West Virginia recently passed a charter school law, breaking its promise to the state’s teachers. A new board was created to authorize charters. That board just approved two for-profit online charter schools. One is run by K12 Inc., which changed its name to Stride. The other will be run by Ron Packard’s Accel, which operates low-performing charters in Ohio. Packard was the first CEO of K12 Inc., where he was paid $5 million a year.

Online charters are known for low academic performance, low graduation rates, and high attrition. A study by CREDO found that students in online charter schools learn almost nothing.

While findings vary for each student, the results in CREDO’s report show that the majority of online charter students had far weaker academic growth in both math and reading compared to their traditional public school peers. To conceptualize this shortfall, it would equate to a student losing 72 days of learning in reading and 180 days of learning in math, based on a 180-day school year. This pattern of weaker growth remained consistent across racial-ethnic subpopulations and students in poverty.

On September 22, the National Alliance for Public Charter Schools put out a press release boasting of unprecedented enrollment growth during the pandemic. The report asserted that charter school enrollment increased during the pandemic in at least 39 states, with a 7 percent overall increase. The charter lobby said that this growth “is likely” to be “the largest rate of increase in student enrollment increase in half a decade,” as charter schools added nearly a quarter million students.

Carol Burris, executive director of the Network for Public Education, conducted a state-by-state analysis of their claim and discovered that it was a half-truth at best. Maybe a quarter truth. Maybe less.

What she discovered was that most of the enrollment gains occurred at the worst-performing segment of the charter industry: virtual charter schools. Many brick-and-mortar charter schools actually lost enrollment.

Writing on Valerie Strauss’s “Answer Sheet” blog at the Washington Post, Burris documented the hollowness of the charter lobby claim.

She began:

The National Alliance for Public Charter Schools (NAPCS) has been broadcasting a 7 percent surge in charter school enrollment during the 2020-2021 pandemic school year. Parents are “voting with their feet,” according to its new report, preferring charters to their local public schools. What the authors of the report avoid telling readers is that much of the increase — and likely most of it — was in virtual charter schools, the worst-performing in the charter sector. This occurred even at the expense of brick-and-mortar charters.

The report says this:

“Although a school-level analysis was not conducted as a part of this paper, in some states (e.g., Oklahoma, Pennsylvania, and Utah), charter school enrollment increases were primarily driven by enrollment in virtual charter schools. This explains some but not all of the enrollment increases experienced by the charter school sector nationwide last year.

What exactly does “primarily” mean? How bad is the problem? To find out, the Network for Public Education did a school-by-school analysis of virtual charter growth in the states with the largest proportional enrollment increases.

We began with the three mentioned states. In Oklahoma, the virtual charter-school sector more than doubled enrollment. Ninety-seven percent of the more than 35,000 new students in charters enrolled in virtual schools — most in the for-profit EPIC, which has been repeatedly under investigation for misreporting costs to state officials, improper financial transfers and more.

In Pennsylvania, 99.7 percent of the charter enrollment growth occurred in virtual charter schools. Enrollment in the Commonwealth’s traditional brick-and-mortar charter schools increased by a mere 78 students.

Cyber charters accounted for over 131 percent of the growth in Utah, with enrollment in traditional charters declining.

We expanded our analysis to see if this trend occurred in other states. We began with Michigan, a state whose auditor general had recently released an audit finding that cyber charters could not document participation in at least a single course in more than half of the inspected student records.
The enrollment surge in that state’s cyber charters accounted for 237 percent of the increase. Cyber charters enrollment increased by 5,071 students, while traditional charter enrollment dropped by nearly 3,000.

We then looked at Arizona, a state where families have been bombarded with cyber charter ads and billboards. Over 94 percent of the charter enrollment growth in that state was in the cyber charter sector.

Burris then includes a graph of every state that experienced at least a 10% increase in charter enrollments; there were 13. The graph shows how many students switched to online charters and how many to brick-and-mortar charters. In sum, 95.5% of the enrollment growth was virtual charters. Some brick-and-mortar charters lost enrollments.

Why does this matter? The virtual charter schools have a record of low academic achievement, high attrition, and low graduation rates. In addition, the sector has experienced massive scandals, like the A3 chain in California, whose founders pleaded guilty to phantom enrollments and are repaying the state hundreds of millions of dollars. Like ECOT (Electronic Classroom of Tomorrow) in Ohio, which collected $1 billion over 20 years, gave generously to politicians, then declared bankruptcy rather than comply with a court order to repay $67 million to the state for padded enrollments.

