Politico wrote recently about the powerful impact of campus towns. They typically vote Democratic, and they have a large impact on state elections. It’s long been known that education is a factor in voting. The most educated counties vote Democratic, and the least educated vote Republican.

Politico wrote:

Spring elections in Wisconsin are typically low turnout affairs, but in April, with the nation watching the state’s bitterly contested Supreme Court race, voters turned out in record-breaking numbers.

No place was more energized to vote than Dane County, the state’s second-most populous county after Milwaukee. It’s long been a progressive stronghold thanks to the double influence of Madison, the state capital, and the University of Wisconsin, but this was something else. Turnout in Dane was higher than anywhere else in the state. And the Democratic margin of victory that delivered control of the nonpartisan court to liberals was even more lopsided than usual — and bigger than in any of the state’s other 71 counties.

The margin was so big that it changed the state’s electoral formula. Under the state’s traditional political math, Milwaukee and Dane — Wisconsin’s two Democratic strongholds — are counterbalanced by the populous Republican suburbs surrounding Milwaukee. The rest of the state typically delivers the decisive margin in statewide races. The Supreme Court results blew up that model. Dane County alone is now so dominant that it overwhelms the Milwaukee suburbs (which have begun trending leftward anyway). In effect, Dane has become a Republican-killing Death Star.

“This is a really big deal,” said Mark Graul, a Republican strategist who ran George W. Bush’s 2004 reelection campaign in Wisconsin. “What Democrats are doing in Dane County is truly making it impossible for Republicans to win a statewide race.”

In isolation, it’s a worrisome development for Republicans. Unfortunately for the larger GOP, it’s not happening in isolation.

In state after state, fast-growing, traditionally liberal college counties like Dane are flexing their muscles, generating higher turnout and ever greater Democratic margins. They’ve already played a pivotal role in turning several red states blue — and they could play an equally decisive role in key swing states next year.

One of those states is Michigan. Twenty years ago, the University of Michigan’s Washtenaw County gave Democrat Al Gore what seemed to be a massive victory — a 60-36 percent win over Republican George W. Bush, marked by a margin of victory of roughly 34,000 votes. Yet that was peanuts compared to what happened in 2020. Biden won Washtenaw by close to 50 percentage points, with a winning margin of about 101,000 votes. If Washtenaw had produced the same vote margin four years earlier, Hillary Clinton would have won Michigan, a state that played a prominent role in putting Donald Trump in the White House.

Name the flagship university — Arizona, Colorado, Georgia, Iowa, Kansas, Kentucky, Ohio, Texas, Virginia, among others — and the story tends to be the same. If the surrounding county was a reliable source of Democratic votes in the past, it’s a landslide county now. There are exceptions to the rule, particularly in the states with the most conservative voting habits. But even in reliably red places like South Carolina, Montana and Texas, you’ll find at least one college-oriented county producing ever larger Democratic margins.

The American Communities Project, which has developed a typology of counties, designates 171 independent cities and counties as “college towns.” In a combined social science/journalism effort based at the Michigan State University School of Journalism, the ACP uses three dozen different demographic and economic variables in its analysis such as population density, employment, bachelor’s degrees, household income, percent enrolled in college, rate of religious adherence and racial and ethnic composition.

Of those 171 places, 38 have flipped from red to blue since the 2000 presidential election. Just seven flipped the other way, from blue to red, and typically by smaller margins. Democrats grew their percentage point margins in 117 counties, while 54 counties grew redder. By raw votes, the difference was just as stark: The counties that grew bluer increased their margins by an average of 16,253, while Republicans increased their margins by an average of 4,063.

Back in 2000, the places identified as college towns by ACP voted 48 percent to 47 percent in favor of Al Gore. In the last presidential election, the 25 million who live in those places voted for Joe Biden, 54 percent to 44 percent.

Many populous urban counties that are home to large universities don’t even make the ACP’s “college towns” list because their economic and demographic profiles differentiate them from more traditional college counties. Among the missing are places like the University of Texas’ Travis County, where the Democratic margin of victory grew by 290,000 votes since 2000, and the University of New Mexico’s Bernalillo County, where the margin grew by 73,000 votes. The University of Minnesota’s Hennepin County has become bluer by 245,000 votes.

North Carolina offers a revealing snapshot of a state whose college towns have altered its electoral landscape. Five of the state’s nine counties that contain so-called college towns have gone blue since voting for George W. Bush in 2000. Back then, the nine counties together netted roughly 12,000 votes for Bush, who carried the state by nearly 13 percent. Twenty years later, those numbers had broken dramatically in the opposite direction — Biden netted 222,000 votes from those counties. He still lost the state, but the margin was barely more than 1 percent.

There’s no single factor driving the college town trend. In some places, it’s an influx of left-leaning, highly educated newcomers, drawn to growing, cutting-edge industries advanced by university research or the vibrant quality of life. In others, it’s rising levels of student engagement on growing campuses. Often, it’s a combination of both.

What’s clear is that these places are altering the political calculus across the national map. Combine university counties with heavily Democratic big cities and increasingly blue suburbs, and pretty soon you have a state that’s out of the Republican Party’s reach.

None of this has gone unnoticed by the GOP, which is responding in ways that reach beyond traditional tensions between conservative lawmakers and liberal universities — such as targeting students’ voting rights, creating additional barriers to voter access or redrawing maps to dilute or limit the power of college communities. But there are limits to what those efforts can accomplish. They aren’t geared toward growing the GOP vote, merely toward suppressing Democratic totals. And they aren’t addressing the structural problems created by the rising tide of college-town votes — students are only part of the overall phenomenon.

The Texas Monthly published its rankings of the best and worst legislators of 2023, based in part on how they voted on Governor Greg Abbott’s must-pass voucher legislation. The Governor spent months touring religious schools to sell his plan to subsidize their tuition. Two dozen Republican legislators in the House voted to prohibit public funding of private schools. Governor Abbott has promised to call special session after special session until he gets an “educational freedom” bill to pay private and religious school tuition. Those Republican legislators, known as “the Dirty Two Dozen” are standing in his way.

There are 150 members of the Texas House of Representatives. Eighty-six are Republicans; 64 are Democrats.

Here’s one big difference between the legislatures of Texas and Florida: Florida Republicans do whatever Governor Ron DeSantis tells them to do. Texas Republicans tell their governor to get lost when his plans are bad for their district.

That’s why Florida is going to spend billions on vouchers for whoever wants them, rich or poor, but vouchers were defeated in the Texas legislature by the votes of mostly rural Republicans.

The Texas Monthly writes:

Sound and fury signifying nothing: that’s the Texas Legislature, the overwhelming majority of the time. Lawmakers yell and scrap for 140 days every other year, nibble around the edges of issues that require urgent action, and typically produce little worth remembering. On two occasions, the Eighty-eighth Legislature stood tall: when the House expelled a member, Bryan Slaton, for sexual misconduct and again when it impeached Attorney General Ken Paxton. But for the most part the session was a drag.

It could have been different: this session offered transformational opportunities for Texas. The GOP’s control of redistricting in 2021 ensured safe seats for almost all its members for the rest of the decade, and lawmakers came to town with an unprecedented $33 billion budget surplus, the largest in state history. Previous generations of legislators would have danced with the devil at midnight to be so politically secure and have such ample patronage to dole out. Almost any dream, large or small, could be made real. Connect Dallas and Houston by high-speed rail? No problem. Pull Texas from near the bottom in spending per public school student? We could afford it.

