Reed Hastings is a tech entrepreneur, a billionaire, and founder of Netflix. He is determined  to replace public schools with charter schools. He served for a time as president of the state board of education in California. He has donated millions of dollars to the California Charter Schools Association. He was a founder of Rocketship, the charter that places poor kids in front of computers for hours each day and hires TFA to teach them in large classes, but skips the arts. He funds campaigns of charter champions like Nick Melvoin. He recently funded Antonio Villaraigosa for Governor and Marshall Tuck for State Superintendent of Instruction, both of them are part of the charter cabal.

He famously declared his opposition to the very existence of elected school boards.

Governor Andrew Cuomo has never been a friend to public schools or to public school teachers.

He pushed for the harsh and ineffectual test-based teacher evaluations that everyone now acknowledges have failed.

He was the primary driver of state legislation benefitting non-union charter schools. 

Why? Because his biggest campaign funders are hedge fund managers who believe in privatization and want to destroy teachers’ unions.

Now, Cuomo is counting on support from unions and public school teachers in his bid for a third term.

They should ask themselves whether he deserves their support.

It was a frigid February day in Albany, and leaders of New York City’s charter school movement were anxious. They had gone to the capital to court lawmakers, but despite a boisterous showing by parents, there seemed to be little clarity about the future of their schools.

Then, as they were preparing to head home, an intermediary called with a message: Gov. Andrew M. Cuomo wanted to meet.

To their surprise, Mr. Cuomo offered them 45 minutes of his time, in a private conference room. He told them he shared their concern about Mayor Bill de Blasio’s ambivalence toward charter schools and offered to help, according to a person who attended but did not want to be identified as having compromised the privacy of the meeting.

In the days that followed, the governor’s interest seemed to intensify. He instructed charter advocates to organize a large rally in Albany, the person said. The advocates delivered, bringing thousands of parents and students, many of them black, Hispanic, and from low-income communities, to the capital in early March, and eclipsing a pivotal rally for Mr. de Blasio taking place at virtually the same time.

Mr. Cuomo’s office declined on Wednesday to comment on his role.

As the governor worked to solidify support in Albany, his efforts were amplified by an aggressive public relations and lobbying effort financed by a group of charter school backers from the worlds of hedge funds and Wall Street, some of whom have also poured substantial sums into Mr. Cuomo’s campaign (he is up for re-election this fall). The push included a campaign-style advertising blitz that cost more than $5 million and attacked Mr. de Blasio for denying space to three charter schools.

Charter school leaders had built a formidable political operation over the course of a decade, hiring top-flight lobbyists and consultants. They had an ally in former Mayor Michael R. Bloomberg, but Mr. de Blasio promised a sea change, saying that he would charge rent to charter schools that had large financial backing, and that he would temporarily forbid new schools from using public space.

In public, the mayor largely ignored the outcry. At his prekindergarten rally, before a smaller crowd at the Washington Avenue Armory in Albany, Mr. de Blasio spoke about the value of early education. Not far away, a much larger crowd of charter school supporters was gathered on the steps of the State Capitol. In an act that his aides later said was spontaneous, Mr. Cuomo joined the mass of parents and students.

“You are not alone,” he told the roaring crowd. “We will save charter schools.”

The move to protect charter schools had begun months before, when it became clear that Mr. de Blasio was favored to win the mayoral race. Charter school leaders were in a panic; a memo circulated over the summer by one pro-charter group, Democrats for Education Reform, had identified Mr. de Blasio as the candidate least friendly to their cause.

Charter schools — privately run, but with taxpayers paying the tuition — have become popular nationwide among Democratic and Republican leaders, as well as with tens of thousands of low-income parents who submit to kindergarten lotteries every year. They are also popular among Wall Street leaders who see charter schools, which often do not have unions to bargain with and have relative freedom from regulation, as a successful alternative to traditional public schools. But many Democrats, including the mayor, have sought to slow their spread, contending that they are taking dollars and space from other public schools. Pro-charter advocacy groups, including Families for Excellent Schools, StudentsFirstNY and the New York City Charter School Center, met regularly to plot strategy. Increasingly, they turned to state officials.

A lot was riding on the debate for Mr. Cuomo. A number of his largest financial backers, some of the biggest names on Wall Street, also happened to be staunch supporters of charter schools. According to campaign finance records, Mr. Cuomo’s re-election campaign has received hundreds of thousands of dollars from charter school supporters, including William A. Ackman, Carl C. Icahn, Bruce Kovner and Daniel Nir.

Kenneth G. Langone, a founder of Home Depot who sits on a prominent charter school board, gave $50,000 to Mr. Cuomo’s campaign last year. He said that when the governor asked him to lead a group of Republicans supporting his re-election, he agreed because of Mr. Cuomo’s support for charter schools.

“Every time I am with the governor, I talk to him about charter schools,” Mr. Langone said in an interview. “He gets it.”

It was not until late February, shortly before the rally on the steps of the Capitol, that a full-fledged battle broke out.

Mr. de Blasio, reviewing plans for school space, had decided to deny it to three schools run by Success Academy Charter Schools, a high-performing network founded by Eva S. Moskowitz, a former city councilwoman. While he allowed the vast majority of charter schools to continue using public space, many supporters of Ms. Moskowitz’s schools were outraged.

Daniel S. Loeb, the founder of the hedge fund Third Point and the chairman of Success Academy’s board, began leaning on Wall Street executives for donations. Later this month, he will host a fund-raiser for Success Academy at Cipriani in Midtown Manhattan; tickets run as high as $100,000 a table.

The governor and his staff worked with Republicans in the State Senate and others to come up with a package of protections for charter schools in the city. He was already said to be displeased with Mr. de Blasio for rejecting his compromise offer on prekindergarten funding.

Mr. Cuomo did not mention charter schools in his State of the State address, but now, with Mr. de Blasio under assault and charter advocates behind him, he pushed for a sweeping deal.

The proposed legislation included provisions to reverse Mr. de Blasio’s decisions on school space, and it required the city to provide public classrooms to new and expanding charter schools or contribute to the cost of renting private buildings. It also suggested increasing per-pupil funding for charter schools and allowing them to operate prekindergarten programs.

​When champions of market-based reform in the United States look at public education, they see two separate activities—the government funds education and the government runs schools. The first is okay with them; the second is not. Reformers want to replace their bête noir—the “monopoly of government-run schools”—with freedom of choice in a competitive market dominated by privately-run schools that get government subsidies. Public funding, private management—the four words sum up American-style privatization whether applied to airports, prisons, or elementary and secondary schools. In the last twenty years, the “ed-reform” movement has assembled a mixed bag of players and policies, complicated by alliances of convenience and half-hidden agendas. Donald Trump’s election and his choice of zealot privatizer Betsy DeVos as U.S. Secretary of Education bolstered reformers but has also made more Americans wary. What follows is a survey of the controversial movement—where it came from, how it grew, and what it has delivered so far to a nation deeply divided by race and class.

The Backstory in Brief

​In the latter decades of the nineteenth century, consensus grew around an expansive vision of education in which government plays a far-reaching role: schooling should be government funded and administered, universal, and compulsory until a certain age. In a nation that was increasingly industrialized and home to new immigrants, citizens expected public schools to accomplish a great deal, including impart general knowledge and practical skills, prepare young people psychologically and socially for self-sufficient adult lives, educate for democratic citizenship, unify a diverse population, and create opportunity for upward mobility. Over time, many Americans came to regard public education as a mainstay of democracy.

