Max Brantley writes in the Arkansas Times that the voucher lobby is determined to reverse their 44-52 loss in the Arkansas House. Backed by Walton money, they are naming and shaming the legislators who stood up for their community’s public schools.

Although Sam Walton, founder of Walmart, and his children attended public schools, they are determined to destroy public schools that provide the same opportunity for other people’s children. They blithely toss out millions to buy the support of people who have no heart or soul and will gladly lobby to harm the institution that has been an abiding symbol of our democracy for generations. Public schools have failings, like every other institution. They must be far better, and they should have the respect and the funding to provide equal opportunity to all children.

But the Waltons have led the forces of greed that seek to undermine public schools that accept all students and have standards for professionals. Let me tell you what I think of the Waltons: I think they are greedy. I think they don’t care about other people’s children. They hate unions and public schools. They love privately managed charter schools, vouchers,and any other substitute for the public schools they attended. They treat everyone else as peasants. They are arrogant. They are prideful.

The Waltons represent the worst of American society: people who have become fabulously wealthy by killing small towns, driving small stores out of business, underpaying their one million employees, using their vast wealth to impoverish others and to undermine the community institutions that enrich the lives of people they treat with contempt. For them and their ilk, playing with the lives of other people’s children is a hobby, a pastime. They are very, very rich, and they must have their way. They don’t understand why the peasants refuse to bow down to their wishes.

Educators in Kentucky expressed their opposition to the voucher legislation that was rushed through the Legislature without careful deliberation of its likely negative impact on the state’s public schools. Nor was there any discussion of the research showing the harm that vouchers do to the children that use them or the high attrition rates of voucher schools.

Acting Fayette Superintendent Marlene Helm on Tuesday issued a strong statement before the House and Senate approved a bill in which private school tuition in Fayette and other counties could be paid from newly created education opportunity accounts.

“Quite honestly, I am dismayed that a bill of this magnitude has been brought forward this late in the session without thorough, public discussion with various stakeholders,” Helm said.

In addition to Fayette, Jefferson and Kenton counties, House Bill 563 now adds Boone, Hardin, Daviess, Warren and Campbell counties — all with populations of 90,000 — to those in which private school tuition amounts can be paid out of the scholarship funds.

The Kentucky Senate Appropriations and Revenue committee passed the bill 6-2. Later, the full Senate approved it with a 21-15 vote as did the House 48-47 in a marathon session Tuesday, the last day of the General Assembly before the veto recess. The bill will now be sent to the Governor for signing. Lawmakers will come back on March 29 and 30 to override any gubernatorial vetoes.

“This bill is dangerous. This bill is bad education policy. It’s bad fiscal policy. And its bad public policy. It does nothing to protect our students and their families or to assure that they receive a high quality education,” Kentucky Education Association President Eddie Campbell told the committee Tuesday…

In voicing his opposition, Campbell said private schools will be charging for many of the services that their tuition already covers. The services are already provided by public schools for free under the law, he said.

Campbell said the bill prohibits oversight of the education service provider that will receive the donations to distribute to families. He said providers are not required to have credentials or background checks. He said the bill opens the door for discrimination on the basis of race, religion, ethnicity, disability, sexual orientation and other fronts…

Kentucky Education Commissioner Jason Glass said he was concerned with the bill on multiple fronts.

“It is being rushed through the legislative process with little effort at gaining input or correction of obvious flaws and predictable negative consequences which the current language contains,” Glass said after the full House vote. “This legislation is of potentially enormous consequence – which begs a more thorough approach to considering both the public school choice and tax credit aspects.”

Jim Flynn, executive director of the Kentucky Association of School Superintendents, said his group remains steadfast in their opposition to any privatization of public funds for education “–this bill provides that in the form of tax credits for education opportunity accounts.”

The mainstream media are filled with warnings about “learning loss” and how we must measure it and why students should go to summer school to make up for what they have “lost.” If we can’t quantify it, they say, how can we know which students are behind? This is silly. There was no “pre-test,” so there can’t be a “post-test.” A test that students take this spring can’t possibly demonstrate “learning loss,” since they can’t be compared to anything else. If you want to know where students are in their learning, ask their teacher.

Here are some good readings on “learning loss.”

Peter Greene gathered some and calls his post a “learning loss debunkery reader.” And don’t miss Peter’s personal tale of his own “learning loss.” It began right after high school graduation, when he realized he had forgotten algebra!

