Democratic Congressional leaders wrote a stern letter to Betsy DeVos, rebuking her for turning coronavirus relief funds into cash for vouchers. They are acting in the belief that Congress decides how money is to be spent and defines who should receive federal funding.

Betsy DeVos really doesn’t care what Congressional leaders say or do. She considers herself superior to Congress because she is a billionaire. She buys senators and members of Congress. She thinks of them as the household help. They appropriate the money and she decides how to spend it. How dare they try to tell HER what to do!

As I mentioned in the 2 pm post, even Republican Lamar Alexander chastised Betsy DeVos for diverting money from the CARES coronavirus fund to private schools. Here is the Washington Post report on the same events: DeVos is playing Reverse Robin Hood: Steal from the poor and give to the Rich.

She is thumbing her nose at Congress. She doesn’t care what their intent was.

Education Secretary Betsy DeVos faced bipartisan resistance Thursday to her decision to direct federal stimulus money away from high-poverty public schools and to private schools serving wealthy students.

It’s one of several examples of DeVos using the relief funding to advance her longtime goals, including taxpayer support for private and religious schools. On Thursday, she defended her controversial decision on how to distribute the federal money.

She also has used $180 million from the stimulus fund for a “microgrant” program for parents to pay for educational expenses, including private school tuition. Critics say they are akin to vouchers.

Earlier in the week, she said her goal was to advance her broader agenda.

In an interview with Cardinal Timothy Dolan, the archbishop of New York, on Sirius XM radio, Dolan asked DeVos if she was trying to “utilize this particular crisis to ensure that justice is finally done to our kids and the parents who choose to sent them to faith-based schools.”

DeVos responded, “Yes, absolutely”

“For more than three decades, that has been something I’ve been passionate about,” she said. “This whole pandemic has brought into clear focus that everyone has been impacted and we shouldn’t be thinking about students that are in public schools vs. private schools.”

Congress allocated roughly $13.5 billion to K-12 schools as part of the Cares Act, a stimulus package meant to mitigate the economic damage from the coronavirus crisis. Most of the funding was to be distributed to elementary and secondary schools based on a formula driven by how many poor children they serve.

The formula has long allocated some funding for poor children attending private schools. But in guidance sent to the states, DeVos said states should use a calculation that takes into account the total number of students private schools serve, not just the number of poor students attending.

The result is that millions of dollars that would otherwise assist high-poverty schools in the Title 1 program will instead be shared with private schools, regardless of the economic needs of their families.

On Thursday, Sen. Lamar Alexander (R., Tenn.), chairman of the Senate Education Committee and a DeVos ally, said her interpretation of the law is at odds with his own.

“My sense was that the money should have been distributed in the same way we distribute Title 1 money,” he said. “I think that’s what most of Congress was expecting.”

Harsher words came Thursday from leading Democrats, who asked DeVos to immediately revise her guidance to conform with the law.

The guidance “seeks to repurpose hundreds-of-millions of taxpayer dollars intended for public school students to provide services for private school students, in contravention of both the plain reading of the statute and the intent of Congress,” wrote Reps. Robert C. “Bobby” Scott (D-Va.), chairman of the House education committee, and Rosa L. DeLauro (D-Conn.), chairwoman of the House Appropriations subcommittee, as well as Sen. Patty Murray (D-Wash.), the top Democrat on the Senate Education Committee.

They cited Louisiana as an example. The state will spent $23 million on students at private schools, they said, which is $14.4 million more than would be the case under the normal Title 1 formula.

The guidance holds considerable sway, but states are not required to follow it.

Subsequent legislation passed by the House would overturn the DeVos guidance, but that legislation is part of a large aid package whose prospects are unclear.

DeVos defended her reasoning in a question-and-answer session with reporters Thursday.

“It’s our interpretation that [the funding] is meant literally for all students, and that includes students no matter where they’re learning,” she said.

She made her comments after an online discussion about remote education across the nation that featured officials with private companies, private schools and charter schools, as well as traditional public school leaders.

DeVos has long been a vocal supporter of school choice programs that allow tax dollars to follow children to private and religious schools. She argues that this gives parents more options, though critics say it drains public schools of badly needed resources.

DeVos’s pandemic response for higher education has also stirred controversy.

She has made a range of controversial choices about how to allocate funding to aid higher education, including barring aid to undocumented students, which Democrats and other critics say was not Congress’s intent. She also made funding available to some very small, private universities without demonstrated need.

Senator Lamar Alexander of Tennessee, the ranking member of the Senate Health, Education, Labor and Pensions Committee, publicly questioned Betsy DeVos’s guidance to states to include private schools when distributing federal funding of coronavirus relief. DeVos says the money should be divided according to enrollment. Alexander says it was supposed to follow the Title I funding and go to the neediest students, who are not in private schools.

