Unfortunately the court did not throw out the worst part of the trial court’s decision: the erroneous ruling that the state adequately funds its public schools. To paraphrase the dissent, today’s ruling is tantamount to saying our constitution allows us to leave our neediest children behind.

Exposing the deep irony of the NCLB law which originally presumed to force an accountability for the lowest performing 20% — in so many states that lucrative game has now conveniently turned itself into: So long as you push our invasive Big Money reforms, it is okay to ignore your lowest performing 20%.
