On December 3, Kanawha Circuit Judge Jennifer Bailey issued a permanent injunction that prevents the West Virginia Professional Charter School Board from authorizing any new charter schools without the approval of the voters in the county where the charter wants to do business.
West Virginia passed a charter school law in 2019; that law stated that charter schools would be authorized by county school boards, or in some rare cases, the state school board. But local elected school boards can be reluctant to open up competing schools funded with local taxpayer dollars (in fact, the very first application for establishing a charter school was rejected by the county board). In 2021, the state modified the charter law. The bill turned every mention of “charter school” into “public charter school,” and it created the West Virginia Professional Charter School Board, a new path for charter authorization.

Allowing the public to vote on charter school measures is the most transparent and democratic way to managing the growth of unregulated charter schools. That is why privatizers reject public participation in the process. Politicians often represent special interests instead of the those of the public.
In Florida privatization has been totally a top down directive from the governor and his minions. The public has been deliberately removed from the equation. What is currently happening at the University of West Florida is a perfect example. The governor appointed Manny Diaz to lead the university, rigged who is serving as university trustees, and manipulated the whole process. Diaz has been appointed the president of the university with a compensation package of more than $900,000. He and his wife have already applied to set up a management company to establish a charter school at UWF, although the details of the deal remain a mystery. The public is unhappy, but the whole rigged privatization juggernaut marches on, despite the public concerns. Charter schools represent special market-based interests, not those of the typical tax paying citizen. The wording in Missouri’s law is that charter schools are public schools. It was purposely written that way to make a private enterprise appear to be public. In other words is a lie.

The major charter school lobby is called the National Association of Public Charter Schools.
Charters want to be considered “public schools,” but without the accountability of public schools.