ALEXANDER, DEVOS PART WAYS ON STIMULUS GUIDANCE: DeVos is now getting pushback from Alexander for controversial guidance calling on school districts to distribute stimulus funds to private school students more expansively than they would under regular federal education aid through Title I.

— Her policy says schools should spend money on services for private school students based on the total number of all students enrolled, rather than poverty levels.

— “My sense was that the money should have been distributed in the same way we distribute Title I money,” Alexander told reporters on Thursday. “I think that’s what most of Congress was expecting.”

— DeVos defended her interpretation of the law when asked by POLITICO during a video conference to respond to Alexander’s comments. “In our implementation of Congress’ action under the CARES Act, we have indicated it’s our interpretation that it is meant literally for all students and that includes students, no matter where they’re learning,” she said.

— DeVos later said that public schools should work with their private counterparts to understand student needs and to help provide services, such as tutoring or teacher professional development for teachers.

Indiana’s superintendent Jennifer McCormick has announced that she will ignore the DeVos guidance. Tennessee, however, will divert money from needy public schools and give it to private schools with advantaged students.

As DeVos’s response shows, she doesn’t care what Congressional leaders think, not even when they are members of the Republican party. She does what she wants, without regard to Congressional intent or authorization or rebuke. She was born a billionaire, she is privileged, and she is spoiled. She is a hardened ideologue. She doesn’t care about helping poor kids as much as she cares about funding private schools. She doesn’t care about the law. She, like Trump, thinks she is above it.

Without Congressional authorization, Betsy DeVos has urged states to dispense CARES Act funding based on enrollment, to include private schools, not based on economic need. As usual, she is using her authority to promote privatization of public funds intended for public schools.

The Education Law Center wrote an appeal to Governor Cuomo, urging him to reject the DeVos formula, which will divert money from the poorest children and defy the intent of Congress.

Stan Karp has written a brilliant critique of federal policy and Betsy DeVos’s audacious and vicious assault on our nation’s public schools and their students. Don’t believe those who say that Congress has blocked her most horrendous actions. She has used her authority and exceeded the intent of Congress to advance her single-minded and narrow-minded pursuit of privatization. When Congress tries to blunt or control her actions, she simply ignores Congress. She is out of control. She treats members of Congress like her household help.

Then he shows how the pandemic has given DeVos the tools to wreak havoc on our public schools, which enroll the vast majority of children.

He writes:

The emergency CARES Act, passed without a single dissenting vote and signed in March, was the first of several massive pieces of federal legislation rushed through Congress in response to the pandemic. While the CARES Act didn’t include the same kind of signature federal initiative that RTTT represented for Obama and his secretary of education, Arne Duncan, it did give Duncan’s successor, the wildly unpopular, right-wing billionaire Betsy DeVos, extraordinary powers in a host of important policy areas.

There will be additional federal action affecting schools in the months ahead, including attempts to address the financial tsunami that is already engulfing school budgets. But even a cursory comparison between the federal response in 2009 and the initial response to the current crisis provides some clues about the extended emergency ahead for public education.

The CARES Act included $13.5 billion for K–12 schools, $14 billion for higher education, and another $3 billion that governors can split between the two as part of $31 billion in “stabilization aid” for state budgets. But while the total $2.2 trillion legislative package was several times larger than the $800 billion American Reinvestment and Recovery Act of 2009, the initial amounts provided for education in the CARES Act were much smaller.

The Recovery Act sent $54 billion in education aid to states primarily for K–12 programs and the implementation of RTTT. Moreover, as noted by Education Week, the “2009 stimulus didn’t just shore up education budgets; its unprecedented windfall of education aid also helped the Obama administration put financial muscle behind its priorities. Those priorities focused on areas like standards and accountability.” To promote those policies, the funds came with prescriptive regulations about their use, including provisions that drove an expansion of charters, standardized testing, and test-based teacher evaluation. States and school districts desperate for federal dollars had to commit to this agenda to receive RTTT’s “competitive grants.”

“The CARES Act doesn’t take the same approach,” Education Week’s analysis concluded. “It’s hard to see discrete elements of a Trump education policy agenda driving current coronavirus aid — although U.S. Secretary of Education Betsy DeVos indicated last week she wants to change that.”

DeVos Given Tools of Destruction

The CARES Act gives DeVos multiple tools to do so. It gives the secretary of education authority to waive many requirements outlined in the Every Student Succeeds Act (ESSA), the omnibus federal education legislation that replaced NCLB. The first — and undoubtedly most popular — use of this authority came when all 50 states sought and received in a matter of weeks a waiver to suspend federally required annual standardized testing for the current school year. The educational irrelevance of these tests and their existence as an obstacle to serving the real needs of students was one of the first lessons of the pandemic.

