State Senator John C. Sheehan was one of many people in Rhode Island who wondered what State Commissioner of Education Deborah Gist wrote in the dissertation she completed in June 2012. It was about creating a new teacher evaluation system for the state, and Gist would not allow anyone to read it.

Sheehan eventually got a copy of the embargoed dissertation, and he understood why she wanted to keep it under wraps. The theory she wrote about was leadership based on respect and collaboration, on trust and “buy-in,”but her practice was heavy-handed, confrontational, and top-down.

Sheehan recalled the mass firing of staff at Central Falls High School, then the mass firing of teachers in Providence.

Sheehan wrote:

“As soon as students underperformed on tests, teachers were blamed for the failure, resulting in unprecedented low morale. The Gist reaction was on national display when all of the teachers at Central Falls High School were fired. The individual merits of the teachers did not matter nor did it matter if students had applied themselves or were disadvantaged. Under Gist’s leadership philosophy (corporate reform), all teachers were held strictly accountable for low school test scores. Educators were again broadsided by the mass firing of all of the teachers in Providence, a year later. What hurt the commissioner’s credibility in Providence was her defense of wholesale firings, calling them a “good and just cause” [ignoring RIDE’s own case law which would have prohibited firing all teachers].”

“Good leaders lead by example. If Gist were to do so, she would hold herself to the same standard and consequence for performance failure as she does teachers. In the new evaluation, teachers must develop Student Learning Objectives to be used to demonstrate their students are continually making progress based on standardized tests or other measures of student performance. If teachers do not meet this standard, they can be deemed “ineffective”. If teachers do not improve after a year, they face termination as had teachers in Central Falls Ironically, the Department of Education, at Gist’s request, has set 33 targets for statewide student performance. The bulk of them are related to closing the achievement gap while a few involve graduation rates and how students do after high school. In 2012, the state reached just 1 out of those 33 targets. In other years, under Gist’s leadership, RIDE did not fair much better. Yet, the commissioner is not held to account for these dismal results.”

He added:

“Gist failed to get the level of “buy-in” necessary to create a fair evaluation system that would garner the support of a majority of teachers. That failure was not due to teachers’ fear of change or being held accountable, but to the Commissioner’s own poor leadership ability. Befittingly, 82% of public school teachers polled had a negative view of Gist’s job performance! All things considered, I can appreciate why she wanted to keep her dissertation out of the public eye as long as possible.”

Levi B. Caener, a special education teacher in Idaho, happened to read a publication by the National Governors Association “A Governor’s Guide to Human Capital Development.” Really. People who work for the NGA think of children as “human capital.” Do they have children? When they come from the office, do they say, “hello, my little human capital?” On the weekends, do they play ball or go to the zoo with their human capital? Do they take their human capital for a new pair of shoes?

Levi writes:

“Yes teachers and parents; we are not instructing creative individuals to become well rounded global citizens. On the contrary, we are building “human capital” and thus the job of a teacher, and consequently the instruction, must be collectivized to the extent that every widget, ahem, student can contribute to whatever the central planning authority (or the National Governors Association – NGA) dictates is appropriate….Never mind that creativity stuff. Nobody cares. Teachers aren’t meant to create artists or independently thinking individuals. No, we are creating human capital! Thus, a one-size-fits all approach is not only recommended, it is required in order to fulfill the vision of utopian human capital!”

He concludes:

“So let me go on the record. According to this report I am bad human capital.

“You see, I want to inspire my students. I believe that every one of them can be successful in their individual pursuits. Sometimes, certainly, this is within the corporate structure of wages, salaries, etc.

“However, I am just as eager to motivate the artists: the painters, the poets, the musicians, the sculptors. I encourage my students to think critically of the country and world they live in, and to use credible evidence researched to support their claims.

“While I want students to be able to perform as well as they can in any assessment situation, including a standardized format, I am well aware that such a single snapshot is not reflective of a student as a whole. Yet, the National Governor’s Association wants to use this single snapshot to drive education policy.

