Benjamin Herold of Education Week did the fact-checking:
In her written response to questions from a key Democratic senator, Education Secretary-nominee Betsy DeVos defended full-time online charter schools using graduation rates significantly higher than those used for state and federal accountability purposes. The figures and language cited by DeVos directly mirror those used in a report from K12 Inc., the country’s largest for-profit operator of cyber charter schools, in which DeVos is a former investor.
According to the Ohio education department, for example, the Ohio Virtual Academy has a four-year graduation rate of 53 percent, good for an “F” on the state’s accountability system.
DeVos put the figure at 92 percent….
She was specific in her lies.
In written questions, Murray, who is the ranking member of the Senate Health, Education, Labor and Pensions committee, asked whether it is appropriate to advocate for the schools, despite their poor results.
DeVos responded:
“High quality virtual charter schools provide valuable options to families, particularly those who live in rural areas where brick-and-mortar schools might not have the capacity to provide the range of courses or other educational experiences for students. Because of this, we must be careful not to brand an entire category of schools as failing students.”
She then cited a number of schools and what she described as their graduation rates, which differ markedly from the figures used by each school’s state for accountability purposes:
The Idaho Virtual Academy has a 90 percent graduation rate, DeVos said. The school’s most recent publicly reported figure for state accountability purposes is 33 percent.
The Nevada Virtual Academy has a 100 percent graduation rate, DeVos said. The school’s most recent publicly reported figure for state accountability purposes is 67 percent.
The Ohio Virtual Academy has a 92 percent graduation rate, DeVos said. The school’s most recent publicly reported figure for state accountability purposes is 53 percent.
The Oklahoma Virtual Academy has a 91 percent graduation rate, DeVos said. The school’s most recent publicly reported figure for state accountability purposes is 40 percent.
The Utah Virtual Academy has a 96 percent graduation rate, DeVos said. The school’s most recent publicly reported figure for state accountability purposes is 42 percent.
The schools listed in DeVos’ written response, and the language she used to introduce them—”the following virtual academies have four-year cohort graduation rates at or above 90 percent”—is the same as the language used by K12 Inc. in its 2016 Academic Report.
Here is what she did not mention, but that the Senate HELP Committee–and the full Senate–should know.
The Tennessee Virtual Academy is the lowest-performing school in the state (Senator Alexander must know that). When then-State Commissioner of Education Kevin Huffman tried to close it, he was stymied by its friends in high places.
The New York Times reported that the Electronic Classroom of Tomorrow has the lowest graduation rate in the nation.
Even DFER founder Whitney Tilson inveighed against K12 Inc. because of its “dismal academic results” and “sky high” attrition rates.
Stephen Henderson, the editorial page editor of the Detroit Free Press, warned that Betsy DeVos has a long-standing habit of twisting data to promote her favorite causes (charters and vouchers), and that she is not to be trusted to tell the truth.
He wrote:
A true advocate for children would look at the statistics for charter versus traditional public schools in Michigan and suggest taking a pause, to see what’s working, what’s not, and how we might alter the course.
Instead, DeVos and her family have spent millions advocating for the state’s cap on charter schools to be lifted, so more operators can open and, if they choose, profit from more charters.
Someone focused on outcomes for Detroit students might have looked at the data and suggested better oversight and accountability.
But just this year, DeVos and her family heavily pressured lawmakers to dump a bipartisan-supported oversight commission for all schools in the city, and then showered the GOP majority who complied with more than $1 million dollars in campaign contributions.
The Department of Education needs a secretary who values data and research, and respects the relationship between outcomes and policy imperatives.
Nothing in Betsy DeVos’ history of lobbying to shield the charter industry from greater accountability suggests she understands that.
If she’s confirmed, it will be a dark day for the value of data and truth in education policy.

I wonder how many Republicans are being blackmailed and/or threatened to support her, and because of fear of exposure from something they did in the past, they crumble and get down on their knees to kiss Littlefingers on his 11th little finger.