But DeVos’ new authority has much more sinister potential. The CARES Act gives her the power to waive Title I funding regulations, which govern the largest federal education program supporting children from low-income families. It also allows her to suspend Title II rules defining professional development and Title IV requirements to “provide students with a well-rounded education” including the arts, mental health services, and training on trauma-informed practices — all crucially important in the current crisis. The CARES Act specifically allows schools to shift money from these areas to purchase “digital devices.” By early April, 28 states had received waivers to reallocate ESSA spending.

In the guidelines for distributing the first pot of CARES funding, the $3 billion Governor’s Emergency Education Relief Fund, DeVos blocked any use of funds to support DACA recipients or international students. She also said any monies awarded to teacher unions to provide services defined in the CARES Act would be “inconsistent with statutory requirements,” although last year she authorized church and religious groups to receive federal funds to provide similar services.

DeVos has a long and notorious record of using agency guidance and regulatory action to undermine equity. One of her first acts after being confirmed as secretary was to support the repeal of protections for transgender students, including their right to choose restrooms. She was sued for rolling back protections against predatory lenders at for-profit colleges and threatened with jail by a federal judge for “intentionally flouting” a court order to stop collection proceedings for such loans. DeVos rescinded sexual assault guidance issued under Title IX, a move the National Women’s Law Center said would have a “devastating” impact, and in May released new guidance that weakened protections for victims of sexual harassment and assault. She proposed allowing schools to use federal “student enrichment funds” to purchase guns and used a school safety commission formed in the wake of the Parkland school shootings to recommend repeal of regulations on school discipline practices that were rooted in civil rights concerns. Similarly, DeVos tried to rescind Obama-era rules that required districts to track racial disparities in special education classification rates, an effort a federal judge blocked as “arbitrary and capricious.” In April, DeVos relaxed oversight and accreditation rules for higher education online programs at a time when the pandemic was massively expanding the scale of such programs.

Beyond putting her very rich thumb on the wrong side of the scales of justice, DeVos is now in position to be a key gatekeeper for a new and crushing era of austerity for school budgets. To access the CARES Act’s stabilization funds, states must nominally commit to maintaining recent levels of education funding for fiscal years 2021 and 2022. But DeVos can waive that requirement and no doubt will. Already, she has issued guidelines for distributing CARES Act funds that drive more dollars to private schools and wealthier students by circumventing requirements to allocate the funds according to more progressive Title I formulas.

DeVos undermines equity. She flouts the Will of Congress. She seeks to dismantle civil rights protections.

Unlike Trump, she is not incompetent. She is not stupid. She is very clever. She is diabolical. Trump will never fire her because she sows chaos as surely as he does, but without bluster and braggadocio.

If you need a reason to vote for Joe Biden, think about Betsy DeVos.

Hooray for State Superintendent Jennifer McCormick of Indiana!

She rejected Betsy DeVos’ guidance to share CARES relief funding between public and private schools.

No wonder Republicans are planning to get rid of her and replace her with an appointed state superintendent whom they can control, on behalf of charter schools and voucher schools.

The state education department estimates that if they followed DeVos’ plan, poor kids in public schools would lose more than $15 million to private schools.

Tennessee’s public schools will share federal CARES funding with private schools, as Secretary of Efucation Betsy DeVos recommends.

DeVos never skips a chance to funnel federal money to non public schools. Tennessee has a Trumper Governor, and together they are harming the state’s public schools.

DeVos has slyly turned the CARES Act funding into the voucher funding that Congress has consistently rejected.

Chalkbeat reports:

The decision means students in the state’s 200-plus private schools could receive more support than they expected from Tennessee’s share, while high-poverty public school districts would get less money.

DeVos instructed districts to distribute CARES money to support students in private schools based on their total enrollments — not just on the number of low-income students they serve.

NEW JERSEY MUST REJECT EDUCATION SECRETARY DEVOS’ ADVICE TO GIVE EMERGENCY COVID-19 FUNDS EVEN TO WEALTHY PRIVATE SCHOOLS

Education Law Center is urging New Jersey Governor Phil Murphy to firmly reject a non-binding directive from U.S. Secretary of Education Betsy DeVos to set aside federal emergency relief funds under the Coronavirus Aid, Relief and Economic Security (CARES) Act for all private school students, even the most wealthy.

In a May 11 letter to Governor Murphy, ELC explains that Secretary DeVos’ guidance to New Jersey and other states to allocate CARES Act funds to all private school students, without regard for income level, is based on a patent misreading of the express terms of the CARES Act and the federal Title I statute, which governs the distribution of CARES Act funding to local school districts. ELC further explains that Secretary DeVos’ flawed legal interpretation would also significantly diminish the resources available to New Jersey school districts to provide effective and equitable remote learning opportunities while students are sheltering at home to prevent the spread of COVID-19.