To do any of that, state leaders would have had to put aside their petty intrigues and think big. Instead those intrigues shaped the session. Governor Greg Abbott invested the lion’s share of his political capital in a school-voucher program, knowing full well that rural members of the GOP deeply opposed it. Abbott offered those members their choice of a carrot or a stick and then when they wouldn’t acquiesce, tried beating them with both.

Here are some of the legislators who stood up to Abbott and blocked vouchers:

Representative Ernest Bailes, a Republican from Shepherd, Texas:

Bailes isn’t outspoken or otherwise prominent, like most of the lawmakers on these lists. The Republican has represented his rural southeast Texas district since 2017 but is rarely seen at the House microphones. The big dogs in the room might describe Bailes’s proposals this session as minor—one of his notable bills would have adjusted labeling rules for Texas honey producers.

Rural Republicans who support public schools were in the hot seat this session as the governor pushed a voucher program they saw as inimical to their districts’ interests. That fight brought out the best in Bailes, whose wife works as a schoolteacher and whose mother is a former school board president. The rurals held together and won. On two occasions Bailes won glory for himself.

One small victory came when state representative Harold Dutton, a Houston Democrat, claimed, while laying out a bill, that in one of the school districts in Bailes’s district just 5 percent of third-grade students could read at grade level. The school district was, in fact, “one of the highest-ranked districts in the state of Texas,” Bailes told Dutton from the House floor. Bailes wondered aloud what other falsehoods Dutton was deploying. Dutton’s bill was voted down, and it took him five days to resuscitate it.

A greater victory came when Public Education chair Brad Buckley asked the House to allow his committee to have an unscheduled meeting so that he could pass a hastily drafted voucher bill onto the floor—late at night, without a public hearing. In most cases, these requests are approved, no objection registered. But there, like Leonidas at Thermopylae, stood Bailes at the microphone.

Did Buckley really intend to bring an eighty-page bill to the floor without inviting public comment, Bailes asked? Buckley demurred. Did he not think Texas kids deserved better than “backroom, shady dealings”? Bailes, defender of Texas bees, had the powerful chairman dead to rights. The chamber sided with Bailes. Individual voices still matter in the House. Texans should be glad Bailes used his when it counted.

Representative John Bryant, a Democrat from Dallas.

Bryant is easily the most energetic new voice among Democrats. He’s well prepared. He’s principled. Elected in 2022, he just might be the future of House Democrats. Also: he previously served in the House before some current members were even born and is 76.

But it’s a Sylvester Stallone 76—not, say, a Donald Trump 76. He’s come out of retirement, he’s back in shape, and now he’s whipping up on the youngsters.

Bryant came back to Austin this year with a clear mission: to set an example of how to serve courageously in the minority. Because of his previous tenure in the Lege, he arrived with seniority, landing a nice Capitol office and, more important, a plum seat on the Appropriations Committee, which writes the budget.

Unlike many in his party who seem content to warm their seats, Bryant came armed with facts and tough questions. He impressed and unnerved his colleagues by making Texas education commissioner Mike Morath squirm over the sad state of education funding during a hearing on the budget. Bryant’s genial but ruthless grilling of witnesses earned him a visit from a Democrat cozy with House leadership. Would he please stop asking so many questions? It was upsetting the Republican chairman and jeopardizing certain Democrats’ pet legislation. Bryant declined the request. As he kept pounding—on raising the basic allotment for public schools, on the dismal state of the mental health-care system, on the need to increase funding for special education—he started winning over skeptical colleagues, who saw in him a model for principled opposition.

“Bryant is a folk hero,” said one insider. “He’s reintroduced the spirit of the Democrats in the seventies.” Said another: “John Bryant is a really good John Wesleyan Methodist who believes you do all you can, for as long as you can, for as many people as you can. And that is the only thing that is really motivating him.”

Senator Robert Nichols, Republican from Jacksonville.

There are no Republican mavericks in Dan Patrick’s Senate. But until a real iconoclast shows up, Robert Nichols will do.

Nichols, who represents a largely rural swath of East Texas where few private schools exist, has long opposed creating vouchers, which siphon money away from public schools. Patrick has long supported creating them. So it was notable when the East Texan schooled the lieutenant governor and voted against his voucher plan. “He’s managed to effectively represent his vast district in the politically hostile work environment created by Dan Patrick,” said a longtime Capitol insider.

And Nichols wasn’t just the lone Senate Republican “no” on school vouchers. He’s one of the few Republican legislators to support adding a rape exception to the state’s abortion ban and raising the legal age for purchasing certain semiautomatic weapons to 21. Both of these positions enjoy overwhelming public support yet remain politically untenable because the Republican Party is in thrall to campaign contributors and the 3 percent of Texans who decide its primary elections. When a state’s priorities are set by a small but vocal minority, standing up for broadly popular policies counts for real courage.

So far Nichols appears to have maintained a relationship with Patrick, and he’s been able to get several bills passed. Perhaps Nichols’s greatest accomplishment this session was making Stephen F. Austin State University, in Nacogdoches, part of the University of Texas System. Membership in the UT System will provide the East Texas institution, which celebrates its centenary this year, with a much-needed infusion of money and energy.

The Texas Monthly left off a few outstanding Republican legislators who stand strong against vouchers. So I’m adding them here to my own list of the best legislators in Texas because they stand up for the common good and ignore Gregg Abbott’s demands. They are not afraid of him.

Glenn Rogers (R, Graford)

Glenn Rogers has been fearless in his fight for public education. The billionaire Wilks brothers will come after him again in the 2024 primaries.

Steve Allison (R.-San Antonio)

Steve Allison from Alamo Heights in San Antonio. served on the Alamo Heights ISD school board for many years before running for the House in 2018. He has voted against vouchers and in favor of raising pay for teachers, librarians, counselors, and school nurses. He increased funding for women’s health care, providing lower-income women increases access to cancer screenings and mammograms.

Drew Darby (R.-San Angelo)

Drew Darby is a veteran legislator who strongly supports public schools and opposes vouchers. In this interview with the local media, he explains why he opposes vouchers. He says there is already plenty of choice in his district. The crucial issue, he says, is whether it is right to take money away from public schools and give it to schools that are completely unaccountable and that choose which students they want to educate. Greg Abbott can’t scare him! He has been recognized by the Pastors for Texas Children as a “Hero for Children.”

Charlie Geren (R.-Fort Worth)

Charlie Geren is a veteran legislator who has stood strong against vouchers repeatedly. He is clear about his advocacy for teachers and public schools. On his Twitter feed, he publicizes his support for teachers. He has been recognized as a “Hero for Children” by the Pastors for Texas Children. Greg Abbott can’t scare him!

The following is a press release from Democrats on the House Appropriations Committee, reacting to deep cuts in the funding bill proposed by House Republicans for federal programs in education, health, labor, and human services. The Title I funding program, which supports schools serving low-income students, is subject to a draconian cut which could lead to layoffs of 220,000 teachers. Every other program sustains cuts. Though not mentioned here, the federal Charter Schools Program received additional funding, one of the few to escape the Tepunlican axe.,

House Republican Funding Bill Kicks Teachers Out of Classrooms, Takes Away Job Opportunities, and Harms Women and Children

 

In the midst of a teacher shortage, Republicans are kicking more than 220,000 teachers from classrooms.