​The U.S. Constitution makes no mention of education, so the federal government had no specified role to play. Since the earliest days of the republic, local and state authorities shaped elementary and secondary (K-12) public education. Racial segregation in schools, which became the law in seventeen states and the norm almost everywhere else, was also a local and state matter. This did not change until 1954 when the U.S. Supreme Court ruled that racially segregated public schools were “inherently unequal” and therefore unconstitutional (Brown v. Board of Education of Topeka). When the federal government stepped in to enforce school desegregation, it met with fierce resistance. After several years of minimal progress, federal authorities resorted to court-ordered desegregation plans, which they imposed on school districts across the country, not only in the South. For the first time, government at the highest level assumed a significant role in K-12 schooling. In the mid-1960s and 1970s, the federal role expanded to include protecting the civil rights of all students and offering financial assistance to public schools with high percentages of low-income students.

​In the 1980s, the political climate shifted. An international renaissance of laissez-faire economics, updated as “neoliberalism,” challenged the dominant Keynesian model of regulated markets. Governments around the world began to act on a suite of neoliberal principles: competition and choice in the free market are the best organizing principles for most human activity because they produce greater efficiency and higher quality; the role of government is to provide a framework that allows the market to function freely; most other government activity merely clogs the system with bureaucracy and special interests. Ruling elites believed that implementing these principles would solve high inflation, stagnation, unemployment, low productivity, and whatever else was ailing an economy. Neoliberalism led logically to specific policies such as cut taxes and government spending, deregulate the economy, and transfer as much government activity as possible to the private sector, including education. And when government funding is necessary to get something done, turn management over to the private sector.

​The ideological shift to neoliberalism was rapid and widespread. This was the age of Britain’s Margaret Thatcher and the U.S.’s Ronald Reagan—two world leaders who aimed to revolutionize economic policy at home and abroad. Governments around the world embraced austerity, deregulation, and privatization. Consider, for example, some major nationalized industries that were privatized in the 1980s: British Telecommunications (1984), Spain’s car manufacturer, SEAT (1986), New Zealand Steel (1987), Japanese National Railways (1987), Air Canada (1988), to name just a few.

An Education Guru for Neoliberalism

​One of neoliberalism’s major thinkers and its most successful popularizer was economist Milton Friedman (1912-2006), who advised Republican candidate Reagan during the 1980 presidential campaign and joined his Economic Policy Advisory Board in 1981. On education policy, Friedman never deviated from the model he presented in his 1955 essay, “The Role of Government in Education.” He proposed that government get out of the business of running schools altogether. Instead it should fund a voucher worth the same amount of money for every school-age child to use at his or her choice of private school. For Friedman, the choices would include private for-profit schools, private nonprofit schools, religious schools, and “some even” run by the government. A democratic society, he reasoned, requires “a minimum degree of literacy and knowledge on the part of most citizens.” Hence government has a legitimate interest in requiring and paying for what the community decides will be the necessary “minimum amount of education.” But government running schools is not “justifiable in its own right in a predominantly free enterprise society.”

​In this marketized system, competition would, theoretically, eliminate low-performing schools because they wouldn’t attract enough customers to stay in business. In the real world, the poor buy necessities at a price they can afford even if the quality is inferior. This is why the free market has always failed to meet the real needs of low-income people; they get what they can pay for. In a school voucher system, wealthy families can (and will) add as much money as they want to their vouchers to pay for their choice of schools; middle-income families will pull together whatever resources they can for the best schools in their price range. Low-income families without additional resources will “choose” schools charging the value of the voucher. Almost no higher quality schools will be available because they will have no incentive except altruism to offer their products at the minimum price. (For example, the value of a government voucher for high school in Washington, D.C. in 2016-2017 was $12,679 while tuition at Washington’s elite private schools exceeded $40,000 a year.) As a last resort, low-income families could choose a “government school.” For free-market ideologues, government schools are always a last resort and available to the poor.

​Backtracking for a moment, many Southern states anticipated the 1954 Brown school desegregation decision and prepared policies to evade racial integration. Between 1954 and 1959, eight states adopted what were whites-only versions of Friedman’s voucher system. They used public funds to pay for white students to attend all-white private schools, which were called “freedom of choice schools” or “segregation academies.” States also leased unused public school property to private schools. Shortly before publication of his 1955 essay, Friedman added a footnote to address the segregationist versions of “essentially this [i.e. his own] proposal.” He argued that both forced segregation and “forced non-segregation” were evil. His solution for the South and everywhere else was publically funded vouchers used for “exclusively white schools, exclusively colored schools, and mixed schools. Parents can choose which to send their children to.”

Friedman’s essay prefigured the indifference of today’s pro-market reformers to racial segregation in education as long as the tradeoff is private schools. The essay still functions as a touchstone for them.

Sowing the Seeds of Market-Based Reform
​Education policy advisors in Reagan’s administration hoped to wean Americans off public schools while also weakening the teachers’ unions, which were a significant source of power for the Democratic Party. Starting the weaning process required convincing Americans that public education was failing. In 1983 the administration released A Nation at Risk, a report aimed at generating support for radical reform. The rhetoric was hyperbolic: “…the educational foundations of our society are presently being eroded by a rising tide of mediocrity that threatens our very future as a Nation and a people.” Apocalyptic claims were backed up by what one researcher called “a golden treasury of spun statistics.” The media hyped the report to the point of stoking a panic about failing schools. Politicians across the political spectrum called for higher standards, better test results, and greater performance accountability from public schools. Conservatives simultaneously aimed for deep spending cuts.

​The sky-is-falling panic about public schools and the “standards and accountability” demands attracted bi-partisan support. Neoliberal thinking had influence far beyond ideological devotees. It tinged political moderates, self-identified liberals, media people, and think-tank opinion makers. It permeated what became the dominant wing of the Democratic Party—the “New Democrats.” Their jargon included choice, competition, efficiency, and downsizing government; they often competed with Republicans for pro-market credibility.

​In the 1990s, the escalating drive for tougher education standards, better test scores, and more accountability coincided with a declining commitment to racial desegregation. Public school integration, on the rise since the mid-1960s, peaked in 1988 when 43.5 percent of all black students attended schools that were at least 50 percent white. Although research showed that integrated schools narrowed the achievement gap between minority and white students without harming the latter, the dedication of most government officials to proactive desegregation had dissipated.

Decisions of the U.S. Supreme Court in 1991, 1992, and 1995 made it easier for school districts to abandon their court-ordered plans. Resegregation began immediately. In just ten years, the percentage of black students attending schools that were at least 50 percent white dropped to 32.7 percent. By 2011 that figure had fallen to 23.2 percent.
​Highly segregated schools attended by low-income minority students were notoriously under-resourced compared to public schools attended by white middle-class and wealthy students. Schools in poor urban neighborhoods needed much greater support. Moreover, although the achievement gap between minority and white students had been narrowing, it still existed. Politicians might profess a commitment to reducing racial inequality, but most acted within neoliberal boundaries and with no interest in pushing integration further. Glorification of the market along with the vogue for standards and accountability led to a new approach: government could commit to improving education for low-income minority students with market tools while leaving schools segregated. The mainstream political world seemed to slide easily from the ostensible goal of racial integration to aiming for something like “separate but improved” for low-income minority children. Government would hold public schools to high standards, monitor how well they were doing, and help students in inadequate public schools move to better schools of their choice. The primary measure of school quality would be student scores on standardized tests despite the fact that most education scholars agreed the scores reveal little about education success.

