With the Obama administration’s latest policy pronouncement, the federal grip on American education grows tighter and stupider every day.

The latest: the administration plans to reward the best teacher-training institutions and drive the “worst” ones out of business. This is like Race to the Top for teacher preparation programs.

What are their measures? Of course, student test scores loom large.

“The goal: To ensure that every state evaluates its teacher education programs by several key metrics, such as how many graduates land teaching jobs, how long they stay in the profession and whether they boost their students’ scores on standardized tests. The administration will then steer financial aid, including nearly $100 million a year in federal grants to aspiring teachers, to those programs that score the highest. The rest, Duncan said, will need to improve or “go out of business.”

Thus, programs that send their graduates to work in urban districts with high-needs students will get low ratings. Duncan will drive them out of business. Smart institutions will steer their graduates to affluent suburbs, where scores will go up regardless of what they do.

The message from the U.S. Department of Education to the nation’s colleges of teacher education:

1. Do not send your graduates to teach struggling students who are likely to get small or no gains on standardized tests, such as students with extreme disabilities and English language learners, as well as gifted students, who are unlikely to post gains because of the ceiling effect.

2. Teach to the test. Drill the students hour after hour. Extend the school day whenever possible so there is more time for test prep.

3. Don’t waste time on non-tested subjects like the arts, history, civics, and science. They don’t count.

4. Invest in Pearson and McGraw-Hill stock.

The evidence is overwhelming that value-added measures for teachers are inaccurate, but neither secretary Duncan nor the White House care about evidence.

As reporter Stephanie Simon points out:

“The formulas for measuring how much “value” a teacher adds to a student’s test scores are complex and often carry a sizable margin of error.

“Earlier this month, the American Statistical Association warned that such formulas must be used with caution because teachers generally account for less than 15 percent — and in some studies, as little as 1 percent — of the variability in student test scores. Value-added models spit out precise-sounding numbers that purport to quantify a teacher’s impact on her students, but in fact the formulas “typically measure correlation, not causation,” the group concluded.

“A recent study funded by the Education Department found that value-added measures may fluctuate significantly due to factors beyond the teachers’ control, including random events such as a dog barking loudly outside a classroom window, distracting students during their standardized test. A 2010 study, also funded by the Education Department, found the models misidentify as many as 50 percent of teachers — pegging them as average when they’re actually better or worse than their peers, or singling them out for praise or condemnation when they’re actually average.

“Yet another challenge: Calculating scores for educators who do not teach subjects or grades assessed with standardized exams. Nationally, some 70 percent of teachers — including most high school and early elementary teachers, plus art, music and physical education teachers — fall into that category.

“Despite such complications, [White House policy director Cecilia] Muñoz made clear in a call with reporters on Thursday that Obama wants student test scores, or other measures of student growth, to figure heavily into states’ evaluations of teacher prep programs.

“This is something the president has a real sense of urgency about,” she said. “What happens in the classroom matters. It doesn’t just matter — it’s the whole ballgame.” So using student outcomes to evaluate teacher preparation programs “is really fundamental to making sure we’re successful,” Muñoz said. “We believe that’s a concept … whose time has come.”

Yes, using student test scores to evaluate teachers, principals, schools, and teacher colleges is “a concept… whose time has come,” despite the fact that there is no evidence for it, despite the fact that the nation’s leading scholarly organizations have warned about its limitations and misuse, despite the fact that it fails to account for factors beyond the teachers” control, and despite the fact that it misidentifies teacher effectiveness at an alarmingly high rate.

The Education Department is pulling Washington state’s No Child Left Behind waiver because the state has not met the department’s timeline for tying teacher evaluations to student performance metrics.

Washington is the first state to lose its waiver. The loss will give local districts less flexibility in using federal funds. For instance, they may now be required to spend millions on private tutoring services for at-risk students. The waiver revocation could also result in nearly every school across the state being labeled as failing under NCLB.