Seeing this increase in schools with abysmal performance is cause for alarm. A study of virtual schools by CREDO in 2015 concluded that students who attend these schools lose ground. While findings vary for each student, the results in CREDO’s report show that the majority of online charter students had far weaker academic growth in both math and reading compared to their traditional public school peers. Students may have”voted with their feet” to enroll in virtual schools during the pandemic, but we have to wait for the evidence to find out if they stayed or returned to public schools. If they decide to stay in virtual schools, we should be alarmed.

Nora de la Cour is a high school teacher and writer. This article about the sham of for-profit remote instruction appeared in Jacobin. Study after study has demonstrated the poor results of virtual instruction, but the research does not deter the greedy entrepreneurs who see the profit in virtual charter schools. You may recall the recent press release from the National Alliance for Charter Schools about how charter schools increased enrollment by 250,000 during the pandemic; what the press release didn’t admit was that the “increase” was due entirely to growth in virtual charter enrollments, which may turn out to be a temporary response to the pandemic.

De la Cour sees the push for for-profit remote learning as another front in the privatization movement.

She begins:

In spring of 2020, we saw signs that billionaires and neoliberal politicians were looking to use the COVID-19 lockdown to finally eliminate one of the last remaining venues where Americans convene in the practice of democratic self-governance: the brick-and-mortar schoolhouse.

Plutocrat-funded techno-optimists giddily suggested we use the temporary requirement of virtual learning to test-drive modelsthat give families more “flexibility” and “freedom.” Then-governor Andrew Cuomo formed a partnership between New York state and the Bill & Melinda Gates Foundation to explore a post-pandemic future without “all these physical classrooms.” Betsy DeVos announced $180 million in grants for states to “rethink” K–12 learning, and her cohort of privatization pushers began licking their chops.

Advocates of public education were rightly horrified, recognizing that this would amount to a further hollowing out of one of our last remaining public goods. Fortunately, a combination of factors turned the discourse emphatically back in favor of preserving in-person K–12 learning as the American standard — for now.

The nearly universal problems with remote instruction last year made it politically impossible for the privatization crew to continue arguing that e-learning is the glittery new frontier of educational progress. In fact, survey data shows that a majority of parents disapprove of any kind of change to traditional schooling. This is despite a relentless onslaught of rhetorical attacks on public schools — from the bipartisan vilification of teachers’ unions to right-wing attempts to use mask mandates and critical race theory to breed ill will among parents. The term “school choice” has apparently become so distasteful that school choice conservatives are looking to rebrand their body blows to public education as a “school freedom” and “parents’ rights” movement. They’re winning legislative battles in diverse states, but they’re losing the war for public opinion.

It’s widely accepted that in-person schools meet critical developmental needs and are necessary for most students. Nevertheless, the pandemic has swiftly accelerated the expansion of digital instruction. Public education advocates are now at a crossroads. We can either proactively define the relationship between remote and in-person schooling, or we can watch from the sidelines as private companies claim a monopoly over distance learning and use it to undermine public education.

Denis Smith worked for many years in the Ohio State Department of Education, finishing his career in the Office of Charter Schools. He writes in the Ohio Capital Journal about the existential threat posed to our democracy and our society by the privatization of public schools. His advice: Be careful what you wish for.

In the last few months, Americans have witnessed a series of assaults by the political right on key parts of the bedrock principles of democracy. Those attacks include new restrictions on voting rights in more than half of the states, the storming of the U.S. Capitol on Jan. 6 by thousands of insurrectionists, and most recently, clear evidence that the former president pressured the top leadership of the Justice Department to help him overturn the 2020 election results.

Certainly these scary developments are newsworthy and have garnered banner headlines and filled airtime on the evening news. But these high-profile assaults on our democracy have served to obscure another, perhaps even more serious threat, an added variant and supplement to the seditious behavior of insurrectionists and a twice-impeached president who encouraged their assault on democracy.

In the midst of the chaos caused by angry militia types working to keep in power a rogue administration, and being mindful of the distraction these events have caused, it’s past time to get educated about the future viability of public education.

While the U.S. Capitol was placed under assault some months ago, public education has been targeted for forty years, when Ronald Reagan signaled his followers that the public sector was undesirable and that private enterprise was always preferable in the nation. His attitude was immortalized in his remark that “the nine most terrifying words in the English language are ‘I’m from the government and I’m here to help.’”

This observation has been interpreted by the right as a command from Reagan himself to privatize about everything in the public sector — except the military — as part on an ideology which holds that a private enterprise is always preferable to a public function. That thinking has morphed into a crusade to destroy perhaps the most recognized and common artifact in any community: the public school.

Individual liberty v. community responsibility

For those who know this institution’s place in American history, the terms public school and common school are used interchangeably, and the leading proponent who believed that every community should offer a program of education was Horace Mann, considered the father of American public education. In his role as the first commissioner of education in Massachusetts, Mann believed that “education should be free and universal, nonsectarian, democratic in method, and reliant on well-trained professional teachers.”