Russ on Reading turned “learning loss” into a Henny Penny fable, in which the wolves are trying to get into the henhouse.

“Wait a minute. Are we sure our children have lost their learning? I know a year away from the schoolhouse is concerning. And I know the online learning is not as good as beak to beak learning, but just what are we worried about here. Our children are learning lots of things. They have learned how to make the best of a bad situation. They have learned how we all need to pitch in to help each other. They have learned to wear masks in public. They have learned a lot about communicable diseases. They may have different learning this year, but is that the same as losing learning?  Before we let the foxes into the hen house, we better be sure there is a big problem.”

The Zoom meeting went silent. Goosey Loosey shut down Foxy Loxy’s Zoom feed. She said, “You know maybe we have bigger things to worry about than learning loss. I am going to go read my chicks a book.”

This interview was recorded by Town Hall in Seattle, which is a great venue for speakers but in COVID Times was recorded remotely. I interviewed them about their important new book, A Wolf at the Schoolhouse Door.

Before he became a member of Congress, Jamaal Bowman was principal of a middle school in the Bronx. He knows what kids need: more support, not more testing. He is now vice chair of the House Education Committee. In New York, before entering Congress, he was an active member of the opt-out of testing movement. He is now spearheading an effort to roll back the Biden administration’s refusal to grant waivers to states from the mandated federal testing.

He wrote a letter to Secretary Miguel Cardona and gathered signatures from other members of Congress. What is remarkable is how few members signed his letter.

Bowman said that requiring testing this year would add stress to kids who are already traumatized and divert school administrators’ resources and attention away from reopening safely. 

“We absolutely should not be doing this now in the middle of a pandemic,” he said in an interview, adding that it would be “too much of a heavy lift” for states.

“We already know where the gaps are because we’ve been testing for 20 years,” Bowman said, adding that the federal government should engage with teachers and principals to determine where resources need to be targeted as a result of the pandemic.

The letter to Cardona, shared with POLITICO, was also signed by Reps. Ilhan Omar (D-Minn.), Tom Suozzi (D-N.Y.) and Mark Takano (D-Calif.) as well as Sens. Ed Markey (D-Mass.) and Kirsten Gillibrand (D-N.Y.)...

The new testing guidance was unveiled by the Education Department on Feb. 22, before Cardona was confirmed by the Senate. The guidance was signed by Ian Rosenblum, former executive director of The Education Trust-New York, who is the acting assistant Education secretary for elementary and secondary education. 

“Mr. Rosenblum, with all due respect, has never been a teacher or school administrator in his life, and it’s important that our parents and educators know that these decisions are being made by people who do not have the experience to make those decisions,” Bowman said. “That’s unacceptable in and of itself.”

The resumption of testing is supported by the chairs of the House and Senate education committees, Rep. Bobby Scott of Virginia and Senator Patty Murray of Washington State. They imagine that the standardized tests will somehow promote equity and measure “learning loss.” It will do neither.

“We must do everything in our power to make up for lost learning time and address achievement gaps that have been exacerbated by the pandemic — and that starts by understanding the scope of the problem,” Scott and Murray said in a joint statement last month.

They should listen to Jamaal Bowman, who knows what he is talking about.

And they should read this article, which explains why standardized testing does not close achievement gaps and does not promote equity and will not measure “learning loss.”

Please call or write your members of Congress to register your views about the resumption of standardized testing as we are still in the pandemic, following a year of disrupted schooling, in which educational opportunity was unevenly available. If you want to know how your kids are doing, ask their teachers.

 Vouchers Blocked Again!
Last week, we celebrated the victory of your tireless advocacy for public education funding for our children when we announced Gov. Greg Abbott’s decision to extend “hold harmless.” Today, we have another piece of good news: 

The voucher proposal in this session’s House Bill 3 has been removed. 

In a meeting earlier today with Pastors for Texas Children and Raise Your Hand Texas, HB 3 author Dustin Burrows (R-Lubbock) indicated that all education issues, including vouchers, are being taken out of the bill. This change will be reflected in a committee substitute later this week. We thank Chairman Burrows and Gov. Abbott for their wisdom in removing the voucher from the bill.

PTC Executive Director Rev. Charles Johnson gives “joyous testimony to the love and support Texans have for their neighborhood and community public schools – and firm opposition to the privatization of them through vouchers.”  

“That we have to keep delivering that memo to the Governor and a third of the Legislature is outrageous and unacceptable,” he says.

