Rachel M. Cohen tells an important and powerful story of the time when Senator Bernie Sanders stood up to Teach for America.

His efforts were ultimately defeated by Arne Duncan, Senator Michael Bennett of Colorado, and Eli Broad.

In 2011, the Obama administration and TFA’s friends in Congress were eager to call the program’s inexperienced and ill-trained recruits “highly qualified,” to meet the requirements of the No Child Left Behind Law. At that time, Sanders was the only member of Congress to question how a recent college graduate who had never taught could be considered “highly qualified.”

TFA enjoyed the vigorous support of the Obama administration, which gave the wealthy organization $50 million in 2010 (as did the ultra conservative, anti-union Walton Family Foundation). In addition, TFA placed its alums on the staff of every member of the Senate and House education committees, thanks to the generosity of a California billionaire named Arthur Rock, who are then in a position to protect TFA’s interests as well as funding for charter schools. TFA recognized that few if any members of Congress pay close attention to education, since the federal role in education is small, especially compared to issues like healthcare, Social Security, and foreign policy. Thus, most rely on junior staff to inform them, which gives extraordinary power to the TFA plants.

Cohen tells the story of TFA’s battle to ensure that its uncertified recruits were considered “highly qualified” teachers, an oxymoron.

Beginning in the mid-2000s, the group was enmeshed in a dispute over teacher credentialing under the No Child Left Behind Act that demonstrated its ability to marshal influence in D.C. Under the law, a school district was permitted to hire educators who did not meet the “highly qualified” bar if there were teacher shortages. Schools that did so, however, had to then inform parents if their child was taught by such a teacher, publicly disclose how many teachers in the entire school were not highly qualified, and develop a plan to reach 100 percent highly qualified teachers. The law also barred schools from disproportionately concentrating inexperienced and uncertified teachers in classrooms with low-income students and students of color. In other words, if noncertified teachers had to be hired, they also had to be fairly distributed across schools.

Teach for America and its allies in the education reform community lobbied the government, and in 2002, the Department of Education issued a regulation that said “highly qualified” teachers could now also include unlicensed teachers for up to three years if they were making progress toward their certification. This effectively resolved the problem for Teach For America, as most program recruits planned to leave the classroom at the end of their assignment anyway.

In 2007, the civil rights law firm Public Advocates filed a suit against the Department of Education over this regulation. In effect, the lawyers argued, it created an exemption that condoned the assignment of novice, inexperienced teachers to students in high-poverty schools, which are disproportionately nonwhite and low-income.

“It seemed pretty simple to us all along that you can’t have a law that requires ‘full state certification’ for teachers to be highly qualified and also say that people who are in the process of getting their certification meet that designation,” said John Affeldt, the lead attorney for the plaintiffs. “Those are two different states of being.”

Affeldt said there was little question as to why the 2002 regulation came about. “Teach for America applied pressure because they saw the original statute as threatening to their model and to the growth of their organization,” he said. “At some point between its founding and the mid-2000s, Teach for America had changed its belief system from ‘Every student needs fully qualified, highly effective teachers’ to ‘Every student needs us.’ TFA’s model depends on being able to concentrate their people in low-income, high-minority schools, and they thought that was a good thing. And if the law incentivized districts to hire other types of teachers ahead of TFA, well, they didn’t want that. They wanted to be seen on the same level, and some in leadership truly believe that TFA’s teachers-in-training are as good or even better qualified than certified teachers who might apply.”

TFA fought the lawsuit in court and lost, then flexed its political muscles in Congress to protect its interests. The Democrat-controlled Congress overrode the court decision, which infuriated civil rights groups, which actually wanted highly qualified teachers in the classrooms of the neediest students.

The civil rights groups turned to Senator Sanders to fight their battle against TFA. He took up their banner, insisting that “highly qualified” should actually mean “highly qualified.”

In a Senate HELP committee hearing, Sanders emphasized that his amendments would not conflict with the goal of attracting new, bright teachers to the classroom, and said he is “a strong supporter of programs like Teach for America and other efforts to attract young people into education.” But, he stressed, it is wrong to characterize someone starting in the classroom two months after college graduation as already highly prepared.

“I think most of the people around this table would agree that doesn’t make any sense,” Sanders said. “That doesn’t make that person not a good teacher, not an inspired teacher; it simply does not make that teacher ‘highly qualified.’”

“If you had a heart condition, and you were going to go to a surgeon, you would go to a surgeon who has many surgeries successfully done,” he added. “And while another surgeon may be wonderful, a young surgeon who hasn’t yet performed his first surgery, you would probably go to the experienced [surgeon] who has already achieved a certain level of accomplishment.”

But Sanders’ efforts were countered and ultimately defeated by the persistent opposition of Senator Michael Bennett, recently appointed to the Senate after serving as superintendent of the Denver Public Schools. Bennett was and is a huge supporter of corporate reform. He is not an educator. Before his appointment to manage the Denver schools, he was a financier.

