Carol Burris demolishes myths about teacher evaluation that were contained in a recent opinion piece in Phi Delta Kappan.

Frankly, it is pretty shocking to see that the editor of this journal for educators believes that standardized testing should have any role in evaluating teachers. We are already seeing a renewed emphasis on teaching to the test and more narrowing of the curriculum as teachers’ careers hinge on student scores.

It’s also shocking to see this editor agree that teachers should have no due process rights. When that happens, we can bid farewell to academic freedom and expect to see many districts where evolution is no longer taught.

The editorial criticized here just parrots the uninformed claims of the corporate reformers. Nothing proposed here will improve education. It’s guaranteed however to demoralize teachers.

Burris once again demonstrates the candor, intelligence and integrity that placed her on the honor roll as a hero of public education.

Voters in Idaho gave Mitt Romney a landslide  but simultaneously voted overwhelmingly to repeal the “Luna Laws,” the brainchild of state superintendent Tom Luna.

This stunning victory for public education demonstrates that not even red-state Republicans are prepared to privatize public education and dismantle the teaching profession.

The Luna Laws imposed a mandate for online courses for high school graduates (a favorite of candidates funded by technology companies), made test scores the measure of teacher quality, provided bonuses for teachers whose students got higher scores, removed all teacher rights, eliminated anything resembling tenure or seniority, turned teachers into at-will employees, and squashed the teachers’ unions.

The campaign to support the Luna laws was heavily funded by technology entrepreneurs and out-of-state supporters of high-stakes testing and restrictions on the teaching profession, including New York City Mayor Michael Bloomberg.

The voters in this reddest of red states overturned all three of the Luna laws (which he called “Students Come First”; anything in which children or students or kids come “first” is a clear tip-off to the divisive intent of the program).

As the story in the Idaho Statesman reported:

In a stunning rebuke to Gov. Butch Otter and Superintendent of Public Instruction Tom Luna, Idahoans on Tuesday repealed the laws that dominated the pair’s agenda the past two years.

Idahoans agreed with teachers unions — which spent more than $3 million to defeat Propositions 1, 2 and 3 — that the reforms Luna called “Students Come First” and detractors called “The Luna Laws” went too far.

As GOP presidential nominee Mitt Romney won a 65 percent Idaho landslide, Otter and Luna — both touted as possible Cabinet secretaries in a Romney administration — lost their signature issue by large margins.

With 99 percent of all Idaho precincts reporting:

— 57 percent opposed to restrictions on teachers unions in Prop 1.

— 58 percent voted no on Prop 2, which paid teacher bonuses based on student test scores and other measures.

— 67 percent rejected a mandate for laptops and online credits for every Idaho high school student.

The scale of the defeat reached across Idaho.

Voters in 37 of 44 counties rejected all three measures. The seven outliers — Adams, Boise, Fremont, Jefferson, Lemhi, Madison and Owyhee — are largely rural. Not one of Idaho’s most populous counties voted for even one of the laws.

Big political contributions have poured into a local school board race in Perth Amboy, New Jersey.

Donors in California andColorado are supporting a slate of school board candidates in that small New Jersey district.

As Jersey Jazzman explains here, the school board in Perth Amboy has been trying to oust the district’s divisive superintendent. Acting Commissioner of Education Chris Cerf has protected her, preventing the board from getting rid of her. The election provides an opportunity to fire the board and install one that will defend Chris Christie’s agenda: anti-teacher, anti-union, anti-tenure, pro-privatization.

As Jersey Jazzman writes:

It seems absurd, and yet it’s true: four wealthy Californians and one wealthy Coloradan – heavy hitters in the tech, financial, and health care sectors – have contributed tens of thousands of dollars to a slate of candidates running for the school board in Perth Amboy, a city of 50,000 with a majority Hispanic population.

“According to New Jersey election records, the slate of candidates calling themselves “Better Schools Now!” has collected $64,700, mostly from sources outside of Perth Amboy. In contrast, an opposing slate, “New Vision, New Voice” has collected $7,005, with all of its donations over $300 coming from within the city.”

There is a clear pattern emerging here and elsewhere around the country: a small number of extremely wealthy individuals are pouring huge amounts of money into elections, state and local, to buy the result they want: privatization, budget cuts, anti-union policies, a compliant school board.

It happened last year in Denver and last spring spring in Louisiana; its happening now in Perth Amboy, New Orleans, Idaho, Santa Clara County (CA), Washington State, Georgia, and elsewhere.

This is not haphazard. These are takeover targets.

Time for an investigative journalist to find out who is coordinating this subversion of democracy.

A group called Education Voters of Idaho refused to disclose its donors until required to do so by a court order.

The biggest donor is a businessman who is an investor in K12, the online charter corporation ($250,000); the second biggest donor is Mayor Michael Bloomberg ($200,000).

EVI promotes the anti-union, anti-teacher, privatizing policies of state superintendent Tom Luna. Supporters of public education are seeking to repeal the Luna laws, which are deceptively called “Students Come First.” The phrase echoes Michelle Rhee’s StudentsFirst and Joel Klein’s Children’s First.