​Thus the seeds for twenty-first-century market-based reform were sown.

Building a Movement from the Top Down

​Neoliberal innovations in education policy took hold slowly. Reagan proposed several voucher-type programs, but they died in Congress. He did, however, cut the federal government’s portion of total public education spending from 12 percent to 6 percent. The George H. W. Bush administration (1989-1993) produced no major education laws although some policy ideas were picked up by Bill Clinton (1993-2001). In 1994 Clinton signed the Improving America’s Schools Act, which provided federal funds to states to create a new type of school: publicly funded, privately operated “charter schools.” They would have more autonomy than district (traditional) public schools and, advocates claimed, be more innovative. The first charter school in the United States had opened in St. Paul, Minnesota, in 1992 under state law. Clinton’s Improving America’s Schools Act was designed “to increase the number of charter schools nationwide”. In 1999 Florida’s Governor Jeb Bush (the former president’s son) signed into law the nation’s first statewide voucher plan. Still in operation, the Florida Opportunity Scholarship Program allows students in “failing” public schools to use state funds to pay for private schools, including religious schools.

​After the turn of the twenty-first century, pro-market ed-reformers began to attract enough support and funding to build organizations and to operate like, or at least look like, a movement. Charter schools and voucher programs appealed to conservatives and centrists of all stripes but few progressives. By 2010 “reform-think” dominated the national conversation on K-12 education. Still, market-based reform never became a grassroots movement. It attracted elites: billionaire philanthropists, private mega foundations, finance and high-tech entrepreneurs, politicians at every level of government, business leaders, media figures, and think-tank associates. The players have been overwhelmingly white; their methods consistently top-down. Notably missing have been teachers, school administrators, parents, and students. With elite support, ed-reformers collected enough money to build an ed-reform industry of organizations employing same-thinking researchers, program designers, consultants, lobbyists, campaign organizers, and media producers. A cadre of super-wealthy donors regularly gives millions of dollars to pro-ed-reform candidates for state and local offices; they fund ballot initiatives around the country and pour hundreds of thousands of dollars into local school board races. The right-wing American Legislative Exchange Council (ALEC), which drafts model legislation for conservative state lawmakers, has been an important ally of the ed-reform movement. Some states have adopted ALEC model education legislation verbatim.

​Help also came from the White House. George W. Bush (2001-2009) advanced both charter schools and vouchers. His signature education law, No Child Left Behind (signed in 2002), established that students in low-testing, low-income public schools could transfer within their district to another public school or to a charter school. In 2004 Bush signed into law a voucher program that Congress designed for Washington, D.C. (Congress has final jurisdiction over the District of Columbia). The Opportunity Scholarship Program offers every low-income student in D.C. a federally funded voucher to use at a participating private school, secular or religious.

​Barack Obama (2009-2017) opposed school vouchers, but he quickly became Charter-Advocate-in-Chief. In the depths of the “great recession” in 2009, his Department of Education (DOE) launched a $4.35 billion competitive grant program called Race to the Top. The rules stipulated that each competing state submit a public school reform plan, taking into account a long list of DOE pet policies. States that scored highest on the DOE’s point system would win millions of dollars to implement their plans. DOE criteria included not limiting the growth of charter schools (some states had capped the number).

States were also required to give charter schools free use of public facilities or help charters pay for facilities. Public school supporters fiercely opposed the measures because they diverted resources from already stretched-to-the-limit education budgets. But state governments were desperate for money from anywhere; all but four eventually entered the contest. Obama’s Race to the Top gave the entire charter school enterprise a substantial boost.

Anatomy of Vouchers and Charter Schools

​Both voucher programs and charter schools channel public funding to private entities but in different ways. When students receive a government-funded voucher for a set amount of money, they give the voucher to a private or religious school as payment or partial payment for tuition. All the tax-payer funds that end up in private and religious schools are funds no longer available for public education. In the charter school system, the private entities that run the schools receive an allotment of public funds for each student who enrolls. The allotments are transferred directly from district schools to the charter schools, shrinking the district public school budgets. The public schools are left with the same fixed expenses but fewer students and therefore less money coming in. They almost inevitably deteriorate: a school that could previously afford, say, a librarian, art teacher, nurse, or smaller classes can no longer cover costs.

​Ed-reformers do not promote vouchers and charter schools to the public as strategies to privatize public education. Instead, they pitch their reforms as ways to create choice in K-12 schooling. Reformers claim that charter schools and vouchers give low-income students “trapped” in low-performing schools new choices, and thus their parents—like wealthy parents—have the power to choose the schools they know are best for heir children.

Who could object? Reformers have successfully made “choice” the subject of the policy debate. A candid description of vouchers and charter schools—for example, these policies drain public funds from district public schools and channel the money to private entities student by student, school by school—would attract little support (see the analysis of public support below). While conservatives consciously aim to shift control over K-12 education from government to the private sector, moderates in the ed-reform camp do not have privatization as their main goal.

Instead, they want to move as many students as possible, as quickly as possible, out of low-testing schools. They see their twenty-year-old alliance with conservatives as tactical. Yet not only have they ended up buttressing conservatives politically, they practice a kind of triage without thinking through the consequences. By steadily draining resources from district public schools, they undermine the very schools that the overwhelming majority of American children, including low-income children, still attend. Both conservatives and moderates call school choice “the civil right issue of our time.”

​Charter schools claim to be public schools because they receive tax-payer money and, in theory, are overseen by state-approved authorities. But private-sector entities—boards of directors and charter management organizations (CMOs)—manage the schools and control finances. Private management, which can be for-profit or non-profit, allows charter schools to avoid the transparency and accountability required of district public schools. When the public or press asks for documentation, managers can claim private status. They regularly refuse access to their financial records, data, and internal communications—information that public entities are required to make available. In September 2017, for example, investigative reporters requested some emails from Eva Moskowitz, CEO of Success Academy Charter Schools, Inc., a CMO that runs forty-six schools in New York City. The company’s lawyer responded that the CMO “is not itself a charter school or a government agency…it is not in and of itself subject to FOIL [Freedom of Information Law] or required to have an appeal process.”​Charter school lobbies press state governments for as little supervision as possible. For example, in California, where over 1,200 charter schools operate, government audits are neither regular nor proactive; they take place only when a county official suspects fraud and requests an audit. Some 90 percent of charter schools nationwide are not unionized, so unions can not provide general oversight. Predictably, inadequate transparency and oversight have led to widespread malfeasance in the sector (more on this below).

​Pro-market reformers also champion online (virtual) schools, most of which are privately run, for-profit, and notably lucrative. They use the same funding mechanism as charter schools—the operators get public funds for each child who signs up—but they do not have to maintain buildings, provide transportation, or pay for full staffs. One teacher can follow scores, even hundreds, of students as they tap their way through digital lessons on their own computers.

Charter School Performance

​According to the National Alliance for Public Charter Schools (2017), charter enrollment increased from 1.2 million students in 2006-2007 to an estimated 3.1 million in 2016-17. The number is still tiny compared to the overall size of the U.S. K-12 system. For example, the federal government projected that about 50.7 million students would attend public and charter schools in fall 2017; about 5.2 million would attend private schools. In addition, about 1.7 million were homeschooled in 2016. But charters schools are highly concentrated geographically and wield substantial political clout. About 92 percent of K-12 students in New Orleans attend charter schools; 53 percent in Detroit; and 45 percent in the District of Columbia. Charter networks run well-funded lobbying efforts in most states. As of November 2017, only six states did not allow charter schools.