As Mann’s nineteenth-century idea of the common school spread across the new American Republic, in villages, small towns and cities where a community’s shared and accepted values were honored and embraced, the little red schoolhouse became an icon, the force that helped to mold the very idea of community.

That was the America we recognized until several decades ago.

Today, attacks by insurrectionists attired in their cammies and state legislators dressed in business suits are hard at work to undermine that very sense of community, of place. Instead of embracing the idea of place, the community and its schools which educated generation after generation, those same legislators mumble vaguely about something they call “socialism” or “government schools” and instead espouse something else called “educational choice.”

That word choice, used often in the same sentence with freedom, serves as the anti-government elixir peddled by legislators to further encourage insurrectionists and religious zealots who do not accept the idea of community – and its public or common schools.

And with the frequent use by the right of such terms as choice, freedom, and liberty, that tattered social fabric we should be concerned about is worn down even more.

Indeed, words – particularly those three – have consequences.

Several years ago, the New York Times columnist David Brooks critiqued the work of author Marcia Pally, who observed that Americans project a prominent duality – a need to explore as well as be “situated” – i.e., having a sense of community. But today, our very sense of community is under stress, a weakened social fabric fueled by politicians who in their continuing mischief and purposeful vandalism promote divisive policies that result in the transfer of public funds away from our common schools to support private, religious, and charter schools.

In spite of these destructive policies adopted by state legislatures that are antithetical to societal cohesion, the need for community comes at the very time, in Pally’s analysis, when the forces of global migration, globalization, and the internet are proving to be transformative and thus challenge the very idea of community, of being situated.

But it was Brooks’ added observation that a fourth force, in the form of individual choice, gained my attention then and now, particularly in the current and growing national atmosphere that proclaims it’s all about me and my freedom to choose, regardless of compelling community needs, including health, safety, and the transmission of a common cultural heritage, as Horace Mann, John Dewey, and other visionaries labored to establish in another, more unified time in our history.

The byproduct of this thinking — that it’s all about me — centered as it is on the individual and not the community, is seen in both the Capitol insurrectionists and the anti-vaxxers. These protesters are seemingly also armed with the idea that personal freedom and individual choice trump any responsibility in caring for the well-being of others, whether by wearing a mask or being vaccinated against COVID.

To hell with elections. It’s all about me and what I believe, we are being told by those who protest the warnings of scientists and public health experts. And to hell with masks and vaccinations. We don’t need tyranny, they tell us.

And while we’re at it, to hell with the idea of community. When it’s all about me and what I believe, there is no room for what you value.

It doesn’t take many dots to connect this thinking with the deterioration of the idea of community, of being situated, and of having common values like the public schools that were created to serve all the youth in a particular community. We hold that truth (or should we use the past tense now?) to be self-evident. Not.

But in all of this, of slogans like freedom and choice, be careful what you wish for.

In my reaction to Brooks and his review, I wrote this in April 2016:

“…how we preserve freedom serves to illustrate the certainty of unintended consequences for conservatives, viz., how can you promote the concept of choice, particularly educational choice, as a desired public policy outcome, while also warning about weakened community cohesion and a frayed, tattered, strained social fabric”?

Five years later, I stand by those words. In light of recent events, that strained social fabric is even more fragile, and approaching an irreparable state of repair. It follows that with such disrepair, the idea of community in this country may soon be on a ventilator.

Cookie-cutter legislation

The enemy, it seems, is within. We witnessed this bashing of democracy with the images of militia-types beating police with flagpoles. Another version of that assault is the introduction of cookie-cutter legislation, some of which was crafted by the Koch-funded American Legislative Council, which exists to destroy education by taking the word public out of it, and replacing elected local school boards with charter schools whose boards are hand-picked by for-profit chains rather than being elected by voters in a community.

When state legislators vote to create educational vouchers that subsidize private and religious school tuition with public funds, they are making a decision to support schools that often teach content that has not been subject to a thorough review process, as public schools are. By contrast, vouchers mean that students can now be attending schools, free from state regulation, that may not even teach science or other subjects, or use instructional materials that do not support appropriate knowledge about our world.

The image of a caveman and a dinosaur, coexisting in an earlier time, as displayed in a Kentucky museum, comes to mind. It’s not too hard to imagine that under a voucher scheme, if a church affiliated with the museum operated a school and offered a curriculum in line with such a view, it could be eligible for state educational choice dollars.

Yes. Your tax dollars. And mine.

