After the murder of a recreation worker at a city center, Mayor Jim Kenney issued an executive order banning guns at playgrounds and recreation centers. A local judge overturned Mayor Kennedy’s order, because it violates state law.

This is madness. People will die. Are guns in schools okay too?

A Philadelphia Common Pleas Court judge on Monday blocked the city from enforcing an executive order Mayor Jim Kenney signed last week banning guns at recreation centers and playgrounds following the fatal shooting of a Parks and Recreation employee last month.

The Gun Owners of America, on behalf of several state residents, filed a lawsuit last Tuesday, the day Kenney signed his order. After hearing arguments Friday, Judge Joshua H. Roberts issued his ruling siding with the plaintiffs and ordering Philadelphia to be “permanently enjoined” from enforcing Kenney’s ban.

The lawsuit cited Pennsylvania state law that prohibits any city or county from passing gun-control measures. The preemption law, which the city has repeatedly sought to overturn, bans local government from passing gun-control measures that are stricter than state gun laws.

Andrew B. Austin, the attorney representing the plaintiffs, said in an emailed statement: “For my part, I am gratified that the Court of Common Pleas was able to so quickly resolve this suit, but that was in large part because the law is so explicit: The City is not allowed to regulate possession of firearms in any manner.”

Jerry Zahorchak, a former Secretary of the Pennsylvania Department of Education, explains why the Republicans’ voucher bill would harm students and public schools and deepen inequity.

He writes:

Imagine a school district with $4,000 less to spend per student than its wealthier neighbors with many students who lack supports to reach grade-level. How would you help?

Most people would guarantee that this school district had funds to hire enough teachers and aides to give students who are behind supports. Indeed, nearly two-thirds of Pennsylvania parents in a recent PSBA (Pennsylvania School Boards Association) poll agreed that struggling schools need more resources.

Legislative leaders are instead considering taking taxpayer money away from some of the state’s lowest funded schools and sending it private schools, no strings attached.

The bill, HB 2169, passed the State House in May and could be considered by the state Senate at any time this session. Under the bill, students who live in the attendance zone of public schools with test scores in the bottom 15% statewide would be eligible to receive the average per-student state funding for public schools – around $7,000 per year – as a voucher that can be used for any qualified educational expense, including private school tuition. Funding would come directly from their local school district, and would cost struggling school districts around $140 million annually (PSBA).

Rather than giving students in underfunded schools resources, they would use taxpayer money to fuel the private market. Families would be on their own, forgetting that we all have a stake in making sure that each child learns to cooperate with neighbors of every stripe and become self-supporting, knowledgeable citizens.

Proponents claim these “lifeline scholarships” will help families access quality education they wouldn’t otherwise be able to afford. The real story is not so simple.

Supporters never mention that districts with high academic performance are able to spend around $4,600 more per student on average than low-performing districts. These resource gaps – which will be worse with HB 2169 – closely track local wealth. When we adjust for the fact that poor school districts serve more students in poverty and other students who need more support, the gap between wealthy and poor school districts is more than $7,000 per student.

The fantasy that the private market will provide a better deal for students at a cheaper price falls apart under scrutiny.

Private schools often reject students that public schools rightfully must educate: students who are behind grade-level, have behavioral challenges, are learning English and more. There’s no guarantee to make private schools accommodate students with disabilities, unlike public schools where federal laws guarantee students with disabilities the right to a Free Appropriate Public Education (FAPE). Private schools can reject students simply because they don’t “fit the culture” or can’t pay the entire cost of tuition. Because many of these students need services that cost more, there is an incentive to say no.

The voucher bill was narrowly passed by the Republican-led House and also the State Semate Education committee.

For some inexplicable reason, it was endorsed by Josh Shapiro, the Democratic candidate for Governor.

We recently learned that Josh Shapiro, Democratic candidate for Governor of Pennnsylvania, has endorsed vouchers.

One of our readers supplied an email for this “Democrat” who has embraced the Republican agenda for education. Josh Shapiro is a hypocrite. Real Democrats support public goods. Real Democrats care about the common good. Real Democrats fight privatization of what belongs to the public.

If you don’t know why you should not be supporting the same education policies as Donald Trump and Betsy Devos, then you have no business holding public office for the democratic party.

Peter Greene is a retired teacher in Pennsylvania; he stepped down after nearly 40 years in the classroom and has been a prolific writer ever since, stepped in the wisdom of practie.

He is disgusted with Democratic Gubernatorial candidate Josh Shapiro’s decision to support school vouchers.