In case you missed it, HB3 is a pandemic response bill that deals with many issues, among them school vouchers. Here is the language of the voucher: If a district of residence fails to compensate the off-campus instructional program before the 46th day after the date of receiving a bill, the commissioner of education shall reimburse the off-campus instructional program from funding deducted from the district. 

According to this bill, the commissioner of education would get to decide which programs qualify for reimbursement from the state, which would be “deducted from the district” directly.  

A voucher bill has been filed in every Texas Legislature since 1995, so we were not surprised, nor were we unprepared. The people of Texas do not want vouchers taking money from their public schools. Furthermore, we will remain vigilant to block any future voucher proposals.

You may recall that sociologist and author Eve Ewing wrote an opinion piece in the New York Times that said it was time to end the debate about charter schools and celebrate all good schools, whatever they are called. This is one of the talking points of the charter industry, which prefers the public not to notice how many charter schools close every year, how many are low-performing, and how many are run by non-educators who turn a handsome profit.

The New York Times published letters to the editor about the Ewing article. Only one was favorable, written by Jeanne Allen, who runs a charter advocacy organization called the “Center for Education Reform,” funded by rightwing billionaires and Wall Street financiers. CER promotes all kinds of school choice and is hostile to public schools.

The first letter was written by Denis Smith of Ohio, who has appeared on this blog:

Re “End the Fight Over Charter Schools,” by Eve L. Ewing (Op-Ed, Feb. 23):

Why do we allow two separate but seemingly parallel systems of education, using scarce public funds that are taken from traditional public schools to fund charters, a seeming experiment gone awry? Why do we allow one entity that is accountable and has governance conveyed from the voters in each community and allow the other to avoid the same transparency and accountability?

Here in Ohio, charters are exempt from 150 sections of law that the public schools must be in compliance with to legally operate, yet the public schools are required to support charters with the school district’s transportation system and other services at no cost.

So no, we can’t stop fighting about the subject of charters until we have the same rules for both. If one is exempt from wholesale sections of the law, then by definition it is not a public school but something else, a school that acquires public funds to operate yet has its own rules and is free from much oversight.

As readers are well aware, the federal law called the Every Student Succeeds Act continued the mandated annual testing of students in grades 3-8 in reading and math (as well as one high school test) that was the heart of George W. Bush’s No Child Left Behind law, enacted in 2002. The Secretary of Education is allowed to grant waivers to states that ask not to give the tests. Last year, as the pandemic closed most schools, Secretary Betsy DeVos offered a blanket waiver to all states. She vowed not to do it again.

During the campaign of 2020, candidate Joe Biden publicly and unequivocally pledged to abandon the tests. He seemed to understand that they were not producing useful information and were squeezing out valuable instruction and subjects that are not tested.

Education Trust, led by John King, who was Obama’s Secretary of Education in his last year in office, created a campaign to demand that the Biden administration refuse all waiver requests and demand that everyone be tested, despite the pandemic. Education Trust, and most of the organizations that signed its two letters, are heavily funded by the Gates and Walton foundations.

The decision not to allow waivers, bowing to the EdTrust campaign, was announced by Ian Rosenblum, a low-level political appointee who previously worked for Education Trust New York and was an advocate for high-stakes testing. His boss was John King, who sent the pro-testing letters. The decision was made before Secretary Cardinal was confirmed. My guess is that the decision was made by Carmel Martin, who was an influential testing advocate in the Obama administration, then worked for the neoliberal Center for American Progress. She now works in the Biden White House as a member of the Domestic Policy Council. If I am wrong, I hope she corrects me.

I think it may be useful to put a timeline around some these flows of money and federal policies.

MAY 2020. Guidance for ESEA section 8401(b)(3)(A) testing waivers were published in May 2020 and almost every state or comparable jurisdiction requested and received these waivers for the 2019-2020 school year, well before the full force of the pandemic required large scale changes in schools. https://www.federalregister.gov/documents/2020/05/19/2020-10740/notice-of-waivers-granted-under-section-8401-of-the-elementary-and-secondary-education-act-of-1965.