But where is the proper public purpose for taxpayer support of such an imagined school? Right now, for example, the proposed expansion in some states including Ohio of so-called educational choice vouchers to religious schools could make such situations possible in the future. One wonders what would happen if private and religious schools would first be required to agree to a set of very detailed assurances, including the teaching of specific courses of study consistent with the curricular offerings of local public schools, before receiving any state funding in the form of educational vouchers.

I think we know the answer to that. It’s called having it both ways – getting public money with no accountability and no strings attached.

The purpose of public schools

And then there is the subject of citizenship and our common heritage. Besides its purpose to produce skilled and literate individuals, public schools have also been charged to prepare young people to be caring and ethical citizens. By contrast, it can be argued that with private and religious schools, their own unique missions may not place civic-related ideals in the top rank, but instead subordinate civic education and awareness to a more narrow or sectarian purpose that mirrors the defining purpose of the school.

But if in the name of freedom and educational choice there is already enough concern about the use of public tax dollars to help fund private, religious and charter schools and thus undermine public education, weaken our democracy, and further damage our social fabric, there is yet another problem created by the actions of state legislatures to fund religious schools through vouchers.

It’s the Establishment Clause.

A product of The Enlightenment, the First Amendment’s Establishment Clause was crafted by the nation’s founders, who knew that religious wars had consumed Europe in the centuries preceding the American Revolution. Currently, in my home state of Ohio, a coalition of school districts is preparing a court challenge to check the legislature’s intent to expand the state’s voucher program as not only a violation of the constitutional prohibitions against supporting sectarian schools but also a violation of the Ohio Constitution’s purpose to establish a “system of common schools.”

I trust that this language from the Ohio Constitution is illustrative of how other states establish a system of public education.

[Article VI, Sec. 2 Education] The General Assembly shall make such provisions, by taxation, or otherwise, as, with the income arising from the school trust fund, will secure a thorough and efficient system of common schools throughout the State; but, no religious or other sect, or sects, shall ever have any exclusive right to, or control of, any part of the school funds of this State.

Certainly, private and religious schools do not meet the definition of a common school that must be supported by public funds, yet in the name of educational choice there is a nationwide movement to expand voucher programs that will support private and religious schools, in spite of any Establishment Clause violation and other legal prohibitions.

So we return to the purpose of the common school as a unifying force to build community and not be a dividing force, as private and religious schools will be, if they are put on an equal footing with public education through support with public funds.

If all of these issues might seem to be troublesome, there is one which will likely prove to cause the most damage: How can you maintain the concept of E Pluribus Unum when public policy seems poised to support all types of schools and thus erode the idea of the common school, in this case the Unum in our national motto, as the essential driver to ensure that children who come from many backgrounds form a single nation through our common schools?

Indeed, we know that the mission of public education is to prepare young people to be skilled, literate, and ethical citizens. But that’s only part of it.

Let’s take a look at the Unum part of the equation. In an essay about the role of public education written two decade ago, Kenneth Conklin, a Hawai’i philosophy professor, raised some concerns about how a fragmented educational system can itself cause a fragmented society.

“If an educational system is altered, its transmission of culture will be distorted,” Conklin wrote. “The easiest way to break apart a society long-term without using violence is to establish separate educational systems for the groups to be broken apart.”

Public tax dollar support of private, religious, and charter schools clearly represent the establishment of separate educational systems. Such tax support violates the very idea of Horace Mann’s common school, the very image of democracy in every community.

Conklin provides some additional advice for us to consider:

“A society’s culture can survive far longer than the lifespan of any of its members, because its educational system passes down the folkways and knowledge of one generation to subsequent generations. A culture changes over time, but has a recognizable continuity of basic values and behavioral patterns that distinguishes it from other cultures. That continuity is provided by the educational system.” (Emphasis mine)

What’s next?

We’re in trouble. A community thrives on consensus, of shared values. The actions of agents of disinformation spreading lies about vaccines have undermined confidence in science and public health. And if we lose a consensus about public education and the shared values it represents, we have lost our democracy.

But there is hope.

In reaction to this assault on public education in Ohio, a group of 85 school districts have joined to challenge the intent of the Ohio General Assembly to greatly expand the Educational Voucher program and put private and religious schools on an equal footing to receive tax dollars siphoned away from constitutionally established common schools. Their position is that Article VI of the Ohio Constitution makes no provision for publicly supported but parallel and competing forms of education supported by public funds.

The Ohio Coalition for Equity and Adequacy of School Funding, which was itself established twenty-five years ago to ensure fair state funding for school districts irrespective of wealth, is facilitating the legal efforts of districts in challenging the constitutionality of educational vouchers and the blatant violation of the Establishment Clause in establishing funding for religious schools. With so much at stake for future state funding of public school districts, more districts are expected to join this lawsuit in the coming weeks

So what is the lesson to be learned from public support of private and religious schools, along with the privatization of what is left of public education?

