Robert Amsterdam, who was hired by the Turkish government to investigate the US charter school chain of imam Fethullah Gulen, filed a lawsuit against the Harmony schools in Texas. The lawsuit calls on the Texas Education Agency to investigate these schools for illegal practices.
Gulen charter schools operate under many different names. It is one of the largest charter chains in the nation, with 155 schools, all publicly funded. Typically, a Gulen charter has a board that is made up of mostly Turkish men, as well as many Turkish teachers. It is strange to have “public schools” operated by foreign nationals. How do they teach the duties of American citizenship –a prime responsibility of public schools–when they are not citizens?
Amsterdam’s law firm issued the following statement:
“The law firm Amsterdam & Partners LLP has filed a formal Complaint against Harmony Public Schools (Harmony), urging the Texas Education Agency (TEA) to conduct a full investigation into Harmony based on documented abuses suggesting a wide-spread pattern of fraud, discrimination, and abuse in the Harmony network.
“Harmony – which is financed by over $250 million federal and state tax dollars annually – operates seven open-enrollment charter school districts serving forty-six charter campuses in Texas. The Complaint sets out numerous substantiated violations of laws and regulations designed to ensure transparency, accountability, and responsible stewardship of public resources.
“According to the Complaint, Harmony engages in illegal employment discrimination on the basis of national origin and gender, preference and selection of affiliated vendors in violation of open and competitive bidding requirements, and misuse of public education funds.
“The TEA has a responsibility to taxpayers to ensure that public education dollars are used solely for their intended purpose,” said Robert Amsterdam, founding partner of Amsterdam & Partners LLP. “Our own limited investigation reveals that Harmony uses taxpayer funds to finance an illegal H1-B visa scheme that places underqualified Turkish teachers into key positions in its schools, while simultaneously underpaying its more qualified non-Turkish teachers. We have also learned that Harmony misappropriates public funds by routinely engaging in improper self-dealing transactions with affiliated vendors, which has the further effect of preventing local businesses from competing for contracts at Harmony schools.”
“Harmony has been the subject of federal and state investigations in recent years, with findings including poor financial controls, misuse of federal program funds for special education and Title I, and significant underrepresentation of English-language learners and students with special needs in Harmony schools. As those investigations did not examine Harmony’s employment, procurement, or business practices, the Complaint formally requests that the TEA conduct a comprehensive investigation into Harmony to ensure that these past legal violations have been rectified and that its ongoing practices are consistent with the law. The TEA and Commissioner have broad authority to monitor and investigate Harmony, and the Complaint submits that the Commissioner should conduct an investigation now in light of Harmony’s aggressive expansion plans to open up to fifteen new campuses in Texas over the next two years.
“The Complaint also asserts that Harmony and many of its directors, employees, and related vendors are connected to the Gülen Organization, a network of schools and affiliated businesses headed by Fethullah Gülen, a reclusive Turkish cleric residing in Saylorsville, Pennsylvania. “We believe that Harmony’s ill-gotten gains are funneled to the Gülen Organization, which uses them to enrich itself and to expand its political influence in the United States, Turkey and dozens of other countries around the world,” said Amsterdam. “My firm is submitting this Complaint in its own name, without any of the numerous Texas taxpayers who support the Complaint, owing to the Gülen Organization’s standard practice of harassing and intimidating anyone who speaks out against it.”

It is so bizarre that ed reform is now involved in a giant political dispute in Turkey.
Does this work the other way? Does Turkey fund a big chain of US-owned charters? Are they importing US teachers and paying them with funds from Turkish citizens?
I realize US lawmakers are completely selling us down the river but sometimes the venality shocks even me 🙂
I think most people in Ohio would be shocked if they knew they were funding a Turkish charter chain that not only employs foreign nationals, but prefers to hire them! US politicians promote this chain! Apparently they’re all for it. Incredible.
The Gulen movement has charters in other countries, but no other country gives them public money and allows them to replace their public schools.

informed about the Gulen Movement, and the 155 Gulen Charter Schools? It behooves all informed Ohioans to keep the pressure on the media to so inform the populace. The information is all online and people need only to google it and read about this dangerous group who are feeding off American taxpayers.