“Using a single snapshot of information is synonymous to assuming since it is raining today, it must rain tomorrow. In the absence of other measures or input, there is no logic to suggest otherwise.

“The fallacy of using standardized data leads to poor planning of education policy; however, more importantly, it leads to treating students as “human capital” instead of incredible individuals ready to be challenged and immersed critical thinking and motivated by personal inquiry and personal fulfillment of understanding new topics.

“Sorry National Governors Association. I am content to be bad human capital. I will continue promoting an individualized approach to education that recognized I am not a robot and my students are not widgets.”

Allie Gross arrived to teach in Detroit as a Teach for America recruit. Her three years in a charter school opened her eyes. She saw classrooms without supplies, children promoted who were not ready and did not get the intervention they needed, she saw feckless leadership promoted to larger roles. And she saw the growth of an industry. In this article, she describes what she learned about “the charter school profiteers.”

Here is a sample of a fascinating and disturbing portrait of what is happening in Detroit:

“In charter-heavy Detroit, permissive regulations have created an environment ripe for mismanagement.

“According to the National Alliance for Public Charter Schools, Detroit ranks number two nationally for charter enrollment. The city is right behind New Orleans, with over half of its school-aged students attending a charter school in the 2012-2013 school year. That number will no doubt rise now that Michigan has lifted its cap on charter schools. Even more pernicious, the majority of them are run by for-profit education management organizations (EMOs). According to a report by the National Education Policy Center, Michigan has the highest proportion of for-profit EMOS running their charter schools — 79 percent of the total.

“Privatization and limited oversight have conspired to produce a new figure: the education entrepreneur. In the chaos of the Detroit school system, education entrepreneurs see an opportunity for experimentation, innovation, and venture capital. And the decentralized nature of charter schools works to their advantage. With little coherence across schools, the issue of serial education entrepreneurs emerges. Those with limited track records of success are able to wedge their ways into school after school, with nobody checking up on past performance.”

The mainstream media love to point to New Orleans as the national exemplar of the new brand of “reform”: replace public schools with privately-managed charter schools and get rid of the teachers’ union. Success! Many cities, especially those with high concentrations of poor African-American majorities, such as Detroit, Newark, and Philadelphia, seek to copy the New Orleans model.

What really happened in New Orleans?

“The state of education in New Orleans is often presented as a sort of grand bargain: on the one hand, the neoliberal transformation has been undemocratic and has marginalized community members, parents, and educational professionals; on the other hand, advocates of reform are quick to cite higher test and state school performance scores as evidence that the reforms have been successful. While the former is true, the claim that there has been substantial improvement in the educational experiences of young people is unfounded.

“In such a market-based system, students’ assessment data are used to compare charter providers, recruit families, maintain charter contracts, and reward teachers. The willingness of reform advocates to hold up test scores as the key indicator of success places enormous pressure on schools and teachers to produce quantifiable results. When the focus is on increasing assessment data, what happens to the democratic purposes of schooling?

“If we are willing to accept that the purpose of schooling goes beyond raising test scores, and is in fact tied to preparing citizens to engage in and deepen our democracy, then we need to look more closely at how power has been distributed in school governance across New Orleans and the ways in which this distribution shapes the experiences of students.

“We must ask if we are raising test scores at the expense of raising citizens.”

Recently:

FBI raided 19 Gulen-affiliated schools in Ohio and two other states.

Former teachers asked the state school board determine why apparent test tampering and other irregularities at the Gulen Horizon Science Academy in Dayton were covered up.

After hearing explosive testimony from teachers about cheating, racism and sexism, a state school board member asked for all 19 Gulen schools to be investigated but the Ohio Department of Education is limiting the probe to just one school.

A new study by Innovation Ohio suggests cheating has been systemic at Gulen’s Horizon Science Academy in Columbus.

Yet the state is still not aggressively investigating these allegations.

When Campbell Brown’s Vergara-style trial moves to New York City, its star witnesses should testify for the defense, not the plaintiffs, argues Gary Rubinstein of New York City. Tom Kane of Harvard testified in Los Angeles that teachers in New York City were not maldistributed, as they were in Los Angeles. Another star witness for the Los Angeles was Raj Chetty.

