The image of ICE arresting the child wearing his Spiderman backpack and his bright blue hat with bunny ears spread across the Internet. He and his father were arrested and sent to a detention center in Texas. Today, a federal judge ordered ICE to release them both.

A federal judge on Saturday ordered the release of a 5-year-old boy and his father from immigration custody, condemning their removal from their suburban Minneapolis neighborhood as unconstitutional.
The image of Liam Conejo Ramos, wearing a Spider-Man backpack and an oversize fluffy blue winter hat as he was detained by officers earlier this month, spurred outrage at a moment when many were already incensed by the Trump administration’s harsh immigration tactics in Minnesota and elsewhere across the country.
In a blistering opinion, Judge Fred Biery of Federal District Court for the Western District of Texas condemned “the perfidious lust for unbridled power” and “the imposition of cruelty.”
The boy’s father, Adrian Conejo Arias, was also arrested and the pair were taken to an immigration detention center outside San Antonio.
Judge Biery, who was appointed to the bench by President Bill Clinton, said both Liam and his father must be released from custody by Tuesday. His brief but fiery ruling chastised the government’s “ignorance of an American historical document called the Declaration of Independence” and called for “a more orderly and humane policy than currently in place.”
At the bottom of his three-page ruling, he included the photo of Liam, standing in front of a car, as well as two Bible verses. It was ordered, he wrote, “with a judicial finger in the constitutional dike.”

I wonder if they will return them to their home in Minneapolis or leave them outside the prison gates.

IDK, but since there has never, ever been a February 31st and today is January 31st, plus at the top right of the ruling it says “FILED January 31, 2026…” it’s clearly a typo, so I think it should not matter –but I am not a lawyer, so we’ve got to hope…

Liam and his father had entered the country legally by following the procedure that they had been told to follow. They filled out the asylum documents using the CBP schedule one app to schedule an appointment and legally presented themselves at a port of entry in December 2024 to seek asylum. What ICE did to the Ramos family follows the reckless and lawless pattern of behavior they have exhibited repeatedly in Minneapolis. Thank goodness for judges like Biery that believe in the rule of law.

it’s a GOOD thing, that at LEAST, the JUDICIARY still operates INDEPENDENTLY of the Executive branch of the U.S. government, so, democracy is still alive, for now…thank HEAVENS for these court justices who are still able to think for themselves and decide WHAT is right and wrong, instead of following the DIRECT orders of the Emperor!

One has to wonder how long this can continue. I saw a graphic that was said to be DHS statistics that showed a huge share of those arrested were here legally, and many were citizens. Is this what Trump supporters want?
I live among a population of people who voted for Trump. Ask a trumpist and you will generally get a head on the sand answer that includes simple trust in the administration (“I just wish people would give him a chance.”), distrust of any narrative that challenges Trumps, and the honesty of some who just spout racism at immigrants or other feared groups.
