This important post by Walker Bragman and Alex Kotch documents the Koch money behind the campaign to get schools open, regardless of the risks, and to eliminate mask mandates. The goal of Charles Koch and others on the right was to get the economy back to normal.

The updated CDC guidance signals the Democratic party’s shift from beating the virus to surrendering to it as a fact of life — including in schools. The new approach was likely shaped by a number of factors, including declining COVID numbers, concerns about far-reaching public COVID fatigue, and the fact that many of those now most at risk of severe disease have refused to get vaccinated for non-medical reasons.

But the end of school masking is also in part due to a campaign by right-wing business interests, including the dark money network of oil billionaire Charles Koch, to keep the country open for the sake of maintaining corporate profits. These interests have been meddling in the education debate, first pushing to reopen schools and then fighting in-school safety measures, even as COVID case numbers were rising and children were ending up in hospitals. For nearly two years, these groups have been promoting questionable science and creating wedges between parents, teachers, and administrators in order to get America back to work — even at the risk of the nation’s children.

“Tapping Into The Full Productive Capacity Of The Workforce”

When the pandemic first hit the U.S. in the spring of 2020, Koch-affiliated groups saw an opportunity to reassess American education, moving away from public schools to private and homeschool alternatives. Koch and his brother David, who died in 2019, had spent decades fighting teachers’ unions, pushing school privatization, and attacking state education funding.

On March 13, 2020, Yes Every Kid — a front group founded by the Koch network in 2019 as part of a larger effort to shape K-12 education in the states — launched a #LearnEverywhere campaign promoting remote learning and homeschooling. Three days later, the Cato Institute, a libertarian think tank co-founded and heavilysubsidized by Koch, published a commentary declaring that the U.S. could “tap into” charter, private, and homeschooling “if brick-and-mortar schooling is substantially disrupted.”

The Heritage Foundation, a right-wing nonprofit heavily funded by the Charles Koch Foundation and Charles Koch Institute, also published articles in March 2020 in favor of using public school funds to pay parents to homeschool their kids. Heritage senior policy analyst Jonathan Butcher wrote a policy brief for the Koch-founded-and-funded Mercatus Center, a free-market think tank based at George Mason University, calling to funnel state funds into for-profit charter school companiesproviding virtual learning.

The message was blasted out by other groups in Koch’s orbit, including his flagship political advocacy outfit, Americans For Prosperity (AFP); the Independent Women’s Forum, a dark money group bankrolled by Koch organizations and the heirs to the Walmart fortune; and the State Policy Network, a web of libertarian state-based policy organizations.

But within a few months, the school narrative out of Koch world began to shift, coinciding with growing concerns about labor shortages and changing workplace dynamics caused by nationwide school closures. According to Education Week, a staggering 55.1 million students were impacted by the closures at their peak.

The closures meant a loss of childcare for many parents, which contributed to plummeting labor force participation early in the pandemic. An April 2020 guide to school reopenings from the consultancy McKinsey & Co., whose clients include many of the world’s largest companies, estimated that 27 million Americans were dependent upon childcare in order to work.

“Where a significant proportion of workers rely on schools for childcare, reopening schools (at least for younger children) might be a prerequisite to tapping into the full productive capacity of the workforce,” the report noted.

The tight labor market changed the relationship between employers and their workers, who began demanding moreflexibility and better work-life balance. Companies were forced to respond by raising wages — albeit inadequately — in order to attract workers.

Enterprises like Koch’s were eager to force a return to the old paradigm. These interests had already begun employing the same think tanks and quasi-academic networks they had pioneered a decade before promoting the anti-government Tea Party movement to fuel and legitimize attacks on pandemic safety measures, so they could force a return to normalcy and boost corporate profits.

Now, these interests began to use the same playbook to try to force schools back to normal.

“Keeping Children At Home Might Expose Them To Considerable Risks”

The very groups that had celebrated remote learning as an opportunity for public school alternatives began demanding that schools reopen, citing concerns about learning loss as well as student mental health. These groups downplayed the risks of the virus and slammed teachers’ unions for holding up the return to normalcy.

In May 2020, two months after the World Health Organization declared COVID a global pandemic, the Hoover Institution, a right-wing think tank based at Stanford University that has received substantial backing from Koch over the years, held a virtual conference at which senior fellow Eric Hanushek argued that remote learning was causing learning loss among low-resourced students and damaging “teacher accountability” through the elimination of standardized testing.