Luna has received heavy funding from technology corporations, and his laws mandate the purchase of a laptop computer for every student, and every student must take two online courses for graduation. They eliminate tenure and seniority. They require that student test scores count for 50% of every educator’s evaluation, including district superintendents, principals and teachers. All educators will have a one or two year contract. They initiate bonus pay based on test scores for all educators. Teachers will not get a written explanation if the principal decides to fire them.

A sample of one of the laws:

School districts no longer have to prove a financial emergency before reducing teacher numbers. School boards can reduce teacher numbers at their discretion but cannot consider seniority when deciding who to eliminate.

TeachPlus is one of those Gates-funded teacher organizations that is supposed to provide a different perspective on teaching than the teachers’ unions. It can be counted on to advocate for the interests of new teachers who allegedly want merit pay, don’t care about job protections, and want to be judged by the test scores of their students. The teachers for whom it seems to speak are part of the New American Economy, where jobs are short-term, not seen as part of a career.

TeachPlus has just conducted a survey of teachers. Its first startling discovery is that “For the first time in almost a half-century, teachers with ten or fewer years experience comprise over 50% of the teaching force. We refer to these teachers as the New Majority.” This “new generation” of teachers–unlike, we may suppose, the older generation of veterans–have “high expectations for their students and a strong desire to build a profession based on high standards.”

The “new generation” wants student growth to be part of teacher evaluations (the veterans do not); the new generation wants students growth to count for at least 20 percent of their evaluation (the veterans do not); the new generation wants to change compensation and tenure so younger teachers (themselves) can get higher salaries (the veterans do  not). The veterans want licensure tests to cover the skills needed in the classroom (the new generation does not).

Both generations agree they need more time to collaborate with their peers. Both agree on the importance of clear and measurable standards.

And here is the interesting part:

Both agree that current evaluations are not helpful in improving practice (what are current evaluation? Using test scores to measure teacher quality.)

Both agree that a longer school day would not be helpful “to support students more effectively.”

Both agree that increasing class size to pay some teachers more would be a mistake.

The takeaway: Teachers, young and old, agree and disagree on various “reform” proposals.

On two issues they are united: They do not see the value of a longer school day, and they do not want larger class sizes in exchange for higher pay.

But a matter that should concern us all: Current “reform” policies are driving experienced teachers out of the nation’s classrooms. This cannot be good for anyone. It is certainly not good for the young teachers, who need senior teachers to help them improve.

How can a profession become “great” by demoralizing and ousting those who know the most?

Who would go to a hospital in an emergency and insist on being treated by an intern, not a senior physician?

Who would want their legal affairs to be handled by a lawyer who just graduated law school if they could get a senior partner instead?

When will President Obama, Secretary Duncan, Bill Gates, Eli Broad, and all the other people driving current policy realize that they are inflicting harm on the nation’s education system?

Vermillion Parish School Board in Louisiana joins the Honor Roll as a hero of public education because of its refusal to bow down to the unjust, unwise demands of the State Department of Education. The Louisiana State Department of Education is not at all “conservative.” It believes that bureaucracy should override local control and that the people should hand their local schools over to the whims of the state.

The Louisiana Department of Education chastised four school districts for refusing to obey the Legislature’s command to pay no attention to seniority or tenure when laying off teachers. Three of the four districts–including Vermillion–are among the top 15 districts in the state.

You see, the Legislature thinks it knows more about how to reform education than the best districts and the best educators in the state. Ditto State Commissioner John White, who has only two years teaching for Teach for America and has never been a principal or a superintendent until he was suddenly elevated to his present job by Governor Bobby Jindal, who wants to privatize public education and implement the full ALEC agenda.

The Legislature passed a law (Act 1) last spring saying that layoffs should be based “solely” on demand, performance, and effectiveness. Vermillion’s attorney says that the board has a policy based on the same criteria, but it uses experience as a tie-breaker. Unfortunately, in the eyes of the state, the high-performing Vermillion has a teachers’ union, and the district agreed with the union that seniority or tenure would be used as a secondary way to reduce staff.

Anthony Fontana, a member of the Vermillion school board, spoke plainly about what the Jindal administration was trying to do:

This is an opportunity for Jindal’s administration to bad mouth public education,” said Fontana. “This is another attack on public education. We are not going to stand for it. We have to stand up and fight.”

Jerome Puyau, the superintendent elect of Vermission Parish Schools said, “Our policy does protect great teachers by adding more objective criteria, it takes away the possibility of politics coming into play whether it is the board or superintendent who institutes it. Vermilion Parish respects the experience, certification, and training that great teachers have achieved through the years and has always placed these criteria for major consideration in hiring which is a major reason that Vermilion Parish has been so successful with student achievement.”

This contretemps makes clear what is behind the Jindal agenda: Not improving schools, but privatizing them, even if it ruins the good schools that already exist in Louisiana.

The most important voice in state education policy today is the American Legislative Exchange Council, known as ALEC.

ALEC has 2,000 state legislators as members, and dozens of corporate sponsors, including the biggest names in business.

