Leonie Haimson watched five hours of a legislative hearing about mayoral control of the NYC public schools. She writes that it was “the best ever” because legislators asked tough questions and did not accept the party line from the Chancellor, who was appointed by the new mayor Eric Adams, who naturally wants mayoral control. Governor Kathy Hochul has proposed a four-year extension of mayoral control.

When Michael Bloomberg was elected in 2001, he said he would take control of the schools and fix everything. The legislature gave him what he wanted.

Mayoral control was passed by the legislature in 2002, at Bloomberg’s request.

NYC has had mayoral control for 20 years, and its problems remain critical. Thus, legislators were in no mood to hear rosy promises.

Haimson wrote:

I’ve testified at countless mayoral control hearings since it was instituted nearly 20 years ago. Yesterday’s joint Senate and Assembly hearings far surpassed any of them. You can watch the video here. Sorry to say there were very few news stories about it, because most of the education reporters were covering the Mayor’s announcement about lifting the mask mandate in schools. It was their loss, since the questioning by legislators was sharp and had a new seriousness about it, and the testimony from parent leaders was passionate and incisive.

In recent years, the opposition to Mayoral control has grown, here in the city and nationwide. As I point out in my testimony, the system has never been popular among average voters. But the evident dysfunctionality of the system and the way it allows autocracy to override the wishes of parents and the needs of children, no matter who is Mayor, is now more widely recognized. Many districts such as Detroit and Newark that once suffered under mayoral control or worse, state control, have returned to an elected school, and Chicago will soon do so.

This was the first time in my experience that influential legislators seem really intent about making improvements to the law. Sen. John Liu, chair of the NYC Education Senate committee, and Sen. Shelley Mayer, chair of the NY State Senate Education Committee, along with Assemblymembers Harvey Epstein and Jo Anne Simon, closely questioned Chancellor Banks about what changes could be made that would ensure that parents have a real voice in the system. Yet he seemed strangely unprepared for their pointed questions.

Chancellor Banks had the chutzpah to claim that the new mayor and he had brought down the COVID positivity rate. Supermen. The legislators weren’t buying it.

Another problem that both Mayor Adams and Chancellor Banks encountered is a glaring contradiction in their rhetoric . Both repeated their now-familiar refrain about how terrible our schools are, especially for Black and brown kids. But of course, if true, this failure persists after twenty years of mayoral control – the very system that they claim is necessary to solve the problem.

Like most states, New York has a limit (a “cap”) on the total number of charters permitted to open in New York State and in New York City. The state cap is 460 charters. The city cap is 242 (included in the state total). The charter lobby has urged an increase in the number allowed, because there is no room for growth. Recently, the State University of New York authorized a new charter high school in NYC, claiming that it was an expansion, not a new charter school. The city and state teachers’ union, along with parents, filed a lawsuit to require the State University of New York to follow state law.

Unions, parents sue SUNY over New York City charter school cap-busting scheme

NEW YORK March 4, 2022 — New York city and state teachers unions, joined by parents, have filed a lawsuit against SUNY and its Charter Schools Institute to block the creation of a new charter high school in New York City that would illegally pierce the state cap on new charters in the city.

The United Federation of Teachers, its state affiliate, New York State United Teachers, and parents allege that SUNY circumvented the clear statutory cap on new charters by authorizing a new Bronx high school, Vertex Partnership Academies, disguised as an expansion of existing charters through a new partnership, Ventoux Partnership Network. That partnership made between Brilla College Preparatory Charter Schools and Public Prep Charter School Academies would funnel students from both networks to the new high school, an agreement designed specifically to evade both the cap and statutory requirements for the creation of new charter schools.

The scheme not only was called out by the State Education Department and Board of Regents in July as clearly violating state law, the lawsuit states that SUNY itself is treating the high school as if it’s a new charter, requiring accountability measures that in SUNY’s own words are “normally reserved for new schools.”

