, and Ramadan.

To everyone, I send my personal hope that we can share a world without war, a world of kindness, a world of plenty, a world in which we can share the bounty of a healthy earth, and a world in which everyone is respected.

Above all, in this moment, I hope that Mr. V. Putin stops his war against Ukraine. Please end the killing and destruction.

Let us together seek Peace, Joy, Freedom, Democracy, and Justice. Not just for ourselves but for everyone.

What if your race had known only tragedy
throughout America’s history? What if your people had been enslaved, murdered, persecuted and denied their civil rights?

And what if, instead of owning up to having inflicted such outrages, showing remorse, asking forgiveness, and making amends, those responsible, their descendants and
sympathizers denied that those actions had ever
occurred or, if they had, they had best be forgotten?

But what if the history of those deeds could
never be taught in our schools, but covered in
silence because it would only be “divisive” or
“racist” against those whites who had committed
them? Rather, let bygones be bygones! We should
forget the past and simply move on!

This is the white supremacist gospel being
preached by some in our country today, especially
by protestors at school board meetings. It is the
New Jim Crowism that would leave no public
record in the classroom of the centuries-old infamy that was inflicted on the Black race.

Moreover, these protestors add insult to injury
by denying the victims of this racism the chance to finally have their story told to America’s children as our schools have done for the Holocaust. Children deserve the truth, not fairy tales, even when the truth makes racists uncomfortable.

Anyone with an ounce of humanity could not
help but be moved when learning about the brutal treatment of Blacks over the centuries. Students would learn that the justification of slavery was preached even from church pulpits. They would learn about the KKK, Jim Crow laws, lynchings, fire bombings of Black churches, racial segregation of our schools today—decorously disguised as “school choice,” the assassination of Martin Luther King Jr., the killing of George Floyd, and the freedom march in Birmingham, Alabama when Commissioner “Bull” Conner turned his fire hoses, attack dogs, and police truncheons on peaceful Black marchers demanding their civil rights, as Americans watched aghast at their TV
screens as it unfolded.

It would be a national catharsis to know that
America was finally coming to terms with the dark
chapters in its history and not-so-distant past. For
this is what great nations do that are big enough,
humble enough, contrite and courageous enough
to admit their failings and vow to do better. The
beginning of healing is the admission of wrong!

Great nations also reverence the sacrosanct
nature of the mind. They do not insult those who
have dedicated their lives to the noble profession of
teaching the young. They do not force teachers to
indoctrinate their students with a sanitized history
that omits the entire truth about their nation’s past.

However, teaching the truth is terrifying to these
protestors who view truth as dangerous, especially
for their children, for it would mean losing control
over their minds. Schools that teach what actually
happened should be shut down because truth
leads to social unrest, and it is better to have peace
based on lies.

In a word, we are dealing with an
educational philosophy that teaches: Thou shalt
not think! Thou shalt not question! Thou shalt
only conform!

These protestors abhor teaching about what
happened to Black people since this would mean
the end of their white supremacist world. Their
protests are an assault on the mind itself, the
importance of truth, and the nature of education.

An education in its ultimate sense is not an
initiation rite into the myths of one’s tribe, but
a personal struggle to free oneself from those
myths. It is escaping from Groupthink. An
education is not about fear of the truth or a blind
acceptance of White supremacist doctrine.

Teachers resist such indoctrination of their
students. They want to teach, not suppress, the
truth of what happened, but these protesters know
what happened and want to suppress it lest it be
taught not only to their children, but to everyone’s
children, as well, a.k.a. censorship.

Teachers refuse to aid and abet this fantasy
of a dying white Supremacy whose days are
numbered as anyone knows who has checked
the demographics, for what we are hearing today
is but its death knell!

A classroom is a sacred place, a temple of
reason, not a recruiting station for a white
supremacist doctrine that would ban the teaching
of Black history because it dismisses Black people
themselves as unimportant in their kind of
supremacist democracy that is not a democracy
at all, but an ethnocentric, xenophobic, wouldbe fascist dictatorship, and not the American
democracy most of us know, cherish, and want
to preserve.