When the issue came up again a year later, members of Congress were lobbied by billionaire Eli Broad, who was then vice-president of the neoliberal Center for American Progress and an array of corporate charter chains, which needed TFA recruits. They falsely claimed that without the TFA loophole, “hundreds of thousands of tremendously gifted teachers who have a significant impact on students will not be able to continue to teach.”

Cohen points out that Congresswoman Rosa DeLauro conducted a study that determined that more than 800,000 of the nation’s neediest students had teachers who were still in training, not certified, certainly not “highly qualified.”

This is an excellent analysis of how TFA flexed its muscles and power to defend its self-interest, undermine the plain language of the law, and inflict unqualified teachers on children who actually needed—but didn’t get—highly qualified teachers.

 

 

 

The federal Charter Schools Program handed out $440 Million this year. Betsy DeVos uses this money as her personal slush fund to reward corporate charter chains like KIPP ($89 million), IDEA (over $200 million in two years), and Success Academy ($10 million). Originally, it was meant to launch start-up charters, but DeVos has turned it into a free-flowing spigot for some of the nation’s richest charter chains.

Last March, the Network for Public Education published its study of the ineptness of the Charter Schools Program, revealing that at least one-third of the charters it funded had either never opened or had closed soon after opening. About one billion dollars was wasted by this federal program.

Despite the program’s manifest incompetence and failure, Betsy DeVos asked Congressional appropriators to increase its funding to $500 million a year, so she could more efficiently undermine public schools across the nation.

House Democrats responded by cutting the Charter Schools Program to $400 Million ($400 million too much), but $100 million less than DeVos asked for.

Senate Republicans want to increase the funding for the destructive Charter Schools Program to $460 million, giving DeVos a boost of $20 million. The Senate Republicans added a special appropriation of $7.5 million for charter schools in rural districts. Is there a need for charter schools in rural districts that may have only one elementary school and one high school?

The best remedy for the federal Charter Schools Program would be to eliminate it altogether.

Charter schools are amply funded by the Walton Family Foundation, the Gates Foundation, Reed Hastings, Eli Broad, Michael Bloomberg, the Koch foundation’s, hedge fund managers, and a bevy of other billionaires on Wall Street and in Silicon Valley.

 

 

Tom Ultican, retired teacher of advanced mathematics and physics, has written a series of posts about the Destroy Public Education Movement. In this comprehensive post, he reviews the unimpressive but very expensive charter sector in the District of Columbia. Many charter operators have made big salaries and the British testing corporation Pearson has been enriched, but charter performance has lagged behind that of the public schools for the past two years. The District continues to have the biggest achievement gaps between racial groups of any urban district in the nation.

The District has had an intense love affair with Broadies. Mayor Muriel Bowser, who completely controls the schools, prefers Broadies, despite their continued failures.

The Mayor has almost dictatorial control over the school system with very little input from teachers, students or parents. When Muriel Bowser was elected Mayor in 2014, she inherited school Chancellor, Kaya Henderson. Bowser appointed Jennifer Niles as her chief education advisor with the title Deputy Mayor for Education. Niles was well known in the charter school circles having founded the E. L. Haynes Charter School in 2004. Niles was forced to resign when it came to light that she had made it possible for Chancellor Antwan Wilson to secretly transfer his daughter to a preferred school against his own rules.

Bowser has an affinity for education leaders that have gone through Eli Broad’s unaccredited Superintendents Academy. She is a Democratic politician who appreciates Broad’s well documented history of spending lavishly to privatize public-schools. When Kaya Henderson resigned as chancellor in 2016, Antwan Wilson from the Broad Academy class of 2012-2014, was Bowser’s choice to replace her. Subsequent scandal forced the Mayor to replace both the Chancellor and the Deputy Mayor in 2018. For Chancellor, she chose Louis Ferebee who is not only a member of Jeb Bush’s Chiefs for Change, but is also a graduate with the Broad Academy class of 2017-2018. The new Deputy Mayor chosen was Paul Kihn Broad Academy Class of 2014-2015.

With the control Mayor Bowser has over public education, she has made the DCPS webpage look more like a vote for Bowser publication than a school information site.

Ultican describes the high levels of segregation in the charter schools, as well as the high salaries.

Mayor Bowser has handed control of the charter board over to the charter industry, which guarantees no oversight or accountability.

In the 2018-2019 school year Washington DC had 116 charter schools reporting attendance. Of that number 92 or 82% of the schools reported more than 90% Black and Hispanic students. Thirty charter schools or 26% reported over 98% Black students. These are startlingly high rates of segregation.

Of the 15 KIPP DC charter schools, all of them reported 96% or more Black students. According to their 2017 tax filings seven KIPP DC administrators took home $1,546,494. The smallest salary was $184,310.