The Koch-backed reopening push kicked into high gear after President Donald Trump, facing reelection and a slowing labor market recovery, tweeted in early July 2020, “SCHOOLS MUST OPEN” in the fall.

The Koch-affiliated right-wing think tank American Enterprise Institute (AEI), meanwhile, published a “blueprint” for reopening schools, citing the need to get parents back to work. The State Policy Network and its affiliates also started pushing for school reopening.

Two days after Trump’s tweet, Yes Every Kid published a playbook for reopening schools. Soon after that, Hoover senior fellow Scott Atlas, a radiologist who Trump would soon tap as his senior COVID advisor, called for reopening schools in an interview published that same day. Atlas argued that schools were an “essential business” and that the risk COVID presented to anyone under the age of 18 was incredibly low.

A few days later, the Heritage Foundation joined in, claiming in an online article that in-person learning was possibly “one of the safest activities the nation can restart,” and that “keeping children at home might expose them to considerable risks to their educational progress, their mental health, their nutrition, and alarmingly, even their safety and welfare…”

The drumbeat to return to in-person schooling continued throughout the summer and into the fall. Koch’s flagship group, AFP, put out an online recruiting call for people to reach out to Kansas state legislators and urge them to give school districts and schools the “flexibility” to reopen. A week later, the Mercatus Center published a policy brief warning of “educational scarring” if schools remain closed. Mercatus would later start funding the work of Brown University economics professor and parenting blogger Emily Oster after she began publishing controversial research and articlessupporting school reopenings and downplaying concerns about children and COVID.

On August 12, 2020, the Independent Women’s Forum called on schools to reopen across the country, citing detrimental impacts on student learning and mental well-being. And in October 2020, Hoover’s Center for Research on Education Outcomes released a study estimating that in spring 2020, students lost 57 to 183 days of learning in reading and 136 to 232 days of learning in math.

Big industry groups also fought school closures, including the U.S. Chamber of Commerce, the nation’s premier corporate lobby group. In September 2021, Chamber executive vice president and chief policy officer Neil Bradley said that “we have to have the schools fully reopen” in order to help solve the labor shortage.

“The Dangers Of Masks”

As schools started reopening under the new Democratic administration, Koch-affiliated groups adopted a harder line. In the lead-up to the 2021 state elections, the organizations began opposing in-school mask requirements for students and teachers in addition to closures…

Meanwhile, Koch groups and their affiliates have also quietly worked to support grassroots efforts to end mask mandates.

The Maine Policy Institute put up a petition on its website opposing mask mandates in schools, arguing that “many parents are uncomfortable with their children being required to wear masks in schools” and that “families deserve a choice.” The Federalisthelped promote a lawsuit against Indiana state officials over school mitigation measures brought by parents who erroneously claimed COVID wasn’t infectious in children.

The Koch network also has ties to the shadowy nonprofit Parents Defending Education (PDE). Founded in early 2021, PDE promotes private schooling and combats liberal “indoctrination” in public schools around the country, often by ginning up anger at school boards. The nonprofit’s vice president, Astra Nomani, as well as its director of outreach, Erika Sanzi, have been vocal critics of school mask mandates, and the organization keeps a directory of conservative parents groups that support ending such mandates and other conservative causes….

Please open the link and read the full article. Before reading it, I was unaware of this well-funded, well-coordinated campaign. I was also unaware that the work of Professor Emily Oster at Brown University was funded by the Koch-related Mercatus Institute as well as the Walton Family Foundation, and the Arnold Foundation.

The National Education Policy Center reviewed a report about the relationship between school choice and equity. Basically, equity is an afterthought, not a goal.

Rhetorically, school choice advocates regularly claim that these policies advance equity. Yet a new research report of school choice policies in five geographically and demographically diverse states found that equity has been little more than an afterthought in the development and implementation of these policies.

The study is based on interviews conducted with 58 state policymakers and experts in Colorado, Florida, Louisiana, Michigan, and Oregon. The states were selected with an eye to including a diverse set of geographic, demographic, and school choice policy settings.

Authored by NEPC Fellow Katrina Bulkley of Montclair State University in New Jersey, and by Julie A. Marsh and Laura Mulfinger of the University of Southern California, the report, States Can Play a Stronger Role in Promoting Equity and Access in School Choice, was published in December by the National Center for Research on Education Access and Choice (REACH) at Tulane University in Louisiana.

