This email arrived today. The parents who wrote it live in a small town in upstate New York. New York is on fire with opt outs. Last year, 60,000 children refused the Common Core tests. This year, the number will grow significantly. Panicked superintendents, pressured by state bureaucrats, are sending out letters warning parents not to opt out. The Chancellor of the Board of Regents has told affluent communities that she might exempt them and their teachers from the punitive consequences of the testing, in an effort to dampen the Opt Out movement. As this letter shows, this all-hands-on-board attempt to quell the opt outs is not succeeding.
Why Our Third Grade Daughter Will NOT Take NYS Assessments
The direction of NYS public education is being driven by political control and corporate greed instead of what is best for children. The FREEDOM for school administrators to lead, teachers to teach, and students to learn in a child-centered classroom has been STOLEN by bully bureaucrats in Albany and Washington D.C. who know little about education and believe a “one size fits all” approach will somehow “fix” public education.
In 2010, New York State officials, lured by MONEY from the Federal GOVERNMENT through the Race To The Top program, agreed to implement Common Core State Standards (CCSS) which were heavily financed by Bill Gates and developed by private interest groups with heavy influence from the corporate testing industry. CCSS were hastily adopted with no transparency while “grave concerns” from childhood development specialists and educators were ignored. Contrary to the marketing rhetoric that continues to be sold to the American people, CCSS were NOT state led, NOT internationally benchmarked, NOT piloted or tested, and NOT evaluated for cost or efficacy prior to implementation.
The Federal Government then spent hundreds of millions of taxpayer dollars to develop National Standardized Tests based on the unproven Common Core Standards which quickly drove the development of unproven curriculum and teaching methods. Now, NYS Dept. of Ed. and our Governor intend to have students take these costly and developmentally inappropriate tests to evaluate the “performance” of school districts and determine whether teachers should keep their jobs.
The NYS Common Core Tests (Grades 3-8) to be administered in April 2015:
- Compel teachers to narrow curriculum and spend a high percentage of the year prepping students to take tests on two subjects (Math and ELA) rather than teaching a well-rounded and balanced curriculum that inspires creativity and fosters the joy of learning for all students.
- Requires many hours to take and have NO diagnostic value for teachers in supporting the academic achievement of students.
- Are flawed, ambiguous, and intentionally designed to fail a high percentage of children by deliberately manipulating the “passing score” through arbitrary and subjective means.
- Are being used to collect a vast amount of data on children without parental knowledge or consent.
- When refused, will not affect a student’s classroom grade, placement, or services received.
Parents refusing to allow children to take the NYS Standardized Tests will send a clear and powerful message to Albany (and Washington D.C.) that children are not guinea pigs, high-stakes testing based on unproven standards is harmful to public education, and implementing destructive academic reforms using bully tactics will NOT be tolerated!
We have the power to say NO to government overreach. Refuse NYS Assessments and become part of the critical movement to put the “public” back into public education. The time to act is now.

While I agree parents should have the choice to opt out, there are parts of this argument I have an issue with. First, there are good components in the Common Core. The problem lies partly in whether it is developmentally appropriate but more so its heavy misguided emphasis on testing. However, this heavy handed emphasis began with NCLB. It was okay to focus on testing then, as long as it did not affect the burbs. In other words, okay to use urban kids as guinea pigs. Now that the reach is unleashed, the outcry begins in earnest. Listen I am the first to say take a stand against the testing, but don’t decry the over reach as if it begun in the last several years….it started long before this! Of course this is all just my opinion.

Also concerned parent, NCLB got the testing craze going, Duncan pushed it further with Race to the Top. Common Core is the ugly spawn of NCLB and RTTT. Parents are right to be alarmed by this corporate takeover of their schools and their children. Don’t belittle the importance of bringing in new allies from the suburbs. That strengthens the movement to restore the purpose of education as civic and humane, not workforce preparation and not just academic.

The heavy handed emphasis really started with the Common Core testing waiver. No one complained under NCLB because state standards and state tests were fairly reasonable. Unlike the CC exams, they were not intended to produce aritficial, super-failure rates of 70%.

I have been following your blog with great interest and concern. While the work you do is nothing short of greatness and I am in awe of your stamina and pointed blog posts, I am also deeply dismayed by what I am reading and learning. I am Canadian and teach in British Columbia. Unfortunately, it would appear the movement to privatize education has begun here. It is in its earliest stages; the current government is paving the way with legislation that will allow for the type of policies that have already been created in America. There is little transparency, mind you, and the public, by and large, is unaware of the “hoax” as you call it. All in all, it is a bloody shame… It is a crime against humanity. I see no social justice in the privatization of public education. It is a scam by political hacks. In any case, this may sound ridiculous but I wonder if you have thought about contacting Oprah to ask her to get involved. I have a feeling that the right person could convince her of the importance of her involvement at this point in history. No one with any decency who is paying attention and connecting the dots finds this new system tolerable; rather they are incensed. The article that appeared in the New York Times that documented the abuses of both students and teachers at Success Academy is most alarming and it is just the tip of the proverbial iceberg in terms of the new way of doing things, isn’t it? The kind of society we are creating as a result of the recklessness is deplorable and anyone in the system who is not fighting back is helping to facilitate the hoax and crime.
Anyway, just a thought.

Thank you for your kind words. I don’t think Oprah would care. She featured the leaders of the corporate reform movement on her show. She hosted Mark Zuckerberg and Mayor Corey Booker when Zuckerberg put up $100 million to “transform” the city’s schools by turning them over to charter operators (that money has long since disappeared, it seems to have been consumed by consultants). She started a feature story about the heroic transformation of a charter school in New Orleans by Steve Barr (the founder of the California-based Green Dot chain), but the school closed down not long after her program. She has never shown any interest in preserving public schools. Look, the private sector has been good for her.

