The U.S. Department of Education has been a major force in protecting the civil rights of students and promoting desegregation.
But, writes Jeff Bryant, these issues do not seem to be part of Betsy DeVos’s agenda. Nor are they a high priority for Jeff Sessions at the Justice Department.
He writes:
“So far, Trump’s Education Secretary Betsy DeVos has sent numerous signs she is assembling a staff and laying down a policy mindset that seems indifferent – if not outright averse – to the needs of nonwhite students.
“DeVos has taken the helm of federal education policy at a time when black and brown school children and youth critically need leaders in the federal government to address their needs.
“The number of Latino, African-American, and Asian students in public K-12 schools passed the number of non-Hispanic whites over two years ago. Nevertheless, schools have become more racially segregated than they were 40 years ago.
“The weight of research evidence shows when schools are racially and socioeconomically integrated, all students – even the white kids – benefit academically and in their social and emotional capabilities. Yet, without strong federal leadership, states and local districts generally shirk their responsibilities to enforce school integration.
“Racial segregation is not the only problem nonwhite students confront in schools. Students of color in our nation’s schools are disproportionally more apt to receive out-of-school suspensions than their white peers, which significantly raises their tendency to eventually get entangled in the criminal justice system. A recent report from the Center for Popular Democracy found that in New York City alone these punitive school discipline programs cost the city more than $746 million annually.
“How may we expect a DeVos administration to step up to address these challenges?
“As I reported shortly after her nomination, DeVos has a problematic track record on civil rights, based on her actions in Michigan to promote school choice programs that significantly worsened the state’s racial and socioeconomic segregation of schools.
“In one of her earliest moves as Secretary, DeVos announced her department’s decision to end a federal grant program created during the Obama administration to encourage more diversity in schools. Experts on poverty and race had called her handling of that program “a real test of her commitment to school integration.” She flunked it.
“More alarming is recent news of how many new hires for the education department have a history of making racially offensive comments and expressing controversial opinions on efforts to level the social and economic playing field for African-Americans and other racial minorities.”
Choice promotes segregation by race, religion, and income. The more she sticks to the only script she knows, the more segregated our society will become.
To hear her and Trump speak about education as “the civil rights issue of our time” is to drown in hypocrisy.

DeVos NEVER had to be concerned about HER civil rights.

SO pardon me, if I and two hundred thousand former teachers are not shocked when DeVOS does her thing.

HERE IS A little STORY, that illuminates the behavior. I am a playwright by nature, and I know that there are ‘scenes’ that tell it all. Years ago, I told this little moment to someone I knew— Dan Rather — and it astonished him, too.
Let me be clear; when I was removed from my celebrated practice I spent 6 MONTHS at the district office (this is the rubber room) WITHOUT A WORD FROM MY UNION DESPITE GRIEVANCES.
(Again… I was THE NYS Educator of Excellence—>>> freak’n FAMOUS!
and being filmed for Harvard and Pew ( I was the cohort for the REAL New Standards research whites whether could not just charge me with INCOMPETENCE…a favorite ploy…which eventually they tried, too.)
Finally, in September, after they had trashed my practice, decimated my room, stolen my books and materials, I was called in for a meeting!
If an American was jailed for six months, wouldn’t the right o confront an accuser come into play?
Onlyif there was a legal rep… a lawyer! The union is our lawyer!!!
Instead of discovering why I had been removed from a famous practice, I was TOLD that I had BEEN FOUND GUILTY OF CORPORAL PUNISHMENT.
HUH? Wait! What?
YUP. No charges, no hearing… the SUPERINTENDENT OF DISTRICT 2, ELAINE FINK, SAID SO, and she WROTE A LETTER — claiming that a false allegation that I HAD CURSED at a child, was in her opinion, corporal punishment. SHE SPREAD IT FAR AND WIDE…to the school slandering me!
Civil rights! hahahahahaha! LOL!
HERE IS MY POINT>>> the head of the Manhattan Bureau,, Ivan Tiger (long since gone) sat there, at that ‘meeting’ as that letter was read —- and said not a word.
However, I said. “WAIT WHAT?”
he told me to be quiet and to sit down!
I asked for their ‘investigation’. Apparently students A,B,C,D.E and F, had been questioned, and 2 of them said “Yeah she cursed” but their names were confidential!
HUH? No right to confront accusers.
SO DO NOT TALK TO ME ABOUT BETTY DEVOS!
The fact that, even if it Were true,it aint’ corporal punishment, did not phase my school union rep or THE MANHATTAN BIG HONCHO! MR. UFT SAT THERE, MUTE!
I walked out and a parent found an attorney to file a suit (IT IS NOT easy to find anyone to go up against the NYC BOE, or the union) and for my 25 THOUSAND, the charges disappeared (and so did IVAN) but I never saw my practice again… and you all know the story.
SO, WHAT HAPPENED NEXT TO SUSAN LEE SCHWARTZ, back at the schools that she helped to put on the map of NYC????
In the closet, where I was housed now, teaching 7 kids a period instead of the entire seventh grade, the NEW principal came daily, to find problems, and then to fill my employment folder with documents of my incompetence!
I filed grievances. NO UNION came to my rescue—- I have a tape recording of Ian the terrible HANGING UP ON ME!
SO, they put be back in the rubber room, saying this time THAT I HAD told a teacher that I THREATENED TO KILL THE PRINCIPAL….
At THAT point, my husband. my hero, called Randi Weingarten direct, and she got me a medical leave… and then arranged for arbitration so I would keep my benefits… as they FORCED ME OUT!
Seeing Randi and DeVos side by side does not surprise anyone who was teaching in the nineties, as NYC was EMPTIED OF ITS EXPERIENCED TEACHER-PRACTITIONERS. Today, the last of them like Francesco Portelos are subs, and being harassed out. (Google him)
THAT is the BIGGEST UNION IN THE NATION and why charter schools began to get public money, and schools began to share space with these funded entities, while being starved for money.

Our removal is the CRUX OF WHAT IS HAPPENING NOW, and it is virtually UNKNOWN.

On yesterday’s news, there was a story on the first charter school for Alabama. The school will be in Mobile, and it will run by ACCEL serving high school students that do not “fit” into traditional settings. The representatives from the school were African American, and they stated that the school is a “big win for civil rights.”

Retired teacher, it is a shame that the privatization movement has co-opted the language of civil rights, when they are actually creating a dual school system.
Pouring resources into the public schools of Alabama would be a “big win for civil rights.” That’s where the overwhelming majority of the children are..

THE most important civil rights issue involving education today is the state mandated standardized testing that results in discrimination against students whose inherent mental capabilities are considered less than desirable.
Just as African Americans were considered less than desirable, just as women were considered less than desirable and just as those with disabilities were considered less than desirable and who received, or even didn’t receive less than a proper education, and that the discriminatory practices against those groups were adjudicated to be unconstitutional as abridging the rights of those in those groups, so too, hopefully the disgustingly discriminatory effects of standardized testing will eventually be declared so by the courts.
It’s a long haul process but we need to address this issue in the courts, somehow.

There are multiple and overlapping forms of segregation that choice advocates want. They want segregated schools and from a long menu of possibilities. Segregation may be based on race, gender, ethnicity, religion, socioeconomic class, ablities, and other categories that deny we can and should learn to live together.

Of the “other categories”, right now, THE most important one is segregation/discrimination by mental capabilities/abilities as is done in and is the heart of the standardized testing regime.