WASHINGTON — House Appropriations Committee Republicans today released the draft fiscal year 2024 Labor, Health and Human Services, Education, and Related Agencies funding bill, which will be considered in subcommittee tomorrow. The legislation is an assault on education and job training, decimates research funding, and abandons ongoing public health crises.

 

For 2024, the bill provides $163.0 billion, a cut of $63.8 billion – 28 percent – below 2023. This year’s Republican allocation was the lowest for the Labor, Health and Human Services, Education, and Related Agencies bill since 2008. The legislation:

 

  • Decimates support for children in K-12 elementary schools and early childhood education.
  • Abandons college students and low-income workers trying to improve their lives through higher education or job training.
  • Stifles lifesaving biomedical innovation by cutting funding for cancer research, mental health research, and neurological research, and by slashing funding for advanced research projects intended to develop new cures and therapies.
  • Surrenders to ongoing public health crises in mental health, opioid use, HIV/AIDS, and health disparities.
  • Harms women’s health by cutting programs that support maternal and child health, eliminating programs that provide access to health services and contraception, and adding numerous partisan and poison pill riders related to abortion and reproductive health.

 

“When 161 House Republicans voted earlier this year to eliminate all K-12 funding at the Department of Education, I was horrified, but that was just the beginning. Now, in the midst of a teacher shortage, they have introduced a bill that would kick 220,000 teachers from classrooms. We are witnessing a widespread attack on public education that should horrify all of us” Appropriations Committee Ranking Member Rosa DeLauro (D-CT-03) said. “Regardless of age or stage in life, this bill means you cannot count on government for any help.  It limits women’s access to abortion while stripping maternal health services and making diapers more expensive. It decimates access to preschool, education, and job training. People can only hope they do not get cancer or need mental health services—you will not find support from House Republicans. These awful cuts will make it very hard for people and should not even be considered by this committee.”

The 2024 funding bill:

Department of Education (ED) – The bill includes a total of $57.1 billion in discretionary appropriations for ED, a cut of $22.5 billion – 28 percent – below the FY 2023 enacted level. Of this amount:

  • The bill includes $3.7 billion for Title I Grants to Local Educational Agencies, a cut of $14.7 billion below the FY 2023 enacted level. This cut could force a nationwide reduction of 220,000 teachers from classrooms serving low-income students.
  • The bill eliminates funding for English Language Acquisition, a cut of $890 million that would remove vital academic support for 5 million English learners nationwide.
  • The bill eliminates funding for Title II-A (Supporting Effective Instruction State Grants), a cut of $2.2 billion below the enacted level.
  • The bill eliminates funding for Promise Neighborhoods, a cut of $91 million below the enacted level.
  • The bill eliminates funding for Social and Emotional Learning (SEL) grants within the Education Innovation and Research program, a cut of $87 million below the enacted level.
  • The bill eliminates funding for Magnet Schools, a cut of $139 million below the enacted level.
  • The bill includes $100 million forFull-Service Community Schools, a cut of $50 million below the enacted level.
  • The bill fails to provide an increase for the maximum Pell Grant award for the first time since 2012.
  • The bill eliminates funding for Federal Work Study, a cut of $1.2 billion that would eliminate work-based assistance to 660,000 students nationwide
  • The bill eliminates funding for Federal Supplemental Educational Opportunity Grants, a cut of $910 million that would eliminate need-based financial aid for 1.7 million students nationwide
  • The bill includes $1.8 billion for Student Aid Administration, a cut of $265 million below the enacted level.
  • The bill eliminates funding for Teacher Quality Partnerships, a cut of $70 million below the enacted level.
  • The bill eliminates funding for Child Care Access Means Parents in School, a cut of $75 million below the enacted level.
  • The bill eliminates funding for Hawkins Centers of Excellence, a cut of $15 million below the enacted level.
  • The bill eliminates funding for HBCU, TCU, and MSI Research and Development Infrastructure Grants, a cut of $50 million below the enacted level.
  • The bill includes $105 million for theOffice for Civil Rights, a cut of $35 million below the enacted level.

 

Department of Labor (DOL) – The bill includes a total of $9.1 billion in discretionary appropriations for DOL, a cut of $4.7 billion – 34 percent – below the FY 2023 enacted level. Of this amount:

  • The bill eliminates funding for WIOA Adult Job Training state grants, a cut of $886 million that would eliminate job training and employment services for 300,000 adults who face barriers to employment.
  • The bill eliminates funding for WIOA Youth Job Training state grants, a cut of $948 million that would eliminate job training and employment services for 128,000 youth who face barriers to employment.
  • The bill eliminates funding for Job Corps, a cut of $1.8 billion that would eliminate job training and employment services for 50,000 youth who face barriers to employment.
  • The bill eliminates funding for the Senior Community Service Employment Program, a cut of $405 million that would eliminate community service positions for more than 40,000 low-wage seniors.
  • The bill includes $1.4 billion for theWorker Protection Agencies at the Department of Labor, a cut of $313 million below the enacted level, including—
    • $153 million for the Employee Benefits Security Administration, a cut of $38 million below the enacted level
    • $185 million for the Wage and Hour Division, a cut of $75 million below the enacted level
    • $537 million for theOccupational Safety and Health Administration, a cut of $95 million below the enacted level
  • The bill includes $98 million for theOffice of the Solicitor, a cut of $33 million below the enacted level.
  • The bill eliminates funding for theBureau of International Labor Affairs (ILAB), a cut of $116 million below the enacted level.
  • The bill eliminates funding for theWomen’s Bureau, a cut of $23 million below the enacted level (including elimination of the Women in Apprenticeship & Nontraditional Occupations program).

Department of Health and Human Services (HHS) – The bill includes a total of $103.7 billion for HHS, a cut of $17.4 billion – 14 percent – below the FY 2023 enacted level. Of this amount:

  • National Institutes of Health (NIH) – The bill includes a total of $44.6 billion for NIH, a cut of $2.8 billion below enacted level, including:
    • $7.1 billion for the National Cancer Institute (NCI), a cut of $216 million below the enacted level
    • $2.7 billion for the National Institute of Neurological Disorders and Stroke (NINDS), a cut of $139 million below the enacted level
    • $2.2 billion for the National Institute of Mental Health(NIMH), a cut of $139 million below the enacted level
    • $5.1 billion for the National Institute of Allergy and Infectious Diseases (NIAID), a cut of $1.5 billion below the enacted level

 

  • Advanced Research Projects Agency for Health (ARPA-H) – The bill includes $500 million for ARPA-H, a cut of $1 billion below the enacted level.
  • Centers for Disease Control and Prevention (CDC) – The bill includes a total of $7.6 billion for CDC, a cut of 1.6 billion below the enacted level.
    • The bill eliminates funding for Firearm Injury and Mortality Prevention Research, a cut of $12.5 million below the enacted level
    • The bill eliminates funding for Tobacco Prevention and Control, a cut of $247 million below the enacted level
    • The bill eliminates funding for the Ending the HIV Epidemic initiative, a cut of $220 million below the enacted level
    • The bill includes $100 million forPublic Health Infrastructure and Capacity, a cut of $250 million below the enacted level

    • The bill eliminates funding for Title X Family Planning, a cut of $286 million below the enacted level
    • The bill includes $781 million for the Maternal and Child Health Block Grant, a cut of $35 million below the enacted level
    • The bill eliminates funding for Healthy Start, a cut of $145 million below the enacted level

Opening Tuesday’s House subcommittee hearing on the origin of the COVID virus, the panel’s chairman, Rep. Brad Wenstrup (R-Ohio), promised an impartial inquiry.

