Two California teachers unions, which are currently deadlocked in separate contract talks with their respective school districts, are on the verge of launching the West Coast’s biggest teacher walkout since 1989. What happens next will decide far more than fair wages for career educators. At stake are broader principles of equity, expressed as contract demands for smaller class sizes and less testing, the addition of sufficient health and social services staff, and an investment in community schooling and fair funding — aimed at restoring public education as a public good for all Californians, rather than as a private interest granted to the lucky few…

Meanwhile, an estimated 90 Oakland Unified teachers skipped classes December 10 in a one-day wildcat sickout to protest some of the state’s lowest teacher pay — against a backdrop of California’s fast-rising living costs. But a more fundamental grievance is with the $60 million that Oakland Unified must cut over the next two years. It has led superintendent Kyla Johnson-Trammell to adopt a draconian district downsizing plan that could close up to 24 mostly low-income neighborhood public schools and coordinate the remainder of the 87-campus district with the city’s 34 charters on things like enrollment and transportation. The strategy has been likened to a “portfolio model,” the controversial template for privatized district governance that favors charter expansion at the expense of traditional public schools.

It also bears an uncanny resemblance to “Re-Imagine LAUSD,” the prematurely leaked but still mostly secret pet portfolio plan of L.A. Unified supe Austin Beutner — just one of the issues behind the takeover by 50 placard-carrying protesters at the L.A. school board meeting last Tuesday. Students, parents and teachers seized the floor and unfurled a banner of union-aligned demands: an end to random student searches; reductions in class sizes and testing; and the hiring of more health workers, community schools and per-pupil funding. For good measure, they also chanted down attempts by board president Mónica Garcia to restore order, a caterwaul that eventually drove Beutner and his board allies from the room…

If November’s blue wave means the tide has indeed turned against California’s market-driven ed reformers, grassroots activists aren’t resting on any laurels. That’s why they are circulating a petition launched by the Oakland Public Education Network (OPEN), asking Governor-elect Gavin Newsom to abide by four seemingly common sense hiring principles:

*No conflicts of business interests

*Education-related appointments must strictly mirror California’s 90/10 proportion of public-to-charter-school enrollments

*No more Betsy DeVoses guarding the regulatory henhouse (i.e., appoint only seasoned, public school-committed educators to the Advisory Commission on Charter Schools)

*Genuinely partner with the public schools community to uproot what OPEN considers the predatory incentives and equity barriers that it says are the legacy of California’s 25-year-long ed reform wrong turn.

I remember back in the late 1980s and early 1990s when charter schools were first invented. Advocates (then including me) said they would be more accountable than public schools, because if they didn’t get academic results they promised, they would close. They would also save money because they would cost less than real public schools. Turns out none of this is true. Charter schools fight for equal funding with public schools, and now we know they fight against any accountability. Even failing charter schools get renewed.

When charters close because of financial scandal or academic failure, they are typically replaced by another charter.

When a charter school fails to meet its goals, its charter should be revoked and it should be returned to the public schools to be run by professionals, not amateurs.

Greg Windle writes in The Notebook about the decision by the Philadelphia school board to renew a failing charter school. Parents thought the bad old days of the state-dominated School Reform Commission were over. SRC thought that charters were always the answer to every problem.

He writes:

After the Board of Education meeting Thursday night, many longtime activists in the audience felt as if they had returned to the days of the board’s predecessor, the School Reform Commission. The most controversial vote reversed the SRC’s 2017 decision to close Richard Allen Preparatory Charter School for years of poor and declining academics, instead granting it a one-year extension.

This charter had gotten an extension in 2017 despite poor performance. The school met no standards in any of the three categories—academic, organizational, or financial.The SRC voted not to renew on October 4, 2017:

RENEWAL RECOMMENDATION: REVOCATION AND NON-RENEWAL
Richard Allen Preparatory Charter School was part of the 2014-15 renewal cohort. In spring of 2015, the CSO recommended the Charter School for a one-year renewal with conditions due to declining academic performance in years 3 and 4 of the charter term. The SRC did not take action on the 2014-15 renewal recommendation because the CSO and the Charter School did not reach agreement on the terms of a renewal charter agreement. During the 2016-17 school year, the CSO supplemented the 2014-15 comprehensive renewal evaluation with data and information from the years since the 2014-15 evaluation was conducted; primarily the 2014-15 and 2015-16 school years for academic success and financial health and sustainability and through the current school year, 2016-17, for organizational compliance and viability. The Charter School’s performance in the most recent years reflects continued declines in academic success and financial health and sustainability performance and sustained non-compliance for organizational requirements. The Charter School has not demonstrated an improvement in academic performance; proficiency scores are below comparison groups in both 2014-15 and 2015-16 and proficiency rates declined in English Language Arts (ELA) and Science in 2015-16.Furthermore, the Charter School did not meet the growth standard in any subject in both 2014-15 and 2015-16. The Charter School continued to not meet the standard for organizational viability and compliance and now only approaches the standard for financial health and sustainability in 2016-17 due to related party, inaccurate attendance reporting and financial transaction concerns. Based on the aggregate review of performance in the three domains, the Charter School is recommended for revocation.