Along with this profiteering, the seven people Mayor Bowser appointed to lead the Public Charter School Board seem more like charter industry insiders than protectors of the public trust.

*Jim Sandman (Member): President of the Legal Services Corporation.

Shouldn’t it be a conflict of interest to place members of the charter industry on the board in charge of supervising them?

 

Jan Resseger writes here about the difference between Superintendents who understand the importance of collaborating with and respecting the community they serve, and the Superintendents connected to Jeb Bush’s Chiefs for Change, who believe in state takeovers and imposing their views on their communities. She might have added the Brodie’s to the latter category, those who are “graduates” of the Broad Superintendents Academy. The BS Academy teaches Eli Broad’s corporate-style of Top-Down management.

She writes:

There is an ongoing battle of values and language that shapes the way we think about and talk about education.  The current threats across several states of state takeover of school districts are perhaps the best example of this conflict.  According to the Chiefs for Change model, the school district in Providence has recently been taken over by the state of Rhode Island.  Texas now threatens to take over the public schools in Houston. In Ohio, four years of state takeover has created chaos in Lorain and dissatisfaction in Youngstown.  East Cleveland is now in the process of being taken over, and the Legislature has instituted a one-year moratorium while lawmakers figure out whether to proceed with threatened takeovers of the public school districts in Columbus, Dayton, Toledo, Canton, Ashtabula, Lima, Mansfield, Painesville, Euclid, and North College Hill.

Among the most painful situations this summer is the threatened closure of the high school or the state takeover of the school district in Benton Harbor, Michigan, a segregated African American community and one of the poorest in the state.  Michigan has actively expanded school choice with charter schools and an inter-district open enrollment program in which students carry away their school funding. The statewide expansion of charters and inter-district school choice has undermined the most vulnerable school districts and triggered a number of state takeover actions.  Michigan State University’s David Arnsen explains: “In Michigan, all the money moves with the students. So it doesn’t take account of the impact on the districts and students who are not active choosers… When the child leaves, all the state and local funding moves with that student. The revenue moves immediately and that drops faster than the costs… In every case they (districts losing students to Schools of Choice) are districts that are predominantly African American and poor children and they suffered terrific losses of enrollment and revenue….”

Benton Harbor—heavily in debt and struggling academically—has been threatened with state intervention like Inkster, Buena Vista, Highland Park, and Muskegon Heights—whole school districts which were closed, charterized, or put under emergency manager control by former governor Rick Snyder.  Now the new Governor Gretchen Whitmer has threatened to close the high school in Benton Harbor or eventually close the district.

If your superintendent supports state takeovers, mass firings, replacing public schools with charter schools, or other corporate management strategies, he is not on the side of your community.

 

 

The house of cards and propaganda that sustained the charter industry is beginning to crumble. Despite the Obama-Duncan promotion of charters through the disastrous Race to the Top program, no Democrat in the crowded presidential race will openly endorse charter schools. Not even Cory Booker will support charters, despite two decades of fighting for them.

Now, it is no longer cool for a Democrats to back charters.

Democrats support public schools, not charters, vouchers, or privatization. Thank you, Betsy DeVos, for clearing the air.

Shawgi Tell of Nazareth College in upstate New York describes what happened when Democratic Governor Tom Wolf stated the obvious: Charter Schools Are NOT public schools. 

Tell writes:

Calling a charter school public is mainly for the self-serving purpose of illegitimately funneling vast sums of public money from public schools to wealthy private interests who own-operate nonprofit and for-profit charter schools. Charter schools are essentially pay-the-rich schemes masquerading as “innovations” that “save public education” and “give parents choices.”

Charter school owners-operators would not be able to fleece public money from public schools if they were openly recognized as the privatized arrangements that they are. Most people understand that public money belongs solely to the public, not private interests. They understand that public wealth must be used only for public purposes and that private interests have no right to decide how to use public money.

 

 

This is a puzzlement. Andy Stern was once one of the nation’s most important labor leaders as head of the Service Employees International Union (SEIU). After he stepped down, he became close to Eli Broad and joined the billionaires’ fight against teachers’ unions!  

Hamilton Nolan writes:

Andy Stern spent 14 years as the head of the SEIU, America’s most politically active labor union. He was perhaps the most visible union leader in America. And what is he doing now? He’s lending his name to a billionaire-funded astroturf group that aims to quash the power of teacher’s unions.

When Stern left the SEIU in 2010, he was a true political power player—his official bio, in fact, brags that “Stern has visited the White House more frequently than any other single person during the Obama Administration.” Under his leadership, his union dramatically grew its membership and helped Barack Obama get elected. But his successes came at a cost. Stern developed a reputation as a business-friendly union leader, known for striking deals with companies that were often seen as too weak by many in the labor movement. Under the guise of modernization and growth, Stern seemed to lose his connection to the grassroots, radical, people-powered aspects of the union world. In 2010, The Nation quoted one union leader as saying, “Andy Stern leaves pretty much without a friend in the labor movement.”