FEBRUARY 3, 2021. The Education Trust sent a letter to Dr. Miguel Cardona. This was after his nomination but before his confirmation on March 1. This letter was signed by 18 organizations in addition to the Education Trust. The February 3 letter ends with two footnotes. The first is for McKinsey & Co.’s data about achievement before schools closed and the transition to remote learning began. This analysis includes “epidemiological scenarios” for learning loss (in months) for students who are white, black, and Hispanic. As usual, Mc Kinsey & Co. cares about the economic value of test scores “We estimate that the average K–12 student in the United States could lose $61,000 to $82,000 in lifetime earnings (in constant 2020 dollars), or the equivalent of a year of full-time work, solely as a result of COVID-19–related learning losses…. The second footnote refers to a Bellwether Education report justifying their use of “crisis” rhetoric about school attendance data. The report estimates that about three million school-age children had difficulty engaging in or accessing education in the spring and fall 2020. That estimate was based on data from multiple sources, including media reports.

FEBRUARY 22. On this date Ian Rosenblum, “Delegated the Authority to Perform the Functions and Duties of the Assistant Secretary of Elementary Education” announced “guidance for state testing” with particular attention to the conditions required if waivers of any find were requested. Note that Dr, Cardona has not yet been confirmed as Secretary of Education. I have yet to discover how he was granted authority (or grabbed it) to assert national policy on testing for the 2020-2021 school year. It is worth noting that Rosenblum’s prior employer had been The Education Trust, (New York). FEBRUARY 23. In no time flat, The Education Trust sent this second letter to the U.S. Department of Education, titled “Response From Civil Rights, Social Justice, Disability Rights, Immigration Policy, Business, and Education Organizations to the U.S. Department of Education’s Updated Guidance on Key ESSA Provisions in 2020–21.” This letter was signed by 30 organizations in addition to the Education Trust. This letter emphasized that local assessments were not suitable for accountability:

”We want to be clear: The Department must not, as part of its promised state-by-state “flexibility,” grant waivers to states that would allow them to substitute local assessments in place of statewide assessments or to only assess a subset of students. By design, these local assessments do not hold all students to the same standards and expectations. They do not offer appropriate accommodations for students with disabilities or English learners, as required under federal law for statewide assessments; they are not peer reviewed to ensure quality and prevent bias; and the results of these assessments will not be comparable from district to district.”

In effect, the only accountability measures that matter to The Education Trust and those who signed on to these letters are features of a factory model of education. Standardization is the ultimate criterion for data entering into decisions about federal policy. This factory model is also positioned as if the primary way to address equity and civils rights. We must “hold all students to the same standards and expectations.”

The February 23 letter also articulates a clear distain for assessments most likely to be meaningful to teachers, students, and parent caregivers; namely teacher and district developed evaluations of learning with these judgements student-specific, curriculum relevant, informed by face-to=face conversations and providing a meaningful pathway for guiding students.


Maureen Tracey-Mooney joined the White House staff as a Special Assistant to the President for Education.

She is a graduate of the notorious Broad Center, the plaything of billionaire Eli Broad, which teaches its “students” the value of applying business principles in education and the benefits of closing low-performing schools instead of helping them. According to the Broad Center, “As a Broad Resident, Maureen Tracey-Mooney worked with Achievement First as Director of Extended Learning.” Achievement First is a “no excuses” charter chain that is known for harsh discipline. It is based in Connecticut, Rhode Island, and New York and was funded by billionaires like Jonathan Sackler, who made his billions selling OxyContin and creating an addiction crisis that took at least 200,000 lives. (In 2019, the charter chain announced it would take no new donations from Mr. Sackler, who had already given $1.6 million).

Maureen Tracey-Mooney, Special Assistant to the President for Education

Maureen Tracey-Mooney worked on the domestic policy team on the Biden-Harris Transition and supported the development of President Biden’s PK-12 agenda. Previously, she worked on President Obama’s campaign and transition. She served as then-Vice President Biden’s Deputy Domestic Policy Advisor in the first term of the Obama-Biden Administration, working on education, labor and other issues. In that role she supported the development of the Obama-Biden Administration’s successful Race to the Top Early Learning Challenge and President Obama’s Preschool for All plan. She left the Vice President’s office to earn her MPA from Princeton University and transition to local education work. Immediately before joining the transition she worked for the Newark Board of Education in New Jersey, where her work focused on the development of new teachers. Originally from Ohio, Maureen graduated from the University of Chicago; her life is possible because a generous friend gave her a kidney.