​To justify the existence of charter schools, ed-reformers have always claimed they outperform the district public schools that most low-income and minority students attend. Indeed, unless charters perform better, they serve no purpose other than choice for the sake of choice regardless of quality. To measure performance, both government and ed-reformers still rely on student scores on standardized tests. Since 2009 a pro-privatization research center at Stanford University has regularly conducted nationwide studies comparing the test scores of charter school students to the scores of demographically similar students at district public schools. The studies have generated a fairly consistent, albeit very rough, picture of average performance nationwide: about one half of all charters perform at the same level as district schools, about one quarter perform worse, and about one quarter perform better although often by minuscule amounts. A much clearer picture of performance comes from state and district studies, not national averages. In 2016, for example, a study of charter schools in Texas found that “at the mean, charter schools have no impact on test scores and a negative impact on [future] earnings.” These mediocre results fall far short of reformers’ claims and hardly justify undermining district schools.

​As for the higher-performing charter schools, research has shown they often boost test scores by “counseling out” the most challenging students—those with cognitive and physical disabilities, behavior problems, and English language learners. These students remain in district schools, increasing the concentration of at-risk students in precisely the districts that have lost funding to charter schools. In the 2013-14 school year, the Budget, Facilities, and Audit Committee of the Los Angeles Unified School District (LAUSD) reported that 1.2 percent of charter school students were severely disabled; the figure for LAUSD overall was 3.8 percent—more than three times as large. In December 2017, the American Civil Liberties Union of Arizona released the results of its investigation of 471 charter schools, which found that 56 percent had enrollment policies that clearly violate the law or discourage at-risk students. For example, Spanish is the most commonly spoken language after English, but only 26 percent of these schools provide enrollment documents in both languages. Attrition rates—that is, how many students drop out of a school or class in a given period—are strikingly high for high-testing charters. In 2006 Eva Moskowitz launched Success Academy Charter Schools, Inc. with 73 first graders. In 2018 this class became the first to graduate from the academy’s high school, but only seventeen of the early enrollees remained—an attrition rate of 77 percent.

A Closer Look at Vouchers

​The goal of staunch voucher advocates is to replicate the system that Milton Friedman proposed in 1955: a tax-payer funded voucher for every student to use in a free market of secular and religious private schools. Several states now offer vouchers to all families regardless of income, but public support for such “universal” programs is low. To get around this obstacle, ed-reformers promote programs limited to low-income students, students in low-performing schools, or students with special needs. They have also devised several variations on vouchers, all of which channel public funds to private schools but avoid using the unpopular “v” word. “Private-school tuition tax credits” allow families to subtract the cost of tuition from the taxes they pay; “tax-credit scholarships” give tax credits to donors (corporations included) who fund scholarships for other people’s children to attend private schools. Donors cycle their money through private nonprofit “school tuition organizations” (STO). Rerouting the money this way, reformers argue, prevents any violation of the separation of church and state: the STO “middleman” separates the government funding (the tax credit) from the religious institution (the school). In reality, the process works like money laundering: funds pass through a private entity and arrive at a religious school scrubbed clean of their taxpayer origin. Another tool—“education savings accounts”—gives families government-funded debit cards to use for various private education expenses in addition to tuition. ​
​According to the Milton and Rose Friedman Foundation (which changed its name in 2016 to the less politically charged EdChoice), there were 64 voucher and voucher-type programs in 30 states and the District of Columbia as of January 2018. Most of the money ends up at religious schools. For example, 82 percent of the nearly 100,000 students in the Florida Tax Credit Scholarship Program chose religious schools in 2017. Republicans, who control a large majority of state governments as well as the White House and Congress, aim to expand voucher programs. Paradoxically, the promised expansion comes after the release of several studies showing that voucher programs actually hurt student performance. In late 2015, researchers reported that Indiana’s “voucher students who transfer to private schools experienced significant losses in achievement” in math and no improvement in reading. In June 2016, a study of a large Ohio voucher program, published by the pro-reform Thomas B. Fordham Institute, found: “The students who use vouchers to attend private schools have fared worse academically compared to their closely matched peers attending public schools….Such impacts also appear to persist over time….”
​Voucher supporters (Milton Friedman included) have always assumed that transferring from a public school to a private school would mean transferring to a better school. But in recent years, public schools in the United States have closed the achievement gap with private schools. Since government vouchers never cover the cost of higher quality private schools, most low-income students end up at schools that are academically no better or even worse than the public schools they leave.

Corruption and Segregation

​Both charter school management and voucher programs are rife with fraud. It comes with the territory when states hand out millions of dollars to private sector actors without adequate vetting or ongoing oversight. The pro-public-school Network for Public Education posts a feature on its website called ANOTHERDAYANOTHERCHARTERSCANDAL, which keeps a running account of charter misconduct along with links to source material. Here are a few typical scandals from a four-week period in fall 2017: The founder and former administrator of Southwest Learning Centers, which ran four charter schools in Albuquerque, NM, pleaded guilty to pocketing over $2 million by having his schools pay fake invoices to a fake company he set up in Las Vegas; he also billed parents for online credits that their children never earned and charged his schools double the actual rent for a building he leased. The Pennsylvania Ethics Commission fined the former CEO of the defunct Pocono Mountain Charter School in Coolbaugh Township for four years of deficient financial statements. The commission also cited him for asking the charter board to raise his wife’s salary at the school and hire his children for school positions. The former principal of a Delaware charter school—the Academy of Dover—pleaded guilty to embezzling $145,480. The case went to federal court “due to the significant [federal] funding received by the Academy of Dover”.

​The case of Ohio’s Electronic Classroom of Tomorrow (ECOT)—once Ohio’s largest online charter school—epitomizes the corruption in the virtual charter sector. ECOT was notorious for its low graduation rate (under 39 percent in 2014) and its dropout numbers (the highest in the nation, according to federal data). But despite the school’s abysmal performance, Ohio’s Republican establishment gave it unwavering support. According to an exposé in Mother Jones magazine, ECOT’s founder and the CEO of its management company, William Lager, took home about $153 million from the school between 2000 and 2017. In the same period, he contributed $1.9 million to political candidates, mostly Republicans. In 2016 and 2017, the state’s Department of Education found that ECOT had overcharged taxpayers about $80 million in just two years for “truant” students—students who had not logged into the online instruction system for even the required minimum of once every thirty days. On January 18, 2018, the board overseeing ECOT voted to close the school immediately because it could not repay its $80 million debt. ECOT’s 12,000 students were left scrambling to find places at other schools—a problem created whenever a charter school suddenly shuts down.

​Voucher corruption looks like this: The Arizona Christian School Tuition Organization (ACSTO) is one of the state’s largest groups giving out vouchers, called tax credit scholarships, for private schools. From 2010 to 2014, private donors contributed $72.9 million to ACSTO. Arizona law allows families of all income levels to use these vouchers; it also allows voucher granting groups to keep 10 percent of all donations to cover overhead.

ACSTO’s founder and executive director, Steve Yarbrough, is also president of the Arizona State Senate and a longtime voucher promoter. ACSTO outsources much of its work—from data entry to customer service—to HY Processing, a private for-profit company owned by Yarbrough, his wife, and another couple. ACSTO also pays $52,000 a year in rent to its landlord, who is Yarbrough. When Yarbrough bought a $16,000 car in 2012, ACSTO reimbursed him for the full amount.