“This erroneous guidance lays bare Secretary DeVos’ personal agenda for reducing federal emergency CARES Act funds to public schools and redirecting as much of that funding as possible to private schools,” said David Sciarra, ELC Executive Director. “By advising that even the wealthiest students in the most expensive private schools should receive services paid for with CARES Act funds, the guidance would lead New Jersey and other states to divert millions of dollars critically needed by public school students, including access to continuing instruction while their schools are closed.”

Estimates based on 2017 census data show that New Jersey’s high poverty districts will be most impacted by following Secretary DeVos’ directive given the differences between the poverty rates of the district as a whole and those of private school students.

For example, in Jersey City, 12% of the district school-aged population attend private schools, while only 14% of those students are poor. Following DeVos’ directive would mean diverting nearly $1 million more of the CARES Act funds from Jersey City public school students, 30% of whom are poor.

Similarly, in Passaic City, an estimated 16% of students attend private schools, but only 10% of those students are poor. In Passaic public schools, 51% of students are poor. Using Secretary DeVos’ preferred approach would increase the amount of federal CARES Act funds reserved for private school students from $300,000 to $1.4 million.

ELC also underscores that rejecting Secretary DeVos’ directive is compelled by New Jersey’s constitutional obligation to “provide for the maintenance and support of a thorough and efficient system of free public schools” for all students. As the New Jersey Supreme Court affirmed in the landmark Abbott v. Burke rulings, public school students have a fundamental right to an education that prepares them to be informed citizens and productive members of society and that right “must remain prominent, paramount and fully protected.”

Beyond New Jersey, ELC is calling on governors and education officials to decline Secretary DeVos’ legally improper directives and ensure maximum CARES Act funds to enable school districts across the country to bring an end to the digital divide.

Nancy Bailey just keeps getting better and better as she points her pen and her blog at malfeasance in education.

In this post, she points to the recent landmark decision that recognized that the children of Detroit have a right to literacy, a right not previously acknowledged by any court (or overturned on appeal). The court quite correctly decided that young people cannot exercise their rights and responsibilities as citizens if they can’t read.

What is DeVos’s role in the Detroit debacle? She has spent large sums of money to promote the false idea that the way to improve education is to expand school choice. Detroit is her handiwork, and it proves the failure of school choice. What she purchased was widespread inequity and inadequacy.

The Detroit landmark decision that children deserve to learn to read in school is a case that reflects decades of troubled education in Detroit. Education Secretary Betsy DeVos and school privatization are not mentioned in this case. But school privatization initiatives have been failing children in the Motor City for years. DeVos is the current face of a long line of those peddling such reforms.

Harmful school reform initiatives go back to Gov. John Engler’s administration. Many school reformers, both Republican and Democrat, have their fingerprints on the crime scene. The DeVos family is from Michigan and has affected Detroit and school reform there for years.

The U.S. Sixth Circuit Court of Appeals has ruled in favor of Detroit students who claim they were denied their rights to a “basic minimum education.” Called the “Right to Read” lawsuit, Gary B. v. Whitmer exposes the decrepit conditions found in schools run by State leaders who failed to support Detroit’s students. The case was originally filed under former Gov. Rick Snyder’s administration.

It’s critical to recognize DeVos’s connection to the Detroit school failures. During this pandemic she is flagrantly redirecting public money to the same privatization agenda. It puts democratic public schools in jeopardy, like schools were put at risk in Detroit. Here’s a petition you can sign now to try and stop her.

School privatization cheerleaders have for years promoted the idea that choice will equalize education by giving parents choices. They’ve pushed for online charter schools and school turnarounds that get tough on teachers and students of color. Choice failed in Detroit.

Reading

Schools had no literacy programs.

The case describes what good reading instruction should consist of in school. Sometimes it appears to be delving into the Reading Wars, emphasizing the loss of explicit phonics.

The trouble is, one can’t get to a debate over how students learn to read, without overcoming the fact that students have untrained teachers and an atrocious learning environment.

It’s troubling to think the case might result in only professional development and a push for unproven programs, even online reading programs, that don’t address the need for creating quality schools, professional teachers, and more individualized attention for the children of Detroit.

School Buildings

Poor school conditions have been a part of Detroit’s schools for years. Students struggle to learn in slum-like conditions, no air-conditioning in the summer, freezing temperatures in the winter. Who can forget these pictures from 2016, the year the case was filed?

Vermin, mold, and contaminated drinking water plague the schools. Bullets, dead vermin, condoms, and sex toys have been found on the playground. Fire safety equipment and fire regulations are missing.

Betsy DeVos’s mantra is that education is about students and not buildings. She has done nothing to improve the condition of schools in Detroit or around the country.

Lacking Resources

Teaching resources were deficient. The case describes classrooms without enough textbooks, and old books that haven’t been updated in years.

The only school library mentioned had no librarian and was locked!