“This is not an attack on science,” he said. “And it’s not an attack on an individual.”

He and his GOP colleagues proceeded over nearly three hours to accuse Dr. Anthony Fauci, the former director of the National Institute of Allergy and Infectious Diseases — one of the most respected such scientists in the world — of having masterminded the creation of the virus, with the connivance of Dr. Francis Collins, then the director of the National Institutes of Health.

The Republicans’ main “evidence,” such as it is, involves a seminal paper in the scientific study of the virus.

Published as a letter in the journal Nature Medicine on March 17, 2020, under the title “The Proximal Origin of SARS-CoV-2,” the paper weighed the two major theories of COVID’s origin: that it reached the human population from infected wildlife (known as zoonosis) or that it leaked from a government lab in Wuhan, China, the teeming metropolis where the first COVID outbreak occurred in late 2019.

The paper’s authors noted that all the features of SARS-CoV-2, the virus that causes COVID, are observable in nature, coinciding with the zoonosis hypothesis. They added, “we do not believe that any type of laboratory-based scenario is plausible.”

For years, Republicans have asserted without a scintilla of evidence that Fauci and Collins manipulated the scientific consensus away from the lab-leak hypothesis.

Why have they seized on this theory? Its provenance may offer a clue: It flowered during the Trump administration among political appointees in the State Department, who saw it as a cudgel with which to beat the Chinese government, which they viewed as an economic threat to the U.S. It was also useful to undermine the authority of Fauci, whose skepticism about Trump’s COVID policies was manifest.

Soon enough, it became Republican orthodoxy.

Lab leak proponents in government and Congress have smeared and vilified Fauci and Collins, among other scientists, in the service of purely partisan claims, ignoring the utter absence of any scientific evidence for a lab leak and the mounting evidence that it first reached humans through interactions with susceptible animals being sold illegally at a wildlife market in Wuhan.

The foils for this phase of the GOP effort to construct an evidence-free narrative of COVID’s origin were two of the five authors of the “Proximal Origin” paper, Robert F. Garry of Tulane and Kristian G. Andersen of Scripps Research in La Jolla.

Garry and Andersen sat patiently at the witness table in the committee room as the Republican members used cherry-picked quotes from their emails, misrepresented their research findings and ignored their painstaking explanations of how science is done in the real world. They listened stoically to committee members — some of whom have medical degrees but none any evident expertise in scientific research — harangue them about supposed flaws in their scientific methods.

“We do know something for certain,” Westrup said: “that the drafting, coordination and publication of ‘Proximal Origin’ and downplaying the lab leak was antithetical to science. “

One low note among many others during the hearing came from Rep. Ronny Jackson (R-Texas), who charged that “Dr. Anthony Fauci and Francis Collins realized that they had been implicated in the creation of production or the creation of this virus and they were doing everything they could including both of you to come on board as tools or vehicles to undermine that theory.”

Truth to tell, however, the committee majority’s purpose was no secret from the start. The hearing was titled, after all, “Investigating the Proximal Origin of a Cover Up.”

It may be useful to examine the path the subcommittee’s GOP majority traveled to come to its assertions that the Proximal Origin paper was a sham.

As laid out in written testimony submitted to the subcommittee by Garry and Andersen, it started in January 2020, when almost nothing was known about the virus and not much about its genomic family.

The first examinations of its structure revealed several features unfamiliar to virologists. At first glance, they looked like nothing occurring in nature. Many thought this pointed to some sort of laboratory engineering.

When Andersen brought this concern to Fauci during a call on Jan. 31, Fauci urged him to write a scientific paper about the issue, and suggested that if confirmed, the matter should be referred to the FBI and the British intelligence service MI5.

Jeremy Farrar, an infectious disease expert who is currently the chief scientist of the World Health Organization, convened a conference call on Feb. 1 among nine scientists, including Andersen and Garry. Fauci and Collins joined the call, but by all accounts merely listened in without contributing any opinions.

New data came to the scientific community in a torrent over the next few days and weeks. The unfamiliar features turned out to be more common in nature than many virologists had known, and the process by which they might become incorporated in SARS-CoV-2 progressively better understood.

By the end of February, when the authors of the Proximal Origin paper submitted an initial draft to Nature Medicine, they still did not have enough data to rule out either major theory but had become more certain that a laboratory role was plausible.

The subcommittee Republicans profess to be thunderstruck that a theory about COVID’s origin could be posed and discarded in the space of a few days, but Andersen and Garry tried to explain that they’re wrong.

The scientists started with no data, and incorporated new information into their viewpoints as it arrived. In any event, Andersen testified, the period between the conference and the publication of the paper wasn’t three days, as the Republicans kept insisting, but 45 days. Neither Fauci nor Collins played any role in guiding the authors’ conclusions, the witnesses said.

The published paper, moreover, made clear that the state of SARS-CoV-2 research was in its infancy. “More scientific data could swing the balance of evidence to favor one hypothesis over another,” the authors wrote.

But its general conclusion that a lab leak is implausible and the virus probably emerged by natural spillover from animals “has only been further supported by additional evidence and studies,” Andersen told the subcommittee. He and Garry said that if evidence emerged supporting a lab leak, they would examine it objectively and be guided by their findings. As of this moment, there is none.

Under prompting by subcommittee Democrats, the witnesses pointed to the long-term consequences of the Republican efforts to foment mistrust of science by mainstreaming conspiracies.

“Misinformation, disinformation and conspiracy theories around the paper have resulted in significant harassment and threats,” Andersen said. “Including everything from typical targets on social media to emails, to telephone calls to my office … to death threats…. Online there are so-called kill lists and I have found myself on those lists together with my co-authors.”

The thrust of the subcommittee’s claims, he said, “is that the virus was created and that American scientists played a role in that and have been covering that up…. All of which, as the record clearly shows, is false…. The focus has been that there’s a need to blame someone.”

What has been going on here has been nothing less than a partisan witch hunt. Westrup made clear that the Republican narrative was predetermined: “We’re examining any conflicts of interest, biases or suppression of scientific discourse regarding the origins of COVID-19,” he said. The record shows, however, that what occurred was the scientific method in action.

If the subcommittee members are truly devoted to protect Americans from a future pandemic, they couldn’t find a worse way to reach that goal. “If I was a future scientist, looking at the attacks directed at us, for example, maybe I wouldn’t go into infectious disease research…. It’s incredibly damaging,” Anderson said.

Heather Cox Richardson describes the bitter factionalism among Republicans. They are going ever more extreme; the Freedom Caucus expelled Marjorie Taylor Greene for not being extreme enough. They spend their time attacking the military, the FBI, and the CIA. In addition to the time they spend attacking the integrity of elections. The Republican Party has become a wrecking ball for democratic institutions.