Teachers refuse to violate their consciences by
lying to children and shattering their trust in them,
and when they are forbidden to tell the whole
truth lest it embarrass white racists, they refuse
to betray both children and truth

Historian Heather Cox Richardson has interesting insights on the Russian invasion of Ukraine. The overwhelming resistance to Putin is remarkable, and Putin has turned to carpet-bombing cities and devastating civilian areas. Despite Russian efforts to convince the Russian public that the war “to liberate Ukraine from fascists” is going well, she points to the growing number of anti-war protests in Russia.

She writes:

In Ukraine, Russian troops escalated their bombing of cities, including Kyiv, Kharkiv, Odesa, and Mariupol, in what Ukraine president Volodymyr Zelensky called a campaign of terror to break the will of the Ukrainians. Tonight (in U.S. time), airborne troops assaulted Kharviv, which is a city of about 1.5 million, and a forty-mile-long convoy of tanks and trucks is within 17 miles of Kyiv, although a shortage of gas means they’ll move very slowly.

About 660,000 refugees have fled the country.

But the war is not going well for Putin, either, as international sanctions are devastating the Russian economy and the invasion is going far more slowly than he had apparently hoped. The ruble has plummeted in value, and the Kremlin is trying to stave off a crisis in the stock market by refusing to open it. Both Exxon and the shipping giant Maersk have announced they are joining BP in cutting ties to Russia, Apple has announced it will not sell products in Russia, and the Swiss-based company building Nord Stream 2 today said it was considering filing for insolvency.

Ukraine’s military claimed it today destroyed a large Russian military convoy of up to 800 vehicles, and Ukrainian authorities claim to have stopped a plot to assassinate Zelensky and to have executed the assassins. The death toll for Russian troops will further undermine Putin’s military push. Russians are leaving dead soldiers where they lie, likely to avoid the spectacle of body bags coming home. It appears at least some of the invaders had no idea they were going to Ukraine, and some have allegedly been knocking holes in their vehicles’ gas tanks to enable them to stay out of the fight. Morale is low.

Associated Press correspondent Francesca Ebel reports from Russia: “Life in Russia is deteriorating extremely rapidly. So many of my friends are packing up & leaving the country. Their cards are blocking. Huge lines for ATMs etc. Rumours that borders will close soon. ‘What have we done? How did we not stop him earlier?’ said a friend to me y[ester]day.” The Guardian’s Moscow correspondent, Andrew Roth, agreed. “Something has definitely shifted here in the last two days.”

According to the BBC, a local government body in Moscow’s Gagarinsky District called the war a “disaster” that is impoverishing the country, and demanded the withdrawal of troops from Ukraine. Another, similar, body said the invasion was “insane” and “unjustified” and warned, “Our economy is going to hell.”

Putin clearly did not expect the European Union, the North Atlantic Treaty Organization (NATO), and the U.S. and other allies and partners around the world, including the United Kingdom, Canada, Japan, Korea, Australia, New Zealand, and others, to work together to stand against his aggression. Even traditionally neutral Switzerland is on board. The insistence of the U.S. on exposing Putin’s moves ahead of time, building a united opposition, and warning of false flag operations to justify an invasion meant that the anti-authoritarian world is working together now to stop the Russian advance. Today, Taiwan announced it sent more than 27 tons of medical supplies to Ukraine, claiming its own membership in the “democratic camp” in the international community.

This extraordinary international cooperation is a tribute to President Joe Biden, who has made defense of democracy at home and abroad the centerpiece of his presidency. Biden, Secretary of State Antony Blinken, and State Department officials have been calling, meeting, listening, and building alliances with allies since they took office, and by last Thanksgiving they were making a concerted push to bring the world together in anticipation of Putin’s aggression.

Their early warnings have rehabilitated the image of U.S. intelligence, badly damaged during the Trump years, when the president and his loyalists attacked U.S. intelligence and accepted the word of autocrats, including Putin.

It has also been a diplomatic triumph, but in his State of the Union address tonight, Biden quite correctly put it second to the “fearlessness,…courage,…and determination” of the Ukrainians who are resisting the Russian troops.