What’s more, Ventoux founder Ian Rowe publicly touts in his biography for the Thomas B. Fordham Institute the creation of “a new network of character-based, International Baccalaureate public charter high schools to open in the Bronx.”

“Put simply, if it looks like a new charter, is held accountable like a new charter, and is structured like a separate and new charter, then it is indeed a new charter and not an expansion,” the lawsuit states.

“This is a clear end run around the charter cap. Once again, the charter sector is acting as if the rules don’t apply to them. We are here to say – you have to follow the law,” said UFT President Michael Mulgrew.

“The SUNY Trustees and their Charter Schools Institute may think this scheme to create new charter schools is clever, but the law is still the law,” NYSUT President Andy Pallotta said. “Those who view the charter cap in New York City as a suggestion instead of a statutory mandate are living in a fantasy land. We look to the courts to give them a reality check.”

“City schools already have struggled enough as these charters siphon resources away from our students,” said Ana Rivera, a plaintiff and mother of a Bronx 12th grader. “Enough is enough. We as parents won’t stand for charters that think they exploit the law and take more from our students.”

As soon as he was elected NYC mayor in 2003, Michael Bloomberg asked the Legislature to give him full control of the schools. The Legislature, wowed by the billionaire mayor with a reputation for business acumen, gave him what he wanted. He promptly renamed the Board of Education, and turned it into the Department of Education, no longer an independent agency but a branch of city government, like the Fire Department or the Department of Sanitation. It’s previous governing board, called the Board of Education for more than 150 years, was dubbed the Panel on Educational Priorities. The PEP had a majority appointed by the mayor, who served at his pleasure. He could fire them at will. Bloomberg used his power to reorganize the entire school system four times, to close scores of schools, especially large high schools, to open hundreds of small schools and charter schools.

The old Board of Education had a public relations department of three people, whose main job was to write press releases. Under Bloomberg’s control, more than 20 people joined the PR department, and they existed to glorify and exalt every action or decision by the mayor and his chancellor.

This authoritarian structure has remained in place for almost 20 years. No mayor wants to give up control of the schools. The schools continue to be plagued with problems, not surprisingly. Mayoral control solved nothing, despite years of extravagant (and illusory) claims about a “New York City miracle.” Academics wrote books about the glories of mayoral control, now forgotten. The “miracle” faded away.

Parent leaders wrote a demand to restore democratic governance, which appeared in the Gotham Gazette.

On Saturday, I went to a matinee of “The Music Man” on Broadway. Before entering, every person had to prove that they were fully vaccinated. Everyone in the audience wore masks.

We are used to that now.

What we are not used to yet is seeing a full Broadway musical, in all its glory, with a huge and very talented cast, wonderful sets and staging, and a large orchestra.

Sutton Foster as Marian the Librarian was excellent, as was Hugh Jackman as Professor Harold Hill.

The audience was ecstatic, applauding everything and everybody, every dance number and song.

Broadway is the beating heart of New York City, and Broadway is back!

The New York State Board of Regents has tried for years to enforce a state law requiring orthodox Jewish religious schools to teach core subjects in English. Yeshiva graduates have complained that their education in Yiddish and Hebrew left them unequipped to function in the modern world.

Despite the state law, a Brooklyn Yeshiva decided to drop the only secular subject taught in eighth grade.

A Hasidic Jewish school in Brooklyn recently notified parents that it will stop teaching secular studies to eighth graders, even though state law requires such classes, according to a new complaint filed by an education advocacy group.

Yeshiva Talmud Torah Ohr Moshe, on the outskirts of Borough Park, sent a letter to parents last month stating that it would replace its middle schoolers’ nonreligious study course with a class on practical laws of the sabbath observance.

The change was made in response to requests from parents, according to the letter in Hebrew obtained by THE CITY.

Before the switch, the school only offered students 45 minutes of secular education per day, according to Yaffed (Young Advocates for Fair Education), the advocacy group that reported the school to city investigators…

The latest complaint from Yaffed to city education officials comes seven years after the group’s initial grievance against close to 40 schools triggered a review by the city Department of Education — an investigation school officials claim is ongoing.