​Vouchers and charter schools create still another problem: they increase racial and socioeconomic segregation. A March 2017 report by the Century Foundation, which analyzed longitudinal data from the Milwaukee Parental Choice Program, found that 68.4 percent of voucher-participating private schools had enrollments that were either 90 percent white or 90 percent black. Overall, 90 percent of voucher transfers “increased segregation in private schools, public schools, or both sectors.” According to a 2016 comprehensive report by the Brookings Institution, “charter schools enroll more black and poor students than traditional public schools in the same areas and are more likely to be at one extreme or the other of the racial and economic demographic spectrum than traditional public schools”. In the 2016-17 school year, charter students comprised about 6 percent of the combined enrollment of all district and charter schools nationwide; the figure for black students was over 12 percent.

Conclusion: The Shifting Landscape​

​Given disappointing academic results, endemic corruption, and growing segregation, why does anyone interested in equal and excellent education for all still support vouchers and charter schools? One reason is money. Entrepreneurs recognized early on that market-based ed-reforms could be a source of substantial profits. Private operators quickly found ways to tap into the vast public resources—now more than $600 billion a year—spent on K-12 education. Equally important, ideology trumps evidence for free-market boosters, and ed reformers have developed a culture of true-believers. In January, 2018, a government-solicited audit revealed that school officials in Washington, D.C. had knowingly allowed 34 percent of high school seniors to graduate in 2017 without fulfilling all requirements. The news triggered an uproar because reformers, private funders, and the media had been touting D.C.—with its voucher program and high penetration rate of charters—as ed-reform’s great success story. Reflecting on the gulf between triumphalism and facts, Frederick Hess, Director of Education Policy Studies at the conservative American Enterprise Institute and one of the few reformers who confront problems publicly, wrote:

[S]o many in the world of school reform tend to clamber aboard the bandwagon of the moment while parking their skepticism.…”[R]eformers” have tended to circle their wagons, fueling a “with-us-or-against-us” dynamic. That leaves little ground for friends to offer tough-minded public appraisal without being labeled an enemy of the movement…. [I]t’s time for the reformers, funders, and pundits to ask ourselves how we’ve contributed to a culture that’s heavy on cheerleading and light on skepticism—and how to find a better balance going forward.​

​In another case of ideology über alles, pro-reform members of Congress went so far as to ban rigorous evaluation of D.C.’s voucher program. In spring 2017, the Institute of Education Sciences (IES), which is the independent research arm of the federal Education Department, released a study showing that, in math, Washington, D.C. students who used vouchers to attend private schools fell behind their peers who remained in public schools. The research was a randomized controlled trial, considered the “gold standard” experimental design. A week later, the Republican-led Congress approved a budget that included “a prohibition on the use of the experimental design evaluation method in any future federally funded studies of the D.C. voucher program.”

​Given the overall record of charter schools, support In the general public and among minorities has been slipping. According to the most recent survey conducted by the pro-reform journal Education Next, support among all respondents dropped from 51 percent to 39 percent from 2016 to 2017. Among African Americans, support for charter schools dropped from 46 percent to 37 percent; among Hispanics, from 44 percent to 39 percent. Ed-reformers also suffered a major defeat when they tried to increase the number of charter schools in Massachusetts using a ballot initiative. The state has the strongest oversight system in the country and a relatively small number of charters. The ballot initiative drew national attention because of the outsized campaign spending—$25 million on the “yes” side, $17 million on the “no” side. On November 8, 2016, voters rejected the charter increase by an overwhelming margin, 62 percent to 38 percent.

​Many African American advocacy organizations have taken a stand against market-based reforms. In a 2014 resolution, the National Association for the Advancement of Colored People (NAACP) pledged to “continue to advocate against any state or Federal legislation which commits or diverts public funding, allows tax breaks, or establishes preferential advantages to for-profit, private and/or charter schools.” The 2016 NAACP national convention passed a resolution supporting “a moratorium on the proliferation of privately managed charter schools.” Shortly after the NAACP vote, the Movement for Black Lives—a network of more than fifty organizations representing African Americans—released a platform that included a moratorium on new charter schools. In 2017 the largest and best known African American ed-reform organization—the Black Alliance for Educational Options (BAEO)—closed down after it had “struggled to remain financially viable and relevant over the last several years.”

​Unfortunately, not all Americans know enough about market-based ed-reform to evaluate it. Despite two decades of heated public debate, many do not understand how charter schools and vouchers are funded. According to a 2017 poll by the independent research company SSRS, a little more than half of Americans supported charter schools until they learned that the funding is taken from district public schools. Then support plummeted to 30 percent. For participants in the 2017 Education Next survey, support for vouchers hinged on whether the survey questions contained the phrase “wider choice” or “use government funds.” A proposal to “give all families with children in public schools a wider choice, by allowing them to enroll their children in private schools instead, with government helping to pay the tuition” received 45 percent support.

But a proposal to “use government funds to pay the tuition of all students who choose to attend private schools” received only 27 percent support. Neither question contained the word “voucher.” It turns out that when Americans know that market-based reforms drain funds from public schools, most oppose the policies. The success of the ed-reform movement so far has depended on their not knowing.

​The survival of public education in the United States is a political choice. Opposition to market-based reform is growing stronger, but it needs to be transformed quickly into electoral activism. Privatizers now control the Trump administration, Congress, and most state governments. Running for president, Donald Trump promised sweeping privatization policies for K-12 education, but so far his program has stalled in Congress. Some Republicans object to expanding federal influence and squelched the administration’s proposals in the 2018 budget. Secretary of Education Betsy Devos has not been a strong asset. She quickly made herself the most publically reviled member of Trump’s controversial cabinet with her combined ignorance of and scorn for public education. But effective power over public education still belongs to the state governments. As of April 2018, Republicans held a near-record thirty-four governorships and thirty-two state legislatures; they continue to approve new voucher programs and more charters.

​Draining resources from public schools has already undermined districts around the country, especially those serving low-income and minority students. Time is short for rescuing and improving public education. Destroying it will not require privatizing the entire system or anything near that. We are watching death by a thousand cuts.

Colorado is heating up as a battleground over education issues. The gubernatorial race could be a watershed moment in the fight to reverse failed and punitive reforms.

There are three candidates for Governor. Two are corporate reformers: Jared Polis and Michael Johnston. The third, Cary Kennedy, has taken them both on for betraying public schools and teachers. I am not aware of any political race where the issues are drawn as sharply as they are in this race.

Polis and Johnston are angry at Kennedy because a teacher-funded group bought ads criticizing their education views. She can’t control the outside group. Polis and Johnston say she is engaged in negative campaigning and call the ad an attack ad. It seems to me that voters need to know where candidates differ. If they can’t criticize one another for their records, how will voters learn about the candidates?

Cary Kennedy was Colorado State Treasurer, Chief Financial Officer and Deputy Mayor of Denver. She has been endorsed by the Colorado Education Association. She also won a surprise victory at the state Democratic assembly. The Democrats of Colorado had previously denounced the hedgefunder group DFER (Democrats for Education Reform) for claiming to be Democrats while pushing conservative anti-public school, anti-teacher Policies.

