DeVos’ world gets stranger by the day.

After hearing from rape victims, DeVos and her top civil rights official have decided to champion the rights of those accused of raping the women.

The New York Times calls this “a new look” at the issue of campus rape.

Indeed.

The letters have come in to her office by the hundreds, heartfelt missives from college students, mostly men, who had been accused of rape or sexual assault. Some had lost scholarships. Some had been expelled. A mother stumbled upon her son trying to take his own life, recalled Candice E. Jackson, the top civil rights official at the Department of Education.

“Listening to her talk about walking in and finding him in the middle of trying to kill himself because his life and his future were gone, and he was forever branded a rapist — that’s haunting,” said Ms. Jackson, describing a meeting with the mother of a young man who had been accused of sexual assault three months after his first sexual encounter.

The young man, who maintained he was innocent, had hoped to become a doctor.

In recent years, on campus after campus, from the University of Virginia to Columbia University, from Duke to Stanford, higher education has been roiled by high-profile cases of sexual assault accusations. Now Education Secretary Betsy DeVos is stepping into that maelstrom. On Thursday, she will meet in private with women who say they were assaulted, accused students and their families, advocates for both sides and higher education officials, the first step in a contentious effort to re-examine policies of President Barack Obama, who made expansive use of his powers to investigate the way universities and colleges handle sexual violence.

How university and college administrations have dealt with campus sexual misconduct charges has become one of the most volatile issues in higher education, with many women saying higher education leaders have not taken their trauma seriously. But the Obama administration’s response sparked a backlash, not just from the accused and their families but from well-regarded law school professors who say new rules went too far.

In an interview previewing her plans, Ms. Jackson, who heads the Education Department’s Office for Civil Rights and organized Thursday’s sessions, made clear that she believes investigations under the 1972 law known as Title IX have gone deeply awry. A sexual assault survivor herself, she said she sees “a red flag that something’s not quite right” — and that the rights of accused students have too often been ignored.

The alleged perpetrators of rape, it seems to Candace Jackson, are the real victims.

What a strange new mission for the Office for Civil Rights.

This article is an excellent analysis by civil rights lawyer Wendy Lecker of the deliberate destruction of public education in black and Latino neighborhoods in Chicago.

Chicago has purposely sacrificed the needs of black and Latino students while protecting and enhancing the needs of white students. We have to bear in mind what Rahm Emanuel told CTU leader Karen Lewis when he was first elected: about a quarter of these kids are uneducable. Everything else flows from that assumption.

“Chicago is this nation’s third largest city, and among its most segregated. Recently, several unrelated reports were released about education policy in Chicago that, together, provide a vivid picture of the divergent views policymakers of have of public education; depending on who is served.
As reported by researchers at Roosevelt University, between 2009-2015, Chicago permanently closed 125 neighborhood schools, ostensibly because of low enrollment or poor performance.

“The standard Chicago used for low enrollment was 30 students to one elementary classroom — an excessively large class size, especially for disadvantaged children.

“The school closures occurred disproportionately in neighborhoods serving African-American, Latino and economically disadvantaged students. Professors Jin Lee and Christopher Lubienski found that Chicago’s school closures had a markedly negative effect on accessibility to educational opportunities for these vulnerable populations. Students had to travel longer distances to new schools; often through more dangerous areas.

“School closures harm entire communities. As Georgia State Law Professor Courtney Anderson found, where neighborhood schools were a hub for community activities, vacant schools become magnets for illegal activity. Moreover, buildings in disuse pose health and environmental dangers to the community. Vacant buildings depress the value of homes and businesses around them, increase insurance premiums and insurance policy cancellations. In addition, the school district must pay for maintenance of vacant buildings.

“Although Chicago claimed to close schools to save money, the savings were minimal — at great cost to the communities affected.

“At the same time Chicago leaders closed 125 neighborhood schools, they opened 41 selective public schools and 108 charter schools; more than they closed. Chicago charter schools underserve English Language Learners and students with disabilities, and have suspension and expulsion rates ten times greater than Chicago’s public schools. Even more astounding, despite the self-selecting and exclusive nature of charters, researcher Myron Orfield found that Chicago’s public schools outperform charters on standardized test passing and growth rates in both reading and math, and high school graduation rates.