Washington had pledged in its waiver application to make student growth a significant factor in teacher and principal evaluations by the 2014-15 school year. But the state Legislature refused to pass a bill mandating that student performance on statewide assessments be included in teacher evaluations. The department placed the state on “high-risk” status in August. Arizona, Kansas and Oregon are also at risk of losing their waivers.

Secretary of Education Arne Duncan handed out numerous waivers to states to avoid the 2014 deadline in the No Child Left Behind law.

Under the law, every state must assure that every single child in grades 3-8 is proficient on state tests of reading and mathematics.

No state met the deadline. If the law remains in effect (it was supposed to be reauthorized in 2007, but gets extended year after year), every state would be declared a failed state, and virtually every public school in the United States would be closed or privatized or suffer some other sanction for failing to meet an impossible goal. It bears pointing out that no nation in the world can claim that 100% of its students are proficient in reading and math.

But Duncan didn’t hand out waivers wholesale. Instead, he made the waiver conditional on the state agreeing to accept his conditions, which were similar to the conditions in Race to the Top. In effect, states are now following Race to the Top requirements but without the prize money.

One of the central conditions of the waiver, like Race to the Top, was that states must agree to evaluate their teachers and principals based to a significant degree on the test scores of their students.

Washington State has failed to create such a system. Today Arne Duncan withdrew Washington State’s NCLB waiver to punish it for failing to do as he demanded.

Perhaps legislators in Washington State noticed that this method of evaluating teachers and principals has failed wherever it was tried.

Perhaps they read the joint report of the National Academy of Education and the American Educational Research Association, which cautioned that “value-added measurement” was inaccurate and unstable, and that it measures who is in the classroom rather than teacher quality. The legislators probably did not have a chance to read the recent report of the American Statistical Association, which also cautioned on the use of VAM, because of its imprecision and its unintended effects. But they may have read Stanford Professor Edward Haertel’s advice that states should not set numerical percentages for the use of test scores to evaluate teachers. All of these reports reach the same conclusion: that Duncan’s favorite solution to raising teacher quality does not have evidence to support it.

Let’s hope that Washington State says no to the illegitimate demands of the Secretary of Education. Duncan is overreaching. He is not the nation’s superintendent of schools. He should learn about federalism and about the limited role of the federal government in the area of education.

Meanwhile, I hope that the state of Washington sues the Secretary of Education and helps him learn about federalism and about the importance of evidence in policymaking.

Matt Farmer, a lawyer and public school activist in Chicago, wrote a brilliant satire of the Obama administration’s Race to the Top. You may recognize Matt Farmer as the brilliant litigator who cross-examined and tried billionaire Penny Pritzker in absentia. At the time, Pritzker was a member of the Chicago Board of Education, merrily cutting services for the children in public schools while raising money for a glorious library at her children’s private school. Last year, President Obama appointed Pritzker as Secretary of Commerce. She was a major Obama fund-raiser.

In this new post, Farmer tells us that Arne Duncan has discovered that American kids spend too much time eating lunch.

Other countries spend less time in the lunchroom, he says gravely. We must beat the international competition!

Farmer writes:

“Secretary Arne Duncan’s April 15, 2014, remarks to employees and diners at the National Place food court in Washington.

Today we cross an important threshold in school cafeteria reform by releasing draft guidelines for states to apply for the $3.6 billion dollar Graze to the Top fund. We gather here today at Washington D.C.’s National Place food court to announce – and celebrate — a new Graze to the Top in schoolhouses across America.

For too many years, our nation’s public school students have been trapped for nearly 20 minutes a day in under-performing school cafeterias. Simply put, kids are spending too much time in lunchrooms and not enough time in classrooms. In today’s global economy, a country that eats lunch in less time than America will out-compete us.

And what we now know from international assessments is that students in countries such as Poland, Slovenia, and the Czech Republic spend far less time eating school lunches than do their U.S. peers.”