Jared Polis is a multimillionaire member of Congress who is zealous about charter schools. He started two of them, and as a member of Congress he has pushed for generous charter funding. When I met with Congressional Democrats on the House Education and Labor Committee in 2010, after the publication of my best-selling book, The Death and Life of the Great American School System: How Testing and Choice Are Undermining Education, Polis literally threw my book across the table at me and said it was “the worst book he had ever read.” He asked me to give him his money back. Another Congressman peeled off a $20 bill and bought Polis’ copy. I became the target of his wrath because I criticized charter schools.

Michael Johnston is a TFA alum who was briefly principal of a school, then won a seat in the State Senate. He authored a bill called SB 191, which assigns 50% of every teacher and principal’s evaluation to test scores. The Colorado Education Association fought it but lost. Johnston promised that his bill would guarantee that every school, every principal, and every teacher in the state would be “great.” Eight years later, even reformers acknowledge that the bill failed. But Johnston has opposed its repeal. I happened to be in Denver to meet with about 60 civic leaders on the day the bill passed in April 2010 and to debate Johnston. He didn’t appear until I finished my presentation—literally, as I finished, he walked in— so he never heard what I thought of his evaluation bill. I predicted it would fail. He was jubilant because he had just re-engineered Colorado education to march to the beat of standardized tests.

I have never met Cary Kennedy, but I am impressed by her education views and her deep experience. She is a graduate of Manual High School in Denver, one of the schools that reformers have toyed with for years.

If I were lucky enough to live in Colorado, I would vote for Cary Kennedy in the Democratic primary on June 26.

In this video, she talks with veteran journalist Bob Herbert about the mistakes of those in power who rely on standardized testing as the sole definition of success, about segregation, about the damage wrought by charter schools, and about the changes that will benefit all students.

Jan Resseger reports on a startling development in Michigan. She quotes the new superintendent of the Detroit Public Schools, who just completed his first year on the job. His words are inspiring. He is actually fighting for the kids and the public schools. Dr. Nikolai Vitti was chosen by Detroit’s elected school board in 2017, after years of disastrous state control, led by people who enabled erosion of the public schools and the advance of privatization.

She writes:

Dr. Nikolai Vitti was their choice, and last week at the end of his first year on the job, at a conference sponsored by the Chamber of Commerce at the Grand Hotel on Mackinac Island, he confronted the dogma of Michigan’s power establishment—Rick Snyder, the DeVos family and all the rest.

The Washington Post‘s Valerie Strauss reprinted part of Dr. Vitti’s remarks: “People often ask me, ‘What were you most surprised about when you took the job and started to work in the system?’ And I often say I was shocked, horrified at the lack of systems and processes for traditional public education. Traditional public education has always been, and hopefully will always be, the vehicle for social change, for social justice, for equal opportunity in this country. And walking into the system and seeing a lack of systems and processes is a testament to the lack of belief in what children can do.”

Vitti continued: “And there is a racist element to what has happened. Children in Detroit have been treated like second-class citizens. When a system is allowed to be run over a decade by individuals, and it’s not about one individual, but individuals that had no track record of education reform, no local governance structure to address immediate concerns and issues by the community through an elected board… and year after year of low performance, a lack of growth, drop in enrollment, facilities that are not kept up, that would never ever happen in any white suburban district in this country. And that is a testament of race. Because this country would not allow that. We see signs of that in Flint and we saw signs of that in New Orleans after the flood and we have multiple examples of this.”

Resseger quotes a column written by Rochelle Riley of the Detroit Free Press, who served as moderator for the panel discussion at Mackinac Island. Her column was titled “Miracle on Mackinac Island: Business Community Gets Woke to Race.”

She said that the meeting may have been “a watershed moment in Michigan history.” For once, the power structure got a lesson about racism and the treatment of children in Detroit as second-class citizens.

Speaking to the state’s white power structure, Vitti pulled no punches:

His words drew loud and sustained applause. But Vitti also said something that drew tears. When I, as moderator of the forum, asked him to speak to the assembled crowd as an 8-year-old third-grader and tell them what he wants, he looked out and said:

“I want the same thing that your child wants,” he said to loud applause. “I may not have your privilege. I may not have the color of your skin. I may live in a different ZIP code. But I want the exact same thing you want for your son, your daughter, your grandchild, your niece, your nephew. That’s what I want.”

The Michigan legislature keeps piling on mandates, but with no support to reach them, she wrote.

The Michigan Legislature has scared some parents and teachers to distraction with a new law banning schools from promoting third-graders who do not read at grade level. Nine of 10 third-graders in the city schools do not read at grade level. And some parents and teachers feel the law will exacerbate an existing third-grade-to-unemployment pipeline similar to the fourth-grade-to-prison pipeline that already exists.

The shame is this is yet another example of the state attempting to polish its reputation at the expense of our children. Rather than help districts find ways to improve, then raise standards, the Legislature keeps raising standards without any support to make meeting them possible. One would think that legislators are trying to make public schools fail to make it easier to increase the number of charters across Michigan, but nah, that couldn’t be it, right?

Detroit’s Mayor Mike Duggan said that all of Michigan was in trouble, not only Detroit, because of bad leadership at the state level:

“We know the history. We had 10 years of state-appointed emergency managers,” Duggan said. “During that time, we lost half of the enrollment. … They eliminated career technical education, eliminated art, eliminated music … and all that happened was children continued to leave. … But this isn’t just Detroit.”

He cited National Assessment of Educational Progress scores that tell a larger story.

“For white students in the state of Michigan, fourth-grade math and reading level, in 2013 we were 14th in the country,” he said. “Last year — 46th in the country. Now, if you sat down in 2013 and said how can I sabotage Michigan’s future? … I’m not sure you could have accomplished it.”

Duggan said the state chose tax cuts over children, which was a mistake.

Michigan’s leaders (think Betsy DeVos, who has played a major role in state education policy, pushing charters) thought that they could fix the schools by adopting school choice while cutting taxes.

It didn’t work.

Now, let’s see how the power structure responds. Are they able to change course or will they double down on failure?

Should progressives embrace charter schools?

This question came up again recently when Teach for America alum and apparent expert on school choice, Conor P. Williams, landed an op-ed in the June 3 New York Times. Williams, who is now an education policy analyst with the New America Foundation, used Minneapolis’s Hiawatha Academies charter school chain as a key example of why, in his opinion, liberal and progressive activists should indeed be pro-charter school.

In 2017, Hiawatha Academies, which operates five highly segregated charter schools in Minneapolis, received a federal school choice expansion grant worth over $1 million dollars, courtesy of Secretary of Education Betsy DeVos. The money has likely been absorbed into Hiawatha Academies’ expansion plans, as the charter network seeks to enroll “6.2% of the Minneapolis student population” in the coming years.

Being affiliated in any way with DeVos and her devotion to accountability-free school choice schemes is probably uncomfortable for a charter school network like Hiawatha Academies, which likes to bill itself as progressive. DeVos continues to not only staunchly defend a Wild West-style approach to public education, she is also heavily engaged in rolling back many federal education policies that are there to protect the nation’s most vulnerable students.

Frankly, it is becoming harder and harder to separate, or pretend to separate, school choice and the spread of segregated charter schools from Betsy DeVos.

Perhaps that is why many of the links in Williams’ op-ed are as stale as the very premise underlying his piece. His first paragraph includes a description of an elementary school in the Hiawatha Academies’ chain, complete with a charming image of a teacher standing before students in a colorful kindergarten classroom. This, Williams proclaims, is one of “Minnesota’s best public schools.” To support this, he links to a celebratory 2012 PR-laden article written by Minnesota based education writer, Beth Hawkins.

