Judge Amy Berman Jackson, the federal judge who sentenced insurrectionist Kyle Young, gave a stern lecture to the Republicans who refused to defend the nation’s Constitution and its democratic process.
For those of us old enough to remember the Republican Party of Dwight D. Eisenhower, today’s Republicans are pusillanimous cowards who worship at the feet of a man who has no intellect, no character, no ethics, and no sense of history. The fact that such a man dominates a once-honorable party is appalling.
Judge Jackson did not mince words, according to Politico.

A federal judge delivered a blistering rebuke of Republican Party leaders Tuesday for what she said was a cynical attempt to stoke false claims of election fraud of the kind that fueled the Jan. 6 attack on the Capitol.
U.S. District Court Judge Amy Berman Jackson said former President Donald Trump had turned his lies about the election into a litmus test for Republican candidates and that “high-ranking members of Congress and state officials” are “so afraid of losing their power” that they won’t contradict him. That fealty, she said, comes even as law enforcement and judges involved in cases related to the former president are facing unprecedented threats of violence.
It’s up to the judiciary, she added, to help draw the line against those dangers.
“The judiciary … has to make it clear: It is not patriotism, it is not standing up for America to stand up for one man — who knows full well that he lost — instead of the Constitution he was trying to subvert,” said Jackson, who was appointed by former President Barack Obama.
In addition, Jackson said, Trump and his allies are using rhetoric about the multiple criminal probes connected to Trump that contain dangerous undertones.
“Some prominent figures in the Republican Party … are cagily predicting or even outright calling for violence in the streets if one of the multiple investigations doesn’t go his way,” Jackson said…
She’s not the first federal judge to rebuke Trump in the context of Jan. 6 riot prosecutions. Judge Amit Mehta lamented that many of the low-level rioters were duped by powerful figures, including Trump, into marching on the Capitol, only to suffer criminal consequences as a result. Judge Reggie Walton called Trump a “charlatan” for his conduct related to the election. And a federal judge in California, David Carter, determined that Trump’s actions related to Jan. 6 likely amounted to a criminal conspiracy to subvert the election.
But Jackson’s comments were the most stinging assessment not only of Trump but those in the upper echelons of elected GOP leadership who have echoed him. She also pushed back at claims by some Trump allies that Jan. 6 defendants had been targeted for political reasons.
“You were not prosecuted for being a Trump supporter. You were not arrested or charged and you will not be sentenced for exercising your first amendment rights,” she said to Young. “You are not a political prisoner … You were trying to stop the singular thing that makes America America, the peaceful transfer of power. That’s what ‘Stop the Steal’ meant.”

The local newspaper today has an article entitled, “Extremist Groups Surge Again in Florida.” A study from the Anti-Defamation League reports that there was a 71% increase in extremist related incidents from 2020 to 2021. The majority of the incidents are from groups with white supremacist ties. These insular groups feed on bogus propaganda and lies, and hateful rhetoric is continuing to spread in online forums that cater to these groups. Florida is not alone in the spread of extremist hate groups in this country.

If Garland does not indict, arrest, try, and convict Trump and his co-conspirators, his inaction will make Neville Chamberlain’s policy of appeasement look like the stand of Leonidas and the 300. Inaction would be a historic failure with devastating consequences. Democracy itself is at stake.

Judge Jackson’s speech was not directed only at Republicans, but also at the “Judiciary” as a whole.

If the judiciary does not make a stand in this case and indict Trump for the insurrection ( not simply for the documents issue) might as well stick a fork in the US.

I think the better analogy would be the German conservatives who disliked the Weimar government so much that they preferred Hitler, whom they thought could be managed. Chamberlain was faced with a public of his own, not Germany’s public. Incidentally, the right wing in Britain, whose idol was Oswald Mosley, mirrored a similar movement in the US Burns discusses in the Recent film. Could Chamberlain ever have led Britain into a second war? Was appeasement his only option? That has been cussed and discussed ever since he stepped out of his twin engine plane talking about peace in our time

If Trump is charged with anything at all, it will be with “mishandling” classified documents or maybe even something like “failing to follow the procedure for declassifying document”.
I don’t believe he will be indicted for aiding and abetting the January 6 insurrection. Nor do I believe he will be indicted under the Espionage Act.
I think we can be fairly certain that Garland is going to follow the path of least resistance in the Trump case, just as he did in the case of Gaetz when the DOJ indicated that they will not prosecute.

In just the last week, the National Archives said that Trump has still not returned all the requested material, which may be an indication that Garland’s intentions are along the latter line.
That would allow Garland to avoid all the hard issues and serious charges.

If Trump is charged with violating the Presidential Records Act (which is probably the most likely charge to be brought, if any charges are brought at all), it would actually accomplish very little — other that allow Garland to say “Look, I told you no one was above the law’.
First, there are no criminal penalties for such a violation. Second, even if Trump could somehow be prevented from running for President again, that would actually be what many Republicans are quietly wishing for at this point. It would just make things that much easier for DeSantis to slide into home base.

The highly visible Red Mass held this week in D.C. had notables like Supreme Court justices in attendance. It was a perfect time to address an audience of faithful who likely, based on extrapolation of Pew research, to have been Trump-supporters. Was Christian nationalism and American democracy covered in the address?

Red Mass could have called out Catholic Vote for its $3 mil. spending to defeat Democratic politicians who are Catholic.
Allegedly, the Catholic hierarchy asked a site that included the sect’s name and “militant” to stop using the sect’s name. The hierarchy could ask Catholic Vote to ditch its public-inferred link to the sect.
I won’t hold my breath waiting for liberals in the sect to advance the idea.

The tax and campaign funding systems are so screwed up in the US that mega churches like the Catholic Church can continue to qualify as a nontaxed nonprofit charity organizations while effectively backing campaigns to back and/or defeat specific candidates and to back or overturn specific legal rulings like Roe.

SCOTUS decided to allow the state to get involved in medical issues that should be between women and their doctors. So, when one in 6 American hospitals are Catholic, it’s a problem as is the fact that Catholic organizations are the nation’s 3rd largest employer, as is the new privilege/right that the Supreme Court conferred on religious organizations to violate civil rights employment law, as is the Catholic Medical Association and the Catholic Bar Association.
