Six conservative Supreme Court justices overruled Roe v. Wade, discrediting a decision that had been in force for half a century. Before the Dobbs decision, American women were able to get an abortion. Today one of every three American women lives in states where abortion has been banned.
Here is what the six Justices said about Roe v.Wade at their Senate confirmation hearings.
This is consistent with what I recalled. None of them told the committee that they wouldn’t overrule Roe v. Wade, even when pressed directly to take a position. Some said (accurately) that Roe was “settled law,” but settled law can be reversed. All talked about the importance of stare decisis, but stare decisis does not preclude the Supreme Court reversing a prior decision. In this clip, Roberts explains some of the considerations that the Court must take into account when faced with the possibility of reversing its own precedent. Coney Barrett does the same. None of these justices lied about whether they would reverse Roe v. Wade. And dare I say that if they had lied, nobody would have believed them.

I saw it differently. I believed, as did the Democratic Senators who voted to confirm them, that they accepted Roe v Wade as “settled law,” that it had survived many challenges, and that it was shielded by “stare decisis.” If they secretly meant that they had every intention of overturning Roe, they are clever deceivers. Liars.
That surprises me, since everyone who is aware of, say, Brown versus Board of Education knows, or should know, that Supreme Court precedent that is well-settled over many decades can be reversed.
Now, I’m not saying it was obvious to me that all these justices would vote to reverse Roe. But it was equally obvious to me that they were not promising to not reverse Roe.
There is simply no good case that any of these justices lied to Congress about whether they would affirm or reverse Roe v. Wade.

Also, regarding the Democratic Senators who voted to confirm them—if their confirmation votes are an indication of whether they believed these nominees would not reverse Roe, then the vast majority did not believe that. No Democratic senators voted to confirm Coney Barrett. Only 1 voted to confirm Brett K. Only 3 voted to confirm Gorsuch. Only 4 voted to confirm Alito, even 20 years ago when confirmation votes were still less partisan than today. Not even Roberts got votes from more than 50% of Dem Senators.
And who is shocked that Supreme Court justices lie?
The next reproductive right that is going to be outlawed by Trump’s Supreme Court majority is birth control by contraceptives. The six U.S. Supreme Court Justices that make up the majority are all Roman Catholics, and the Roman Catholic Church says that using contraceptives is sinful, just as it says that abortion and IVF are sinful. The Supreme Court has become a branch of The Vatican Council.
By the way, I’m Catholic, but I accept that it is unconstitutional to impose my religion on anyone. The Supreme Court majority clearly doesn’t think that way.