Rubinstein reviewed their testimony, and concluded that their testimony could be used by the defense in New York City.

He wrote:

“Also a major witness was Raj Chetty who published a big paper about how students who had teachers with higher value-added scores made more money in life. These conclusions have been challenged pretty convincingly, but still even the President paraphrased the paper in one of his State of The Union addresses.

“So now there will be a Vergara-like trial in New York City. The prosecution has some very heavy hitters. For the defense, I don’t know. The defendants are people like John King. I wouldn’t be surprised if many of the defendants hope to lose the trial and maybe won’t get the best representation to go against a dream team rivaling the OJ Simpson lawyers.

“But the New York trial, with competent defense attorneys, should be much easier to win. First of all, New York has a three year tenure process, which is something that was argued would be a reasonable amount of time, even by the prosecutors, during the Vergara case…..

“Later on, Kane explains to the defense that Chetty also did not find that ‘ineffective’ teachers were disproportionately assigned to poor students.

Q AND WITH RESPECT TO THIS MALDISTRIBUTION OF EFFECTIVE TEACHERS, PROFESSOR CHETTY DID NOT FIND THIS MALDISTRIBUTION IN THE NEW YORK CITY SCHOOLS; CORRECT?

A THAT’S MY READING OF HIS RESULTS, YES.

So it seems that this would make Kane and Chetty pretty bad witnesses for the New York case. Perhaps they will get other witnesses, or they will get Kane and Chetty and hope that the defense doesn’t have (or doesn’t care to do) what it takes to go up against the big hired pro-bono guns. If only I had gone to law school, like I had originally planned, rather than do TFA, I’m sure I could win this case.”

But the biggest problem the prosecutors are going to have is that in the Vergara case, Kane had said in his testimony that poor kids in Los Angeles had a disproportionate percent of ineffective teachers, according to his research. To show how bad it was, he compared it to New York where this same phenomenon did not occur.”

In an interview with “The Notebook,” civil rights attorney Michael Churchill of the Public Interest Law Center of Philadelphia explains why previous litigation failed and what should happen now to assure that all children get a “thorough and efficient system of public education,” as the law requires.

Here is a small part of a very informative exchange:

Q.: What other legislative or policy fixes could help settle the District’s long-term finances?

A. There are lots. The charter funding formula is absolutely crazy, one of the worst in the country.

But that’s small potatoes compared to our single biggest problem – the state puts in too small a share of funding. Pennsylvania appropriates about 35 percent of the cost of public education. Pennsylvania needs to get up to about 50 percent of the cost of education.

And while they’re figuring that out, they need to calculate real costs – like the cost of educating kids in poverty. When you do that, you’ll take care of the problems. Everything else is just cosmetic – moving around the deck chairs on the Titanic, as people like to say.

We do actually have a commission to look into a new funding formula that’ll start this summer. But we know the solutions. It’s not a mystery. What’s lacking is political will.

Q.: What about the city? Is it contributing enough?

A. Philadelphia used to be near the bottom of local contributions. Now we’re contributing above the median of the rest of the state. This is clearly now a state problem, not a Philadelphia problem.

Q.: Last time we had a funding formula, it didn’t last. Is there any way to compel legislators to use whatever they create?

A.: Most other states have found that the judiciary will step in and say that the constitution [which in Pennsylvania requires a “a thorough and efficient system of public education”] has to be upheld.

In the 1990s, Pennsylvania’s judiciary decided they would not step in. They had some reasons why, but many of those have changed.

For example, we don’t have local control at the level we used to. The state now sets graduation standards. The state sets testing standards. The state tells districts how they have to spend money.

Therefore, there are much stronger grounds for judicial intervention to make sure that the state is providing adequate funding. That’s my thought on the matter. We’ll have to see whether the judiciary agrees.

Q.: Let’s go back to charter finances. What are some policy changes that could stabilize the whole system?