Here is an excellent summary of ALEC’s legislative priorities.

ALEC writes model legislation. Its members carry it home and introduce it as their own in their states.

ALEC promotes charters and vouchers.

ALEC likes the parent trigger.

ALEC likes it when the governor can create a commission to approve charters over the opposition of local school boards.

ALEC favors unregulated, for-profit online schooling.

ALEC wants to eliminate collective bargaining.

ALEC doesn’t think teachers need any certification or credential.

ALEC opposes teacher tenure.

ALEC likes evaluating teachers by test scores.

You should learn about ALEC. Read up on it. It is the most influential voice in the nation on education policy.

I wrote a post about radical legislation in Pennsylvania that will authorize the Governor to create a charter commission with power to overturn local decisions. This legislation was written by the corporate-funded organization ALEC.

The Louisiana legislature passed the radical ALEC agenda last spring. Teachers lost tenure; unqualified people can become teachers. Test scores determine teachers’ careers. More than half the state’s students are eligible for vouchers, with some going to fundamentalist schools. Charters will pop up everywhere. Students can take their tuition money to online schools that get poor results, or to any snake-oil salesman that hangs out a shingle and pretends to be an educator.

Everything comes out of the minimum foundation funding for public schools, which is supposedly illegal, but who cares? Lots of new opportunities to make a buck in Louisiana or any other state that passes ALEC model legislation.

A reader in Louisiana notes that the proposed governor’s commission, stripping local boards of their decision-making powers, has already passed in his state:

This legislation was passed in Louisiana last spring. Don’t let this happen to Penn -teachers get the word out to fight this. This December our Board of Education will present the first list of applicants to fall under this new provision and they have shown that they decry true accountability. My school district,St. Tammany Parish, is the highest performing large school district in the state with highest average ACT score in the state and above the national average. We have never allowed charters but we are now expecting to be invaded. One prospective charter operator is advertising on Craig’s List for personnel to open an “international school.” He is a former instructor of Muslim studies at the Air Force Academy (5years) from Edinburgh, Scotland. Where do these charter promoters come from and how do end up here.

In an earlier post, a parent expressed frustration that her child’s teacher never explained how awful the testing is, how it was stealing time from instruction and was of little or no value.

Many teachers wrote to say that without tenure, they can’t take any risks, can’t upset administrators, can’t speak up without endangering their jobs.

This parent has a different take. I wish Arne Duncan would read this and realize that he is destroying teacher morale and professionalism in schools across the nation. His policies are misguided at best, deceptive and harmful at worst.

I spoke to the teachers at my sons’s school. They are EXHAUSTED. They hate the testing, they are fearful for their jobs but they are even more fearful that their beloved principal will be replaced if they don’t follow these crazy mandates. They are on a watch list now due to NCLB mandates ( special ed failure rate had dipped). This is the BEST school in the whole district- national ranking for newspaper, mock trial, debate, the highest SAT scores in the district, the highest number of AP passing exams score in the district and is ranked in the country. These fantastic teachers, who are dedicated to special needs students and needs of special students, are being crucified by the weekly lesson plans, the state oversight by under-aware and under trained ‘professionals’. These teachers HATE the tests being implemented by this VAM measure that is their prize for winning RTT. They are ridiculous tests that have no merit but the teachers who give their all to the kids in the class and before and after are flat out EXHAUSTED by these VAM measures.

Burning out teachers, who are seasoned and fantastic professionals, for no educational reason at all. That is why parents don’t know.

State after state is imposing new teacher evaluation systems that have never worked anywhere else; new pay structures that no one understands; eliminating collective bargaining rights; removing tenure to make it easier to fire teachers.

All of this is allegedly to “improve” the teaching profession.

But this is what is happening on the ground. Bill Gates, if you are reading this, can you please explain? Arne Duncan, this is what you brought about through your Race to the Top, perhaps you could explain.

Can anyone explain how these measures improve the teaching profession?

I’m a first grade teacher in Indianapolis. We cannot even get anyone to explain to us what the new pay structure is for our school district. We know we will no longer be given pay increases…..we’ve been told nothing about bonus pay, or starting salaries. Our union has no power since our legislature stripped it in this last session. I understand that we want to hold teachers accountable, but I think it is not unreasonable to expect that I be at least told what my pay structure will be so I know what to work towards. I’ve earned a masters degree, two separate certifications and have 16 years of experience in inner city schools. I do what I do because I love it and I make a difference. I’m tired of being demonized and demoralized in the press because I want to know whether or not I am going to be able to continue to support my family. These new evaluation systems are so complicated and at the same time vague and ambiguous. I’m in the process right now of writing my state approved forms for my administrator for part of my evaluation and I’m overwhelmed by what I must now do. People believe all of this paperwork and bureaucracy is going to make better teachers, but in reality it is driving people from the profession. College enrollment in education programs has dropped dramatically over the last 5 years. Who would want to be a teacher in this climate? I don’t know about Chicago and DC, but in Indianapolis, we are all frustrated and worried about the future of our schools.