Surely, spoiled suburban moms will complain. But don’t listen to them. We can’t afford to waste another minute!

“Save, save the minutes!” You have to be a historian of American education to recognize that this phrase was associated with the early 19th century Lancastrian movement, the first effort to standardize education for the children of the poor so that it would be cost-effective. Arne Duncan, the Joseph Lancaster of the 21st century.

Award-winning high school principal Carol Burris reports here on Arne Duncan’s latest foray into New York, where he highly praised the state’s controversial Commissioner of Education John King, disparaged disgruntled educators and parents as a mere distraction, and urged the state to “stay the course.”

Burris, a leader in the effort to expose and reverse some of the worst aspects of Race to the Top, explains why it is important not to stay the course, when the course is leading in the wrong direction.

She writes:

” There is no empirical evidence that rigorous state or national standards will result in higher student achievement or greater college readiness.

“Those who created the Common Core assumed that if we established rigorous standards, student achievement and economic competitiveness would increase. Duncan said, in his remarks at New York University, that it is common sense. Prior to the 15th century, common sense said the world was flat, but that did not make it true.”

She cites research to demonstrate that rigorous standards and high-stakes tests o not produce better education:

“This is not an argument for low standards or no standards—it is an argument that standards reform is not an effective driver of school improvement. Keep in mind that all state standards had high-stakes state tests associated with them. The more rigorous the standards, the more difficult the tests are. As high-stakes tests become more difficult, the curriculum becomes narrower and narrower. The tests soon drive teaching and learning.

“When I hear “I am for the Common Core standards, I am just not for the tests”, I cringe. While thoughtful educators look at the standards through their prism of good practice, test makers look at the standards as the basis for creating “items” that discriminate the learning of one child from another. In the end, the test maker calls the shots. It is no coincidence that the Common Core Standards, PARCC and Smarter Balanced were all born at the same time. In his remarks, Duncan referred to PARCC and Smarter Balanced as the “national tests.”

“The destination of school reform—ensuring that all students have the skills, content and habits needed for college and career success—is the right destination. The challenge is choosing the pathway that gets us there. Good intentions are not enough. If we continue to put our tax dollars and our efforts into “standards reform” because Mr. Duncan and his followers believe it is common sense, we will waste time and treasure.”

Bottom line: Race to the Top is no better than No Child Left Behind. It has no research to support its premises and will come to an ignominious end like its predecessor. Burris hopes that Duncan will change course but his bad ideas seem impervious to evidence.

Perhaps someday historians will figure out how the Obama administration pulled the wool over the eyes of so many people about its plans for urban schools. As a presidential candidate, Barack Obama named Professor Linda Darling-Hammond as his senior education advisor. She went on national television to describe the progressive policies he would pursue if elected.

Soon after the election, President-elect Obama dropped Darling-Hammond and selected his basketball buddy Arne Duncan as Secretary of Education. He introduced Duncan as someone who had enjoyed remarkable success in turning around the Chicago public schools. We now know that Duncan did not enjoy remarkable success, and Mayor Rahm Emanuel is applying a wrecking ball to the Chicago public school system.

What went wrong? How did Obama fool us? Once he was elected, why did he choose as Secretary a non-educator who was determined to make standardized testing the centerpiece of his program, to advance the privatization of America’s public schools, to demoralize teachers, and to make common cause with the nation’s most rightwing governors? Why does Duncan never speak out against segregation? Why does he pretend that poverty doesn’t matter so long as poor kids have “great” teachers? Why does he never speak out against vouchers? What will historians say about Race to the Top, which turns out to have as much evidence as No Child Left Behind?