The researchers found that, rather than equity, lawmakers in the five states emphasized factors such as local control, innovation, efficiency, and parental freedom when designing school choice policies.

These policies have a predictable impact. “A very large number of the charter schools in Colorado serve and explicitly are designed to serve middle-class or even upper middle-class students,” a staff person with the Colorado School Boards Association told the authors of the report.

There are more than a handful who are, for all practical purposes, college prep programs for high-income families. And out of the way we’ve written our laws and the way they’re structured, there’s no reason for them not to do that.

Although the researchers found that state choice policies were neither created with equity in mind nor consistently made more equitable over time, they did suggest several steps that policymakers throughout the United States can take in order to make school choice more accessible, and perhaps therefore more equitable.

  • Accountability: Schools of choice—including charter and voucher schools—should be held accountable for, and incentivized in the direction of, providing high-quality options to historically underserved student populations that too often encounter limited or low-quality school options in or near the neighborhoods where they live.
  • Information: The researchers found that information on schools of choice and school choice policies can be difficult to find and understand. This information needs to be widely available and comprehensible.
  • Enrollment: Burdensome enrollment processes can shut out students from historically underserved groups. States should step in to ensure that this is not the case. The researchers positively highlight a policy in Oregon that financially incentivizes schools of choice to enroll students from underserved populations.
  • Teaching: States should promote teacher quality measures for all schools of choice while also acknowledging the need for teachers who understand culturally relevant pedagogy and other measures designed to serve students from underserved populations.
  • Transportation: Families are often required to provide their own transportation to schools of choice. This can effectively shut out lower-income students whose parents lack the means to help them get to and from school.

These recommendations align with some of those offered in the new book, School’s Choice: How Charter Schools Control Access and Shape Enrollment, by Wagma Mommandi and Kevin Welner. Yet addressing accessibility within school choice systems is best thought of necessary but not sufficient for reaching larger education-equity goals, which must be focused on children’s actual experiences in school as well as the health of the overall system of choice schools and neighborhood public schools.NEPC Resources on School Choice ->

Like most states, New York has a limit (a “cap”) on the total number of charters permitted to open in New York State and in New York City. The state cap is 460 charters. The city cap is 242 (included in the state total). The charter lobby has urged an increase in the number allowed, because there is no room for growth. Recently, the State University of New York authorized a new charter high school in NYC, claiming that it was an expansion, not a new charter school. The city and state teachers’ union, along with parents, filed a lawsuit to require the State University of New York to follow state law.

Unions, parents sue SUNY over New York City charter school cap-busting scheme

NEW YORK March 4, 2022 — New York city and state teachers unions, joined by parents, have filed a lawsuit against SUNY and its Charter Schools Institute to block the creation of a new charter high school in New York City that would illegally pierce the state cap on new charters in the city.

The United Federation of Teachers, its state affiliate, New York State United Teachers, and parents allege that SUNY circumvented the clear statutory cap on new charters by authorizing a new Bronx high school, Vertex Partnership Academies, disguised as an expansion of existing charters through a new partnership, Ventoux Partnership Network. That partnership made between Brilla College Preparatory Charter Schools and Public Prep Charter School Academies would funnel students from both networks to the new high school, an agreement designed specifically to evade both the cap and statutory requirements for the creation of new charter schools.

The scheme not only was called out by the State Education Department and Board of Regents in July as clearly violating state law, the lawsuit states that SUNY itself is treating the high school as if it’s a new charter, requiring accountability measures that in SUNY’s own words are “normally reserved for new schools.”

What’s more, Ventoux founder Ian Rowe publicly touts in his biography for the Thomas B. Fordham Institute the creation of “a new network of character-based, International Baccalaureate public charter high schools to open in the Bronx.”

“Put simply, if it looks like a new charter, is held accountable like a new charter, and is structured like a separate and new charter, then it is indeed a new charter and not an expansion,” the lawsuit states.

“This is a clear end run around the charter cap. Once again, the charter sector is acting as if the rules don’t apply to them. We are here to say – you have to follow the law,” said UFT President Michael Mulgrew.

“The SUNY Trustees and their Charter Schools Institute may think this scheme to create new charter schools is clever, but the law is still the law,” NYSUT President Andy Pallotta said. “Those who view the charter cap in New York City as a suggestion instead of a statutory mandate are living in a fantasy land. We look to the courts to give them a reality check.”