His post-SEIU years have only intensified this feeling. Stern has spent the past decade serving on corporate boards, touting the idea of a universal basic income as an economic solution superior to building labor power, and further ingratiating himself to corporate America as a sort of post-union ambassador to the Aspen Institute world. He also took a seat on the board of the Broad Foundation, a billionaire-funded group that pushed charter schools—raising eyebrows from teacher’s unions, who are often cast as the villain by wealthy reformers seeking to build alternatives to America’s public education system…

The most prominent and powerful American labor actions of the past year were the teacher’s strikes that swept the nation, from West Virginia to California. Public school teachers have, more than anyone, been the most visible engine of recent union militancy. And as all of that was happening, here is what Andy Stern did: in April of this year, he was announced as an official adviser of the National Parents Union, an education reform group with deep ties to the Walton Foundation, the charitable arm of the family of Walmart heirs, the single richest family in America. (Charter schools are a major focus of the Walton Foundation; the NPU’s board members are affiliated with a variety of groups that have received significant Walton Foundation funding, and its co-leader is an executive at Green Dot Public Schools, a charter group funded in part by the Waltons.)…

The SEIU—still a politically active union, and one which is now having its name used, to fight against teacher’s unions, by a corporate-friendly former president who maintains a higher profile than the union’s current president—did not offer any comment.

 

Nick Melvoin was elected to the board of the Los Angeles Unified School District with the most money ever spent on a school board election in American history. The money came from the charter lobby.

It was not hard to assume that he owed an enormous debt of gratitude to Eli Broad, Reed Hastings, Richard Riordan, Bill Bloomfield, and the other uber-rich who funded his election.

Yet, I feel sorry for Nick, whom I have never met.

Michael Kohlhaas just posted emails from his treasure trove of leaked materials that show that Nick was so indebted to the charter lobby that he asked them to write the resolutions that would benefit them. He didn’t write them himself. He asked the California Charter Schools Association to do it for him.

This has got to be deeply humiliating because it shows him to be a complete sellout, a tool.

I am embarrassed for him.

Kohlhaas finds it ironic that the Los Angeles Times endorsed Nick because he would be “an independent thinker.” It turns out that he is not an independent thinker. He is owned by the charter industry and he knows it.

Kohlhaas begins:

We’ve already seen that LAUSD officials, both elected and appointed, have a sickening penchant for sharing confidential materials with Charter lobbyists, giving them advance input into official policy proposals, and so on. I’ve recently reported, e.g., on an episode from September 2018 where Austin Beutner allowed Cassy Horton and Jed Wallace of the California Charter School Association to vet an upcoming speech and also to talk in advance with his speechwriterto explain what they thought ought to be included. Convicted felon slash former schoolboard member Ref Rodriguez did the same thing in March 2018 with respect to a board proposal.

And it turns out that, beginning in January 2018, LAUSD Board member and charter school bootlicker Icky Sticky Nicky Melvoin1was involved in a very similar scheme having to do with LAUSD policies on school facilities, a subject which sounds tedious but is actually bureaucratic code for real estate, a subject which is at the very center of the zillionaire plan to loot the public treasure-stores for their own gain.2

Basically the proposal, which seems never to have made it out of the secret meetings, would have called for LAUSD to list all its facilities so that the privatizers could choose which ones to target, to allocate facilities between charter schools and public schools based on excellence and student success rather than on need, to authorize a putatively neutral third party to settle disputes over co-location offers, to study how to sell or lease LAUSD property to charters, and to do something complicated with bonds used to fund facilities. It all seems incredibly shady, shady beyond belief.

No one knows how Kohlhaas got these emails but no one has questioned their veracity.

What he has revealed so far is the worst kind of corruption: intellectual corruption, moral corruption, ethical corruption. That may be even worse than dollar corruption because it shows a hole in your soul.

There must be many people trembling to think what might come next.

 

Roland Fryer Jr.s Education Innovation lab at Harvard was funded primarily by Eli Broad’s Foundation. Fryer received numerous prestigious awards for his work a san economist. He was the “chief equality officer” for the NYC Department of Education under Joel Klein.

Eli Broad, Michael Bloomberg, Reed Hastings and other billionaires have funded the campaigns of charter advocates. The billionaires spent many  millions to gain control, only to see one member of their slim majority—Ref Rodriguez— indicted for campaign finance violations. Even after his indictment, however, he refused to step down for nearly a year until after the board had chosen businessman Austin Beutner  as superintendent.

But everything changed after the election of Jackie Goldberg, who won Rodriguez’s seat.