Hawkins’ piece was published in MinnPost, a local online news outlet. Here’s why that matters: Hawkins’ stint as an education reporter at MinnPost was funded by the Bush Foundation, one of many local philanthropic groups that has bestowed money, clout and endless public relations support on the growth of charter schools in Minnesota. Oh, and MinnPost was started and run for years by former Minneapolis Star Tribune publisher, Joel Kramer. (Hawkins has since become the national education correspondent for the reform-funded outlet, The 74.)

Here’s why that matters: Kramer’s two sons, Matt and Eli, are both heavily invested in the national and local education reform movement. While Matt was serving as the co-CEO of Teach for America, Eli was busy “growing” the Hiawatha Academies charter school network, which serves mostly Latino families in south Minneapolis. It would be fair to say that the Kramer family has close political and financial ties to elite education reform policy makers and financiers, in Minnesota and on the national stage.

Eli Kramer is leaving Hiawatha Academies. The charter school chain’s new executive director is Colette Owens, another Teach for America acolyte who received her administrative training through a reform-funded venture, the School Systems Leaders Fellowship. Kramer made over $170,000 annually as head of Hiawatha Academies’ five school sites; Owens’s salary has not been publicly disclosed. (For comparison purposes, Ed Graff, superintendent of the Minneapolis Public Schools and its 60+ sites, has a contract worth $225,000.)

The Hiawatha Academies’ site (Morris Park) profiled by Williams sits in one of the two Minneapolis Public Schools buildings purchased by the charter school chain nearly ten years ago, on its path to grow its market share. “Hiawatha schools should be easy for the left to love,” Williams insists, before promising (without any evidence) that the schools are “full of progressive educators helping children of color from low-income families succeed.”

Beneath the wince-worthy white savior aura of this argument lurk some actual facts worth exploring further. First, Minnesota’s charter schools do not have to follow the same desegregation laws as public schools. This means highly segregated charter schools, like Hiawatha Academies, have been allowed to flourish, creating artificially isolated sites that cater to one particular demographic. If this is progressive, it sure smacks of age-old segregationist policies that allowed for school vouchers and, eventually, charter schools in the face of federal desegregation lawsuits.

Hiawatha Academies’ Morris Park location, for example, sits in a south Minneapolis neighborhood where over 75 percent of residents are white, and the majority do not live in poverty. But you would never know this by reviewing the school’s demographic data.

According to the Minnesota Department of Education, 91 percent of Hiawatha Academies’ Morris Park students are Latino, and 88 percent live in poverty. Still, Williams insists that the charter network is “successfully” meeting these kids’ needs, and so, presumably, should be excused for being unnaturally racially and economically segregated. But what is the definition of success? If it is standardized test scores, then no, Hiawatha’s Morris Park students are not receiving an education that is “beating the odds,” as education reformers like to say.

Data actually show that test scores at Hiawatha Academies-Morris Park dropped in 2017 and are lower than those of a nearby Minneapolis public school site, Northrop Elementary. Another neighborhood public school, Lake Nokomis Community School, serves almost as many students in poverty and special education students as the Morris Park charter school, but also has twenty-four homeless or highly mobile students on its roster. The charter school had zero.

In his New York Times piece, Williams does acknowledge that Hiawatha Academies schools are staffed by non-union teachers. He also notes that many progressives may also “worry that charters foster segregation, siphon funding from traditional public schools and cater to policymakers’ obsession with standardized tests.” Rather than addressing any of these very real concerns, however, Williams continues on with his fantasy-like defense of charter schools in general and of Hiawatha Academies in particular.

Hiawatha Academies schools are staffed and run by progressives, he assures readers, and they are determined, in the words of outgoing director Eli Kramer, to “elevate the importance of identity, race consciousness” and “pride in self.” Williams then describes taking a walk through the charter chain’s high school, which will relocate this fall to a newly-built campus that has been funded in part by wealthy, Republican-aligned local venture capitalists and philanthropists, not to mention the Walton Family Foundation.

How progressive is that? Many Walmart employees live on food stamps, leaving plenty of profit left over for the Walton family to pour into the promotion of non-union charter schools.

To wrap up his defense of Hiawatha’s privately run, publicly (and privately funded) charter schools, Williams revives yet another stale debate. In trying to prop up Hiawatha’s racially and economically segregated charters, Williams mentions Robert Panning-Miller, who was president of the Minneapolis teachers union from 2007-2009. (Michelle Wiese, the current head of the Minneapolis Federation of Teachers, is a Latino woman who has helped push the union in a more progressive, social justice-oriented direction. Perhaps her brand of union leadership doesn’t fit into Williams’ narrative.)

Panning-Miller once called Eli and Matt Kramer emblems of a kind of “educational apartheid” for allegedly sending their own children to a private Montessori school (the Kramers’ alma mater) full of wood blocks, natural play areas and hands-on learning, while simultaneously profiting from a test score-driven charter school network for students of color who live in poverty (Hiawatha Academies). Panning-Miller also documented the tightly woven, Kramer-Teach for America cabal that has drawn attention nationwide, and received PR support from, again, Beth Hawkins.

Maybe Williams had to harken back to Panning-Miller’s 2014 critique of the Kramers and Hiawatha Academies because there are so few of them. There is almost no counter-narrative out there for anyone, progressive or not, who would like a more realistic examination of the role Hiawatha Academies and other such narrowly marketed charter schools are playing in the systematic attacks on public education in the United States. As I mentioned, the Kramer family once employed an education writer who continues to serve as a philanthropist-funded champion of school choice.

It is impossible, then, to join Connor P. Williams’ in his unbridled praise for charter schools without fully examining the “ecosystem” of funding, hype and political support that prop up such “schools of choice.” To embrace the racially and economically marginalized population of the Hiawatha Academies charter chain, which Williams tries but fails to defend, would be to also, presumably, embrace the nearly all-white charter schools that also exist in the Twin Cities.

Among these are the Twin Cities German Immersion School, Nova Classical Academy and Great River Montessori School. Is it somehow right for public dollars to be diverted from the public school system (both Minneapolis and St. Paul are facing double-digit deficits for the upcoming school year) to create portfolios of niche charter schools that selectively serve segregated populations of students?

Is that what it means to be a progressive or a liberal? No, it is not. Don’t let the kind of propaganda peddled by Williams and the Kramer family convince you otherwise.

Elections have consequences. In the last Los Angeles school board election, charteristas took control of the school board by one vote. Their fourth vote, however, is tenuous b3cause Ref Rodriguez is awaiting trial on felony charges of campaign finance violations.

The board voted not to renew the contract of the district’s inspector general. He led several investigations into charter school corruption.

The board said they were terminating him due to a “hostile work environment” in his office, although none of the complaints were about him.

The inspector general investigated the Billion-dollar iPad scandal.

The financial scandals at the Celerity charter chain.

Fraud at the PUC charter chain started by Ref Rodriguez.

But this can’t be the reason he is being ousted, right?

When Mayor Bloomberg first took control of the New York City public schools and launched his reforms, his Chancellor Joel Klein said that New York needed not “a school system,” but “a system of schools.” Over time, his meaning became clear. He would break up and close scores of existing schools and replace them with brand new schools, including dozens of shiny new charter schools. “A system of schools” is akin to what others call “the portfolio model.” The board chooses winners and losers, like buying and selling stocks for your stock portfolio.