A.: There’s a whole range of numbers that need to be looked at so that there’s some relationship to cost.

For example, charters have been paid for special education at a rate that’s completely phony, year after year. Chester gets paid $36,000 per special-ed student. But most of them are getting “language and occupational therapy” once a week. That’s a minimal expense.

The cyber charters, which are the fastest-growing section of the charter movement, don’t have any of the same costs as brick-and-mortar charters, but they get the same money. The state hasn’t been able to fix that one, even though the auditor general has been writing reports about it for six years. It’s a complete waste of valuable resources.

And then, there needs to be a complete new set of transparency rules, so we know what charters are spending and accomplishing, and we don’t have the kind of waste and fraud we’ve seen.

Q.: What’s your plan to influence the governor’s race this fall?

A.: I believe that by the fall, we’ll be engaged in the kind of litigation like we talked about, to lay out the facts as to why 50 percent of the schools in Pennsylvania do not meet the standards the state has set for itself.

That’s a massive failure, and it’s closely related to underfunding – which has been known since 2007, when the state issued a report about real costs. We’ll bring that to the attention of the courts and the public.

Q.: The counter-argument is that we need to reduce costs, not spend more. Why shouldn’t Philadelphia be thinking about strategically increasing charter enrollment? Would that drive costs down?

A.: There’s no evidence that that really does, or that it’s sustainable over any length of time. That strategy relies on churn — lots of young teachers who turn over constantly. That is the enemy of a slow-and-steady progress model.

In Chester, for example, they have the largest charter population of any district in the state [by percentage], but they’re no further ahead than other students. But it does cost a great deal more, and a lot of that money is being funneled off into private payrolls.

I think everybody’s been surprised at some of the good things we’ve seen in charters that can be used in regular schools.

But we need to find ways that we adapt those, rather than create so much change that it sets back progress. We don’t want a two-tiered system. We don’t want public schools to be only for those who can’t figure out how to get out of them. What happens inevitably as you privatize is, things become stratified. To me, that would be far too high a price to pay.

Peter Greene regretfully, apologetically disagrees with Susan Ohanian, who recently expressed disappointment that the two national unions did not call on teachers to boycott testing. He says it would do no good because they would be fired and replaced by teachers happy to give tests and have a job. He says, pick your fights with care.

I am not sure I agree with Peter on this one. I agree that if a handful of teachers refused to give the state tests, they would be fired. But if an entire school refused to do it, they would send a loud message and probably no one would be fired. That was the lesson of Garfield High School in Seattle. When the teachers stood together, no one was punished.

Best of all would be if the principal and superintendent led the test boycott and carefully explained that they do not oppose all tests. tests should be used for diagnostic purposes, not for ranking and rating. learning is a process, not a race. School boards should declare that they oppose the deluge of testing that has third graders taking tests that last eight hours, that they oppose standardized tests for children in the k-2 grades, that they oppose the use of standardized tests for high stakes, that they oppose devoting a month of instructional time to testing. It would take extraordinary leadership and integrity and wisdom to stand up to the testing regime that has warped education. What a statement that would be!

Even better would be widespread parent boycotts. No one can fire parents. They have it in their power to pull the plug on this mess. I hope it comes to that.

Those who follow the twists and turns of the “reform ” movement are aware of a growing number of books that exposé the false narrative of reform. The reform narrative is funded by billionaires and philanthropists who believe in the free market and scorn government regulation. It fastens on genuine problems–like the low performance of children who live in poverty–and blames their teachers rather than the poverty that limits their opportunity. The reformers divert their eyes from poverty, segregation, budget cuts, and loss of vital services. What began, arguably, as a well-intentioned effort to shake up schools and unleash innovation has now become a vehicle for privatization of the public schools.

The struggle to save public education will require an informed public. Only an informed public will have the motivation to vote for representatives to defend what belongs to the entire community and to stop the headlong rush to consumerism. Fortunately, teachers and other educators are publishing books to tell the story. The blogosphere and social media have become invaluable means of democratic communication, enabling dissenters from top-down reform to meet and exchange ideas and information.

