The New York State United Teachers issued a statement condemning any policies that punish children whose parents have told them not to take the spring tests.
Next test for NYSUT: when will they call on parents and students to boycott the tests that will be used to rate and (de)grade teachers, based on junk science?
NYSUT said:
ALBANY, N.Y. Feb. 3, 2014 – New York State United Teachers President Richard C. Iannuzzi today called on school districts to abandon educationally unsound and unconscionable policies that force students whose parents have decided to opt them out of state testing to “sit and stare” instead of providing them with a constructive alternative.
At least 15 school districts on Long Island – and, reportedly, others statewide – have recently adopted or are considering such damaging policies ahead of April’s state standardized testing in English Language Arts and math, Iannuzzi said.
“NYSUT strongly condemns the policy of ‘sit and stare’,” Iannuzzi said. “This policy aimed at students whose parents elect to ‘opt out’ their children from state standardized testing is unconscionable. It would be spiteful and counter-productive for any school district to require an administrator or teacher to direct a child to ‘sit and stare’ at a blank desk while other students are taking exams because of a choice made by a parent.”
Iannuzzi added, “This is cruel to those students not taking the exam and a distraction and disservice to those who are attempting to complete it. Punishing or embarrassing children because their parents exercised their right to choose not to have their children participate in tests they consider inappropriate is, frankly, abusive.”
NYSUT Vice President Maria Neira called on the Regents and State Education Department to deliver to school districts clear guidance that protects children against detrimental and abusive testing policies. “This is an opportunity for the Regents and State Education Department to step in and protect students from harmful policies that result from parents exercising their right to decide what’s best for their child,” she said.
NYSUT strongly supports a parent’s right to “opt out” of state standardized tests if the parent believes state testing is inappropriate and may be harmful to his or her child.
Iannuzzi said the union would provide guidance and support to parents – or parent groups – unfairly singled out or harassed for advocating the right to opt out and added, “We will vigorously defend any NYSUT members who are subject to any negative employment considerations for choosing to opt out their own child or who advocate, to the extent permitted by law, for others who opt out of state standardized tests.”
New York State United Teachers is a statewide union with more than 600,000 members in education, human services and health care. NYSUT is affiliated with the American Federation of Teachers, the National Education Association and the AFL-CIO.

There is no end to the culture of cruelty growing from these testing mandates, now we have deeply-ingrained punishment protocols for those who Opt Out! and elect not to be subjected to the cruelty. This should tell us something about the core nature of the beast. ‘Sit and Stare’ is nothing new. It is borrowed from other places in the USA where students finishing state standardized tests ahead of classmates are forced to sit and stare (or sleep) for as long as it takes, hours in some cases. They cannot leave the room. They may not read a book and of course, they cannot draw or write. Just sit and stare until the majority of the room have finished, which can be hours, and only then is a book permitted. If lunch is mid-test then it is a silent meal. This is sick and is not something educators should be participating in, as noted by NYSUT.

Participating in this “kangaroo court” testing scam is what is abusive. Subjecting students to testing that is intended to see them fail so that they will be forced to accept an untested curriculum is the epitome of abuse.
This is not just about teachers. In fact, the teachers exist because of the students. Students deserve more than cookie cutter education contrived and cast upon them by corporate interests.
The idea that children are somehow victims of their parents is another fallacy wrapped up in this scheme. Common Core not only seeks to undermine public education it seeks to undermine parental authority.
The entire plan stinks of despotism. If civil disobedience be are only weapon then “sit and stare”. or better yet stay home.

I would make a LOT of noise if I knew this were occurring in my school. If it were my child, I might kick over a few tables in the front office. (a little hyperbole here)
I was a NYS teacher and parent. Thanks, Dick Iannuzzi….. we hold New York State teachers to a high standard and this practice is “cruel and unusual” . This is why I have been an ACLU member.
These school administrators need to learn how to handle their anger and frustration in acceptable ways…..like we teach to the students. Inexcusable.