Be careful what you wish for.

If you think freedom and choice are the purest ideals to possess and not a sense of community to hold us together, most prominently seen in our public schools, think again. Every vote in every state legislature to offer or expand choice in the end represents a choice for disunion, for a fragmentation of our cultural heritage, a basis for community – and our very nationhood.

We are on the brink. If there is not a counter-movement to roll back this destruction of our communities by the Ohio General Assembly through the planned destruction of the common school, we will get what we deserve.

Yes, be careful what you wish for.

Bill Phillis of the Ohio Coalition for Equity and Adequacy of School Funding is a champion of public schools in a state with many charters and vouchers.

He writes:

A primary purpose for the creation of the common school system for all the children of all the people was to maintain a republican form of government. Knowledgeable people in unity with one another will ward off tyranny, in favor of liberty and equality. A virtuous government operating for the common good is the goal.

Common is a term of art that has universally-accepted meaning. As applied to school, it indicates a place or institution that serves all children free of charge, paid for by taxation. It relates to the community at large, in a symbiotic relationship.

Common means “belonging to all, used jointly, shared by all.” The “common” system is required by the Ohio constitution, and the “system” must be thorough and efficient.

Tax-supported vouchers and charters are foreign to the common school system required by the constitution. They are not only foreign to the system, but are parasitical in taking funds away from the common system. These schemes divide, rather than unite. They serve not all, but selected students. Their goal does not necessarily match the goal of the common system—to maintain the republican form of government. Their relationship to the community is often strained or non-existent, as opposed to symbiotic.

Vouchers Hurt Ohio

It’s true that there are occasional stories of embezzlement or fraud in public schools, but none compares to the sheer audacity of California’A3 online charter chain. Its two cofounders—Jason Schrock and Sean McManus—concocted elaborate schemes and pocketed hundreds of millions of dollars of state funds. They both pleaded guilty and repaid hundreds of millions.

Schrock, however, will not spend a day in prison.

SAN DIEGO — 

One of the two masterminds behind a massive charter school scheme that defrauded the state of California out of tens of millions of dollars was sentenced to four years in prison and ordered to pay $18.75 million in fines in San Diego Superior Court on Friday.

Jason Schrock, a co-creator of the now-defunct A3 charter school network, pleaded guilty in February to one count of conspiracy to misappropriate public funds and one count of conflict of interest. He has been on house arrest in Orange County since he was arraigned in May 2019.

Because the law requires that Schrock receive credit for the more than 750 days he has spent on house arrest, he will not spend a single day in prison.

At Schrock’s sentencing hearing, defense attorney Knut Johnson emphasized that Schrock had been wholly cooperative during the investigation, turning over hundreds of millions of dollars in assets and thousands of pages of documents to further the investigation.

It was that cooperation that kept San Diego Superior Court Judge Frederick Link from handing down a stiffer sentence, the judge said. The case centered on what has been labeled as one of the nation’s largest fraud schemes after taxpayers were fleeced out of $400 million meant for K-12 education. Due in part to the cooperation of Schrock and his co-conspirator, Sean McManus, investigators have recovered $220 million…

A yearlong investigation by the San Diego County district attorney’s office determined that Schrock and McManus and their codefendants fraudulently obtained hundreds of millions in state school dollars from 2016 to 2019 after opening a network of 19 online charter schools. Three of those schools were in San Diego County.

Prosecutors accused A3 leaders of buying children’s personal information to falsely enroll them in the schools and of providing incomplete education services while taking tens of millions of dollars for personal use. A3 leaders also manipulated enrollment figures across their schools to receive more state funding per student and manipulated school attendance reporting to get more money for time that children were not spending in A3 schools.

So far, nine defendants in the case have pleaded guilty.

Online charters have a history of poor performance: high attrition rates, low graduation rates, low test scores.

Will Huntsberry of the Voice of San Diego reports here that online charters were once again among the lowest performing schools in that city.

Huntsberry writes:

Virtual charter schools – as well as other charters that don’t use traditional brick-and-mortar classrooms – performed among the worst in San Diego County in a new analysis of test scores that took each school’s poverty level into account.

The analysis compared 632 schools across San Diego County. Out of 14 non-classroom-based charter schools, as they are called in education jargon, five scored among the 20 lowest-performing schools. Nine out of 14 schools scored among the bottom 15 percent.

California’s non-classroom-based schools have lived under a magnifying glass in recent years. State legislators placed a moratorium on new non-classroom schools, after executives from one online charter siphoned more than $80 million into their own private companies. Legislators also temporarily blocked the schools from receiving new funds.