“City schools already have struggled enough as these charters siphon resources away from our students,” said Ana Rivera, a plaintiff and mother of a Bronx 12th grader. “Enough is enough. We as parents won’t stand for charters that think they exploit the law and take more from our students.”

I have always been puzzled by the indifference of state and federal legislators to widespread failure and fraud in the charter sector. The same mystery shrouds the decisions of the billionaires who keep pouring new money into new charters. No matter how many of the charters fail and close their doors, no matter how many of their founders are convicted of embezzlement or padding enrollment, no matter how many are in the state’s list of low-performing schools, the money keeps flowing.

The obvious reason that politicians support charters is because hedge funds and very wealthy donors make sizable campaign contributions. In New York, both Governor Kathy Hochul and NYC Mayor Eric Adams received millions in campaign donations from the charter boosters. We know why free-market zealots like Betsy DeVos and Charles Koch ignore the evidence: They want to privatize education. Why the Wall Street crowd continues to fund failure is a mystery.

A friend in Missouri sent me the previous post about a charter school that was taking in public money despite low academic performance. I asked him why the legislature wanted more charter schools, instead of supporting public schools. It wasn’t rational, I said.

He replied, you have to understand the Missouri legislature, and he sent me the following article. It was written by Stacey Newman, who served in the Missouri legislature for nine years. The picture she paints conjures up thoughts of Mark Twain, H.L. Mencken and Will Rogers. It’s a description of an institution where chaos, dysfunction, and drunkenness are par for the course.

Newman wrote that “dysfunction” was the legislature’s middle name.

As do most voters, I expect legislators to be serious when they take their oath of office. I want to trust they will treat their offices with reverence instead of middle school immaturity — I really do. My first late-night session as a freshman involved debate over a pornography bill. Arguments proceeded way past midnight as I was introduced to #molegafterdark. Coffee cups are allowed on House chamber desks, yet during evening sessions, many of those cups contain alcohol. I was appalled at the drunken debate, remembering how hard I campaigned just to be sitting at one of those desks. Surrounding us were the words carved at the very top of the House chamber: “Liberty, Justice, Law, Progress, Truth, Knowledge, Honor.” Yeah, right.

Hijinks abound every session — particularly as tempers flare between the Republican-controlled state House and Senate. It is routine for both chambers to be at odds as constitutional deadlines loom and members are often campaigning against each other for higher office. Legislators are permitted to carry concealed guns in the Capitol (really) and many pat their pants pockets during high stress debates, reminding everyone who has firepower. One year, I witnessed a screaming near-fistfight of legislators behind my seat as security rushed to intervene. On another late night, I prepared to hide under my desk as an armed inebriated state senator paced our side gallery in intimidation during a contentious House vote on her bill…

Yet we keep hoping for serious people to take over and heed the state motto, “Let the welfare of the people be the supreme law.” It doesn’t say anything about hijinks. There is plenty to do: Fund public schools instead of banning history and attacking teachers; provide access to health care to those who desperately need it and allocate federal relief education dollars, for starters. Accept that masks are not the enemy during a pandemic and that vaccinations, which most elected officials in Jefferson City have received, are lifesaving. Stop with the anti-science hooey left over from the 1692 Salem witch trials. Stop pretending you are aggrieved and, for once, leave your racism and hatred of transgender kids buried at home.

The St. Louis Post-Dispatch published a front-page story about the financial shenanigans associated with a charter school founded by two TFA teachers (one of whom was the son of the former mayor). The school has a large number of uncertified teachers and an uncertified high school principal and boasts of its staff’s lack of credentials. Its teachers have a high attrition rate. And its academic performance is mediocre. The school handbook says that staff must keep all financial records confidential. Nonetheless, the school Hoovers up millions of taxpayer dollars from local, state and federal governments and claims it wants to “proselytize” about its “method.” Whether they mean to spread their “method” of sucking up public funds or producing unimpressive academic results is not clear.

Despite stories like this one, the Republican-led legislature wants to authorize more charters.

ST. LOUIS — The sponsor of Kairos Academies, a charter school in the Marine Villa neighborhood, has raised red flags over the school’s financial and leadership practices involving a shadow group that employs nearly two-thirds of the staff.