 

The Obama Administration’s “Scorched Earth Policy” for Urban Schools

The Obama Administration, in the five years it has been in office, has pursued an Education “Scorched Earth” policy in major urban centers, closing public schools en masse and replacing them with charter schools. And for the most part, Democratic Mayors have enthusiastically supported this policy. Only in the last year, there has been finally been some resistance to this policy, by newly elected Mayors in New York and Pittsburgh. That resistance must spread if public education is to survive and be revitalized in Urban America. Electing anti-testing, anti-charter school and pro public school Mayors in big cities should be a major priority of activists in the last three years of the Obama Presidency, along with building the multi-partisan movement against the Common Core Standards. That is the only way we can build public schools into strong community institutions where creative teaching and learning is practiced and honored.

The Los Angeles Times tells us what we should already know: The higher the stakes on exams, the more bad consequences will follow.

In India, there are crucial exams, and cheating is a persistent problem. Ingenious students us their ingenuity not to answer the questions, but to find ways to get the right answer, either electronically by remote device or by sneaking in old-fashioned crib sheets.

In the United States, we have seen numerous examples of cheating by administrators and teachers, as in El Paso, Atlanta, and Washington, D.C. We have also seen narrowing of the curriculum to make time for more test preparation and loss of the arts, libraries, physical education, and even recess. We have seen teaching to the test, a practice once considered unprofessional. We have seen states game the system, dropping the pass score to artificially boost the passing rate.

The story in the L.A. Times describes a business that sells electronic devices to text exam questions to someone outside who responds with the correct answer. Officials are aware of the problem:

“At a test center in northern India’s Bareilly district, state-appointed inspectors making a surprise visit last month found school staff members writing answers to a Hindi exam on the blackboard. When the inspectors arrived, the staff members tried to throw the evidence out the window.

“Sometimes the stories are horrifying. A 10th-grader in Uttar Pradesh, India’s largest state, accused his principal last month of allowing students to cheat if they each paid about $100. The student’s impoverished family could barely manage half the bribe. Distraught, he doused himself with kerosene and set himself on fire in the family kitchen. He died the next day.

“At the well-regarded Balmohan Vidyamandir school in central Mumbai, 10th-grade teacher Shubhada Nigudkar didn’t notice the math formulas written on the wall in the back of the classroom in a neat, tiny script until days after the exams concluded.
“There is nothing we can do at that point,” the matronly, bespectacled English teacher said. “I can’t prove anything. So we move on.”

“The problems have prompted education officials to take preventive measures that at first blush might seem worthy of a minimum-security prison. Some schools installed closed-circuit cameras to monitor testing rooms. Others posted armed police officers at entrances or employed jamming devices to block the use of cellphones to trade answers.”

The problem is high-stakes testing. Our own officials in the United States can’t get enough.

The best antidote would be to require them to take the exams they mandate. If they can’t pass them, they should resign.

Someday, in the not distant future, when the history of this era is recorded, No Child Left Behind and Race to the Top will be recalled among the biggest policy failures of our times. They will be remembered as policies that undermined the quality of education, demoralized educators, promoted the privatization of schools, and destroyed children’s love of learning.

Our friend Edward Berger returned from a long period of rest, reading, and reflection, and he is back in fine form.

He wrote a letter to President Obama and the First Lady to warn of the damage their education policies are inflicting on the nation’s children, teachers, and schools.

He writes:

“Prior to your administration, with few exceptions, public schools were not created as sources of investment income or profit. Schools were run by democratically elected boards under state supervision. Schools were accountable for financial management and academic achievement. A proven (if not100%s effective) means of teacher accountability and school effectiveness was in place and functioning well in areas where great poverty and futility were not generated by our failed economic system.

“Prior to your administration, the tax dollars Americans pay for public education could not be accessed by profiteers or religious groups and cults. No taxpayer was forced to support a religion, ideology, or partial school with their education tax dollars.

“Sadly, strengthened by your administration, an unproven and false use of testing replaced the tests used by educators to understand student needs and to teach effectively. Data generated by wrong and unproven means is causing great harm to students and teachers throughout America. The only known beneficiaries of this drive for data are the corporations creating the tests, and the egos of billionaires who use their wealth to force their “hunches” on our schools.