Yaffed and other advocates contend thousands of Hasidic boys get little, if any, basic secular education in religious schools. That includes traditional math, language and science classes.

Some students struggle to speak and read and write English when they graduate from high school, according to accounts from graduates.

Mayors Play Dumb

Mayor Eric Adams has said little lately about the ongoing issue and advocates are urging him to take a more aggressive approach.

The former Brooklyn borough president was endorsed by many Hasidic leaders in the general election for mayor, with some citing his statements supporting them in the face of the drawn-out investigation into their schools.

On the campaign trail, Adams visited an unnamed Brooklyn yeshiva and praised its curriculum.

”I was really impressed by what I saw,” Adams told the Forward last March. “Watching those children understand grammar, understand English, saying they like writing and reading, it was amazing.”

Yes, it is amazing to see children understanding grammar and English when their school instruction is solely in Yiddish or Hebrew.

He noted that the school was among 28 being investigated at the time by city officials but refused to name the school…

In December 2019, the Department of Investigation released a report stating that former Mayor Bill de Blasio had been aware that the investigation was purposely delayed, in part to help him gain support in Albany for an extension of mayoral control of schools.

The report said City Hall engaged in “political horse trading” with state politicians by holding back the yeshiva report in a bid to maintain power over the education system.

Shortly after that, former Schools Chancellor Richard Carranza made public his letter to the state Department of Education explaining what his agency had found: 26 of 28 of the yeshivas named in the original complaint were still not in compliance with state education requirements.

DOE investigators found little or no evidence of secular classes at two of the three high schools they checked since August 2018…

The yeshivas have long pushed back on any meaningful oversight and insist that they are in compliance with state law. At the same time, they’ve argued that education officials should be more concerned with struggling public schools and lobbied elected officials to try to change the law requiring all students to receive a basic secular education.

Why don’t city and state officials require Yeshivas to obey state law and teach their students in English for a meaningful part of the day? Politics. There are a large number of Orthodox Jews of many different sects in New York City and State. They vote as a bloc, and they vote their self-interest. Candidates for city, state, and federal offices court their endorsement.

The Yeshivas receive millions of dollars in state and federal funds. New York Governor Kathy Hochul, who is running for office, added $295 million for non-public schools in her proposed budget. Many more millions pay for using, security guards, and COVID-related costs.

Leonie Haimson, executive director of Class Size Matters and a member of the board of the Network for Public Education, wrote “a short history” of the rise and meteoric fall of Seth Andrews. He founded a no-excuses charter chain called Democracy Prep, which received adulatory praise from the media and millions of dollars in grants from foundations and the federal government. He moved in the top Ed reform circles. He knew all the key players. He was one of them.

After Andrews invited Leonie to tour his charter school, she wrote:

I found him an intriguing character, obsessively throwing a rubber ball against the wall while we walked through the halls of the school, and never taking off his baseball hat though the network had a rigid dress code for students, who were forbidden to wear hats, wear the wrong color socks or the wrong kind of belt.  When we were touring the school, he stopped one student in the hall and berated her for having her Uggs showing. I wondered how long he would last at his own charter school before being suspended or pushed out.  I later learned that his baseball hat was something of a calling card for Seth, and it is even mentioned in the indictment document.

Democracy Prep  is a “no excuses” charter chain, known for its strict disciplinary practices and high attrition rates.  I questioned him about their demerit system which called for keeping students after school for small lapses of behavior, to sit in a room silently, without being able to read or do homework.

But then he was arrested for embezzlement of more than $200,000 from the bank accounts of the charter he founded. His schools were allegedly teaching civic virtue. He is not an exemplar of civic virtue, nor of following the rigid rules he set for his students.