The school’s founders created Kairos Academies Vanguard for “charitable and educational purposes” before the school opened three years ago, according to records with the Missouri Secretary of State. The nonprofit has since grown to employ 36 staff members out of 56 who work at the school, including 10 teachers and all administrators.

Kairos has funneled millions of taxpayer dollars to Vanguard for bookkeeping, human resources, student recruitment, special education and other services, all without a contract. While Vanguard staff members work full time at Kairos, are listed in the school directory and share a staff handbook, school leaders say they are exempt from state laws requiring the release of financial information and participation in an educators’ pension fund.

Vanguard qualifies as a quasi-governmental body subject to Missouri Sunshine Law because its primary purpose is to contract with a taxpayer-funded school, said St. Louis lawyer Elad Gross.

“Schemes like this one to spin off a nonprofit organization are trying to do what a lot of corporations do,” Gross said. “Folks are using those same Wall Street-type practices to avoid liability and public transparency.”

In a “letter of concern” sent this month, the Missouri Charter Public School Commission that sponsors Kairos outlined a 13-point correction plan for the school to complete by March 31. The plan calls for an approved contract with Vanguard, separate audits of the school and the nonprofit, and legal oversight and training on open records laws.

Kairos violated Missouri regulations by not following policies regarding its relationship with Vanguard including approval from its sponsor, according to Robbyn Wahby, the charter school commission’s executive director.

“These requirements exist to ensure that public funds for the education of Missouri students are managed transparently and appropriately,” Wahby wrote in the Feb. 4 letter.

After receiving Wahby’s letter, Kairos set up a mailbox for Vanguard at a coworking space across the street from the school on south Jefferson Avenue. The Kairos board held a special meeting Wednesday to approve a temporary contract through March that pays Vanguard $282,480 per month. Clayton lawyer Hugh Eastwood serves as president of the board of both organizations.

The charter commission “is demanding that the school have a detailed contract with Vanguard so that the commission and taxpayers will know how public funds are used” by the March 31 deadline, Wahby said. “We are pleased that Kairos Academies’ board agrees with our findings and is working to put in place the remedies we are requiring of them.”

$3.3 million

Kairos Academies opened in fall of 2019 led by CEO Gavin Schiffres and chief strategy officer Jack Krewson, son of then-mayor Lyda Krewson. The founders were both 25 at the time and graduates of the two-year Teach for America program. The education reform group Opportunity Trust contributed more than $300,000 in startup costs and continues to provide annual grants.

Kairos now enrolls about 400 students in fifth through eighth grades and will start a high school with ninth graders in the fall. Last spring, 35% of students tested proficient in English and 33% in math on state standardized tests. Only eight current staff members, including Krewson and Schiffres, were with the school when it opened in fall of 2019, according to the school directory.

Schiffres said Vanguard was formed with the “idea of creating a vehicle where we could take what we learned and potentially bring it to other regions, take the Kairos method and proselytize that.”

Charter schools are publicly funded and independently operated. Under Missouri law, charter school employees are required to participate in the Public School Retirement System of the City of St. Louis. Kairos pays 15% of the salaries of 20 teachers into the retirement fund, according to an audit of fiscal year 2021 by St. Louis accounting firm KEB.

The school’s administrators, plus Spanish, art and special education teachers, the principal and head of athletics and secretarial staff are considered contractors who are exempt from the fund. Those 36 employees can receive up to a 3% match for a separate retirement fund, according to the Kairos staff handbook.

The audit of Kairos included Vanguard as an affiliate because “the entities are commonly managed.” It shows the two organizations combined received $3.3 million in local, state and federal tax revenue in fiscal 2021.

No certification

A review of state and school records shows other examples of Kairos operating like a private organization:

• Eight teachers including three English teachers have no Missouri teaching certificates. An additional seven have substitute certificates, according to the Missouri Department of Elementary and Secondary Education. Nilesh Patel, who is slated to lead Kairos’ high school this fall, has no state certification. The Kairos community handbook reads, “Please assume that your child’s teachers are not certified to teach in their assigned grade level or subject. Although most are, Kairos takes cues from the best private schools around the country and recruits talent with diverse, real-world experience.”

• Like traditional public schools, charter schools are not allowed to discriminate in admissions. The Kairos staff handbook suggests that family income can play a role. “Enrolling another low-income student will make it harder to get the high academic results my team is striving for … disadvantaged students tend to come in below grade level,” the handbook describes as a hypothetical admissions decision. “On the other hand, our Finance Team understands the economic value associated with any student: they’re ‘customers’ the state pays us to educate.”