For the first time since 1859, the Marine Corps does not have a confirmed commandant. For five months, Senator Tommy Tuberville (R-AL) has held up the confirmation of about 250 Pentagon officers in protest of the Defense Department’s policy of enabling military personnel to travel to obtain abortion care. So when Commandant General David Berger retired today, there was no confirmed commandant to replace him. Assistant Commandant General Eric Smith will serve as the acting commandant until the Senate once again takes up military confirmations.

That a Republican is undermining the military belies the party’s traditional claim to be stronger on military issues than the Democrats. So does the attack of House Republicans on our nation’s key law enforcement entities—the Department of Justice and the Federal Bureau of Investigation—after traditionally insisting their party works to defend “law and order.”

David Smith of The Guardian this weekend noted that those attacks are linked to former president Trump’s increasing legal trouble.

MAGA Republicans are seeking to protect Trump by calling for impeaching President Biden, Secretary of Homeland Security Alejandro Mayorkas, Attorney General Merrick Garland, FBI director Christopher Wray (a Trump appointee), and U.S. attorney for the District of Columbia Matthew Graves, who has prosecuted those who participated in the January 6, 2021, attack on the U.S. Capitol.

The House Judiciary Committee, chaired by Jim Jordan (R-OH), and a subcommittee of the Judiciary Committee, also chaired by Jordan, have been out in front in the attacks on the DOJ and the FBI. The Select Subcommittee on the Weaponization of the Federal Government has been trying to dig up proof that Biden has “weaponized” the DOJ, the FBI, and the Department of Education against Republicans, especially those supporting former president Trump.

They have not turned up any official whistleblowers—the word “whistleblower” in government context means someone whose allegations have been found to be credible by an inspector general, but House Republicans seem to be using the word in a generic sense of someone with complaints—to support the idea that Biden has weaponized the government.

But Trump did. Last summer the New York Times reported that under Trump, the IRS launched a rare and invasive audit of former FBI director James Comey and Comey’s deputy Andrew McCabe, and Trump talked of using the IRS and the DOJ to harass Hillary Clinton, former CIA director John Brennan, and Jeff Bezos, owner of the Washington Post.

On Thursday, a sworn statement from Trump’s former White House chief of staff John F. Kelly confirmed that Trump asked about using the IRS and other agencies to investigate Peter Strzok and Lisa Page, two FBI agents looking into his 2016 campaign’s ties to Russia.

Another investigation has also backfired on the Trump Republicans. The House Ways and Means Committee has highlighted the testimony of Gary Shapley, a “whistleblower” from the Internal Revenue Service claiming that Attorney General Merrick Garland interfered with the investigation into Hunter Biden. Shapley said that Garland denied a request from U.S. attorney David Weiss, who was in charge of the case, to be appointed special counsel, which would officially have made him independent. On June 22 the committee released a transcript of Shapley’s testimony.

Garland promptly denied the allegation, but on June 28, Senator Lindsey Graham (R-SC), the top Republican on the Senate Judiciary Committee, sent a letter to David Weiss, U.S. attorney for Delaware, repeating the allegations. Weiss, a Trump appointee, replied today, saying he never requested special counsel status. Representative Jordan got around this direct contradiction of Shapley’s testimony by lumping Weiss in with those he’s attacking: “Do you trust Biden’s DOJ to tell the truth?” he asked.

And while the radical right has claimed that Biden is on the take for millions of dollars from foreign countries, today the key witness to that allegation was indicted for being a Chinese agent. Also today, LIV Golf, which is funded by Saudi Arabia’s sovereign wealth fund, announced it is moving its $50 million team championship from Saudi Arabia to Trump National Doral in Miami this October.

In May, LIV Golf allied with the nonprofit PGA Tour to create a new for-profit company in May, but today a prominent member of the PGA board, Randall Stephenson, resigned, saying he and most of the rest of the board were not involved in the deal and that he cannot “in good conscience support” it, “particularly in light of the U.S. intelligence report concerning Jamal Khashoggi in 2018.” (The report concluded that Saudi Crown Prince Mohammed bin Salman ordered the killing of Washington Post journalist Khashoggi.) Stephenson had delayed his resignation at the request of the board’s chair while the PGA Tour commissioner was on medical leave.

The Senate’s Permanent Subcommittee on Investigations is scheduled to start hearings on that merger tomorrow, but they are having trouble lining up witnesses who were involved in making the deal, which was achieved in secret negotiations and has infuriated many of the PGA Tour players.

The MAGA attacks on the Biden administration are part of a larger story. Trump supporters are consolidating around the former president and so-called Christian democracy. They are enforcing loyalty so tightly that the far-right House Freedom Caucus recently expelled Representative Marjorie Taylor Greene (R-GA) either because she is too close to House speaker Kevin McCarthy (R-CA) or because she called Representative Lauren Boebert (R-CO) a “little bitch” on the floor of Congress, or both. Like the far-right Southern Baptist Convention, which is hemorrhaging members but which nonetheless recently expelled one of its largest churches for permitting a female pastor, the MAGAs are purging their members for purity.

But their posturing worries Republicans from less safe districts who know such extremism is unpopular. Today, 21 members of the far right in the House wrote a letter to McCarthy saying they would oppose any appropriations bills that did not reject the June debt ceiling deal that kept the U.S. from defaulting on its debts, threatening to shut down the government. They also rejected any further support for Ukraine.

Larry Jacobs, who directs the Center for the Study of Politics and Governance at the University of Minnesota, told The Guardian’s Smith: “Independent voters, who tend to swing US elections that have become so close, don’t buy into the Trump line. You don’t see support for this unhinged view that the justice department and the FBI are somehow corrupt. There’s not support for that except in the fringe of the Republican party. The question, though, is does the fringe of the Republican party have enough leverage, particularly in the House of Representatives, to force impeachment votes and other measures?”

Alex Isenstadt of Politico wrote today that a new group called Win It Back, tied to the right-wing Club for Growth, which has ties to the Koch network, will run anti-Trump ads starting tomorrow. Americans for Prosperity, linked to billionaire Charles Koch, will also run ads opposing Trump.

Meanwhile, President Biden is on his way to Vilnius, Lithuania, for the 74th North Atlantic Treaty Organization (NATO) summit. NATO was formed in 1949 to stand against the Soviet Union, and now it stands against an expanding Russia. Today, NATO secretary general Jens Stoltenberg announced that Turkey has dropped its opposition to Sweden’s NATO membership. Hungary, which had also been a holdout, said earlier this month it would back Sweden’s entry as soon as Turkey did.

This means that the key issues before NATO will be Ukraine’s defense, and climate change, a reality that U.S. politicians can no longer ignore (although MAGA Republicans later this month will start hearings to stop corporations from incorporating environmental, social, and governance (ESG) goals into their future plans). Currently, forty-two million people in the U.S. South are locked in a devastating heat dome, and Vermont and New York are facing catastrophic flash floods.

President Biden told CNN yesterday that he does not support NATO membership for Ukraine while it is at war, noting that since NATO’s security pact means that a war on one automatically includes all, admitting Ukraine would commit U.S. troops to a war with Russia. Instead, NATO members will likely consider continuing significant military support for Ukraine.