“The Roosevelt University researchers found that the expansion of Chicago charter schools devastated the public school budget, contributing to massive cuts of basic educational resources in Chicago’s public schools. Moreover, many of these new charters have remained open despite falling below the “ideal enrollment” standard used to close neighborhood public schools.

“The education policies of Chicago’s leaders force its poor children and children of color to attend under-resourced schools, often at a great distance from their neighborhoods, on a pretext of under-enrollment and poor performance. Officials fail to consider the devastating effects school closures have on educational opportunities or on the health of entire communities.

“Chicago promised to use the proceeds of the sales of vacant schools to improve those neighborhoods. Yet, city leaders instead used those funds for school capital projects. A WBEZ investigation found that Chicago’s new school construction and additions disproportionately benefit schools that serve white, middle class students, even though white students are far less likely to suffer overcrowded schools than Latino students, whose schools do not see the benefit of capital spending.”

“On this 4th of July, when we celebrate America’s freedoms, it’s a perfect time to discuss our free public schools, and where we are with them when it comes to school reform. It’s important to understand that our public schools have a new threat, as I will explain below.

“Public schools, with all their faults, are the only truly democratic institution we own “together” as a country. Our public schools open their doors to all children.

“Teachers take on the challenge of working with the oppressed, the poor, immigrants, and even those with the most severe disabilities. Collectively, such care of our children will lead to the greater good of our country and the world.

“Local school boards, elected by the people, give all of us a voice as to how our schools are run. This is a democratic process threatened with extinction because of school privatization forces.

“If you don’t like what your public school is doing, you can go to the school board meeting and make your voice heard. If you don’t know how to help your public schools, you can sign up to be a volunteer.

“A public school not only reflects the community that surrounds it, it is an anchor to bring people together.

“Efforts for us to hold onto our public schools are in jeopardy today, and they have been in jeopardy for many years. Business has staked a claim on our public schools. There’s money to be made using our tax dollars.”

Mike Klonsky reports that most schools in Chicago are violating the right of English language learners to mandated services they need.

The worst violators, naturally, were charter schools.

Fifteen were run by the UNO Network of Charter Schools; nine were run by the Noble Network of Charter Schools. (One of the Noble Network schools is named for its patron, Governor Bruce Rauner.)

In 2009, U.S. District Judge Charles Kocoras lifted the consent decree ending three decades of efforts to integrate Chicago schools. The decree’s bilingual education provisions, according to Kocoras, duplicated protections in state law. The ruling came despite evidence presented by DOJ lawyers in court that the district repeatedly failed to enroll English learners in bilingual education fast enough or provide them with required services.

I would be remiss if I failed to point out once again, that it was former schools CEO Arne Duncan who successfully pushed Judge Kocoras to abandon the consent decree. Thousands of the district’s English language learners and their families are still paying the price.

The key job in the federal government in terms of civil rights enforcement is the leader of the Civil Rights Division of the Justice Department. Trump has selected Eric Dreiband, who has represented numerous clients accused of violating civil rights laws. Activists are outraged.

The selection of Dreiband is in keeping with the selection of Betsy DeVos, an opponent of public education; the selection of Scott Pruitt, who sued the Environmental Protection Agency many times, to lead it; and the section of others who are antagonistic to the mission of the agency they head.

Eric Dreiband, a former George W. Bush administration official, represented R.J. Reynolds Tobacco Company in an age discrimination case and Bloomberg in a pregnany discrimination case as a partner at the law firm Jones Day. On Thursday, Trump tapped him to lead the division that handles voting rights, policing and discrimination cases.

Vanita Gupta, head of the Leadership Conference on Civil and Human Rights and a former leader of the civil rights division under President Barack Obama, said Dreiband’s past work showed he was not up for the job.

“Whoever leads the ‘crown jewel’ of the Justice Department must have deep relationships with stakeholders and marginalized communities, and have a deep, abiding faith in our nation’s civil rights laws,” Gupta said. “They must respect the laws that touch everyone, rights that people have literally died for. They must respect the role of what has been called the conscience of the federal government. In all those regards, Eric Dreiband is woefully unqualified to lead the Civil Rights Division.”