• Kairos received $163,000 in 2020 through the U.S. Small Business Administration’s Paycheck Protection Program. The school also anticipates receiving about $2 million in coronavirus relief for public schools from the U.S. Department of Education, according to its records.

• The Kairos handbook says staff must keep financial information, vendor contracts and curriculum confidential.

Do it the Kairos way!

The Georgia branch of Betsy DeVos’ American Federation for Children made a mass mailing to voters in Republican districts urging them to fight against the “radical left” agenda of President Biden, Kamala Harris, and Stacey Abrams, which denies school choice.

It backfired.

A national advocacy group promoting school vouchers bombarded conservative Georgia voters with glossy mailers tying Republican state legislators from their districts to Stacey Abrams and other “radical left” figures. It backfired in spectacular fashion.

Just days after the American Federation for Children financed the mailers in at least 16 Republican-controlled legislative districts, House Speaker David Ralston told The Atlanta Journal-Constitution that the voucher proposal the group sought to pass is dead for the year.

“I am livid. I’ve been around politics for a long time, but this is the dumbest thing I’ve ever seen in my career, and one of the most deceitful,” Ralston said. “These are people we have tried to help over the years, and they turned to attack us very viciously.”

Ralston added: “That voucher legislation will not move at all in the Georgia House of Representatives this year, period.”

The mailers were sent by the Washington-based group to back proposals that would give public school students what it calls “Promise Scholarships,” a state subsidy of about $6,000 a year to help cover private school tuition.

The measures had gained early traction in House committees…

The aggressive strategy was meant to pressure legislators to end a yearslong feud over public funding of private education in Georgia. Instead, the Capitol’s halls buzzed Tuesday with incredulous GOP lawmakers infuriated by the group’s approach.

“It’s very disappointing that this group is targeting lawmakers in the middle of the deliberative process,” said state Rep.

Pastors for Texas Children have worked with a bipartisan coalition to support public schools and stop privatization. Rural Republicans have been an important part of the coalition that has repeatedly stopped voucher legislation and slowed charters.

Candidates that support Texas public schools celebrated significant victories in the Republican primary last night. On the eve of Texas Independence Day, these incumbents declared their independence from the deep pockets of right-wing extremists that are trying to destroy your neighborhood schools. We congratulate those candidates: Stan Lambert, Ken King, David Spiller, Gary VanDeaver, Travis Clardy, Reggie Smith, Ernest Bailes, Giovanni Capriglione.

“Yesterday’s primary elections proved decisively, in the reelection of pro-public education incumbents, that Texans overwhelmingly support their neighborhood and community public schools – and oppose the privatization of them through vouchers and charters,” said Reverend Charles Foster Johnson, founder and Executive Director of Pastors for Children. “These House seats cannot be bought by a couple of right-wing billionaires, no matter how many millions they put up.”

Pastors For Children will continue the fight in the upcoming May runoffs and launch an unprecedented pro-public education campaign for the November General Election.

Pastors For Children stands firm for the belief that there is a moral obligation before God to educate every school kid in Texas. Jennifer Berkshire, expert education journalist and co-author of A Wolf at the Schoolhouse Door, writes in The Nation about the forces driving teachers out of the schools.

She interviewed many teachers who explained why they were leaving. Some cited ”the bad teacher” narrative promulgated by Arne Duncan and his insistence that teachers be evaluated, based on their students’ test scores, which is both ineffective and inaccurate. His and Obama’s “Race to the Top” was deeply demoralizing to teachers, and it accomplished nothing positive.

She begins:

Neal Patel survived teaching in the pandemic. It was the culture wars that did him in.

In the fall of 2020, Patel added two flags to the wall of his science classroom in Johnston, Iowa. Now, alongside images of energy waves and the electromagnetic spectrum were the Gay Pride rainbow flag and a proclamation that Black Lives Matter. The flags, says Patel, represented the kind of inclusive space he was committed to creating, sending a signal to all students that even in this conservative suburb of Des Moines, there was a place for them.

School administrators supported him—on one condition. “They’re just there as decoration,” Patel says. “The only time I discuss the flags is when a student asks me about them.”