The new analysis, performed by Voice of San Diego and the Center for Research and Evaluation at UC San Diego Extension, did not just look at a school’s test scores. It compared a school’s performance on standardized tests to other schools with similar poverty levels.

Brick-and-mortar charters performed in line with traditional public schools in the analysis. But non-classroom-based charters scored significantly worse.

These findings reenforce the statewide study of online charter schools in California, prepared by “In the Public Interest.” They have a long track record of failure nationally.

After a scathing state audit of its finances, the EPIC virtual charter school cut its ties to the school’s for-profit co-founders.


The governing board of Epic Charter Schools underwent a major overhaul Wednesday night and then declared its independence from the for-profit school management company owned by Epic’s co-founders.

Epic’s seven-member board of education unanimously approved a mutual termination agreement, effective July 1, to end its contract with Epic Youth Services, which reportedly has made millionaires of founders David Chaney and Ben Harris.

“Big day for our school; big shift, obviously,” said the newly seated board Chair Paul Campbell, an aerospace and energy executive who founded the Academy of Seminole charter school.

“This school has outgrown its management company, which is why we did what we did today. There is no more CMO (charter management organization). … Not only will we save tens of millions of dollars, but you’re taking a significant leap forward in technology for this school…

In early October, a report on the state’s investigative audit of Epic revealed lax school board oversight and that one of every four taxpayer dollars Epic received went to the for-profit school management company, Epic Youth Services.

The state auditor found that 63% of those monies — nearly $80 million budgeted for students’ learning needs — has been shielded from all public or auditor scrutiny. The auditor is still battling in court to get access to those spending records.null

The state audit also revealed that Epic Youth Services was relying almost solely on Oklahoma public school employees to do the administrative work for both Epic’s Oklahoma and California schools while collecting tens of millions of dollars in management fees.

It also found that the company “improperly transferred” $203,000 in Oklahoma taxpayer dollars from the Oklahoma schools’ student Learning Fund account to help cover payroll shortages at Epic’s California charter school.

I recently had the pleasure of speaking to the North Texas School Boards Association by Zoom. Right now, Texas is ground zero for the charter industry. This is astonishing because the public schools in Texas far outperform the charter schools. The charter school lobby markets themselves as “saviors” of children, but they are far more likely to fail than public schools. This is a summary of what I told my friends in Texas:

I am a graduate of the Houston public schools. My father, who grew up in Savannah, never finished high school; my mother, who was born in Bessarabia, was very proud of her high school diploma from the Houston public schools.

I believe that all of us, whether or not we have children, whether or not we have children in public school, have a civic obligation to support public schools, just as we must support other public services, like police, firefighting, public roads, public parks, and public libraries. Taxes are the price we pay for a civilized society, and no investment is more precious than investing in the education of our children. They are our future. 

Texas, like every other state, guarantees a free public education to everyone. The clause in the state constitution says:

A general diffusion of knowledge being essential to the preservation of the liberties and rights of the people, it shall be the duty of the Legislature of the State to establish and make suitable provision for the support and maintenance of an efficient system of public free schools.

As constitutional scholar Derek Black shows in his book Schoolhouse Burning, the founding fathers of this nation wanted every state to provide free public education. They didn’t have it in their own time, but they saw it as essential to the future of the nation. In the Northwest Ordinance of 1785, the Founders said that any territory that wanted to become a state had to set aside one lot in each town for a tax-supported public school. Not a private academy supported by tax funds, but a tax-supported public school.

The leadership of Texas doesn’t care about the state constitution. Every time the legislature is in session, someone offers a bill to send public funds to religious schools, which are not public schools. Thus far, a coalition of urban Democrats and rural Republicans and the dedicated leadership of Pastors for Texas Children has defeated vouchers.

The Republicans who control the state have substituted charters for vouchers in their eagerness to provide alternatives to the right guaranteed by the state constitution. And they have not given up on vouchers.

Texas now has more than 800 charter schools. These are schools under private management, paid for with tax dollars. Contrary to their marketing strategy, they are not public schools. Some of those charters are part of big corporations, like KIPP or IDEA. Some are nonprofit schools that are managed by for-profit corporations. The GOP leadership wants more of them, even though the existing public schools are underfunded and have not recovered from a devastating budget cut of more than $5 billion in 2011.

When the idea of charter schools first emerged in the early 1990s, I was enthusiastic about their promise. I was in Washington, DC, working as Assistant Secretary of Education for Research in the first Bush administration. We heard from their sponsors that charter schools would be more innovative, would cost less than public schools because of their lack of bureaucracy, would be more successful, and would be more accountable than public schools because they were free of most regulations. 