Corporate privatizers like Betsy DeVos, Donald Trump, Arne Duncan, and Peter Cunningham (previously Duncan’s communications director, now editor of the billionaire-funded Education Post) claim that turning public money over to operators of privately-managed contract schools (aka, “charter” schools) is the “civil rights issue of our time.”

But the authentic voice of the civil rights movement–the NAACP–does not agree. Last summer, the national convention of the NAACP passed a resolution calling for a moratorium on new charter schools until important issues of accountability were addressed and corrected. Despite a concerted effort to persuade the national board of the NAACP to repudiate the resolution, despite critical editorials in the New York Times and the Washington Post, the Board upheld the resolution at its meeting last October.

Since passing and confirming the resolution, the nation’s oldest civil rights group decided to hold hearings across the country. What they learned convinced them to stand by their demand for charter accountability. Even those whose own children are enrolled in charters stuck by the resolution.

Rebecca Klein, education editor at Huffington Post, writes:

“Next month the NAACP will release a report detailing what the task force found. HuffPost, through conversations with several task force leaders, received a glimpse into what these findings might look like.

“After spending time in seven cities, NAACP Task Force on Quality Education chair Alice Huffman says she is more convinced than ever that the call for a moratorium was the correct decision. The election of Trump, and his subsequent appointment of Education Secretary Betsy DeVos, has given the issue specific urgency. DeVos, a notorious champion of school choice, would like to see more charter schools, and her department’s proposed budget has put funding behind them.

“Nobody is convinced … after going all across the country, that the moratorium was wrong,” said Alice Huffman, president of the California NAACP. “My mind wasn’t as made up as it is now.”

Advocates of privatization continue to defend charters, even though they are more segregated than public schools and have higher suspension rates. Supporters of the privatized schools deny that they cherrypick students and point to small test score gains.

I am very impressed that the NAACP did not succumb to the big-money behind the privatization movement. That shows their genuine commitment to the children and families for whom they fight.

This is great news for those who have been calling attention to the corporate reform assault on public schools. We couldn’t gain attention when Obama and Duncan were promoting privatization and bashing teachers. But Betsy DeVos stripped away the pretense of “the civil rights issue of our time.” All you have to do is look at the patented billionaire smirk, listen to her prattle about public schools as a “dead end,” and look at the fringe right groups she hangs out with, like ALEC. At last, the Democrats are beginning to get it. The privatization pushers in the Democratic Party will have to explain why they are in step with DeVos’s policy agenda.

Before DeVos, the Network for Public Education had 22,000 members. Now it has more than 350,000 and is growing.

DEVOS BECOMES DIGITAL LIGHTNING ROD FOR DEMOCRATS: First it was Karl Rove. Then it was the Koch brothers. Now, Education Secretary Betsy DeVos has taken over as Senate Democrats’ top online bogeyman. POLITICO’s Maggie Severns reports that anti-DeVos statements, petitions and especially fundraising emails have become a staple of Democratic digital campaigns in 2017. Emails citing DeVos are raising money at a faster clip than others and driving engagement from supporters.

– Some examples: Indiana Sen. Joe Donnelly’s Facebook post announcing opposition to DeVos’ nomination as Education secretary was the first sign for some Democratic observers that DeVos had political traction. Donnelly and his fellow Democratic senators up for reelection in 2018 have seized on that energy with a salvo of emails soliciting small-dollar online donations.

– DeVos played foil for Montana Sen. Jon Tester when he solicited donations in May for himself and Rob Quist, the Democrat who was defeated in a special election for Montana’s at-large House seat. DeVos’ family “is spending big to influence tomorrow’s election,” Tester wrote in one email after the DeVoses donated to Greg Gianforte’s campaign.

-“For a lot of people, Betsy DeVos has really come to be a symbol of everything that’s wrong with Trump’s approach to government,” said Stephanie Grasmick, a partner at the Democratic digital consulting firm Rising Tide Interactive. DeVos is a prime example of Rising Tide’s new use of “social listening tools,” adopted for this election cycle, that monitor the web for trends. The technology is used by corporations but has yet to be fully embraced by political campaigns.

Betsy DeVos will scale back civil rights enforcement by the Department of Education’s Office of Civil Rights because they take too much time.

“The Department of Education is scaling back investigations into civil rights violations at the nation’s public schools and universities, easing off mandates imposed by the Obama administration that the new leadership says have bogged down the agency.