Patel assumes it was a student who snapped a picture of the display. Somehow it ended up on the Facebook page of a conservative state legislator. Representative Steve Holt, who lives 100 miles from Johnston, pointed to the flags as evidence of creeping left-wing indoctrination in Iowa’s schools and encouraged his constituents to take a stand. Patel says he was shocked by the attention, then upset: “Holt thinks it’s a political issue to try to create an inclusive environment, and he’s using that to try to further divide our community.”Johnston has grown only more divided since Patel became Facebook fodder. At a school board meeting last fall, members debated whether to ban two books on race, including one by the Native American writer Sherman Alexie, after parents complained. The president of the Iowa State Senate, who represents a neighboring county, took the mic during the public comment period, calling for teachers who assigned “obscene” material to be prosecuted. Patel was in the crowd that night, to lend support to minority and LGBTQ students who’d come to speak out against banning the books. And he had an announcement of his own to make: This year would be his last as a teacher in Johnston.

The Obama administration made matters much worse for teachers when it imposed test-based evaluation as the heart of its “reforms.”

The thinking went something like this: Make teacher evaluations tougher, and teaching would get better, which would mean higher student achievement, more students graduating from college, and ultimately a country better able to outsmart China et al. “Tougher” meant holding teachers accountable for how their students fared on standardized tests…

In 2010, Colorado became one of the first states to enact a high-stakes teacher evaluation law; by 2017, nearly every state had one on the books. While the pandemic may have disrupted everything about schooling, policies like Colorado’s Senate Bill 10, with its 18-page evaluation rubric and 345-page user guide aimed at weeding out bad teachers, remain in place.

For Shannon Peterson, an English language acquisition teacher in Aurora, that meant leading her students through a writing exercise last fall as her principal observed. Peterson’s students, many of them immigrants who live in poverty, bore the pandemic heavily, she says: “The kids are stressed, all of their writing is about anxiety, and attendance is way down.”

To her delight, the students responded enthusiastically to the writing prompt she’d come up with: comparing and contrasting the Harlem Renaissance and Black Lives Matter, and how the entertainment industries in their respective eras related to both. In a year of stress and struggle for teachers and students alike, here was something to celebrate. “Excellent writing came out of this,” Peterson says.

Her principal wasn’t convinced. Peterson, he felt, hadn’t done enough actual teaching during the observation. “I just don’t feel comfortable checking off these boxes,” he told her.

The previous year, when the cash-strapped school district had offered teachers buyouts to leave, Peterson turned it down: “I felt an enormous obligation to go back for the kids and my colleagues.” After her evaluation, though, Peterson had reached a breaking point. She quit a week later, walking away from a career that spanned 23 years, 18½ of them in Aurora. “I’m not a box,” Peterson says.

Two weeks after Peterson resigned, a major study came out: The decade-long push to weed out bad teachers had come to naught. The billions of dollars spent, the wars with teachers’ unions, and the collapse in teacher morale had produced “null effects” on student test scores and educational attainment.

It is a mystery of our times why so many billionaires have assumed the power to meddle in education. Gates, Waltons, Bloomberg, Koch, DeVos, Rock, and many more like to play the role of education minister. I have an almost complete list of the billionaires who dabble in education in my book “Slaying Goliath.” I say “almost” because after the book was published, I found more billionaires who were messing up schools, like Tim Dunn in Texas and the Albertsons in Idaho. I am sure I missed others.

The Charles Koch Foundation announced that it is funding a competition for “new models” of education.

He explains here why standardized testing today is neither valid nor reliable.

He begins:

The dirty secret of the standardized testing industry is the breathtakingly low quality of the tests themselves. I worked in the educational publishing industry at very high levels for more than twenty years. I have produced materials for all the major textbook publishers and most of the standardized test publishers, and I know from experience that quality control processes in the standardized testing industry have dropped to such low levels that the tests, these days, are typically extraordinarily sloppy and neither reliable nor valid. They typically have not been subjected to anything like the validation and standardization procedures used, in the past, with intelligence tests, the Iowa Test of Basic Skills, and so on. The mathematics tests are marginally better than are the tests in ELA, US History, and Science, but they are not great. The tests in English Language Arts are truly appalling…

The Common Core tests, he says, are especially useless.

They are almost entirely content free. They don’t assess what students ought to know. Instead, they test, supposedly, a lot of abstract “skills”–the stuff on the Gates/Coleman Common [sic] Core [sic] bullet list, but as we shall see below, they don’t even do that.