Shapiro has joined forces with the GOP. How curious that Shapiro has thrown himself in the same boat with Greg Abbot, Ron DeSantis, Doug Ducy, and every other anti-public school governor.

Greene writes that Shapiro’s website touts his support for vouchers:

Josh favors adding choices for parents and educational opportunity for students and funding lifeline scholarships like those approved in other states and introduced in Pennsylvania.

The Lifeline Scholarship bill is a GOP education savings account bill–a super-voucher bill– currently sitting in the appropriations committee in the House; the Senate has passed their version. Not just charters. Not just traditional vouchers. But nice shiny, super vouchers. Take a bunch of money from public schools (based on state average cost-per-pupil, not local numbers, so that many districts will lose more money than they would have spent on the students). Handed as a pile of money/debit card which can be spent on any number of education-adjacent expenses.

The state will audit the families at least once every two years. The bill contains the usual non-interference clause, meaning that the money can be spent at a private discriminatory school, and no one will be checking to see if the school is actually educating the student. The bill is only old-school in that it uses the old foot-in-the-door technique of saying that this is just to rescue students from “failing” public schools (but includes no provisions to determine if the child has been moved to a failing private school).

Choicers are ecstatic…

You know a great way to make sure that zip code, ethnicity, and class don’t determine a child’s educational quality? It’s not to give some of them voucher money that may or may not get a few students to a better education.

It’s to fully fund and support all the schools in all the zip codes.

Boy, would I love to vote for a governor who supported that for a plan.

But no–we now have a choice of two guys who are barely different on education. Mastriano would gut spending completely while implementing vouchers, while Shapiro would just slice open a public education vein.

In fairness to Shapiro, his site says he’s going to fully fund education, too, which would be kind of like putting a hose in one side of your swimming pool while chopping a gaping hole in the base on the other side. It’s not a great plan. If he means it, which now, who’s to say.

Shapiro’s position is awful. It would align him with just about any GOP candidate in any other state, and the only reason it isn’t a disqualifier in this state is because insurrectionist Doug Mastriano is so spectacularly, so uniquely terrible, so ground-breakingly awful. Mastriano is still a terrible, terrible choice.

Voucher fans were sad because they could see their hopes and dreams going down in flames with Mastriano, but now they can rest assured that whoever wins, they will get a governor who supports an education program that any right wing Republican would love. For those of us who support public education, it is brutally disappointing.

In a shocking development, Josh Shapiro, the Democratic candidate for Governor, has endorsed a school choice bill that was barely passed by the Republican House.

Shapiro is currently the state’s attorney general. He is running against an extreme Trumper who participated in the January 6 insurrection.

On Saturday, Shapiro told supporters that he favors the “Lifeline Scholarship Program,” which passed the Republican House in April by a vote of 104-98. That was the first time that a voucher bill ever passed the State House. It also was passed by the Senate Education Committee in June.

The bill is supported by the Trump-endorsed Republican candidate and puts Shapiro in the same boat with Betsy DeVos and Charles Koch. Shapiro joins the tiny number of Democrats, like Senator Cory Booker of New Jersey, who supports school choice.

You can bet that many parent advocates and teachers are shocked. The research is clear that school choice does not improve student’s educational outcomes. What’s up?

Pa. cyber-charter schools lead on cost; lag on results

As public schools made the often-awkward pivot between in-person and online instruction during the early days of the COVID-19 pandemic, the commonwealth’s cyber-charter schools saw their enrollment explode as parents raced to find reliable schooling for their children. In fact, the Keystone State’s 14 cyber-charter schools saw their enrollment rise from slightly more than 38,000 students in October 2019 to more than 60,000 students by October 2020, marking the largest year-over-year increase, the Post-Gazette reported last May, citing data compiled by the Pennsylvania Department of Education. By last April, that popularity showed no signs of abating, with a poll by Republican-friendly Susquehanna Polling & Research in Harrisburg showing that nearly 7 in 10 respondents to a poll of 700 Pennsylvanians supported the online programs, the Post-Gazette also reported. Despite that popularity, the online programs have come in for constant criticism by advocates for traditional public schools, who argue that the online schools aren’t worth the return on investment and that student performance suffers as a result (Obligatory Caveat: Charter schools are public schools that receive taxpayer money, but are run by private operators). A recently released report by a wing of the progressive-leaning advocacy group Children First keeps up that drumbeat of criticism, finding that, of the 27 states that authorize cyber-charter schools, Pennsylvania spends the most public money on these programs, but has the “weakest systems to ensure students and taxpayers are getting their money’s worth.”