Three decades later, this is what have we learned: 

   a). Charter schools are not more innovative than public schools. The only innovation associated with charters is harsh disciplinary practices called “No excuses,” where children are punished for minor infractions of strict rules. The largest charter chain in Chicago, the Noble Network, recently announced that it was getting rid of “no excuses” because it is a racist policy, meant to force black children to adopt white middle-class values.  

    b) Charter schools are not more accountable than public schools. In most states, the charter associations fight any effort to impose accountability or transparency. They don’t want to be audited by independent auditors. The only time they are accountable is when they close their doors because of low enrollment or abject academic failure. 

    c) Charter schools do not cost less than public schools. They typically demand the same public funding as public schools, even though the public schools pick up some of their costs, like transportation, and even though they have fewer high-need students than public schools. In some states, like Texas, charter schools get more public money than public schools.

    d) Charter schools are less effective than public schools. Those that have high test scores choose their students and families carefully and push out those they don’t want. On average they don’t outperform public schools, and they spend more money on administration than public schools. In some states, like Ohio, the majority of charter schools are rated D or F. 

Charters are unstable. They open and close like day lilies. Sometimes in mid-semester, leaving their students stranded.

The worst charter schools are the virtual schools. 

The state pays the cybercharters full tuition to provide nothing more than a computer, a remote teacher, and some textbooks. They charge double or triple their actual costs.

Virtual charter schools have high attrition rates, low graduation rates, and low test scores.

There have been huge scandals associated with virtual charter schools.

In Ohio, the Electronic Classroom of Tomorrow collected close to a billion dollars over 18 years. It was started by a businessman, who made generous contributions to political leaders. It had one of the lowest high school graduation rates in the nation. In 2017, ECOT was audited by the state and found to have collected tuition for phantom students. Rather than pay the state $80 million, ECOT declared bankruptcy in 2018. No one was fined, no one went to prison, no one was held accountable.

The biggest scandal in charter history was the A3 virtual charter chain. It had a massive scheme to enroll fake students. Eleven people were indicted. Eventualy, the leaders of A3 agreed to repay the state $215 million.

The largest of the virtual charters is K12 Inc; it is registered on NY Stock Exchange. Its results are familiar: high attrition, low test scores, low graduation rates. Their top executives are paid millions of dollars each. K12 is are operating in dozens of states.

Poor academic performance is not punished; financial fraud is not punished. There is no accountability. 

IDEA in Texas is in a class of its own when it comes to luxuries. They get hundreds of millions of tax-payer dollars, but they decided they needed to lease a private jet for their executives. When the story got into the newspapers, they dropped that idea. The media also reported that IDEA bought season tickets for special seating at San Antonio Spurs games. When the CEO decided to retire, he received a $1 million golden parachute. How many school superintendents do you know who got such a generous going-away present?

Charter schools claim that they “save poor kids from failing schools.” 

That’s not true. There are currently some 356,000 students in charter schools in Texas. Three-quarters of them are enrolled in charter schools in A or B school districts. The charter school students are being drawn away from successful schools in successful districts.

The charter lobby claims that there are long waiting lists. Don’t believe it. The so-called wait lists are manufactured. They are never audited. In Los Angeles, at least 80% of the existing charters have empty seats, yet still the lobbyists talk about wait lists. In New York City, charters buy advertising on city buses. When you have a waiting list, you don’t buy advertising.

The charter industry in Texas has a number of charter expansions already approved and expects to grow by 50,000 students every year. Unless the legislature plans to increase spending on education, charter growth will mean budget cuts for public schools. Charters in Texas currently divert $3 billion a year from public schools. Since they started, they have diverted more than $20 billion that should have gone to the state’s public schools. 

Charter schools in Texas are not more successful than public schools. Texas researcher William Gumbert reported that 86% of public school districts are rated either A or B by the state, compared to 58.6% of charter schools. Only 2.6% of public school districts were rated D or F, compared to 17.7% of charter schools.  

Texas Public Radio reported that graduation rates at charter schools were 30 points lower than the rates at public high schools. 

Two economists—Will Dobbie and Roland Fryer—studied the outcomes of charter schools in Texas. They concluded that charter schools have “no impact on test scores and a negative impact on earnings.”

William Gumbert, an independent analyst in Texas, has calculated that graduates of charter schools enter college less well prepared and are less likely to perform well in college, compared to students who went to public schools. He reported that the 2019 state ratings showed nearly 40% of charters approved by the state have been closed. 

The charters claim that they can close historic achievement gaps between children of different racial and ethnic backgrounds. This is not true. According to careful research by analyst Gumbert, public schools do a better job of narrowing the achievement gaps between black and white students and between Hispanic and white students than charters in the same districts. 