Heather Cox Richardson writes about the recent Moms for Liberty convention in Philadelphia, which drew the leading Republican presidential candidates. An unusual feat for an organization founded only two years ago. By contrast, she says, there is a forward movement across the nation, spurred by Biden’s successful economic policies. She writes:

For more than a week now, I have intended to write a deep dive into the right-wing Moms for Liberty group that held their “Joyful Warriors National Summit” in Philadelphia last week, only to have one thing or another that seemed more important push it off another day. This morning it hit me that maybe that’s the story: that the reactionary right that has taken so much of our oxygen for the past year is losing ground to the country’s new forward movement.

Today the jobs report from the Bureau of Labor Statistics pushed ahead of them by showing that the U.S. economy added 209,000 jobs in June. The rate of job growth is slowing but still strong, although the economy showed that the Black unemployment rate, which had been at an all-time low, climbed from 4.7% to 6%. Since Black workers historically are the first to lose their jobs, this is likely a signal that the job market is cooling, which should continue to slow inflation.

In the Washington Post, Jennifer Rubin called out the media outlets so focused on the idea that Biden would mismanage the economy and that recession was imminent that they have ignored “29 consecutive months of job growth, inflation steadily declining, durable goods having been up for three consecutive months, 35,000 new infrastructure projects, an extended period in which real wages exceeded inflation and outsize gains for lower wage-earners.” As reporters focused on the horse-race aspect of politics and how voters “felt” about issues, she noted, “[w]e have seen far too little coverage of the economic transformation in little towns, rural areas and aging metro centers brought about by new investment in plants, infrastructure projects and green energy related to the Chips Act.”

Also of note is that today is Treasury Secretary Janet Yellen’s first day of talks with top Chinese officials in Beijing, where she will also talk to U.S. business leaders. At stake is the Biden administration’s focus on U.S. national security, which includes both limiting China’s access to U.S. technology that has military applications and bringing supply chains home. China interprets these new limitations as an attempt to hurt its economy. Yellen is in Beijing to emphasize that the U.S. hopes to maintain healthy trade with China but, she told Chinese Premier Li Qiang, “The United States will, in certain circumstances, need to pursue targeted actions to protect its national security.”

Meanwhile, China’s faltering economy has led to new rules that exclude foreign companies, leading U.S. businesses to reconsider investments there. Chinese leaders have tried to reassure foreign business leaders that they are welcome in China, while Yellen told U.S business leaders: “I have made clear that the United States does not seek a wholesale separation of our economies. We seek to diversify, not to decouple. A decoupling of the world’s two largest economies would be destabilizing for the global economy, and it would be virtually impossible to undertake.”

The success of Biden’s policies both at home and abroad has pushed the Republican Party into an existential crisis, and that’s where Moms for Liberty fits in. Since the years of the Reagan administration, the Movement Conservatives who wanted to destroy the New Deal state recognized that they only way they could win voters to slash taxes for the wealthy and cut back popular social problems was by whipping up social issues to convince voters that Black Americans, or people of color, or feminists, wanted a handout from the government, undermining America by ushering in “socialism.” The forty years from 1981 to 2021 moved wealth upward dramatically and hollowed out the middle class, creating a disaffected population ripe for an authoritarian figure who promised to return that population to upward mobility by taking revenge on those they now saw as their enemies.

In the past two years, according to a recent working paper by economists David Autor, Arindrajit Dube, and Annie McGrew, Biden’s policies have wiped out a quarter of the inequality built in the previous forty. And at the same time that Biden’s resurrection of the liberal consensus of the years from 1933 to 1980 is illustrating that the economic problems in the country were the fault of Republican policies rather than of marginalized people, the extremism of those angry Republican footsoldiers is revealing that they are not the centrist Americans they have claimed to be.

Moms for Liberty, which bills itself as a group protecting children, organized in 2021 to protest mask mandates in schools, then graduated on to crusade against the teaching of “critical race theory.” That, right there, was a giveaway because that panic was created by then-journalist Christopher Rufo, who has emerged as a leader of the U.S. attack on democracy.

Rufo embraces the illiberal democracy, or Christian democracy, of Hungarian prime minister Viktor Orbán, saying: “It’s time to clean house in America: remove the attorney general, lay siege to the universities, abolish the teachers’ unions, and overturn the school boards.” Radical right activists like Rufo believe they must capture the central institutions of the U.S. and get rid of the tenets of democracy—individual rights, academic freedom, free markets, separation of church and state, equality before the law—in order to save the country.

Because those central democratic values are taught in schools, the far right has focused on attacking schools from kindergartens to universities with the argument that they are places of “liberal indoctrination.” As a Moms for Liberty chapter in Indiana put on its first newspaper: “He alone, who OWNS the youth, GAINS the future.” While this quotation is often used by right-wing Christian groups to warn of what they claim liberal groups do, it is attributed to German dictator Adolf Hitler. Using it boomeranged on the Moms for Liberty group not least because it coincided with the popular “Shiny Happy People” documentary about the far-right religious Duggar family that showed the “grooming” and exploitation of children in that brand of evangelicalism.

Moms for Liberty have pushed for banning books that refer to any aspect of modern democracy they find objectionable, focusing primarily on those with LGBTQ+ content or embrace of minority rights. During the first half of the 2022–2023 school year, PEN America, which advocates for literature, found that 874 unique titles had been challenged, up 28% from the previous six months. The bans were mostly in Texas, Florida, Missouri, Utah, and South Carolina. A study by the Washington Post found that two thirds of book challenges came from individuals who filed 10 or more complaints, with the filers often affiliated with Moms for Liberty or similar groups. And in their quest to make education align with their ideology, the Moms for Liberty have joined forces with far-right extremist groups, including the Proud Boys, the Three Percenters, sovereign citizens groups, and so on, pushing them even further to the right.

Although the Southern Poverty Law Center labeled Moms for Liberty an “extremist group” that spreads “messages of anti-inclusion and hate,” the group appeared to offer to the Republican Party inroads into the all-important “suburban woman” vote, which party leaders interpret as white women (although in fact the 2020 census shows that suburbs are increasingly diverse—in 1990, about 20% of people living in the suburbs were people of color; in 2020 it was 45%).

When Moms for Liberty convened in Philadelphia last week, five candidates for the Republican presidential nomination, including Trump, showed up. Former South Carolina governor Nikki Haley told them: “When they mentioned that this was a terrorist organization, I said, ‘Well then, count me as a mom for liberty because that’s what I am.”

But here’s the crisis for the Republican Party: Leaders who wanted tax cuts and cuts to social programs relied on courting voters with cultural issues, suggesting that their coalition was protecting the United States from radicalism.

But the Republican embrace of Moms for Liberty illustrates dramatically and to a wide audience how radical the party itself has become, threatening to turn away all but its extremist base. A strong majority of Americans oppose book banning: about two thirds of the general population and even 51% of Republicans oppose it, recognizing that it echoes the rise of authoritarians.

As historian Nicole Hemmer points out today for CNN, Moms for Liberty are indeed a new version of “a broader and longstanding reactionary movement centered on restoring traditional hierarchies of race, gender and sexuality” that in the U.S. included the women of the Ku Klux Klan in the 1920s and segregationists who organized as “Restore Our Alienated Rights” (ROAR) in the 1970s. Hemmer observes: “The book bans, the curricula battles, the efforts to fire teachers and disrupt school board meetings—little here is new.”

In the past, a democratic coalition has come together to reject such extremism. If it does so again, the Republican marriage of elites to street fighters will crumble, leaving room for the country to rebuild the relationship between citizens and the government. When a similar realignment happened in the 1930s under Democratic president Franklin Delano Roosevelt, the Republican Party had little choice but to follow.