“Your administration supports those who can buy access to schools and thus children’s minds. Your administration accepts the whims of billionaires who have no certification, little or no contact with professional educators, no concept of the history of American education and how education is delivered, and most devastating, they have very little concern for our children. Almost all send their children to separate schools that do not follow the rules your administration is instigating.”

The central feature of the Obama administration’s $5 billion “Race to the Top” program was sharply deconstructed and refuted last week by the American Statistical Association, one of the nation’s leading scholarly organizations. Spurred on by the administration’s combination of federal cash and mandates, most states are now using student test scores to rank and evaluate teachers. This method of evaluating teachers by test scores is called value-added measurement, or VAM. Teachers’ compensation, their tenure, bonuses, and other rewards and sanctions are tied directly to the rise or fall of their student test scores, which the Obama administration considers a good measure of teacher quality.

Secretary Arne Duncan believes so strongly in VAM that he has threatened to punish Washington state for refusing to adopt this method of evaluating teachers and principals. In New York, a state court fined New York City $150 million for failing to agree on a VAM plan.

The ASA issued a short but stinging statement that strongly warned against the misuse of VAM. The organization neither condemns nor promotes the use of VAM, but its warnings about the limitations of this methodology clearly demonstrate that the Obama administration has committed the nation’s public schools to a policy fraught with error. ASA warns that VAMs are “complex statistical models” that require “high-level statistical expertise” and awareness of their “assumptions and possible limitations,” especially when they are used for high-stakes purposes as is now common. Few, if any, state education departments have the statistical expertise to use VAM models appropriately. In some states, like Florida, teachers have been rated based on the scores of students they never taught.

The ASA points out that VAMs are based on standardized tests and “do not directly measure potential teacher contributions toward other student outcomes.” They typically measure correlation, not causation. That means that the rise or fall of student test scores attributed to the teacher might actually be caused by other factors outside the classroom, not under the teacher’s control. The VAM rating of teachers is so unstable that it may change if the same students are given a different test.

The ASA’s most damning indictment of the policy promoted so vigorously by Secretary of Education Arne Duncan is:

“Most VAM studies find that teachers account for about 1% to 14% of the variability in test scores, and that the majority of opportunities for quality improvement are found in the system-level conditions. Ranking teachers by their VAM scores can have unintended consequences that reduce quality.” The ASA points out: “This is not saying that teachers have little effect on students, but that variation among teachers accounts for a small part of the variation in scores. The majority of the variation in test scores is attributable to factors outside of the teacher’s control such as student and family background, poverty, curriculum, and unmeasured influences.”

As many education researchers have explained–including a joint statement by the American Educational Research Association and the National Academy of Education– the VAM ratings of those who teach children with disabilities and English language learners will be low, because these children have greater learning challenges than their peers, as will the ratings of those who teach gifted students, because the latter group has already reached a ceiling. Those two groups, like the ASA agreed that test scores are affected by many factors besides the teacher, not only the family, but the school’s leadership, its resources, class size, curriculum, as well as the student’s motivation, attendance, and health. Yet the Obama administration and most of our states are holding teachers alone accountable for student test scores.

The ASA warns that the current heavy reliance on VAMs for high-stakes testing and their simplistic interpretation may have negative effects on the quality of education. There will surely be unintended consequences, such as a diminishment in the number of people willing to become teachers in an environment where “quality” is so crudely measured. There will assuredly be more teaching to the test.. With the Obama administration’s demand for VAM, “more classroom time might be spent on test preparation and on specific content from the test at the exclusion of content that may lead to better long-term learning gains or motivation for students. Certain schools may be hard to staff if there is a perception that it is harder for teachers to achieve good VAM scores when working in them. Over-reliance on VAM scores may foster a competitive environment, discouraging collaboration and efforts to improve the educational system as a whole.”