It’s heart-warming that President Biden has appointed genuine public school educators to the #1 and #2 jobs in the Education Department. Itis alarming that the education staff at the White House and among those surrounding Secretary Cardona and Deputy Secretary Marten are from the Obama administration’s failed Race to the Top, TFA, and DFER. Will we have another four years of the punitive “bipartisan consensus” that melded NCLB, Race to the Top, and Betsy DeVos?

Are the real educators mere figureheads at the top of the Department, while the big decisions are made by deformers in the White House, and stealth political types like Ian Rosenblum, now Acting Assistant Secretary who announced the “no test waiver” policy, responding to a campaign by his former boss, John King of EdTrust.

Biden already lied about his promise to cancel annual standardized tests mandated by the federal government, a policy unknown in any high-performing nation, a policy that has produced zero gains on the National Assessment for a decade.

Will he resume the failed policies of the past or chart a new course in education? Right now, based on personnel, the auguries are not good.

Maurice Cunningham specializes in digging up the facts about Dark Money (political contributions where the donors’ names are hidden). His expose of Dark Money from the Waltons and other billionaires turned the public against a 2016 state referendum in Massachusetts to expand the number of charter schools, and it was defeated. I wrote about this campaign in Slaying Goliath.

In this post, published here for the first time, he exposes a “parent group” demanding more charter schools in Rhode Island.

Cunningham writes:

Parents who care about public education need to be wary of dark money fronts masquerading as concerned reformers. These are lavishly funded efforts with the goal of privatizing public schools. Rhode Islanders should take a long hard look at Stop the Wait RI.

This operation registered with the Rhode Island Secretary of State as a social welfare organization organized under section 501(c)(4) of the Internal Revenue on February 25, 2021. That status allows Stop the Wait to engage in a wide range of political activities including spending on political campaigns. The big advantage for a 501(c)(4) is that it can take in unlimited sums from individuals or corporations, spend generously on politics, and never have to disclose the names of the true donors—the real powers hiding behind the curtain. It’s dark money—political spending with the true interests hidden from the public. Stop the Wait’s web page is pretty explicit—its mission is to “preserve and expand school choice—including access to high-quality public charter schools.” Translation: privatization of public schools.

Privatizing fronts often present as an underdog group of grassroots parents. In politics though, power flows to money and so it’s key to know who is funding such groups. That’s tough with a brand new 501(c)(4) like Stop the Wait, but there are clues.

The first name on the Board of Directors is Janie SeguiRodriguez. Ms. Rodriguez works for the charter school chain Achievement First which is underwritten by among others, the WalMart heir Walton family. She is also on the board of a related corporation organized under 501(c)(3) of the Internal Revenue Code, Parents Leading for Educational Equity. A 501(c)(3) can do reports, organize, advocate, communicate with the public, but can’t get into political campaigns. Contributions are tax deductible, so taxpayers subsidize this advocacy. Even though PLEE was only organized as a non-profit corporation as of July 13, 2020, only three months later, on October 19, 2020 the Rhode Island Foundation announced that PLEE was one of several organizations it had funded and offered it as an example for its new $8.5 million Equity Leadership Foundation. (It’s a little curious that a foundation funds an organization and evaluate it as a model of success in three months). The Nellie Mae Foundation was more patient—it waited all the way until December 21, 2020 before dropping two grants, one for $40,000 and the other for $120,000 into PLEE’s bank account. Actual check writers often give through donor advised funds, a tax advantaged option that keeps their interest in groups like PLEEever unknown.

Web searches indicate that PLEE has actually been around since 2018. But it couldn’t have taken in sums from foundations until it registered with the IRS. 

Ms. Rodriguez is a political veteran as well. She ran for city council in Pawtucket city wide in 2018 and in ward 5 in 2020, losing both (by two votes in ward 5). Another member of PLEErecently assailed teachers unions in a hearing over reopening Pawtucket schools. Look for more of this from PLEE and Stop the Wait. Across the country similar organizations are funded by anti-worker oligarchs like the Waltons and Charles Koch. Examples of right wing billionaire operations masquerading as parents groups include Massachusetts Parents United and National Parents Union

Using upbeat sounding front organizations funded by unidentified billionaires is what Jane Mayer in her book Dark Money: The Hidden History of the Billionaires Behind the Rise of the Radical Right calls “weaponizing philanthropy.” But communities can beat the billionaires. Ask questions, demand answers, accept nothing less than an accounting of the true interests behind dark money fronts like PLEE and Stop the Wait, publicize your findings, contact elected officials. This is your democracy and your public school system.