I have posted several times about the disaster that is happening in Florida, which elected a governor who is a mini-me of Betsy DeVos and Jeb Bush. His name is Ron DeSantis. He did not talk much about education during the campaign, but now that he is governor-elect, he has chosen the F-team to carry out the wishes of ALEC, the Waltons, the Koch brothers, DeVos and every other malefactor of public education.

Teachers in Los Angeles will be marching on Saturday December 15 at 10 a.m. PST at Grant Park in downtown Los Angeles.

Teachers are negotiating with LAUSD and its banker superintendent for a fair contract that includes reduced class sizes; improving school safety by adding more school counselors and social workers. Fully funding schools so that all schools have librarians and other support staff. Less testing and more teaching. Ending the drain of privatization, which removes $600 million annually from the public schools.

UTLA is prepared to strike if necessary.

When the pro-charter LAUSD school board majority appointed investment banker Austin Beutner to superintendent earlier this year it effectively declared war on schools of color and communities of color. Nationwide, public schools have been gutted by the rising tide of charterization, privatization, high stakes testing, union-busting, civil rights rollbacks engineered by the Trump/DeVos Department of Education. Teacher walkouts have reverberated across the country as states slash public education funding and schools re-segregate to pre-Brown v. Board levels.

The cynical appointment of the grossly underqualified Beutner (a one percenter white male with no prior public school teaching or administrative experience) signified that the board was essentially handing over the District to these forces on a silver platter in a swaggering f-you to parents, teachers, and students who’ve seen their schools reduced to detention centers.

Resist!

Stuart Egan describes a parting shot that Tea Party Republicans took, passing legislation to advance charter schools at the expense of public schools.

(A note to the few readers of this blog who continue to believe that charter schools are “progressive,” may I introduce you to the Republican members of the North Carolina legislature? Please be sure to talk to State Senator Phil Berger, who would stamp out public education if he could.)

There are a plethora of ill-fated consequences that can manifest themselves quickly because of this bill. The first three would be felt all over the state. The fourth would only be seen in Charlotte-Mecklenberg Schools as it was originally a local bill.

It could raise everyone’s property taxes in the state. Whatever the state now mandates for public schools and does not choose to specifically fund can now be passed on to local school systems.

It potentially weakens every public school system in the state whether or not it currently has a charter school. Now charter schools can ask the local district for funds to finance anything from custodians to benefits for charter school teachers.

It will probably cause a rise in charter school applications and eventually lead to more charter schools in the state. And the more charter schools there are, the more it hurts traditional public schools which still service the overwhelming majority of students in the state.

But most importantly, it would be allowing for the systemic re-segregation of student populations in the Charlotte-Mecklenberg School System under the auspicious call for “school choice.”

But now that fourth consequence can now be felt in every county in the state.

Dr. Anika T. Whitfield is a minister in Little Rock who speaks out against the steady encroachment of privatization. She recently wrote this letter to the State Commissioner of Education Johnny Key and Little Rock Superintendent Mike Poore. The district was taken over by the state because six of its 48 schools had low test scores. The State Commissioner Johnny Key is an engineer and a former legislator; among his notable positions: he voted to reduce unemployment compensation benefits, he opposed abortion, he voted to allow handguns on church property and to allow university staff to carry concealed weapons and to forbid the release of information about the holders of concealed weapons permits. He was appointed Commissioner of Education in 2015.

Mr. Poore and Mr. Key,

There is great community concern about your recent announcement about more plans for school closures within our beloved LRSD.

No genuine, earnest efforts have been made on your behalf to engage the largest and most invested stakeholders in the LRSD: students, parents/guardians, in developing plans together before you have already developed plans and made impactful decisions of your own. And, to add insult to injury, you continue to deny students, parents and guardians the a viable opportunity to provide their wisdom and insight with you, and other LRSD administrators. Their wisdom and insight should be considered invaluable to you as the Little Rock School District Superintendent and appointed LRSD Board member and chair.