The California State Auditor is investigating Magnolia Public Schools, a Southern California-based charter network that has been accused by L.A. Unified of misusing funds.
“Magnolia Science academies, like all other charter schools in the state, are public schools; as such they receive tax payer dollars for their operations,” Assemblymember Adrin Nazarian of Sherman Oaks said in his request for the audit.
The state’s audit will cost $320,000 and scrutinize a minimum of four of the network’s 11 schools, sifting through vendor and payroll records, truancy and test score data and fundraising practices.
Magnolia Public School officials said they welcome the evaluation.
“Our school leadership has always embraced a policy of transparency and accountability when it comes to the fiscal solvency of Magnolia Public Schools and our commitment to superior student achievement,” said Mike MeCey, a spokesman for Magnolia.
Nazarian asked for the probe at Thursday’s meeting of the California Joint Committee on Legislative Audit, on which he is seated, in response to findings by L.A. Unified’s Office of Inspector General.

Amazing to see that no where in this article, nor in the comments, is the name Fettulah Gulen mentioned. Gulen, of the Turkish Gulen Movement is the owner of the Magnolia Charters, and the Harmony Charters, and about 147 charters in the US. This Turkish Imam who strives to lead a new Turkey ruled by Sharia Law is now a billionaire living in the Poconos Mountains in a heavily guarded estate, and all paid for by U.S. taxpayers.
It is almost impossible to gather information to understand why the last three administrations have allowed him to open this Turkish-directed schools, and why he is allowed to bring to the U.S. thousands of Middle Eastern men ostensibly to teach at, and run, these charter schools. The FBI was investigating the Magnolia Charters in LA for possible fraud some months ago…but there are no recent reports as to this investigation.
Why is this strict Islamist Imam allowed to do these things?

Because politicians love their $ campaign contributions, honors and those famous trips to Turkey and the other Turkic countries like oil rich Azerbaijan, Krygzstan, etc., They are pulling a fast one on LAUSD they pushed all the Turkic people out of the way, including their CEO Mehmet Argin and hired a Hispanic PR CFO, absent at the last meeting where MSA #8 was denied was any of the Turks, some where in the audience but didn’t speak. The speaking was done by the hired mouthpieces of Jerry Simmons, Kim Onisko, Oswaldo Dias, the first two being an attorney and accountant. Their court case will continue and like the other “Gulen Inspired” schools they will scram before they have to testify, give up evidence in discovery or answer interrogatories. The Gulen Movement hates exposure and transparency. They believe they have every right teaching our children and that their education is superior to all others (despite the fact OECD ranks Turkey’s education at below standard 34 out of 36 countries just above Chile and Mexico). Things are about to stink up, the Gulen Networks were declared a “NATIONAL SECURITY THREAT ” in Turkey. Erdogan has dismantled their schools, banks, positions in the government. It’s only a matter of time in the USA.

Annie Gilbertson, if you want a real scoop, investigate the LAUSD’s massacre of older teachers. Thousands of senior teachers including me have been abused by principals, brought up on false and ridiculous charges and forced out of their jobs. the huge abounts of money spent by the superintendent to hire outside law firms to persecute teachers is obscene. You would get the scoop because Howard Blume has told me that his editors believe that all teachers are horrid. The state auditor put out a report in 1997 that warned the LAUSD that it was in legal danger because of the incompetent manner in which they conducted investigation of teacher misconduct. The district took this as a plan of action and follows it to the letter.

It might be appropriate to state that Mike MeCey, is a partner at Magnetic communications. Formerly he was a press secretary for the California Legislature. Hence, he is a paid public relations firm for the Magnolia Schools. This same group has hired a high profile PR firm in Ohio to gloss over their recent FBI raid (concept Schools) and in Texas they hired the ex-PR lady of former President Bush (Karen Hughes) Hopefully, Mr. MeCey will check out the accuracy of his public statements.