A lot of desperate threats being made by Board of Regents and corporate owned media. Parents have every right to do what they feel is best for their child. We can only hope they conclude that disrupting this top down effort at taking over our education system will be successful. Our grandchildren will spend testing time with us. We will engage in meaningful activity that helps them grow. We are proud our children will not let them feed the interests of those who would undermine public educations.

Opt-out numbers in NYS are going be to be huge this year. According to information released last week by my district, a typically high-performing one where it’s been hard to raise awareness, it has received many more letters from parents. Even our teachers’ association has finally made a public statement in support of parent choice.

As most of you know, the Common Core tests kids are taking now are just the beginning- this is a testing “system” and there are more components to come.
What’s amazing in the video is how they are selling the tests as determinative and comprehensive. Not only will Common Core testing measure College and Career Readiness, it also measures critical thinking and a student’s ability to participate in their community.
Are they aware they’re setting this test up as the be-all and end-all for students? How can they continue to claim they won’t over-rely on a single score when they are ALREADY over-relying on this test? It is just inevitable that this test will devour everything in its path, and knock out every other evaluation of students. That will happen and it won’t be an accident or an unintended consequence- they are selling it like that.

Has anyone explained how the second battery (EYO) of PARCC tests will provide valuable information, just 30 school days after the first round (@75%)?

The irony is that the only thing the opt-out movement is going to accomplish is to penalize good teachers. So go to it, privileged white New Yorkers — opt your precious kids out of taking a test. Opt them out of going to public school while you’re at it. With your attitude, there’s no reason you should get $20,000 a year from public tax dollars to fund your kid’s education.

This Brookings analysis really confirms what NYSUT’s Magee said, although the analyst spins it differently.
If many opt out, the inference from data to teacher quality is less defensible (assuming the statistical model).
Statistically, a no-brainer.
If many opt out, it also raises the chance that a teacher will be classified as high-performing.

Do the folks promoting the Common Core testing believe they should tell parents that this year’s testing is just the beginning and that “eventually” Common Core tests will be “used to determine student progress throughout the year” ?
When do they roll out the “speaking and listening” assessments? Next year? Will people feel they were misled if they aren’t told the whole plan at the outset?

California is trying to stop the opt out movement before it begins. Our state has decided that the 11th grade SBAC test will determine what “level” your student is ready for in college classes (remedial or advanced). I’ve been told the kids will be able to “click” on the test to upload their scores to colleges. If they score a 3 or 4 they can sign up for higher-level college classes, but if they score a 1 or 2 then they must take “intensive” senior year remedial classes. Many common core fighters think this is a scare tactic, but I think they will do this. If public colleges get on board then they will say to homeschoolers and opt outs “take the SBAC/Parrc as part of the college application process.” Bottom line (my prediction): they will take it as Juniors or college freshman, but they will have to take it. The question is, will private colleges cave too?

I am a NYS high school special Ed teacher, and I support opting out of testing for the lower grade students. My concern is that HS students cannot opt out because their diploma depends upon the CC exams, and many students with disabilities are paying the ultimate price for not being able to pass these tests, even with the ‘safety net’ low pass option. Or if they manage to do so, they have spent their entire high school career focused on taking and retaking exams at the expense of learning anything that will actually benefit them in the next stage of their lives.
I hate to say this, but I am looking forward to retiring from a system that has become one that only serves to beat down those students who least capable and in the most need of help and belief in themselves. Shame on us, NYS and the US for allowing this to happen to our future.

Don’t get me wrong I am all for ending State Tests and common core curriculum, we wonder why common sense is becoming a rare commodity kids are not able to exercise any of that with this new curriculum, it’s their way or the highway. I have to wonder though….if the number of students being opted out every year keeps increasing ( I have some doubts that parents of students that actually do well are pulling them as fast as others), then what is that showing the state other than the percentage actually performing well is increasing so they keep increasing expectations. If everyone participates and they keep seeing a decline in the “grade level” expectations maybe they will reconsider what they’re actually accomplishing? As I said I do truly believe that common core is basically a joke and these tests are nothing but a waste of time, but really what are we gaining?

There are only two reasons any parent wouldn’t want to take the test. 1. You hate his/her teacher and want them fired(it can and will happen if enough parents do the same). Every kid who doesn’t take it counts as a fail for teacher. 2. Kid isn’t that bright and you know they are going to fail.
Like the 80% of the world that’s ahead of us in education every kid in every city in every state should be able to pass the same test to go on to the next grade. Does this commen core crap need to be fixed. Yes. But its a step in the right derection for a country so far behind the rest of the world. And so what if it puts pressure on kids to succeed. School should, parents should. Granted I think this should start in fifth grade not 1st. But by fifth grade kids need to be pushed. There in fifth grade not 5 years old. There are not babies anymore.

I do not want my son’s teachers fired, and I have confidence that he would do well on the test as he is an honor roll student. I refused to have him take the state tests as a message to Albany. Any test that is not written or scored by teachers, takes months to get the grade back, does not give feedback as to which questions/concepts the students are having difficulty with, and worst of all has a passing grade determined AFTER all of the tests have been graded is just ridiculous ( to put it nicely). If Cuomo’s law school professors were not fired after he failed the bar exam for the fourth time, no teacher should be fired for poor performance of his/her students on one test.

Here is the point that everyone seems to be ignoring – it is an option – it is in the testing manual, it even gives schools the guidelines on how to grade a refusal! Why is there talk of punishment when the manuals put out by the State make no mention of punishment whatsoever – it is a choice that all students and parents have. They have no legal path to justify their desire to punish people for something that they themselves gave us license to do!
