Gus Morales, the outspoken leader of the Holyoke, Massachusetts, Teachers Association, won the right to a hearing from the state’s Department of Labor Relations after he was laid off by his district.
The Massachusetts Teachers Association and his colleagues believe he was dismissed because he led protests against the state takeover of the district.
“The state Department of Labor Relations (DLR) has found “probable cause” to believe that the Holyoke Public Schools illegally fired Holyoke Teachers Association (HTA) President Gus Morales because of his activism as a union leader.
“The DLR will hold a hearing on the complaint, which stems from a charge filed by the HTA on June 25. The DLR complaint is similar to a grand jury indictment; the upcoming hearing will have many of the characteristics of a trial, with witnesses and cross-examination.
“Because I speak out against policies that I see as bad for our students and bad for our educators, I have been targeted for two straight years,” said Morales, whose employment contract with the Holyoke Public Schools was not renewed at the end of the school year.
“Morales, who does not have professional teaching status, was similarly dismissed at the end the 2013-14 school year after his election to lead the HTA. Then, as now, the DLR issued a complaint that found reason to believe that Morales was illegally terminated for his union activism.”

Morales and the HTA were vocal opponents of the takeover, which was imposed in April despite widespread objections from the community and several of its elected leaders.
“It is an outrage that an educator and leader such as Gus Morales, who has spoken out for the students and the Holyoke community, is being targeted for dismissal,” said MTA President Barbara Madeloni. “The MTA will not tolerate attacks on educators, especially when the attack is meant to cause fear among those who challenge the deeply flawed accountability system used to punish educators, students and communities. Gus has the courage to address the real issues affecting Holyoke — such as economic and racial injustice — and the MTA supports him and the HTA in holding the state accountable for providing resources that the community can use to combat these problems.”
“Throughout stakeholder meetings to craft a “turnaround” plan for Holyoke Public Schools, Morales and others from the HTA raised concerns about the influence of standardized tests, the need to provide social services to students living in poverty, inadequate programs for students on special education plans, the lack of ethnic diversity in the teaching ranks and other issues that they felt that the receiver needs to address.”
Morales never got a bad evaluation until he spoke out against bad policies.

To get Professional Teacher Status in MA you have to be employed by a district for 3 years. At the end of the third year the administration typically either recommends the teacher is granted professional status – which doesn’t go into effect until the first day of the fourth school year – or terminates the teacher.

In Gus Morales’ case I take that to mean he hasn’t been in Holyoke long enough to earn professional status but I don’t know that for sure.

The point relates to an unfair labor practice, not tenure (professional status). As a thirty plus year Massachusetts educator, I am incredibly proud of both Gus Morales and the MTA, what a magnificent change with new leadership!). Bravo, bravo. Now if more teachers and unions began to fight back against the deformers and joined with parents in common struggle, then, there will be a wall of labor-parent unity that the deformers will not rollover.

Yes, it’s heartening that the Labor Relations board viewed this as retribution. They could have refused to address it by referring to the lack of Morales’ professional status. It’s also important to note that MA DESE has taken over the system, so he was “non-renewed” at the direction of the receiver – who was Comissioner Mitchell Chester at that time.
Brava to Barbara Madeloni for calling out Chester for his fear mongering ways.

More information on the Youngstown (OH) take-over is coming out:
“Representative-elect Michele Lepore-Hagan, a newly elected Youngstown Democrat, wanted to talk to the governor about the troubled school district she represented. “And he threw a tablet into the air and said those Youngstown City Schools are in such a mess I want to shut them down and put one great big charter school in there.”
He told Ms. Lepore-Hagan that a committee had been assembled to discuss the Youngstown problem but she couldn’t participate “because you’ll make it too political. You’ll muddy it all up.”
Instead, Mr. Kasich suggested she talk with state Rep. Sean O’Brien (D., Bazetta), the only lawmaker he would work with on Youngstown Schools. Ms. Lepore-Hagan informed the governor that Mr. O’Brien represents Warren Schools and that she was the elected official in the Youngstown district.
“The people who voted for me send their children to this school and I represent them, these kids,” she said. “It’s my neighborhood, my district.”
The incoming freshman, married to former longtime state Rep. Bob Hagan, said an angry Mr. Kasich abruptly ended the meeting. The lawmaker persisted. “Governor, my parents were both teachers in the Youngstown City Schools, and this is very important to me.”
He replied, “talk to Sean,” and left, she recounted. Ms. Lepore-Hagan asked Mr. O’Brien about the Youngstown group, but says he indicated he didn’t know anything about it.”

Apparently the plan was kept secret because they were afraid there would be public opposition, but the decision to privatize was made back in June with no public input. This was right around the time a big wad of campaign donations went out from charter contractors to lawmakers which was reported as an effort by lobbyists to kill the charter regulation bill, but may have actually been a down payment on Youngstown.
If you’re in Lorain OH, look out- you’re next. Ask your state reps why they’re selling your schools to campaign donors.