As part of a “run-of-the-mill” inquiry into possible billing fraud — as officials described their investigation — the attorney general’s office demanded that Vanderbilt University Medical Center hand over a vast array of documents from its clinic for gender-affirming care. According to Tennessee Lookout, a nonprofit journalism site, those documents include, among others:

  • complete medical records for an undisclosed number of patients
  • Resumes of clinic physicians
  • information about the clinic’s Trans Buddy volunteers
  • emails sent to and from a public portal for questions about L.G.B.T.Q. health
  • the names of people referred to the gender-affirming clinic for care

Tell me this isn’t a witch hunt. Tell me this isn’t an open campaign of terror against already vulnerable citizens who had every reason to believe that their medical records — their medical records! — were confidential and every reason to believe that the medical clinic of a major university hospital was a safe space.

During the Juneteenth holiday weekend, Vanderbilt notified patients whose confidential medical records were now in the possession of the state attorney general. The hospital has not detailed which documents it provided the state. When two Tennessee Lookout reporters, Sam Stockard and Anita Wadhwani, asked whether Vanderbilt had complied with every state request in connection with the investigation, a hospital spokesman said, “The short response to your question is no.”

State officials contend that they are investigating only the hospital and certain providers, not the patients they serve, and that all the data they’ve gathered will be kept private. But given the sweeping nature of the documents and the obsessive and relentless way that the Republican supermajority in this state — and in virtually every state governed by a Republican supermajority — has persecuted trans people, it’s impossible to trust such claims…

Though the courts have generally sided with transgender families when these laws have faced legal challenges, the behavior of red-state lawmakers and officials remains in lock step with intimidation campaigns conducted against transgender people by right-wing media figures like the Daily Wire’s Matt Walsh, who staged an anti-trans rally in Nashville last fall

Increasingly, this is exactly what it’s like to live in a red state, and not just for vulnerable minorities. The age at which it is possible to marry, the testing required to drive a car, the conditions under which it is possible to carry a firearm — such matters have always varied a bit from state to state. But this is a whole new reality.

Now that Republican-appointed justices dominate the U.S. Supreme Court, we can’t count on the courts to protect us from the most extreme agendas being enacted in Republican-dominated statehouses. Essential civil liberties that citizens of other states can take for granted are no longer liberties that we in the red states enjoy.

Maybe you can count on being able to make health care decisions yourself, following the advice of your doctor. No such luck here, whether you’re seeking transgender care or the safe end to an unsafe or unwanted pregnancy.

Maybe you’re a physician, trained and board-certified in an area of expertise that exactly zero legislators in your state share. You may be under the impression that your education and experience give you the right to recommend medical treatment for your patients. Not in many places here. Even in the case of life-threatening situations, your hands are tied.

Maybe you feel relatively confident that your children are safe in their schools because you live in a state that has enacted measures to keep firearms out of the hands of dangerous people. My state has done nothing of the kind.

Maybe you are represented in Congress by an elected official whose political positions align with the political positions of a vast majority of people who live in the city they represent. In Nashville, as in other blue cities whose voting districts were determined by a Republican legislature, we don’t.

Maybe classrooms and school libraries in your community offer books and other materials that experienced teachers and librarians have chosen for their excellence and their relevance to children’s lives. In the red states, that’s not something parents can count on, for our school boards are being bullied by a minority of conservative parents, and our Republican legislators believe they know better than education professionals which books students are ready to read.

Maybe the full range of birth control options is now available to you in planning whether, or when, to have a baby. Many anti-abortion activists erroneously define birth control measures like intrauterine devices and the medication known as Plan B as abortifacients. If you live in a state where such groups have the ear of legislators, you’d better start paying attention to what’s happening in your statehouse because these folks are coming for you.

We live in two countries now: one in which basic civil and human rights are recognized and enshrined in law, and another in which ideological extremists can decide how everyone else lives.

Governor Josh Shapiro of Pennsylvania announced that he would drop his support for vouchers in order to pass a state budget. Republicans who control the State Senate want vouchers. Democrats, with a slim majority in the House, are opposed to vouchers.

HARRISBURG — Gov. Josh Shapiro says he plans to scrap his push for private school vouchers in Pennsylvania’s state budget in order to close a deal with the commonwealth’s divided legislature five days after the deadline.

The Democrat issued a statement Wednesday acknowledging that talks had deadlocked over a $100 million voucher program, which he had supported and which state Senate Republicans passed as part of their budget proposal last week. Pennsylvania House Democratic leaders oppose vouchers and had refused to act on the Senate’s bill.

Shapiro’s solution, he said, was to promise state House Democrats that if they pass the Senate’s budget, he will then line-item veto the vouchers from the $45.5 billion spending plan.

“Our Commonwealth should not be plunged into a painful, protracted budget impasse while our communities wait for the help and resources this commonsense budget will deliver,” Shapiro said in a statement.

Spotlight PA had previously reported the existence of Shapiro’s plan to cut vouchers out of the budget deal.

In his statement, Shapiro said that over the weekend, state House Democrats requested a legal memo from his administration that confirmed that any voucher program passed as part of the budget could not be implemented without separate enabling legislation — legislation that House Democrats might be able to block.

“Knowing that the two chambers will not reach consensus at this time to enact [the voucher program], and unwilling to hold up our entire budget process over this issue, I will line-item veto the full $100 million appropriation and it will not be part of this budget bill,” Shapiro said.

In a letter to state Senate Republicans viewed by Spotlight PA, House Majority Leader Matt Bradford (D., Montgomery) wrote Wednesday that his chamber plans to take Shapiro at his word.

“With the Governor’s assurance that he neither has the legal authority nor intention to move forward with [vouchers] at this time, the House will consider [the Senate budget bill] on concurrence later today,” Bradford wrote.

The voucher program would fund private school scholarships for students in low-achieving public school districts.

The deal that included it, which passed the state Senate 29-21 on Friday, included key Democratic priorities like increased education funding, universal free school breakfast, and the commonwealth’s first-ever funding for public legal defense. However, Democrats viewed the vouchers as a poison pill.

When they passed their plan last week, state Senate GOP leaders made it clear that their support was contingent on vouchers being included, with Senate President Pro Tempore Kim Ward (R., Westmoreland) telling reporters that any plan that didn’t include vouchers would have to have “a different number.”

This new maneuver from Shapiro, assuming continued support from state House Democrats, would not require the proposed plan to go back to the Senate, thus circumventing Republicans there. Republican leaders did not immediately return a request for comment.

While Bradford has said House Democrats are on board with Shapiro’s plan, members of the caucus expressed doubts throughout the day Wednesday about any plan that would require them to approve a budget with vouchers and rely on the governor to then eliminate them.

“There’s not a lot of trust amongst [Democratic] members and the administration,” one House Democrat, who requested anonymity to discuss ongoing budget negotiations, told Spotlight PA.

He’s one of the most powerful individuals in the country. His spiderweb of connections is extensive. But most Americans, including many working in Washington, have never heard of him.

Occupying the center of an intricate web of political, legal, religious, and business connections, Leonard Leo is the quintessential Man in the Middle, a veritable dark-money spider. Like a spider, he is patient, painstaking, relentless, and much more powerful that he appears. And like a spider, he prefers to stay hidden.