For five years, the Obama administration has been warned by scholars and researchers that its demand for value-added assessment is having harmful effects on teachers and students, on the morale of teachers, on the recruitment of new teachers, and on the quality of education, which has been reduced to nothing more than standardized testing. Secretary Duncan has brushed aside all objections and pushed full steam ahead with his disastrous policies, like Captain Ahab in pursuit of the great white whale, heedless to all warnings.

Based on the complementary statements of our nation’s most eminent scholarly associations, any teacher who is wrongfully terminated by Duncan’s favorite but deeply flawed methodology should sue for wrongful termination. What is not so clear is how the nation can protect our children and our public schools from this administration’s obsessive reliance on standardized tests to rank and rate students, teachers, principals, and schools.

The Education Law Center noted in 2012 that there was a pattern to the distribution of Race to the Top grants:

The states and districts with the most unequal funding won a large share of RTTT grants.

ELC writes:

Since 2009, the US Department of Education’s (USDOE) Race to the Top (RTTT) initiative has given billions in federal funds to states conditioned on launching various education reforms. The USDOE has awarded these grant funds without regard to how equitably the states fund their schools. States control 90% of all school funding, and successful reform requires adequate resources, especially in districts serving high concentrations of low-income students and students with special needs.

In early December, USDOE announced another round of RTTT grant awards, this time to 16 local school districts or groups of school districts. The 16 award winners will share $400 million to support USDOE school reform priorities.

Once again, the RTTT grant process ignores the key precondition for sustaining any meaningful education reform — a fair and equitable state school finance system. The winning RTTT districts are in 12 states, all of which have serious deficiencies in the way they fund schools. Some of the districts are in states with the most inequitable school funding in the nation.

Kenneth Mitchell, a school superintendent in the Lower Hudson Valley of New York, has been concerned about the costs imposed on school districts by Race to the Top. He previously estimated that six districts in his region would spend $11 million to comply with the mandates of Race to the Top, which paid these districts $400,000.

In this comment, he describes a recent meeting with lawyers about possible lawsuits that will be brought because of New York’s flawed Educator Evaluation System.

• How might overly prescriptive, rigid statutory and regulatory policy frameworks, such as §3012-c, regarding teacher evaluation, tenure, and employment decisions withstand teacher and principal appeals?

Statistical Reliability and Validity of Data in Supervision, Evaluation & Tenure Decisions

• How might the statistical reliability and validity of measures of teaching effectiveness – state assessments, VAM, SLO’s, school-wide assessment scores – affect teacher evaluation, tenure, and employment decisions?

• How will the metric of ‘confidence intervals’ be considered in a legal decision about a teacher’s effectiveness?

• How will the number of years of value-added assessment data to determine teacher quality be a factor in a teacher or principal appeal?

• In what ways will the use of locally-developed assessments, such Student Learning Objectives (SLOs), be challenged in an appeal?

Implementation, Professional Development, and Resources

• How will such factors as consistency, training, and quality be considered in observations and evaluations developed by supervisors?

• How will equity issues, such as the access to materials (e.g., Common Core units) or technology, be a factor in an appeal?

• Experts in child and adolescent development have asked for a review of the Common Core to ensure that all of the standards are developmentally appropriate.
Since assessments are being developed on the basis of Common Core and teachers and principals being assessed accordingly, how will the aforementioned concerns be considered?

We have also raised other concerns about the model that we have shared with state legislators, members of the Board of Regents, officials at the State Education Department and with representatives of the governor’s office. There are many other questions that will need to be answered once this enters the legal arena.

We shared that many in our organization have concerns that a) the design of reform model is flawed on multiple levels; b) the expedited and unsupported implementation will further contribute to inevitable legal challenges; c)the weak technical basis and very limited or no research behind elements of the model will not withstand legal challenges. These are just a few of our concerns. As a result, school districts will be wasting even more time and money on legal costs. Unless significant changes are made on the basis of substantive evidence, New York’s reform model is headed for trouble that will move beyond the anxiety and frustration of over-tested students, angry parents, weary teachers, and harried administrators.