Leonie Haimson assesses Bill de Blasio’s record on education after eight years as Maor of New York City. He succeeded Mayor Michael Bloomberg, who served for 12 years and completely upended the schools, first, by getting the state legislature to give the mayor total control of the city’s public schools, then by closing scores of schools and replacing them with hundreds of small schools and charter schools. De Blasio had served on a local school board and offered the hope of restoring stability and ending Bloomberg’s era of constant disruption. (New York City has a two-term limit for its mayor but Bloomberg persuaded the City Council to make an exception for him and themselves).

She begins:

When he first ran for Mayor, Bill de Blasio portrayed himself as a leader who would make a host of progressive changes in our schools. He promised to be a far different leader than Michael Bloomberg, who had expanded high-stakes testing, proceeded to grade teachers and schools primarily via test scores, closed dozens of public schools displacing thousands of students, and helped charter schools expand in their place.

Bloomberg and his schools chancellors had done all this by ignoring community opposition, and despite any tangible evidence that this was the right way to improve education, particularly for disadvantaged students. Though Bloomberg had promised during his campaign to lower New York City schools’ excessive class sizes, they increased sharply during his administration, and by the time he left office he said he would “double the class size” if he could, and that would be “a good deal for the students.”

De Blasio said he would do things differently: to listen to and be responsive to parent and community concerns, de-emphasize test scores, and focus on improving public schools rather than providing space and funding to help charter schools expand. Instead of closing schools, he pledged to increase equity and strengthen learning conditions, including by lowering class sizes.

And yet his record on each of these issues was decidedly mixed. He did attain his primary goal in education – to provide universal, publicly-funded pre-kindergarten to every four-year-old, but in a manner that could have been better achieved, as will be discussed later.

There were some bright spots in the de Blasio record, including the Community Schools initiative, begun in the fall of 2014, in which schools partnered with community-based organizations to provide after-school programs, mental health supports, and other resources. By 2018, more than 200 community schools had been established. An independent study found that in these schools, there were lower rates of chronic absenteeism, more students graduating on time, and in elementary and middle schools, higher math scores and fewer disciplinary referrals.

This statement by a student was published anonymously at Reddit. He wanted to explain what is happening in his school in regards to COVID. The situation, as he puts it, is “beyond control.” There are many absences, students as well as teachers. There is very little learning going on. The writer makes clear that he hates remote learning, but given the conditions in the school, he thinks remote learning is preferable to no learning.

The article has created quite a buzz. It has thus far received more than 5,000 comments, mostly from other students, reporting on their schools, but also from teachers. Meanwhile, the new Mayor, Eric Adams, assures the public that all is well.

The statement begins like this:

I’d like to preface this by stating that remote learning was absolutely detrimental to the mental health of myself, my friends, and my peers at school. Despite this, the present conditions within schools necessitates a temporary return to remote learning; if not because of public health, then because of learning loss.

A story of my day:

– I arrived at school and promptly went to Study Hall. I knew that some of my teachers would be absent because they had announced it on Google Classroom earlier in the day. At our school there is a board in front of the auditorium with the list of teachers and seating sections for students within study hall: today there were 14 absent teachers 1st period. There are 11 seatable sections within the auditorium … THREE CLASSES sat on the stage. Study hall has become a super spreader event — I’ll get to this in a moment.

– Second period I had another absent teacher. More of the same from 1st period. It was around this time that 25% of kids, including myself, realized that there were no rules being enforced outside of attendance at the start of the period, and that cutting class was ridiculously easy. We left — there was functionally no learning occurring within study hall, and health conditions were safer outside of the auditorium. It was well beyond max capacity.

Some schools are managing very well with in-person learning. Others are not. Schools cannot make up for “learning loss” if there is no instruction going on.

An important point to bear in mind. For everyone, this is an unprecedented time. We are in the midst of a global pandemic. None of us has lived through one before. No one knows what will happen a week or a month or six months from now. We follow the science, protect health and life as best we can, don’t take risks, and hope it ends soon. Odds are COVID will become less virulent, manageable with vaccines, and fade into the long list of diseases from which we must protect ourselves. Maybe next winter, the doctors will remind us to get a flu shot and a COVID shot. Meanwhile, we do the best we can.