Your latest press conference, Mr. Poore, was another indication of your lack of respect for the true value of building healthy community relationships through direct open lines of communications, frequent meaningful experiences, and transparency. Your approaches lack all and most importantly, trust.

Mr. Poore, it is not acceptable that you, someone who has shown a personal lack of commitment to the well being and welfare of our city and county by choosing to not become a registered voter in the over two years with which you have resided in our community, continue to make decisions without making sincere efforts to work with the LRSD community that was unwillfully disenfranchised. Willfully exercising absolute power and authority over persons who have been wrongfully denied their rights to voice their vote is not mark of excellence in leadership, nor a sign of strength. It is an indication of fear and weakness.

Mr. Key, both you and Mr. Poore have continued to deny students, parents, guardians and the greater LRSD community the opportunity to make decisions about our children, our schools, and our community without just cause. We understand that the AR State Legislators empowered the State Board of Education to assume control over public school systems based on criteria that have become lawful. And, we are clear that the State Board of Education, prior to your appointment, decided to take over our entire district (48 schools), rather than voting to assist the six schools that were designated as being in academic distress instead.

We know that Governor Asa Hutchinson has been following the playbook of the charter school funders who have used similar tactics to take over public school systems by appointing persons who like you, Mr. Key, who have no certification nor experience as an educator nor as an academic administrator, to become Commissioner of Education.

What remains unclear is why you both have chosen this fate?

Why are you both willing to evoke violence against the most vulnerable children and families in our city? Why have you chosen to come to the largest city in our state with the largest population of students in a public school system who are African American and work to destroy their hopes, dreams, and aspirations along with their families by going along with a slow, but steady plan to destroy the Little Rock School District.

Where is your moral consciousness? Where is your moral character? Why are you choosing to aid in assassinating the hopes, dreams, and potentials of innocent children and their families?

It is beyond understanding how you could/would endeavor to work so diligently to destroy the LRSD community, one of the cornerstones of the city of Little Rock.

We are not unaware nor are we complacent. Systemic racism and poverty are alive and unwell in America, and right here in the city of Little Rock. We are working on both the cure and the sustainability plan of wellness to prevent the recurrence of these man-made epidemics.

This letter is an appeal to whatever remaining hope of justice lies within you. We ask that you release the LRSD community from bondage and free yourselves from bloodying your hands anymore.

Sweet deal, but not for taxpayers!

New Mexico will pay out $6 million to the New Mexico Connections Academy, a virtual charter school, for students who are no longer enrolled. Connections is owned by mega-publisher Pearson. The leader of the Connections chain was also the chair of the ALEC education committee, encouraging red states to buy their product, which they did. Jeb Bush is a huge promoter of digital learning and his organization is heavily funded by software and hardware corporations.

When will states wake up to the fact that virtual charter schools are a scam? Any online courses needed should be under the direction of the local school district, meeting its needs, providing content it cannot provide, with no profit involved. Drive the frauds out of the marketplace.

A charter school in New Mexico that teaches students remotely by phone and internet is receiving public funding for hundreds of students who no longer are enrolled, amid attempts by state education officials to close to the school.

New Mexico Connections Academy will receive about $6 million during the current school year for students who are no longer enrolled, according to an accountability report from the budget-writing New Mexico Legislative Finance Committee. State spending accounts for the majority of public school funding in New Mexico. The school said Wednesday that it was setting aside some of the excess funding for future years when state funding is likely to lag behind enrollment.

Enrollment at the online school for grades 4 through 12 fell from more than 1,800 to students to about 1,100 after state officials declined to renew the school’s charter earlier this year amid lagging student academic results. Connections Academy successfully appealed the decision as arbitrary in state district court, though an appeal by the Public Education Department is pending.

Connections Academy opened in the fall of 2013 and contracts with the for-profit education curriculum provider Connections Education that is owned by Pearson.

The phone rings and a cold, automated voice says your kid’s school is closed tomorrow. A sign hangs on the school’s door saying there are “repair issues.”

That’s all parents of students at Florida’s Unity Charter School received. No word of the K-8 school closing for good. No mention that its building was just foreclosed on and will be auctioned off by the end of the year.

Luckily, the local public school district is ready to help. “If Unity Charter School is foreclosed, we’re happy to welcome students into our classrooms,” says its superintendent.

Turns out, it’s a common story. Students at charter schools, which are publicly funded but privately operated, are two and a half times more likely to have their school close than those at traditional, neighborhood schools.

Between 2001 and 2013, nearly 2,500 charter schools closed nationwide, many because of low academic performance or because the private group in charge committed fraud or wasted public money.