“Pennsylvania is the cyber-charter capital of the nation, ML Wernecke, the director of the Pennsylvania Charter Performance Center, which conducted the study, said in a statement. “But given the persistent performance in cyber-charter programs, and the out-of-control pressure on local taxpayers, this is one place where it is not good to be first.”

Among its chief findings, the report notes that every one of Pennsylvania’s cyber-charter schools has “been identified as needing improvement under the state’s ESSA School Improvement and Accountability plan, placing them among the state’s lowest performing schools.”

Considering cyber schooling for your student? Millions in taxpayer-funded advertising notwithstanding, most Pennsylvania cyber charters have graduation rates 20 percentage points or more below statewide averages for all schools.

Two prominent Pennsylvanians complain that the legislature dropped the ball again on charter reform.

Rob Gleason chaired the @PAGOP for 10 years prior to becoming Westmont Hilltop school board president. Democrat Eugene DePasquale was PA Auditor General for two terms. They get it.

They write:

As longtime public servants representing both major political parties and as concerned citizens who care about public education in the commonwealth, we are writing to express our great disappointment and frustration with the continued inaction by our state legislature despite broad-based, statewide, bipartisan support for charter school reform. The fact that more than 85% of locally elected school boards (434 of 500), in a state as diverse as ours, have passed formal resolutions calling for a substantive charter school law overhaul should send a clear message to policymakers — it is time for reform.

David Lapp, director of policy research for Research for Action in Philadelphia, recently wrote about the money wasted on Cybercharters in Pennsylvania. Apparently, the industry has a strong hold on the Pennsylvania legislature. There is no other reason that it continues to thrive.

During the worst of the pandemic, schools closed for reasons of safety and caution. Cybercharters boomed to fill the gap. But with physical schools open, the truth must be told about Cybercharters: they are a poor substitute for real schools.

Lapp writes:

When the COVID-19 pandemic forced schools into remote learning instruction many Pennsylvania policymakers expressed deep concerns. Many lamented the impact on mental health when students stopped receiving in-person learning and the important social skills that develops. Many were upset by the evidence of significant learning loss that accompanied the switch to virtual instruction.

The Pennsylvania General Assembly even enacted a new law allowing students to voluntarily repeat a grade to make up for lost educational opportunities.

This year policymakers should consider bringing that same energy to a similarly harmful and even more wasteful form of remote learning. One that’s been growing for more than two decades and reached a boiling point during the pandemic. I’m talking about the soaring enrollment growth and accompanying financial cost of Pennsylvania’s cyber-charter school expansion.

There’s solid research both nationally and in Pennsylvania that cyber-charter schools have an “overwhelmingly negative” impact on student learning. The learning loss students experience from virtual instruction in cyber-charter schools appears similar to the learning loss students experienced from virtual instruction during the pandemic.

For each year a student is enrolled in cyber-charter school they are also more likely to experience chronic absenteeism and less like to enroll in post-secondary education.

There’s also clear evidence that spending on cyber-charter school expansion comes at the expense of students receiving in-person learning in school districts and brick & mortar charter schools, where more effective instruction is provided. In fact school districts—which pay for cyber-charter tuition from their own school budgets—have indicated that charter tuition is now their top budget pressure.

It’s easy to understand why. Pennsylvania already had the highest cyber-charter school enrollment in the country and then enrollment grew by 22,618 additional students during the pandemic. Districts are now spending over $1 billion dollars a year on cyber-charter tuition, reflecting an increase of $335 million from before the pandemic. These surging expenses impacted the vast majority of school districts in the state.

Cyber-charter tuition likely represents the most inefficient spending in Pennsylvania school finance. For one, the cyber-charter system is redundant. Both before and since the pandemic, most school districts continue to offer their own virtual schools. Secondly, the tuition rates mandated under current PA law require districts to pay cyber-charters more than it actually costs to operate virtual schools. And finally, when students leave for cyber-charter schools, districts must of course still operate their own brick & mortar schools for remaining students, only now with fewer resources….

In Research for Action’s recent report, The Negative Fiscal Impact of Cyber Charter Enrollment Due to COVID-19, we estimated that the tuition increase in just one year of the pandemic, from the 2019-20 and 2020-21 school years, led to between $290 to $308 million of additional stranded costs borne by school districts. Nearly the entire amount of increases in school district total expenditures statewide in 2020-21 were accounted for by increases in school district tuition payments to charter schools, most of which were for cyber-charters specifically.