The rest of her post is about Biden’s State of the Union address. You will not be surprised to learn that the President was heckled by Congress members Marjorie Taylor Greene and Lauren Boebert. Boebert’s the gun-carrying Member of Congress from Colorado.

More than 100 students walked out at Huntington High School in Huntington, West Virginia, to protest a religious revival in school.

The students “staged a walkout to protest a school-sanctioned religious revival that some of their teachers required them to attend.”

Earlier this week, teachers told students that during a non-instructive class period called COMPASS, they had to go to an assembly where a Christian prayer revival was set to take place. At the assembly, teens were told to close their eyes, raise their arms in prayer and give their lives to Jesus Christ. They were also told that if they didn’t follow the Bible, they would go to hell after they died.

According to reporting from The Associated Press, one student texted his parent, asking, “Is this legal?”

The tenets of the First Amendment of the U.S. Constitution — and a number of Supreme Court rulings — suggest that it was not. According to the Free Speech Center at Middle Tennessee State University, public schools cannot prevent students from expressing or sharing religious beliefs during school hours. However, school officials cannot impose prayer or other religious practices in the building, even if students are not required to take part; to do so constitutes a violation of students’ religious freedom.

Many students at Huntington High School — and their parents — agreed that the revival was not appropriate, and that it violated students’ rights.

“I don’t think any kind of religious official should be hosted in a taxpayer-funded building with the express purpose of trying to convince minors to become baptized after school hours,” said senior Max Nibert, one of the students who led the walkout. “My rights are non-negotiable…”

A spokesperson for Cabell County Schools claimed that the event was optional, and that two teachers made a mistake when they told students they were required to attend.

But once students were at the revival and tried to leave, some were told they couldn’t do so. A Jewish student reported being told they “needed to stay” at the assembly because the classroom where they would otherwise go was locked and unsupervised.

In other words, while the event may have been quietly billed as optional, there were no other options available for students who didn’t want to attend.

How long will it be until the U.S. Supreme Court, with its new-found devotion to unrestricted religious liberty, rules that religious observances in the schools are hunky-dory?

Kimberlé Williams Crenshaw is a professor of law at Columbia and UCLA and one of the leading figures in the field of critical race studies. She wrote the following article for the Los Angeles Times, where she demonstrates that the new laws banning the study of systemic racism simultaneously ban Dr. King’s views of America’s racial problems, which were not solved by passing civil rights laws. The furor over CRT shows that racism remains a powerful force today. Critics of CRT maintain illogically that teaching the history of racism is racist, that uncomfortable facts must not be taught at all, and that history must be scrubbed clean of divisive realities. As Crenshaw points out, King would have fought the current effort to cleanse U.S. history; his own words and works cannot be taught.

For the first time, we’re observing the Rev. Martin Luther King Jr. holiday under new laws in multiple states that ban the instruction of “divisive” interpretations of our racial past. The assaults have given new weapons to an enduring faction in American society that has long resisted the reckoning that his life’s work demanded.

In King’s day, this faction was known as the “Massive Resistance,” an effort to organize and frustrate the Supreme Court’s 1954 Brown vs. Board of Education ruling and efforts to build multiracial classrooms. Today, this faction is known as the “anti-CRT” effort, which seeks to proscribe race-related curricula, books or trainings that offer a discomforting view of our past and its current implications.

Teachers, public officials and students are in a particularly unsustainable bind. They’re charged with honoring King as a figure while disavowing the ideas that he lived and died to advance. They’re being asked not merely to defer King’s dream of racial equality but to decommission it altogether.

King would likely take bitter note of the all-too-familiar dynamics behind today’s backlash. After the 2020 global movement for racial justice in the United States and beyond in the wake of the savage police killing of George Floyd, legislatures in 32 states have relied on what is patently a lie — that antiracism is antiwhite — to fuel the antidemocratic crusade against what they call “critical race theory.”

For more than 30 years, scholars have employed critical race theory as an analytical tool. The right has rebranded it as the new racism, as wokeness run amok, as a threat to innocent schoolchildren and as a stalking-horse for the demise of “Western civilization” itself. The theory has become the target of coordinated efforts to stigmatize and erase generations of antiracist knowledge, advocacy and history. The objective is both to disappear antiracism’s history and to deny its contemporary salience.