To whom it may concern,

BeingblackatKIPP is an Instagram account that was created in the wake of the George Floyd social reckoning. During this time, I was empowered to also seek change in the KIPP network of public charter schools. I had witnessed first hands for many years how white supremacy culture and politics were deeply engrained in this network. I knew from my own experience how policies that aimed to police black and brown bodies and create distrust among the community re-traumatized the very groups of people KIPP claimed to serve.

Once the Instagram page launched the accounts of abuse, racism, and discrimination began to pour in from all corners of the country.

Most recently we have been covering a situation that took place in KIPP NYC. KIPP NYC has a long history of abuse against children that is well known in the alumni community but has received little to no media coverage. Most recently Jesus Concepcion was arrested by the FBI for sexual assault of minors while he was the orchestra teacher under David Levin in the KIPP Academy school in the Bronx. Many previous students alleged that and other leaders knew of Mr. Conceptions’ behavior as he was allowed to have a private bedroom attached to the music room where girls would often be taken to. It has taken 20 years for justice to reach those kids.

Today, in 2021 history is repeating itself in KIPP NYC. This month Cesar Sanchez a decorated science teacher at the KIPP Washington Heights campus was arrested for sexual misconduct towards a minor. What’s most alarming is that Cesar had previously been suspended for misconduct with a student. The principal at his school Danny Swersky had also been suspended for failing to report the misconduct. Both men were allowed to come back to the school where Cesar allegedly continued to groom and abuse middle school girls. On the Instagram page, we have posted voice recordings as well as first-hand written accounts of things Cesar would do to his middle school students. He would notice a child without a bra in a tank top and have the class do jumping jacks as students notice him become visibly “excited”. He would follow students on snap chat, a social platform famous for disappearing messages to further manipulate students in secrecy. He would touch himself in front of students. One student even alleged he asked her if she had her nipples pierced and also showed his nipple tattoo to students. All this was going on, despite other staff allegedly alerting the principal of his behavior. Their concerns fell to deaf ears.

KIPP has a strong clique/mob mentality. Once you are in with leadership you can do no wrong. Cesar was married to another KIPP principal who used to work with his current principal Danny Swersky. The conflict of interest influenced the situation and kept Cesar employed until the police were involved.

Please take time to review the evidence on the beingblackatkipp page on Instagram. This story deserved to be investigated, This community deserves justice and children should not have to be anxious for their return to school. While Cesar has been arrested, the principal who allegedly failed to report him is still set to lead in that school. Our communities deserve better.

Gary Rubinstein, a math teacher at Stuyvesant High School, has no patience for overblown claims. For a few years, he maintained a website devoted to debunking the spurious claims of “miracle schools,” such as those that claimed 100% graduation rates of their seniors but neglected to admit the high attrition that occurred before senior year.

He inevitably had to review the chain called Eagle Academy, which was founded by David Banks, who is Mayor-elect Eric Adams’ choice to be Chancellor of the New York City public schools. The Eagle Academy has six schools, one in each of the city’s five boroughs, and one in Newark.

Gary reviewed public records for the data, and he wondered why none of the city’s media had done what he did.

He writes:

Before Eric Adams was the next mayor of New York City, he was the borough president of Brooklyn. In that capacity, he worked with David Banks to create ‘The Brooklyn Nine’ where Banks would share some of the best practices from Eagle Academy to improve nine schools in Brooklyn. There is a short documentary about Eagle Academy on HBO currently called ‘The Infamous Future’ , similar to Waiting For Superman, made a few years ago in which Eric Adams says that the practices of Eagle Academy should be used in more schools so that they become ‘The Brooklyn 90’ and then ‘The Brooklyn 900′ and eventually the entire school system can replicate the success of Banks’ Eagle Academies. So this gives us some idea of what to expect in the next 4 or 8 years with Adams as Mayor and Banks as Chancellor.