It’s child abuse, pure and simple, and all these parents who opt out should immediately contact both the police and Child Protective Serivces, and fill out actual formal complaints against the the school administrators this barbaric practice.
They then should hire a lawyer, and have that lawyer send a forceful letter to the school administrators—at every level, on or off campus—that threatens that if this policy is not formally reveresed within 15 days, they will be served with a lawsuit on Day 16.
These are their children, for God’s sake.

As the number of parents who refuse to have their children participate grows, the “data” will be compromised. Look for principals and other administrators to threaten teachers with poor evaluations because they can’t get kids in their care to take the tests or because they can’t “manage” those kids forced to sit and stare.

320 kids out of a grade 3-8 population of approximately 400,000 opted out in New York City last year. We are more than just a tick or two away from having the data compromised.

I know you are aware that these actions will become a thing of the past once the UFT is ousts Iannuzzi from office in favor of a more Cuomo-friendly (Reformer friendly) president.
Iannuzzi is just starting to cut the puppet strings and be a strong voice that stands with people like Karen Lewis. And Diane, if you really like the direction he is moving, you will need to add your voice to this power struggle. Otherwise expect King and Tisch to continue their quest to destroy public ed.
People like Arthur and Norm cannot take on this horrible injustice themselves, they need a voice like yours to help. Did you read what Arthur wrote this morning? Could you at least repost it here because right now Mulgrew is lining up upstate unions to back his puppet.

If schools were clever, they would take the kids who opt-out on a field trip to a museum or to a stream to do water sampling, or some other educational experience. I would bet that they would double the number of students who opt out on the next test & punish day. Why should schools participate in their own destruction? Resist.

Where I taught, we couldn’t afford field trips. We literally didn’t have them. But it’s a good idea. Personally, if I were a principal, the kids could spend the day reading in the library. We’d have a read-in. That would be a far more productive thing to do than sit-and-stare. Doesn’t sit and stare deprive them of an education, which is their constitutionally-protected right? I smell a lawsuit.

Does Ianuzzi or anyone else have any recommendations for constructive, productive alternatives, keeping in mind that just about every single staff member and every square foot of available space is being used for kids who are actually taking the test, and remembering that those kids are entitled to the most optimal test environment possible?
Would educational videos in the auditorium with the volume set very low work? Or sitting quietly in the library or gym? That would be about the best possible scenario at my children’s schools, assuming the principals could find subs to babysit.
My advice to parents who are opting out and who are truly concerned about their child’s welfare, not making a political point, is to keep your child at home on testing days, or take them out after attendance is taken.

Under NCLB schools were required to have 95% of students take the exams.
Does anyone know what the minimal % required for test data to be considered ‘uncompromised’ for use in teacher evaluations?

I have an even better idea for opting out families, one that will give students a nice civics/American history lesson. Why not take another field trip to Pearson headquarters, such as the one organized by Leonie Haimson after the Pineapple ? kerfuffle? Have a real art project–make colorful posters/signs & pineapple character costumes. Or–find some new ones based on sample questions/test preps (that can be seen by anyone).
I would suggest simply marching outside one’s school, in protest–that would be really effective (make a little noise so the test takers are disturbed), but there would probably be some arrests–not suitable for young children?

I he were in Middle School level, I would send my son to school with a copy of Animal Farm, and request that he be allowed to sit quietly and read it, so I could follow up with him and discuss the book each night. Pity the administrator who tells him. “No, you can’t read Animal Farm, the rules say you must sit and stare”

Ms. Ravitch, do you have any documentation or links that stipulate NYSED or NYS has legally set in place “sit and stare” policy for handling children who opt-out or is the policy of “sit and stare” at the discretion of local school districts? There seems to be some disagreement regarding this. Thank you.

Jay Goldbaum, I do not know whether the “sit and stare” policy is set by the state or the district. If NYSUT, a statewide organization is protesting against it, it likely comes from the NY SED.