Agreed there needs to be oversight, but Magnolia isn’t the first charter in California to be closed down for financial mismanagement. Many times it leads to a criminal indictment and jail sentence for the charter operators (Ivy Academia, California Charter Academy, Khadijah Gafour) Magnolia Charter Schools, Magnolia Public Schools, Magnolia STEM Schools or Magnolia Science Academy (they change their names) continues to weave a deceitful web of self dealings. 4 days after the LAUSD sent them a letter to shut down the 2 schools the California Department of Facilities awarded them $6 million in grants.
Magnolia claims to have an “independent” accountancy that declares they are solvent – this was used to obtain this $6 million. They are rapidly moving forward with the building of a school in Santa Ana, CA (they were originally denied this by the local school district but got this school overturned at the state level) Shouldn’t this money be put on hold until the finances and the school are cleared of wrong doing? Lastly, Mr. Mekan Mahummodov is the CFO (Chief Financial Officer) of Magnolia Public Schools, he also heads up the MPM – Magnolia Property Management, which stands to benefit from the $6 million. Self dealings are strictly prohibited under racketeering laws if you are a board member of one entity and benefiting from the business of that entity with outside business.
It will be interesting to learn where the furniture, uniforms, catering, janitorial, etc., services to the school are being conducted and who or what “movement” reaps the benefits of this American money. Fortunately the judge already ordered the schools to cease paying Accord Institute (which shares the same building as Pacifica Institute) any more “consulting fees” Accord is collecting fees from all the charter schools on the west coast operated by this “group”
Good Luck California, it’s a shame over $300,000 has to be spent to get a thorough forensics audit. Seems like Magnolia Schools should have to pay that back to the State of California. Poor American Tax payers.

“Among those touring Turkey has been State Rep. Cliff Rosenberger, a Clarksville Republican on the powerful finance and appropriations committee and considered to be a leading candidate for House speaker next year. He was joined on the trip by at least four other state legislators and local government leaders from his area in southwest Ohio.
There have been other trips from Ohio, and in Illinois, there are allegations that state officials who took trips showed favoritism in disbursing public dollars to Concept schools.
Public records show that since late 2009, the U.S. Department of Labor has allowed 19 of these schools in Ohio to hire 325 educators almost exclusively from Turkey.
However, as early as 2002, state audits found thousands of public dollars “illegally expended” to finance the U.S. citizenship process for Turkish employees — some fresh out of college with no classroom experience and broken English. Help with legal and immigration fees also extended to their children and families, including the spouses of directors.”
They must have some clout, these charter schools. It extends all the way to the Labor Dept and Immigration. 100% publicly-financed.

Why is the Turkish government suing on behalf of American tax payers?
Jonathan…Fettulah Gulen has been protected by three American administrations starting with Clinton in 1999, and followed by Bush and Obama. How come? The claim of a “secular” Turkey under Erdogan who was supposedly our sought-after ally, rings hollow with this vast group protecting and enriching Gulen.
Erdogan, himself a dictator who follows Sharia Law, has indicted Gulen and wants him to be returned to Turkey to stand trial for treason and other charges.
Seems as though our government wants him here to keep defrauding American taxpayers to run his 155 Charter Schools, and his many businesses, and making him a multi billionaire. He uses much of our cash to foment turbulence in the Middle East and in Turkey where he rules many in police departments and the even in the army, as he seeks to advance the push for an Islamic world dominance under Sharia Law. Gulen and Erdogan seem to be connected at the hip to impose the same philosophy, and yet they are in a death struggle to rule it all.
In addition, this post today mirrors Diane’s post some weeks back, and this is only about a Complaint, and is NOT a law suit…at least it seems that is the case after reading the link. The Australian law firm seems not to want to join a class action suit to protect others from harm. Very strange indeed.
Why isn’t the US doing any heavy lifting in this situation? Why can a wealthy Charter Queen like the woman who now runs Los Angeles Magnolia Schools claim she in not working for Gulen, when she runs 11 of his schools? Why can’t we get answers to any of our questions?
Speculation. The CIA is not allowed to operate on domestic soil. American villainthropic foundations have a history of facilitating the spooks’ agenda. The involvement of the Walton’s Gen Next Foundation, in national security (and, school privatization), lends credence to the speculation. The fact that the Gen Next Foundation features Bush’s defense secretary, Rumsfeld, and Obama’s former homeland security official, Napolitano, adds merit to the argument.
The fact that Congresses (not national, nor state) will hold hearings on the subject of Gulen, provides corroboration, IMO.
Julian Assange, references Gen Next, in his book chapter, “Google is Not What It Seems” (available on line).
Gen Next is an invitation only organization, that gets some very high powered people as speakers, e.g. HRC.
Remember the 60 Minutes report from a few years ago and the pieces by Dan Mihalopoulos of the Chicago Sun Times on the FBI raids on the Midwestern branch (Concept charter schools) of the Gulen schools.
Usually when something makes no sense, it’s a good idea to check one’s assumptions.
With the proper set of assumptions, this whole thing makes perfect sense.
Chiara reported that the “Dept. of Labor allowed 325 hires”, at schools that are part of the chain. The Dept. of Ed. gave Ohio $71 mil., late last year, to expand charters. On Mon., Ohio’s auditor said “Ohio’s Dept. of Ed. is possibly the worst-run agency in state government”. In Jan., it was reported that the Waltons were spending $100 mil. to expand charters.
Perfect sense, if it’s not about education.
Regardless of the propriety of the operations of the Harmony Schools, this lawsuit has more to do with the Turkish Government and its increasing authoritarian President Erdogan. The law firm that filed this is in the pay of the Turkish Government. US kids are caught in the struggle between Gulen and Erdogan. Neither side is good for the kids.