I first wrote about him in February 2021, in a piece called “Leo the Cancer.” Leo, who I described as “a dandier George Constanza, or if The Penguin worked at Jones Day,” has, I explained,

made himself one of the most powerful figures in the United States. He’s put five—count ‘em, five!—justices on the Supreme Court: Amy Coney Barrett, Brett Kavanaugh, Neil Gorsuch, Sam Alito, and John Roberts. A sixth, Clarence Thomas, is one of his closest friends. And, perhaps most impressively, he quietly led the 2016 crusade to deny Merrick Garland a hearing, when Barack Obama nominated the highly-regarded jurist to replace the late Antonin Scalia (another of Leo’s pals). In the lower courts, he’s been even busier. He’s installed so many judges on so many courts, it makes you wonder if he really is the instrument of God’s will he believes himself to be. I mean, there are only three branches of government. One of those three—arguably the most important one—is Leonard Leo’s domain.

When I began researching that piece, I didn’t know much about the guy beyond his silly, comic-book-villain name. I was surprised to discover that he was, like me, a middle-class product of Catholic upbringing and Italian descent who graduated from a public high school in New Jersey—not at all the well-heeled, oenophilic Master of the Universe he has become. He’s also much younger than I expected; born in 1965, he’s solidly Gen X—only seven years older than Yours Truly.

Yet Leonard Leo, somehow, is the individual most responsible for stripping away federal abortion rights. (The anniversary of the odious Dobbs decision was this past weekend.) As his admiring chum Ed Wheelan presciently wrote in 2016, “No one has been more dedicated to the enterprise of building a Supreme Court that will overturn Roe v. Wade than the Federalist Society’s Leonard Leo.”

As Politico reported—and as I outlined on these pages three months ago—Leo has been rewarded handsomely for his troubles. “I personally don’t believe that Leonard is motivated by greed,” Steven Calabresi, who founded the Federalist Society with Leo and still runs the organization, told Politico. “I think Leonard is motivated by ideology and ideas. I do think he likes to live a high-rolling lifestyle, but I don’t think he’s in the business because of the money.”

To be fair, Leo does spread that money around. He endows more organizations than I can succinctly list here. Friends like Ginni Thomas get a taste. He brings his SCOTUS cronies on lavish fishing trips with his billionaire backers. And yet Payoff Lenny—as I call him—has amassed a fortune for himself, and spends that fortune lavishly: on tailored suits, palatial vacation homes in Maine, and bottles of wine that cost more that what most Americans pay for a month’s rent.

Jesus liked wine, yes, and Jesus hung out with fishermen, sure, but I’m not sure the Son of God would approve of Leo’s stockpile of dirty loot—although his fellow Knights of Malta don’t seem to mind. Money washes away a lot of sins, as anyone familiar with the history of the Catholic Churchwell knows.

And so the rich and powerful Leonard Leo presides spider-like over Washington, moving chess pieces across the great board, raising unfathomably vast sums of money, and cultivating his extensive network, which I have attempted to map out here.

Note: Leo has so many connections that it became unwieldy to confine them to a single dispatch. In today’s installment, I will cover the judges, non-profiteers, lawyers, media members, and titled Europeans. Part Two will focus on the billionaire donors, the politicians, and the religious contacts.

Leonard Leo worshiped at the altar of Scalia, has been close with Thomas for decades and regards him as a sort of godfather, and worked maniacally to secure the confirmations of Roberts and Alito. Thomas and Alito, in particular, he remains tight with, as recent reporting by ProPublica has made clear.

Regarding Alito, the author of the dreadful Dobbs decision: in his 2018 Daily Beast piece on Leo, Jay Michelson points out that “few people had heard of [Alito] before Leo first promoted him.” Alas, we’ve all heard of that sneeringly arrogant dickhead now.

A blog reader who identifies as “Democracy” argues that today’s Republican Party, which prizes individualism over the common good has abandoned the vision of the Founding Fathers.

It appears that Ron DeSantis and the entirety of the Republican Party is in direct opposition to American history and the United States Constitution.

The Founders envisioned a democratic society “in which the common good was the chief end of government.” They agreed with John Locke’s view that the main purpose of government –– the main reason people create government –– is to protect their persons through –– as historian R. Freeman Butts put it –– a social contract that placed “the public good above private desires.” The goal was “a commonwealth, a democratic corporate society in which the common good was the chief end of government.”

The Preamble – the stated purposes – of the Constitution, reads

“We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

In Article I, Section 8 of that document, the legislative branch is given broad, specific powers (among them taxing, borrowing money, regulating commerce, coining money and regulating its value, etc.). Indeed, Article I, Clause 1 gives Congress the power to tax for “the common defence and general Welfare of the United States.” Clause 18 of Section 8 stipulates that Congress had the power “To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers.”

Two Supreme Court decisions early in the republic’s history –– both unanimous –– supported and cemented a broad – liberal – interpretation of the implied powers of Congress.

Republicans call them “socialism.”

In 1819 (McCullough v. Maryland) the Supreme Court reaffirmed that the U.S. government was “a Government of the people. In form and in substance, it emanates from them. Its powers are granted by them, and are to be exercised directly on them, and for their benefit.”

The Court explicitly reaffirmed that one of the critical purposes of government under the U.S. Constitution is to promote the general welfare “of the people.”

In that case, Chief Justice Marshall wrote this about the necessary and proper clause:

“the clause is placed among the powers of Congress, not among the limitations on those powers.” And he added this: “Its terms purport to enlarge, not to diminish, the powers vested in the Government. It purports to be an additional power, not a restriction.”

In Gibbons v. Ogden (1824) Chief Justice Marshall wrote this about the Congressional commerce power:

“This power, like all others vested in Congress, is complete in itself, may be exercised to its utmost extent, and acknowledges no limitations other than are prescribed in the Constitution.”

The history of the United States, and the Constitution, over time, reflect progressive changes. The American Revolution was a progressive movement inspired by the ideas of Enlightenment thinkers; conservatives opposed it. The early expansion of voting rights to those who didn’t own land was progressive, and conservatives of the day fought
against it. The purchase of the Louisiana Territory, a purchase that doubled the size of the fledgling United States, rested on a liberal interpretation of constitutional authority. U.S. government funding of roads and canals relied on a liberal perspective of Congressional commerce power. Those roads and canals were instrumental to economic growth and prosperity, not unlike federal funding of interstate highways, the Internet, medical research, and health care.

And yet, the Republican Party is filled with people who basically reject all of this in favor of sedition.

As David Blight, Yale professor of American history put it,

“Changing demographics and 15 million new voters drawn into the electorate by Obama in 2008 have scared Republicans—now largely the white people’s party—into fearing for their existence. With voter ID laws, reduced polling places and days, voter roll purges, restrictions on mail-in voting, an evisceration of the Voting Rights Act of 1965, and a constant rant about ‘voter fraud’ without evidence, Republicans have soiled our electoral system with undemocratic skullduggery…The Republican Party has become a new kind of Confederacy.

Obviously, public education has a central – critical – role to play here. Here’s how Will and Ariel Durant explained it in ‘The Lessons of History’ (1968):

“Civilization is not inherited; it has to be learned and earned by each generation anew; if the transmission should be interrupted for one century, civilization would die, and we should be savages again.”