Meanwhile, this tuition spike has left cyber-charters in Pennsylvania flush with surplus resources. More than half of the additional funding cyber-charters received from districts in 2020-21 was not even used for student expenses. Rather, cyber- charters funneled over $170 million into their general fund balances that, unlike school districts, have no statutory limits.

Steven Singer asks a reasonable question: Why is a Gates-Funded, anti-union, pro-charter advocacy group part of Pennsylvania’s effort to end the teacher shortage?

So Pennsylvania has unveiled a new plan to stop the exodus with the help of an organization pushing the same policies that made teaching undesirable in the first place.

The state’s Department of Education (PDE) announced its plan to stop the state’s teacher exodus today.

One of the four people introducing the plan at the Harrisburg press conference was Laura Boyce, Pennsylvania executive director of Teach Plus.

Why is this surprising?

Teach Plus is a national 501(c)(3) nonprofit organization that works to select and train teachers to push its political agenda.

What is that agenda?

Teach Plus has embraced the practice of widespread staff firings as a strategy for school improvement.

Teach Plus mandates that test scores be a significant part of teacher evaluation.

Teach Plus advocates against seniority and claims that unions stifle innovation.

Teach Plus has received more than $27 million from the Gates Foundation and substantial donations from the Walton Family Foundation.

How can an organization dedicated to the same ideas that prompted the exodus turn around and stop the evacuation!?

That’s like hiring a pyromaniac as a fire fighter!

A former Republican State Senator and the former State Auditor, a Democrat, wrote to argue on behalf of reforming the charter school law.

Bernie O’Neill (R-29, Bucks) is a former special education teacher for more than 25 years and a 16-year former member of the Pennsylvania House of Representatives.

Eugene DePasquale is former Auditor General of Pennsylvania and former member of the state General Assembly, (D-95, York). He presently serves as a Resident for the Keystone Center for Charter Change at the Pennsylvania School Boards Association.

They wrote:

Our roles as former elected officials from both of the major political parties have given us unique perspectives into not only Pennsylvania’s political process, but also its public education system, particularly charter schools.

Charter schools in the state have grown tremendously in the 24+ years in which they have existed. It is estimated that nearly 170,000 children will attend a brick and mortar or cyber charter school in the current school year and that Pennsylvania taxpayers will spend an estimated $3 billion to fund charter schools.

Despite being in operation for more than two decades, Pennsylvania’s Charter School Law (CSL) has never undergone any significant revision, other than allowing the creation of cyber charter schools in 2002, even though there are numerous glaring problems with the law. That’s not because the General Assembly hasn’t studied and introduced a myriad of legislative proposals each year to enact meaningful reforms. However, the state’s legislative body seems to be unwilling or unable to fix the problems.

Reforming the CSL should be a bipartisan issue. At its core, charter school reform would 1) ensure that public education funds are spent efficiently and appropriately; 2) that charter schools are as accountable and transparent as other public schools; and 3) preserve and strengthen educational choice by bolstering the law to ensure only quality charter school options are available to students and families.

Choice in public education is well-established in Pennsylvania. However, the status quo results in taxpayers sending hundreds of millions of public education dollars more than what charter schools need to provide an education. This is especially true for cyber charter schools, which do not maintain a physical school building and for all charter schools when it comes to well-documented overpayments for special education services. There’s a word for this type of spending – wasteful. And residents across the state feel the impact of these overpayments when their local school districts are forced to raise property taxes because of these costs.

Charter schools are supposed to be public schools. However, the boards that operate charter schools are not elected and are not required to include any representation from the community which they serve. Further, charter schools can contract with for-profit companies to run virtually all operations of the school. Once a charter school enters into one of these contracts, the public loses the ability to see how their money is being spent.

For years, proficiency on state assessments and graduations rates at charter schools have, on average, been substantially lower than those of traditional local public schools. While there are many high-performing charter schools, the current CSL makes it very difficult to close poor performers. Look no further than the fact that every cyber charter school has been identified by the state Department of Education as being in need of improvement for many years.

The bottom line is this: we owe it to our children and to the taxpayers to make sure that we are doing everything possible so that students are getting the best education available and that we are getting the best return on investment for our tax dollars. That’s something that all legislators should be able to support no matter which side of the aisle they’re on.

It is time to end the paralysis in Harrisburg, stop the practice of passing off charter school expansion proposals that fail to address serious funding flaws and contain little accountability as real reform, and finally work in a bipartisan manner to fix the law.