Allowing the Turkish Gulen movement to take over American public schools is a terrible idea. I don’t give a hoot about Turkish politics. I don’t want to see public money going to an organization run by foreign nationals. There are Gulen charters in other nations but none receives public funding. How can citizens of Turkey teach American children the fundamentals of citizenship?
Scott, I think you have the point of the lawsuit. The legal website has a format to solict whistleblowers for Harmony and Magnolia charters in Texas. The legal team makes it very easy for whistleblowers to provide information that, in the end, makes the Turkish Government under Erdogan the hero, and Gulen the troublemakers. I rarely recommend wickipedia but there are some details here, including the use of visas to get teachers, supposedly for subjects in math and sciences… but they were not always used that way at all. The head of Harmony recently applied for the postion of Superintendent of Public Instruction in Ohio.

I have often posted about the insularity of the Gulen movement. As I said in an earlier comment, Gulen charters are themselves a problem. Supporters and paid advocates like to invoke Turkish politics to defend that huge charter chain or to accuse critics of Islamophobia. But that is a smokescreen.
The issue for me is why federal, state, and local governments are paying for schools run by foreign nationals and pretending to be “public schools.” There have been FBI raids on Gulen schools in the Midwest. Gulen schools pay for “free” junkets to Turkey for legislators. How would we react if other foreign groups opened chains of charters to replace public schools. A Russian charter chain? A Mexican charter chain? A Chilean charter chain? A new way to outsource taxpayer dollars.
Laura…please list here what “legal” websites you read that list actual filed law suits by this law firm? So far, from what I have read, they have only filed Complaints…and asked that the Gulen Schools be looked into. If they are working for Erdogan, and this is an international, not national, legal proceeding, it should still be public information if law suits are actually filed with the court system.
In any eventuality, Turkey is a key strategic nation where ISIS is growing a presence, and all this interplay is vital for us to understand.
It is not only a little blip affecting public schools v. charters.
There is far more that we all should/must understand about Turkish engagement with the Saudis, Iran, Afghanistan, etc., and who both Erdogan and Gulen are allied with…for we have seen in America how terrorist actions change all our children’s lives.
Gulen had brought in to America on our dime, close to 3,000 Middle Eastern men, many of whom have overstayed their Green Cards and have been absorbed into the country and it is not known where they are or what they are doing. This is not limited to teachers and education issues.

Are you aware that the Gulen Movement put AKP and Erdogan into power. They were also best buddies until the Gulen Movement got out of hand and were controlling all the soft power: education, media, police, judiciary system and more. When gulenists got greedy (their middle names) there was a falling out between Erdogan and Gulen. This has nothing to do with politics, it’s about the bad behavior of the Gulen Movement . All the complaints are is compelling information to the over seeing board to open up schools
Some people think Gulen has ties to the CIA. Without some kind of protection deal it is hard to understand why the US government, and right-wing Republicans in particular, are willing to turn a blind eye to the Gulen charters.
There is a Broward Math and Science Schools in Florida that is supposed to be a Gulen school. It is run by Riverside Science, Inc. (a non-profit). Riverside Science has not filed an IRS 990 since 2009. They do not have the governing board listed on the website nor board meeting minutes as required by Florida statutes.
For anyone who is interested in learning more about what is happening in Turkey, and how they treat teachers/professors, here is a pdf link. Keep in mind that Gulen and Erdogan are two sides of the same coin…Sharia Law as the dominant rule.