Again, using state records, Gumbert found that graduates of public schools were more successful in college than graduates of charter schools. Public school graduates were more likely to have a higher grade-point average in freshman year than charter school graduates. First-year grade-point average has been shown to predict college graduation. 

Now the charter industry is lobbying for a vast expansion in Texas. They don’t want to have to deal with elected school boards or other elected officials. Democracy is a nuisance, an obstacle. So they are promoting SB 28, which would remove any elected school boards or elected municipal officials from the charter approval process. The state board of education could veto a charter application only with a supermajority. Only one appointed state official—the State Commissioner, appointed by the Governor– would decide whether charters may invade your district, recruit the students they want and locate the charter school wherever they want. That is a major blow to local control of schools. 

Why are state officials in Texas, why is the Legislature, opposed to local control of schools?

After three decades of experience, we have learned about the policies and practices of charter corporations.

First, many charter schools are run by non-educators. They see a business opportunity and they compete for market share. 

Second, they market charter schools by making extravagant claims. They promise that their students will be successful in school and will go to college even before they open their doors. As we have seen, this is usually false.

Third, the few that get high test scores do so by cherry-picking their students or by setting the standards so high that only high-scoring students choose to enroll. BASIS is an example of that. Students have to pass a certain number of AP exams to graduate, so average students need not apply. In Arizona, where most of the state’s students are Hispanic or Native American, the BASIS schools enroll mostly white and Asian students.

Fourth, some charter schools raise test scores by pushing out students who get low scores. That means excluding students with disabilities and students who don’t speak or read English. It also means counseling out or finding creative ways to discourage the kids who are discipline problems or the kids who perform poorly on tests. The most successful charter chain in NYC accepts kids by lottery in kindergarten. Then they begin weeding out those they don’t want, and after third grade, no new students are accepted. By senior year, most of the students who started in K or first grade have disappeared

Fifth, charter schools typically hire young and inexperienced teachers who cost less than older experienced teachers. The turnover is high—sometimes as much as half the staff leaves every year and is replaced by newcomers to teaching. 

Sixth, the true secret of charter expansion is the money behind them. They are supported by a long list of billionaires who want to eliminate public schools. They mock our community schools as “government schools,” but they might as well mock our community police officers as “government security agents.” Our community public schools belong to “we, the people.” We pay for them with our taxes. They reflect our community history. They have the trophies that our parents, our cousins, our aunts and uncles won at football, basketball, baseball, volleyball, chess, and debate tournaments. They are audited and overseen by our neighbors. We elect the school board, and if we don’t agree with their decisions, we elect another one. 

Don’t give your public dollars to entrepreneurs and corporations to educate your children. 

Don’t replace your public schools with a free market where schools compete for customers. Markets produce winners and losers, not equality of educational opportunity. Use your tax dollars to make your public schools the best they can be for all the children.

Whatever your political views are, these schools belong to you, not to Wall Street or libertarian billionaires or opportunists. Tell your legislators to support your public schools. 

School choice means that the schools choose.

Public schools must take everyone. 

School choice is a hoax.

Don’t fund failure.

At a time when there are so many divisions in our society, we need our public schools to teach appreciation for our common heritage as Americans and as Texans.

I especially appeal to those with conservative values: Conservative conserve. Conservatives don’t blow up traditional institutions. People who want to blow up community institutions are anarchists, not conservatives.

Preserve and improve your community public schools for future generations. 

You may recall that the Oklahoma State Board of Education recently voted 4-3 to allow charter schools to share in local tax revenues, over the opposition of State Commissioner Joy Hofmeister, who said that the decision might violate state law. You may also recall that the virtual charter school in Oklahoma called EPIC has been embroiled in scandal after scandal (just google “Oklahoma EPIC scandal” and you will get lots of references to allegations of theft, embezzlement, ghost students, etc.). For example, in fall 2020, the state auditor reported that EPIC owes the state $8.9 million for inaccurate reporting, improper transfer of funds, and a multitude of other egregious (you might say “epic”) calculations. That $8.9 million was the tip of a very large iceberg. The state auditor said that about 1 of every 4 dollars that the state paid to EPIC (a total of $458 million) was deposited as profit by the school’s owners. The story is breathtaking.

We’re wondering why State Board of Education member Jennifer Monies did not recuse herself during last week’s vote to settle a lawsuit that directly benefited another entity of which she serves as board member. She is both plaintiff and defendant in this case yet she still cast a vote. 

“On numerous occasions in the board’s public meetings, Monies has mentioned her service on the board of her son’s school, John Rex Charter Elementary in Oklahoma City, which would stand to benefit from the settlement and which is listed as a member of the Oklahoma Public Charter School Association on the organizations’ website.”