King himself is a prime casualty in this effort. Apostles of the McCarthyite crackdown on critical race theory have exploited him as a mouthpiece for their cause, reducing him to a solitary, decontextualized line from the “I Have a Dream” speech about a future in which his four children were to be judged not “by the color of their skin, but by the content of their character.”

Some use King’s words to erase his deeds and those of millions more who rose up to “make good the promises” since Reconstruction. In Tennessee, for example, the Moms for Liberty sought to ban Frances E. Ruffin’s children’s book “Martin Luther King Jr. and the March on Washington” by framing its descriptions of segregation and the violence meted out against King and others as traumatizing and racist. The Moms argue that Ruffin’s portrayal of white racism against people of color “will sow the seeds of racial strife, neo-racism, neo-segregation, and is an affront” to King’s ideals. This reveals precisely what comes of a persistent and willful ignorance of King’s legacy.

The sheer power on display to turn King against himself — a process that has been underway since the first day this holiday was celebrated — is a grim reflection of the way opponents have long subjected antiracist thinking and activism to distortion, misappropriation and redefinition. The brazen casting of critical race theory as the contemporary villain following 2020’s racial reckoning is no surprise.

The King holiday and Black History Month are an excellent opportunity — perhaps the only opportunity — to course-correct, contest and redirect the misconceptions about King’s legacy and its interface with critical race theory. Recovering the real King begins by freeing his image from the clutches of those seeking to substitute truthful education with a saccharine narrative built on illusions, delusions and lies.

Dr. King was an “inconvenient truth teller.” His insistence on the urgency of racial justice put him at odds with moderate whites in the South, and his denunciation of imperialism put him at odds with allies more narrowly focused on the freedom struggle within U.S. borders.

For telling these truths, in life, King was often criticized rather than celebrated. At the time of his death, polls showed that most white people held an unfavorable view of him. The FBI, under J. Edgar Hoover, framed him as a national security threat. Some Black leaders were hardly convinced of his tactics — his civil disobedience was too radical for some, his nonviolence too accommodationist for others. But for King, the demands for racial justice were not to be won through a popularity contest or by painting a comforting picture of the U.S. social order. Nor was King’s an identity-obsessed demand for recognition. He offered a clear-eyed assessment of a would-be democracy in a state of disrepair. Confronting it at its source was the only way forward.

It’s no accident that the firestorm over critical race theory has singed King’s message: King was, in fact, a critical race theorist before there was a name for it. A core observation of the theory is the recognition that the promise of liberation extends beyond the elimination of formal segregation and individual-level prejudice. Critical race theory explores how racial inequality was historically structured into the fabric of the republic, reinforced by law, insulated by the founding Constitution and embedded into the infrastructure of American society. Similarly, King observed in 1967 that “the doctrine of white supremacy was embedded in every textbook and preached in practically every pulpit,” entrenched as “a structural part of the culture.”

Accordingly, King’s appeal in the March on Washington in 1963 was grounded in the assertion that the promise of a fully inclusive American democracy — one that lived up to its oft-stated ideals — required creative confrontation with a republic out of step with its promises. He rebuffed those who found fault in the tensions created by placing our norms and our realities in sharp relief.

King famously wrote a letter rejecting the counsel of white moderate allies who argued for a gradualist accommodation to the prioritized sensibilities of those who didn’t experience the sting of segregation. As a father, he conveyed the anguish of his own children, who couldn’t understand why they weren’t allowed into the Funtown amusement park, which barred Black visitors, while the joy of white children was privileged. He argued elsewhere that “justice for black people cannot be achieved without radical changes in the structure of our society.”

King centered the promise of equal access to the ballot — now under concerted assault — at the heart of his prophetic mission. He fought to win passage of both the Civil Rights Act and the Voting Rights Act, and he understood that the provisions of each law were part and parcel of the same struggle for true and lasting racial justice. While he hailed the landmark voting reform as “a great step forward in removing all of the remaining obstacles to the right to vote,” he also insisted that the vote be used to “rid the American body politic of racism.” King would instantly recognize the mutually reinforcing objectives of denying the ballot, an indispensable instrument of reform, while also silencing the substantive case for reform by whitewashing the country’s racial past.