Lloyd…. I think you understand politics better than most (though probably not as well as Dianne). You know that the ‘leadership’ will allow the most vulnerable in the Party to cast an ‘independent’ vote if it might harm them with their local constituents as long as the outcome of the total vote remains unchanged. This is a favor extended with the understanding that there will be other favors expected from the grantee.
McConnell called for cloture. He knows he has the votes. Anyone who tells the leadership one thing and then votes the other way is dead (politically). Plenty of Republicans have been blackmailed, but they know that if they ‘play ball’ the Party will have their backs.
DeVos will win confirmation (most likely) or McConnell’s head will roll (rather unlikely) along with heads of those politicians that decided to go back on their word to the leadership.
Only massive, public (possibly violent) action in the next day or two will change the outcome, however Americans are not likely to produce that type of response. Instead, they will ’email or phone’.

I agree with what you wrote in your comment but disagree on one point. There are millions of Americans more than capable of violence and they are not all white supremacists. But what will it take to push them that far? That is the question.

If anyone knows the ins and outs of the existing political system, it’s you, Diane. You are correct (in my mind) for indicating that she was prepared for the question and told how to give a ‘reasonable’ response.
I’ve only dealt with a State legislature, and ‘prepared’ a few answers (and questions) myself, but I know how that works. I don’t fault legislators for not being technical experts in every field imaginable, however I do think that those legislators should be able to separate the information they get into two piles. One, ‘plausible, possible, probable’ and another is ‘BS’. If they can’t do that, they shouldn’t be in a position of authority.

Will the committee people making the decision know this new information? Before the vote will somebody inform them of the fact checking and that she lied? Or will this go un noticed by these people. If you can get one more republican to switch sides, then Pense won’t be the tie breaker after all!

If Lamar Alexander thinks he had trouble getting John King to follow the express language ESSA, I wonder what he expects from DeVos? Certainly everything to date indicates she intends to do whatever the bleep she wants, whether or not legal/ethical. Or maybe these guys just intend to vote to rewrite the entire US Code to suit her?

As Stephen Henderson of the Detroit Free Press wrote, Betsy makes up “facts.” She cherrypicks them. She finds facts–or pays someone to find them–to confirm what she wants to believe. She told the Senate committee that virtual charters have grad rates in the 90-100% range, which is a flat out lie. Did they care that she lied to them? Maybe she didn’t lie. Maybe it was “alternative facts” that she believes. Even though they are not true.

I hope, Diane, that you have contacted Alexander to let him know how disappointed you are that his vote allowed Betsy to advance to a full Senate consideration. I realize, of course, that it is an accomplished fact, however I think he (one of my own State’s representatives) needs to feel a bit of a sting from someone like you, a former colleague.

Diane, Maybe you should show a shred of integrity here and explain to your legion of followers how ON TIME graduation rates are calculated. You could explain to them that these rates statistically reward schools for dropping kids out and statistically penalize the eschools that take these students in on the day they enroll. At my daughter’s eschool over 65% of the 14,000 enrollees start at the school in their high school years and are ALREADY AT LEAST A YEAR BEHIND WHEN THEY ARRIVE. You know better but your politics and school hate have consumed you.

Why don’t you explain that the state of Ohio won a judgment against ECOT FOR $65 million for misreporting data–that was just a few months ago. And while you are at it, describe the millions of dollars that William Lager, who owns ECOT, has given to Republican officials and how many hundreds of millions he has collected from the state to offer online instruction.

I will explain that my own 4.0 child… one of the 100’s of thousands of children you relentlessly attack through your political rhetoric… was one of the students that was falsely flagged as truant and part of the $65Mill headlie that you peddle. You need to slow down and research some things before you regurgitate your school hate. And in fairness you should report equally on the extortion of money from teachers paychecks that is then used to buy legislators, influence and peddle propaganda at both the state and federal level… you may also want to report on the variance between the values of that extortion and lobbying compared to Mr Lagers donations. There are so many real people on the other end of your party politics pitchfork. It’s sad that you have a platform and you use it for this.