It soon turned out that the “system of schools” was a reformer cliche, like offering choice to “save poor black kids from failing schools.” We now know that most of those poor black kids lost their community school and were sent off to a distant school that was no better than the school that was closed. They were not saved. There seems to be a Reformers’ Hymnal that lists all these cliches (“no child’s future should be determined by his zip code,” etc.). I would love to see that list of favorite phrases to rationalize disruption the public schools and replacing them with privatized charters that come and go like day lilies.

Jane Nylund, a parent activist, gave a lot of thought to this “system of schools” thing. Here is her effort to put it in perspective by comparing it to the city’s water system.

She writes:

In all the discussions regarding the idea of creating a “system of schools”, I have not seen any discussion regarding school governance, and why these two sets of schools can never be “systemized” as a means to create an aura of goodwill and cooperation amongst the competitors. That’s because the topic of school governance is seen as unimportant, unnecessary, not needed for quality or equity, etc. Don’t worry about it…parents don’t care, because we told them not to…

I’ve been trying to figure out an analogy for what the board has proposed, and I think I’ve come up with one:

A System of Water

East Bay Municipal Utility District provides a high quality product to just about everyone within our municipality. It’s clear, clean, tasty. It’s not entirely free, but the cost can be subsidized for those who have trouble affording their product. As far as I know, virtually everyone has access to it. It is a public utility governed by an elected public board and heavily regulated. It is also fiscally transparent. It operates for the common good. Everyone gets the same high-quality product. It would be terrible if people couldn’t afford it, or the quality was lacking and people got sick from it.

Meanwhile, an assortment of private bottled water companies are having trouble growing new market share in their mature, saturated market. Their mountain springs are running dry, their expenses are going up, and they need to tap into new markets to keep running, so to speak. Crystal Geyser needs to come up with a strategy to sell to EBMUD, and fast. Their shareholders are breathing down their necks.

Crystal Geyser comes up with this great idea, A System of Water. Who needs a pricey mountain spring? What if Crystal Geyser can use EBMUD’s infrastructure and facilities in order to produce a great tasting product that Crystal Geyser can sell for a profit? EBMUD already has low-cost facilities, so why can’t Crystal Geyser simply take over part of those facilities? It can produce its bottled water easier and cheaper than trying to find another clean, high-quality mountain spring. After all, Crystal Geyser has an ROI to worry about. At the same time, because it’s a business, it also needs to grow market share, so part of that marketing campaign would be to claim that Crystal Geyser is clean, pure, free of any nastiness that might get into the regular water system, you know, EBMUD. So even though their product isn’t really superior, they can sell more of it by bashing the quality of EBMUD’s own water product. Crystal Geyser also has attractive packaging, superior distribution, as well as plenty of advertising budget to sell its water. More and more, you see their ads on social media, TV, AC Transit. Crystal Geyser even hands out discount coupons near public water fountains, warning users of potentially harmful bacteria lurking in the plumbing.

EBMUD’s customers don’t think A System of Water is a good idea. EBMUD has to maintain their quality standards and they are accountable to the voters and the regulators if they don’t perform; if Crystal Geyser takes up a portion of their manufacturing/bottling/purification plant, that’s going to make it more difficult and expensive for EBMUD. They also expose themselves to all kinds of legal and ethical entanglements if they can’t keep the water standards high. They have to be held accountable.

Crystal Geyser’s superior marketing means that they are able to grow their share of the water market, bottled or otherwise. Not everyone wants or needs Crystal Geyser, but that doesn’t matter to them as long as their financials look good. Maybe some people try Crystal Geyser, but they don’t like the idea of using plastic. Or maybe it doesn’t really taste as good as the Hetch Hetchy straight from the tap. Customers complain to the company, but there are other customers willing to drink Crystal Geyser, so not a big concern for the company. Any dissatisfied customer can certainly choose another brand of water or go back to EBMUD.

It also turns out that there is some malfeasance going on with the quality of Crystal Geyser. Lab tests show tiny bits of plastic floating around in the water. If ingested, they can pose a health risk. In addition, it turns out that they have not disclosed to their customers that the company no longer bottles their water from a pure, mountain spring, but they have been filling bottles with EBMUD’s own tap water, slapping their own label on the bottles, and marketing it as mountain spring. Since they are a private company, no one is really checking their marketing claims or making sure that the water is safe to drink.

Does Crystal Geyser care about what happens to EBMUD? Of course not, they are a business. They only care about growing and maintaining their own market share. But the company really, really wants to use EBMUDs facilities to grow and save on expenses, so Crystal Geyser comes up with A System of Water, as a means to increase its market share using EBMUDs infrastructure. Crystal Geyser explains to EBMUD’s customers that they are both on the same page; they both provide a quality product; they are both in demand. There’s room at the table for everyone. Really.

But, as more and more water drinkers start purchasing more and more Crystal Geyser (it’s a nice bottle, and it’s pure mountain-spring!), EBMUD struggles. It has to shut down part of its capacity. Crystal Geyser sees that excess capacity as an opportunity to increase its own production. Soon, EBMUD starts having water quality problems: bacteria, particulates, you name it. They have to add more chlorine to counteract this problem; now it tastes funky. This can’t end well for EBMUD. Meanwhile, Crystal Geyser has managed to set up a brand new filtration/purification system that ensures its side of the plant is functioning well. And now, it can market its water as cleaner, safer, and better-tasting than EBMUD. Bottled water flies off of the shelves. Crystal Geyser’s plan has worked perfectly.

Now, given this scenario, can you imagine this kind of business partnership between two directly competing products ever happening in the real world? Then why would anyone ever think that public district schools and privately managed charter schools can work as a system? It’s the same scenario. My analogy isn’t perfect; charter operators argue that district schools do not, in fact, provide a quality product for everyone; hence the creation of a “choice” system. But of course what ends up happening is that charters “choose” their students in the long run and shed the rest, who often return to the district schools. It’s part of the business model of which the entire charter sector is based, and it’s an effective way to sabotage a public good. Unlike public entities, no business exists to serve high quality to all. It can’t happen. Can everyone buy a Porsche? (sorry, that one doesn’t come with an engine). In contrast, there are plenty of businesses that serve low-quality to most. (Pepsi and Dominos Pizza).

One can also argue that, unlike Crystal Geyser, charters in California operate as non-profits. That feel-good nonprofit label is a tax designation that means their profits don’t go to shareholders, but instead are supposed to be “invested” back into the business. But as we have seen, these investments can include all kinds of money-making opportunities: high admin salaries, big consulting contracts handed out to friends and relations, exorbitant rents paid out to leasing companies owned by friends and relations, etc. No oversight. The usual. All for the kids…

In conclusion, the idea that “Turning charters into the Wolf that guards and hunts with you in lean times, rather than than the one that eats you” is an unenforceable, feel-good platitude at best, and nothing more than a rationale for more charter giveaways. In the business world, they don’t call it “Dog Eat Dog” for nothing. The Waltons would be proud.

NBCT high school teacher Stuart Egan reports on the passage of HB514 by the General Assembly in North Carolina, which he predicts will set the state back by decades.

North Carolina has a regressive legislature that has dedicated itself to gerrymandering, transgender bathroom bills, charter schools, vouchers, and every ALEC-inspired legislation imaginable since it gained a majority in 2010. The new legislation may well spur the growth of “segregation academies.”

North Carolina, before 2010, was known as the most progressive state in the South.

Since the Tea Party takeover, it has systematically starved its public schools and shown preference for charters and vouchers.