Contrary to countless assertions from the right, King did not endorse colorblindness. It wasn’t the remedy for dismantling the ugly realities that white supremacy had produced. Like today’s critical race theorists, King understood that American racism was systemic and demanded systemic remedies. He was forthright in acknowledging that anti-Black racism “was not a consequence of superficial prejudice but was systemic.” Throughout his career, King set his sights on institutional-level change, calling for solutions built on the race-conscious analysis of inequalities across our society.

King invoked a “bank of justice” to be mobilized against the many structures of racial oppression to ultimately realize “the security of justice” for all Americans. This commitment explicitly extended to the mode of race-conscious practice that now goes by the name of affirmative action.

When questioned whether he would support such outlays, King bluntly replied, “I do indeed,” and went on to explain: “Can any fair-minded citizen deny that the Negro has been deprived? Few people reflect that for two centuries the Negro was enslaved and robbed of any wages — potential accrued wealth which would have been the legacy of his descendants. All of America’s wealth today could not adequately compensate its Negroes for his centuries of exploitation and humiliation.”

Much of King’s legacy may never be taught in public schools, if this manufactured panic that demands critical thinking about racism be expunged from curricula and libraries continues. In North Dakota, for example, King’s understanding of structural racism would contradict the state’s newly minted edict that racism cannot be taught as anything more than an individual’s prejudice and bias. His understanding of the historical debt created by centuries of uncompensated labor flies directly in the face of Oklahoma’s prohibition of material suggesting that current generations bear any responsibility for the actions of their ancestors.

Not only did King clearly recognize that antiracism must address built-in headwinds that unnecessarily disadvantage some groups over others, but so does, incidentally, the Supreme Court, as seen in its many rulings. Yet an instructor seeking to explain King’s expansive vision of justice or a professor highlighting legal cases about institutional discrimination will be in jeopardy if they teach these ideas in some states that have adopted such laws.

King’s ideas could also fall under efforts in states such as Oklahoma or Texas that forbid the use of classroom materials that might create guilt or discomfort in public school students. King’s description of a social order in need of repair would trigger complaints that current generations are made to feel responsible for the sins of our past. New Hampshire, meanwhile, has proposed legislation forbidding antiracist critiques of the nation’s founding and history.

Indeed, under most of these laws, King’s concrete work and documented analysis of racism’s enduring legacy in American society would be suspect. In his final speech, on the eve of his death, he said he might not get to the promised land with us. This prophecy would rest uneasily in curricula that sanction assumptions that we haven’t already become that society that King dreamed we would one day be.

This imposition of a fairy-tale account of America makes King’s sacrifice utterly illegible. It is a memory-holed vision of the past better suited to George Orwell’s dystopian reveries than to a nation seeking to redeem its promise of genuine, expansive and democratic self-rule.

Nationwide, lawmakers are legislating that our schools and workplaces turn away from King’s mandate to make good on the country’s broken promises, and wallow instead in the wages of this ignorance. It is an ignorance that grows out of an earlier effort to impose an approved orthodoxy about the American past. One of the enduring consequences of the United Daughters of the Confederacy’s textbook campaigns was the persistence of Confederate propaganda and Lost Cause mythology masquerading as the truth about the history of the Civil War and its aftermath. The United Daughters ensured that millions of children inherited a view of America’s past grossly warped by the whitewashing of slavery and the violent Redemption, when white Southerners called for a return to white supremacy, that followed Reconstruction. The democratic crisis we face today is an unrecognizable spasm from that past, illegible in part because our educational system and national myths have not overcome these past manipulations to embrace this history.

To truly honor King’s memory, then, we must defeat the faction that facilitated the U.S. Capitol riot, put democracy on life support, and continues to demand that critical interrogation of its past be censored by law. King implored that we put our bodies on the line to face the organized forces of white reaction in his day — and it’s clear that he’d be fighting in exactly the same way to preserve his prophetic legacy in our own day, when the right to equal education, to vote freely and to realize true cross-racial justice are once more under bitter attack.

Reclaiming his legacy is to realize that there is no daylight between a truly democratic society and a racially just one.