Videos are appearing too, to get the story to the public. It is not easy for them to get on television or to be distributed commercially. Unlike the charter propaganda “Waiting for Superman,” or “Won’t Back Down,” the films that exposé the dark side of the testing and privatization movement do not have the support of billionaires.

Here are a few of the recent must-see videos that challenge the corporate reform movement.

Vicki Abeles’ “Race to Nowhere” makes the case against high-stakes testing and shows how it distorts the lives of adolescents. Abeles has taken the film to churches, synagogues, community centers across the nation, wherever she can show it.

The film “Rise Above the Mark” was written and produced by educators in West Lafayette, Indiana. It shows what high-stakes testing is doing to the children, teachers, and schools. It is a powerful film.

Daniel Hornberger’s “Standardized” shows how standardized testing is ruining education. The subtitle is, fittingly, “Lies, Money, and Civil Rights: How Testing Is Ruining Public Education.” It includes interviews with prominent educators who denounce the standardization that is now imposed by the federal and state governments.

One of the first videos was released in 2011. “The Inconvenient Truth Behind ‘Waiting for Superman,'” depicts the battle in New York City against corporate education reform, with parents and teachers fighting fruitlessly to save their schools from closure against an unhearing may orally-controlled board. The film was created by a team of teachers and parents called the Grassroots Education Movement.

There are others, and I welcome readers to submit additions to this list. And more are on the way. Help me compile a list of videos that challenge the dominant narrative that fills the airwaves and is destroying public schools, hurting children, dissolving communities, and opening new frontiers for corporate profit.

Many of these films are online for free or the producers will send a video for a nominal fee. Consider showing these films at your next parent and/or teacher meeting. Be informed. There can be no democratic debate when only one side can afford to present its views on television and in commercial films.

Many years ago, in the 1990s and the early years of this century, I was a vigorous participant in what was known as “the reading wars.” I supported phonics and opposed whole language. I was influenced by the work of Jeanne Chall at Harvard, who described the ebb and flow of reading philosophies. I wrote many articles explaining why phonics was crucial and why whole language was deficient. In my book, “Left Back” (2000), I wrote an overview of the reading wars and showed the deficiencies of whole language.

In 1997, Congress created the National Reading Panel, composed of literacy experts who mostly supported phonics. Its report in 2000 strongly endorsed explicit phonics instruction. In 2001, No Child Left Behind included a program called Reading First, which gave large sums to districts that gave preference to phonics. Phonics was winning, for sure. Proponents of whole language (which valued meaning over the mechanics or reading) began calling their program “balanced literacy” to remove the implication that they opposed phonics.

By 2001, it seemed clear that phonics had won the war. But in 2006, the Reading First program blew up; not only were the evaluations unimpressive, but there were allegations of self-dealing and conflicts of interest as some phonics promoters were pushing their own textbooks. And the “war” itself lost steam.

As for me, I no longer think this “war” is a worthy cause. Reading teachers understand that students need both phonics and meaning. They know that children need to be able to sound out words but that it is boring to do that for weeks on end. Children need meaning. They get it when their teachers read to them, and they get it when they learn to read by themselves.

I am no reading expert, but I can see good sense in both approaches. I have seen balanced literacy classes where children were enjoying reading. I understand the importance of phonics as a tool to help children get off to a strong start. Wise teachers know when and how to use the literacy approach they need. Children’s needs are different. Good teachers know that and don’t need to be told by legislators how to teach. (And for older children, I love grammar, spelling, and diagramming sentences).

I read recently that NYC Chancellor Carmen Farina was reviving balanced literacy in the New York City schools, and some of my old allies wrote to ask if I was outraged. No, I was not. Balanced literacy can co-exist with phonics. Children need both decoding and meaning. Most important, they need to learn the joy of reading. It unlocks the door to the storehouse of knowledge.

I am no longer a combatant in the reading wars. What matters most today is the survival of public education. We must stop nonsensical curriculum wars and stand together for equitable funding, stable staffing, and community support for community schools.