Like Unity Charter School, they often have closed abruptly. A charter school in Sacramento, California, handed out letters at the end of the school day informing students that their school was shuttering that night. A Delaware charter school folded with a notice posted on its website, leaving parents and students confused. “Right now, I have no idea where my future is and that’s really heartbreaking to say for myself,” a student said in the aftermath.

Oh, and you guessed it, schools — neighborhood and charter — serving a larger share of students of color and students from low-income families are more likely to be shut down than schools with fewer students of color and similar education achievement.

But charter school closures aren’t just shockingly routine. They’re also a selling point for the deep-pocketed voices aiming to privatize public education.

Like Education Secretary Betsy DeVos, who once compared choosing a school to choosing which food truck you want to go to for lunch. “We must open up the education industry — and let’s not kid ourselves that it isn’t an industry,” she said.

And Facebook’s Mark Zuckerberg, whose infamous $100 million donation to Newark, New Jersey, in 2010 went to $1,000-a-day consultants who did little to improve education for the city’s students but closed neighborhood schools, replacing many with charter schools, some of which are now closing themselves.

And Bill Gates, who has spent millions pushing charter schools. The founder of Microsoft once said, “The freedom to perform in new ways means that if [charter schools] don’t perform, things are shut down after you are given a chance.”

It goes without saying that closing a school is disruptive to students. When charter schools close, many students return to their neighborhood schools and struggle to catch up. Dislocated students are less likely to graduate. A 2013 study found that school closures have contributed to Chicago’s high rate of youth incarceration.

But disruption is exactly what the likes of DeVos, Zuckerberg, and Gates want. They want public education to be like a marketplace, where private boards can decide whether they listen to parents or not, large corporate-like chains like KIPP and Rocketship dominate, and schools open and close overnight in a constant churn of “innovation.”

The Organisation for Economic Cooperation and Development convened a meeting last spring in Portugal to discuss the condition and future of the teaching profession. Each nation present discussed its perspective. The following is the official summary of the presentation by the Minister of Education from Sweden.

SCHOOL CHOICE

Sweden:

In the early 1990s, Sweden moved to a school choice system in which the education system changed from one where the vast majority of students attended the public school in their catchment area to one where many students opt for a school other than their local school, and where schools that are privately run and publicly funded compete with traditional public schools.

Over the past twenty-five years of this unlimited choice system in Sweden, student performance on PISA has declined from near the OECD average to significantly below the OECD average in 2012, a steeper decline than in any other country. The variation in performance between schools also increased and there is now a larger impact of socioeconomic status on student performance than in the past.

Swedish participants described Sweden’s education system as an object lesson in how not to design a school choice system. Housing segregation leads to school segregation, and if you add to that market mechanisms and weak regulation, the result is markedly increased inequity.

The decline in achievement has fueled a national debate about how to improve the Swedish education system, from revising school choice arrangements to improve the access of disadvantaged families to information about school choices and the introduction of controlled choice schemes that supplement parental choice to ensure a more diverse distribution of students among schools. The Swedish government wants to modify its school choice system but this is politically difficult.

The Swedish government is increasing resources to poor schools but has not been able to solve its problem of teacher shortages, which affect the poorest schools the most. The poorest schools have the least experienced teachers, who are overwhelmed by the many problems they face. Teachers also lack time to work with students, and surveys of students report a lack of trustful relations with teachers.

Another Teacher Strike Story with a Happy Ending. If you listen to the champions of charter schools, their chief concern is the welfare of their disproportionately poor and minority students, while those dastardly teachers unions are just out for themselves.

Well—at the risk of injecting actual facts into this discussion, please check out the new contract that the roughly 530 members of the Chicago Teachers Union just struck with their employer, the Acero chain of 15 inner-city Chicago charter schools. As a conclusion of their five-day strike—the nation’s first at charter schools—the teachers not only secured raises for themselves but also a groundbreaking provision to protect their students, whom the union’s attorney described as “overwhelmingly low-income Latino,” from the agents of Immigration and Customs Enforcement (aka ICE). Acero acceded to the teachers’ demand that the schools not collect or share information on the immigration status of students and their families, and not permit ICE agents on campus unless they have a court order.

Of course, Acero could have put such a policy in place all by itself in the years since it opened its schools. It didn’t. It took those self-centered teachers walking out to get the company to agree to protect its students and their families from a federal police agency run amok. Kudos to those selfish teachers for expanding the boundaries of bargaining for the common good—and for common decency, too. ~ HAROLD MEYERSON