“According to an internal memo issued by Candice E. Jackson, the acting head of the department’s office for civil rights, requirements that investigators broaden their inquiries to identify systemic issues and whole classes of victims will be scaled back. Also, regional offices will no longer be required to alert department officials in Washington of all highly sensitive complaints on issues such as the disproportionate disciplining of minority students and the mishandling of sexual assaults on college campuses.

“The new directives are the first steps taken under Education Secretary Betsy DeVos to reshape her agency’s approach to civil rights enforcement, which was bolstered while President Barack Obama was in office. The efforts during Mr. Obama’s administration resulted in far-reaching investigations and resolutions that required schools and colleges to overhaul policies addressing a number of civil rights concerns.

“That approach sent complaints soaring, and the civil rights office found itself understaffed and struggling to meet the department’s stated goal of closing cases within 180 days.
The office’s processing times have “skyrocketed,” the Education Department spokeswoman, Liz Hill, said, adding that its backlog of cases has “exploded.” The new guidelines were to ensure that “every individual complainant gets the care and attention they deserve,” she said.”

Of course, the ED has $1 million a month for DeVos’s Security detail. Money well-spent, in her eyes.

Reverend William Barber, the nation’s most eminent civil rights leader at this time, has been barred from entering the Legislative building in North Carolina.

Reverend Barber, the president of the state NAACP, has led the Moral Monday’s protests at the Capitol, where thousands of protestors meet in front of the statehouse, listen to his impassioned speech defending civil rights and liberties, then call upon their legislators.

His lawyer will fight the ban as infringement of his constitutional right to speak and assemble.

The New York Times recently featured Rev. Barber as a new breed of religious leaders, fervent about social justice.

William Mathis describes Trump’s education budget as a demonstration of Doublespeak, meant to mask its indifference to children.

He writes:

“In 1965, the federal government, driven by the obligation to provide equal opportunities to the least fortunate of our citizens, passed the Elementary and Secondary Education Act. It was intended to lift the nation by strengthening our poorest children and schools, improving the quality of teaching, opening the doors of higher education, and providing skills to adults. It embraced the ideal voiced by the late President Kennedy that “a rising tide lifts all boats.” And the emphasis was on building the common good. By widely investing in our citizens, we invest in the health of our society and economy.

“Those principles have found no refuge in the work of President Donald Trump and Education Secretary Betsy DeVos; all that remains of these great purposes are a confusion of empty words made to appear as if the worst were the better. Larded with phrases like “commitment to improving education” and “maintaining support for the nation’s most vulnerable students,” Trump proposes to slash federal education programs by $9.2 billion, or 13.5 percent. This is on top of past unmet needs, since federal obligations to poor and special education children have never been fully met. Starved programs are now set to have their rations reduced or cut entirely.

“With a remarkable lack of compassion, the Special Olympics budget was zeroed. Twenty-two programs are eliminated including community learning centers, arts, pre-school and teacher improvement.

Blind to clear evidence, every dollar invested in high-quality early childhood education returns $8 in positive social outcomes such as reduced unemployment, stable families, less incarceration and the like. Yet the Trump budget treats this wise and productive investment as another area to defund: Head Start and child care are slotted for small reductions, while preschool development grants are entirely eliminated.

“The “civil rights” framing is stunning doubletalk, since a growing body of independent research shows that school choice segregates students by race, handicap and socioeconomic level.

“It doesn’t get any easier for poor and middle-class students as they get older. Loan forgiveness programs for new college graduates working in schools or government would be eliminated. Student loan interest would be increased. In Trump’s plan, 300,000 students would lose their work-study jobs. In all, $143 billion would be removed over 10 years.

“Why make these cuts? The proposal calls for an increase in defense spending of more than $50 billion (a 10 percent increase) plus tax cuts for the wealthy – and that money has to come from somewhere. By these deeds, a capacity for war is valued more than the needs of the citizenry.

“Yet, Trump says “education is the civil rights issue of our time.” This budget raises questions about whether his true objective is to cut civil rights. The proposal’s centerpiece is school choice. The budget seeks to funnel $1.4 billion, in new as well as repurposed funds, into private schools. The “civil rights” framing is stunning doubletalk, since a growing body of independent research shows that school choice segregates students by race, handicap and socioeconomic level.”
